7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 47 O.S. 2021, Sectio n 6-101, is
8181 amended to read as follows:
8282 Section 6-101. A. No person, except those hereinafter
8383 expressly exempted in Sections 6-102 and 6-102.1 of this title,
8484 shall operate any motor vehicle upon a h ighway in this state unless
8585 the person has a valid Oklahoma driver license for the class of
8686 vehicle being operated under the provisions of this title. No
8787 person shall be permitted to possess more tha n one valid license at
8888 any time, except as provided in p aragraph 4 of subsection F of this
8989 section.

141141 B. 1. No person shall operate a Class A commercial motor
142142 vehicle unless the pe rson is eighteen (18) years of age or older and
143143 holds a valid Class A commer cial license, except as provided in
144144 paragraph 5 of this subsection and subsection F of this section.
145145 Any person holding a valid Class A commercial license shall be
146146 permitted to operate motor vehicles in Classes A, B, C and D, except
147147 as provided for in par agraph 4 of this subsection.
148148 2. No person shall operate a Class B commercial motor vehicle
149149 unless the person is eighteen (18) years of age or older and holds a
150150 valid Class B commercial license, except as provided in paragra ph 5
151151 of subsection F of this sec tion. Any person holding a valid Class B
152152 commercial license shall be permitted to operate motor vehicles in
153153 Classes B, C and D, except as provided for in paragraph 4 of this
154154 subsection.
155155 3. No person shall operate a Class C commercial motor vehicle
156156 unless the person is eighteen (18) years of age or older and h olds a
157157 valid Class C commercial license, except as provided in subsection F
158158 of this section. Any person holding a valid Cla ss C commercial
159159 license shall be permitted t o operate motor vehicles in Clas ses C
160160 and D, except as provided for in paragraph 4 of th is subsection.
161161 4. No person under twenty-one (21) years of age shall be
162162 licensed to operate any motor vehicle which is requ ired to be
163163 placarded for hazardous materials pursuant to 49 C.F.R., Part 172 ,
164164 subpart F, except as provided in subsection F of this section;

216216 provided, a person eighteen (18) years of age or older may be
217217 licensed to operate a farm vehicle which is required to be placarded
218218 for hazardous materials purs uant to 49 C.F.R., Part 172, sub part F,
219219 except as provided in subsection F of this secti on.
220220 5. A person at least seventeen (17) years of age who
221221 successfully completes all examinations required by law may be
222222 issued by the Department:
223223 a. a restricted Class A commercial license which shal l
224224 grant to the licensee the privilege to operate a Class
225225 A or Class B commercial motor vehicle for harvest
226226 purposes or a Class D motor vehicle, or
227227 b. a restricted Class B commercia l license which shall
228228 grant to the licensee the privilege to operate a Class
229229 B commercial motor vehicle for harvest purposes or a
230230 Class D motor vehicle.
231231 6. No person shall operate a Class D motor vehicle unless the
232232 person is sixteen (16) years of age or o lder and holds a valid Class
233233 D license, except as provided for in Section 6 -102 or 6-105 of this
234234 title. Any person holding a valid Class D license shall be
235235 permitted to operate motor vehicles in Class D only.
236236 C. Any person issued a driver license pursuan t to this section
237237 may exercise the privilege thereby granted upon all street s and
238238 highways in this state.

290290 D. No person shall operat e a motorcycle or motor-driven cycle
291291 without having a valid Class A, B, C or D license with a motorcycle
292292 endorsement. Except as otherwise provided by law, any new appl icant
293293 for an original driver lic ense shall be required to successfully
294294 complete a written examination, vision examination and driving
295295 examination for a motorcycle as prescribed by the Department of
296296 Public Safety, and a certified state-approved motorcycle b asic rider
297297 course approved by t he Department if the applicant is seventeen (17)
298298 years of age or younger to be eligible for a motorcycle endorsement
299299 thereon. The written examination and driving examination for a
300300 motorcycle shall be waived by the Department of Public Safety upon
301301 verification that the person has successfully completed a certifi ed
302302 Motorcycle Safety Foundation rider course approved by the
303303 Department.
304304 E. Except as otherwise provided by law, any perso n who lawfully
305305 possesses a valid Oklahoma dri ver license which is eligible f or
306306 renewal shall be required to successfully complete a w ritten
307307 examination, vision examination and driving examination for a
308308 motorcycle as prescribed by the Department, and a cer tified state-
309309 approved motorcycle basic rider c ourse approved by the Departme nt if
310310 the person is seventeen (17) years of age or younger to be eligible
311311 for a motorcycle endorsement. The written examination and driving
312312 examination for a motorcycle shall be w aived by the Department of

366366 approved by the Department.
367367 F. 1. Any person eighteen (18) years of age or older may apply
368368 for a restricted Class A, B or C commercial learner p ermit. The
369369 Department, after the applicant has passed all parts of the
370370 examination for a Class D license and has successfully passed all
371371 parts of the examination for a Class A, B or C commercial license
372372 other than the driving examination, may issue to the applicant a
373373 commercial learner permit which shall entitle the person having
374374 immediate lawful possession of the commercial learner permit and a
375375 valid Oklahoma driver license or provisional driver license pursua nt
376376 to Section 6-212 of this title to operate a Class A, B or C
377377 commercial motor vehicle upon the public highways solely for the
378378 purpose of behind-the-wheel training in accordance with rules
379379 promulgated by the Department.
380380 2. This commercial learner permit shall be issued for a period
381381 as provided in Section 6-115 of this title of o ne hundred eighty
382382 (180) days, which may be renewed one tim e for an additional one
383383 hundred eighty (180) days; provided, such commercial learner permit
384384 may be suspended, revoked, can celed, denied or disqualified at the
385385 discretion of the Department for violat ion of the restrictions, for
386386 failing to give the required or correct information on the
387387 application or for violation of any traffic laws of this state
388388 pertaining to the operation of a motor vehicle. Except as otherwise

440440 provided, the lawful possessor of a commercial learner permit who
441441 has been issued a commercial learner permit for a minimum of
442442 fourteen (14) days may have the restriction requiring an
443443 accompanying driver removed by satisfactorily completing a driver’s
444444 examination; provided, the removal of a restriction shall not
445445 authorize the operation of a Class A , B or C commercial motor
446446 vehicle if such operation is otherwise prohibited by law.
447447 3. No person shall apply for and the Department shall not issue
448448 an original Class A, B or C driver license until the person has been
449449 issued a commercial learner permit and held the permit for at least
450450 fourteen (14) days. Any person who currently holds a Class B or C
451451 license and who wishes t o apply for another class of commercial
452452 driver license shall be required to apply for a commercial learner
453453 permit and to hold the permi t for at least fourteen (14) days before
454454 applying for the Class A or B license, as applicable. Any person
455455 who currently holds a Class A, B or C license and who wishes to add
456456 an endorsement or remo ve a restriction for which a skills
457457 examination is required shall be required to apply for a commer cial
458458 learner permit and to hold the permit for at least fourteen (14)
459459 days before applying for the endorsement.
460460 4. A commercial learner permit shall be issu ed by the
461461 Department as a separate and unique document whic h shall be valid
462462 only in conjunction wit h a valid Oklahoma driver license or
463463 provisional driver license pursuant to Secti on 6-212 of this title,

516516 have been issued whenever that person is op erating a commercial
517517 motor vehicle as provided in this subsection.
518518 5. After one renewal of a commercial learner permit, as
519519 provided in paragraph 2 of this subsection, a commercial permit
520520 shall not be renewed again. Any person who has held a commercial
521521 learner permit for the initial issuance period and one renewal
522522 period shall not be eligible for and the Department shall no t issue
523523 another renewal of the permit; provided , the person may reapply for
524524 a new commercial learner permit, as provided for in this su bsection.
525525 G. 1. For purposes of this t itle:
526526 a. “REAL ID Compliant Driver License” or “Identification
527527 Card” means a driver license or identification card
528528 issued by the State of Oklahoma that has b een
529529 certified by the United States Department of Homeland
530530 Security (USDHS) as compliant with the re quirements of
531531 the REAL ID Act of 2005, Public Law No. 109 -13. A
532532 REAL ID Compliant Driver License or Identification
533533 Card and the process through which it is issued
534534 incorporate a variety of security measures designe d to
535535 protect the integrity and trustworthi ness of the
536536 license or card. A REAL ID Compliant Driver License
537537 or Identification Card will be clearly marked on the
538538 face indicating that it is a compliant document, and

590590 b. “REAL ID Noncompliant Driver License ” or
591591 “Identification Card” means a driver license or
592592 identification card issued by the State of Oklahoma
593593 that has not been cert ified by the United States
594594 Department of Homeland Security (USDHS) as being
595595 compliant with the requirements of the REAL ID Act. A
596596 REAL ID Noncompliant Driver License or Ident ification
597597 Card will be clearly marked on the face indicating
598598 that it is not compl iant with the federal REAL ID Act
599599 and is not acceptable for official federal purposes.
600600 The driver license or identification card wil l have a
601601 unique design or color indicator that clearly
602602 distinguishes it from a compliant license or card.
603603 2. Original Driver License and Identification Card Issuance:
604604 a. Application for an original REAL ID Compliant or REAL
605605 ID Noncompliant Driver License or Identification Card
606606 shall be made to the Department of Public Safety.
607607 b. Department of Public Safety employee s shall perform
608608 all document recognition and other requi rements needed
609609 for approval of an original REAL ID Compliant or REAL
610610 ID Noncompliant Driver License or Identification Card
611611 application.
612612 c. Upon approval of an original REAL ID Compliant or REAL
613613 ID Noncompliant Driver License or Identification Card

670670 REAL ID Compliant or REAL ID Noncompliant Driver

672672 payment shall provide the applicant a temporary driver
673673 license or identification card. A tempo rary driver
674674 license or identification card shall afford the holder
675675 the privileges otherwise granted by the specif ic class
676676 of driver license or identification card for the
677677 period of time listed on the temporary driver license
678678 or identification card or the p eriod of time prior to
679679 the applicant receiving a REAL ID Compliant o r REAL ID
680680 Noncompliant Driver License or Iden tification Card,
681681 whichever time period is shorter.
682682 3. REAL ID Compliant Driver Licens e and Identification Card
683683 Renewal and Replacement:
684684 a. Application for renewal or replacement of a R EAL ID
685685 Compliant Driver License or Identification Card may be
686686 made to the Department of Public Safety or to a motor
687687 license agent; provided, such motor license agent is
688688 authorized to process application for REAL ID

746746 b. Department of Public Sa fety employees or authorized
747747 motor license agents shall perform all document
748748 recognition and other requirements needed for approval
749749 of a renewal or replacement REAL ID Compliant Driver
750750 License or Identification Card application.
751751 c. Upon approval of a renew al or replacement REAL ID
752752 Compliant Driver License or Identification Card
753753 application, the applicant may receive a temporary
754754 driver license or identification card from the
755755 Department of Public Safety or an authorized motor
756756 license agent.
757757 d. A temporary driver license or identification card
758758 acquired under the provisions of this paragraph shall

818818 e. For purposes of this title, an application for a REAL
819819 ID Compliant Driver License or Identif ication Card by

822822 renewal of a REAL ID Com pliant Driver License or
823823 Identification Card.
824824 4. REAL ID Noncomplia nt Driver License and Identification Card
825825 Renewal and Replacement:
826826 a. Application for renewal or replacement of a REAL ID
827827 Noncompliant Driver License or Identification Card may
828828 be made to the Department of Public Safety or to a
829829 motor license agent. A motor license agent may
830830 process the voluntary dow ngrade of a REAL ID
831831 Noncompliant Commercial Driver License to any lower
832832 class license upon request of the licensee; provided,
833833 no additional endorsements or restrictions are added
834834 to the license.
835835 b. Department of Public Safety employees or motor license

908908 License or an approved application for the addition of an
909909 endorsement to a current valid Oklahoma REAL ID Compliant or REAL ID
910910 Noncompliant Driver License sha ll be assessed in accordan ce with the
911911 following schedule:

971971 2. Notwithstanding the provisions of Section 1104 of this
972972 title, all monies collected from the fees charged for Class A, B and
973973 C commercial licenses pursuant to the provisions of this subsection
974974 shall be deposited in the General Revenue Fund of this state.
975975 I. The fee charged for the skills portion of the examination
976976 for a Class A, B, or C commercial license shall be Sixty Dollars
977977 ($60.00). The fee charged for any failed examination shall be Four
978978 Dollars ($4.00) for any Class D license classification.
979979 Notwithstanding the pr ovisions of Section 1104 of this title, al l
980980 monies collected from such examination fees pursuant to the
981981 provisions of this subsection shall be deposited in the General
982982 Revenue Fund of this state.
983983 J. In addition to any fee charged pursuant to the provision s of
984984 subsection H of this section, the fee charged for the issuance or
985985 renewal of a REAL ID Noncompliant Dr iver License shall be in
986986 accordance with the following schedule; provided, that any applicant

12701270 section, the Department o f Public Safety and the Oklahoma Tax
12711271 Commission are authoriz ed to promulgate rules for the issuance and
12721272 renewal of driver licenses authori zed pursuant to the provisions of
12731273 Sections 6-101 through 6-309 of this title; provided, that no such
12741274 rules applicable to the issuance or renewal of REAL ID Noncompliant
12751275 Driver Licenses shall create more stringent standards than such
12761276 rules applicable as of January 1, 2017, unless directly related to a
12771277 specific change in statutory law concerning standards for REAL ID
12781278 Noncompliant Driver Licenses. Applications, upon forms approved b y
12791279 the Department of Public Safety, for such licenses sha ll be handled,
12801280 in accordance with the provisions of subsection G of this section,
12811281 by the motor license agents; provided, the Department of P ublic
12821282 Safety is authorized to assume these duties in any cou nty of this
12831283 state. Each motor license agent accepting a pplications for driver
12841284 licenses shall receive Six Dollars ($6.00) for a 4-year REAL ID

13461346 Dollars ($60,000.00) of all monies collected pursuant to this

14161416 investigations, missing person investigations or any law enforcement
14171417 purpose which is dee med necessary by the Commissioner of Public

14191419 2. By the driver lice nsing agency of anot her state for its
14201420 official purpose; and
14211421 3. As provided in Section 2-110 of this title.
14221422 All agencies approved by the O klahoma Law Enforcement
14231423 Telecommunications S ystem (OLETS) or the National Law Enforcement
14241424 Telecommunications System (N LETS) to receive pho tographs or
14251425 computerized images may obtain the m through OLETS or through NLETS.
14261426 Photographs or computerized images ma y be obtained by law
14271427 enforcement one inquiry at a time.
14281428 The computer system and related equipment acquired for this
14291429 purpose must conform t o industry standards for interoperability and
14301430 open architecture. The Department of Public Safety may promulgate
14311431 rules to implement the provisions of this subsect ion.
14321432 T. No person may hold more than one state-issued or territory-
14331433 issued REAL ID Compliant Driver License or REAL ID Compliant
14341434 Identification Card from Oklahoma or any other state or territory.

14951495 provided in subsection Q of this section, a motor license agent
14961496 shall receive Five Dollars ($5.00) for each processed appli cation
14971497 for a REAL ID Compliant 4-year Driver License and Ten Dollars
14981498 ($10.00) for each processed application for a REAL ID Compliant 8 -
14991499 year Driver License. Any additional amounts pr ovided pursuant to
15001500 this subsection shall not be retained by the Department of Public
15011501 Safety.

15681568 b. ability to read and understand highwa y signs
15691569 regulating, warning and direct ing traffic,
15701570 c. knowledge of the traffic laws of this state including
15711571 a portion on bicycle and motorcycle safe ty, and
15721572 d. ability, by actual demonstration, to exercise ordinary
15731573 and reasonable control in the operation of a motor
15741574 vehicle. The actual demonst ration shall be conducted
15751575 in the type of motor vehicle for the class of driver
15761576 license being applied for.
15771577 The Department of Public Safety may create a knowledge test that may
15781578 be taken on the Internet by an applicant applying for a Class D
15791579 license.
15801580 Any licensee seeking to apply for a driver license of another class
15811581 which is not covered by the l icensee’s current driver license shall
15821582 be considered an applicant for an origin al license for that class.
15831583 2. The Department of Public Safety shall have the authority to

16471647 results from another state for Class A, B or C license applicants
16481648 who have successfully completed commercial motor vehicle drive r
16491649 training in that state and successfully passed the skills test in
16501650 that state; provided, the Department shall not accept skills test
16511651 results from another state when th e applicant has not successfully
16521652 completed commercial motor vehicle driver training in t hat state.
16531653 Nothing in this section shall be construed to prohibit the
16541654 Department of Public Safety from administering the skills test to
16551655 any applicant who has successfu lly completed commercial vehicle
16561656 driver training in another state.
16571657 4. All applicants re quiring a hazardous materials endorsement
16581658 shall be required, for the renewal of the endor sement, to
16591659 successfully complete the examination and to submit to a security

17201720 location within one hundred (100) miles of the residence of the
17211721 applicant. The Department of Public Safety shall make every effort
17221722 to make the examinati on locations and times convenient for
17231723 applicants. The Department of Public Safety shall consider giving
17241724 the examination at various school sites if the district board of
17251725 education for the district in which the site is located agrees a nd
17261726 if economically feasible and practicable.
17271727 6. The Department of Public Safe ty shall have the autho rity to
17281728 collect a skills testing fee of Sixty Dollars ($60.0 0) from each
17291729 applicant upon examination appointment scheduling for an Oklahoma
17301730 Class A, Class B, or Class C license skills test. Failure of an
17311731 applicant to notify the Department at least forty -eight (48) hours
17321732 in advance prior to missing an appointment for a skills test , or
17331733 provide a written medical excuse from a licensed physician, advanced
17341734 registered nurse practitioner or physician ’s assistant, shall result

17931793 the specified class. Failure to submit to the Department of Public
17941794 Safety federally required medical certification inform ation pursuant
17951795 to 49 C.F.R., Part 391.41 et seq. shall result in an automatic
17961796 downgrade of a commercial licens e to a Class D license. Provided,
17971797 however, once the required medical certification information has
17981798 been received by the Department of Public Safety, the license shall
17991799 be reinstated to the classification of the commercial license prior
18001800 to the downgrade and the holder of such a license shall not be
18011801 required to reapply.
18021802 C. Except as provided in subsection E of Section 6-101 of this
18031803 title, any person holding a valid Oklahoma Class A, B or C
18041804 commercial license shall , upon time for renewal thereof, be entitled
18051805 to a Class D license without any type of testing or examination,
18061806 except for any endorsements thereon as otherwise provided for by
18071807 Section 6-110.1 of this title.
18081808 D. 1. Any certified driver education instructor who is
18091809 currently an operator or an employee o f a commercial driver training

18661866 learner permit.
18671867 2. The Department of Public Safety shall adopt a curriculum of
18681868 required courses and training to be offered to applicants who are
18691869 qualified to apply to be a designated examiner. The courses and
18701870 training for certification shall meet the same standards as required
18711871 for driver examiners of the Department of Public Safety.
18721872 3. Each person appl ying to be a designated examiner shall be
18731873 required to pay an initial designated examiner certification fee of
18741874 One Thousand Dollars ($1,000.00). Upon successful completion of
18751875 training prescribed by paragraph 2 of this subsection, the person
18761876 shall be required to pay an annual designated examiner certifi cation
18771877 fee of Five Hundred Dollars ($500.00). If an applicant for the
18781878 designated examiner program is employed by an Oklahoma public school

19361936 examiner certification fees collected by the Department of Public
19371937 Safety pursuant to this subsection shall be deposited to the credi t
19381938 of the Department of Public Safety Restricted R evolving Fund to be
19391939 used for the purposes of th is subsection. No designated examiner
19401940 certification fee shall be refunded in the event that certification
19411941 is denied, suspended or revoked.
19421942 4. A designated exa miner may charge a fee for each Class D
19431943 driving skills examination given, whether the person bei ng examined
19441944 passes or fails the examination.
19451945 5. The Department of Public Safety shall conduct an annual
19461946 complete nationwide criminal history background check o n each
19471947 designated examiner and a complete nationw ide criminal history
19481948 background check on each d esignated examiner applicant. The fees
19491949 for the background check shall be borne by the designated examiner
19501950 or designated examiner applicant.
19511951 6. The Department of Public Safety shall promulgate rules to
19521952 implement and administer the provisions of this subse ction.
19531953 E. 1. Upon application and approval of the Commissioner of
19541954 Public Safety, any public or private comme rcial truck driving school
19551955 that has or maintains a program instructing students f or a Class A,
19561956 B or C license, public transit agency or state, cou nty or municipal
19571957 government agency in this state shall be authorized to hire or
19581958 employ designated examiners ap proved by the Department of Public
19591959 Safety to be third-party examiners of the Class A, B or C driving

20122012 examiners must successfully have completed the courses and traini ng
20132013 as outlined in paragraph 2 of this subsection. The Department of
20142014 Public Safety shall be required to approve at least one public
20152015 transit agency that has or maintains a program instructing students
20162016 for a Class A, B or C license to hire or employ third-party
20172017 examiners pursuant to this section. It shall be permissible for any
20182018 public transit agency operating in the State of Oklahoma to utilize
20192019 the third-party examiners hired or employed by a public transit
20202020 agency approved by the Department.
20212021 2. The Department of Public Safety sh all adopt a curriculum of
20222022 required courses and training to be offered to third-party
20232023 examiners. The courses and training for certification shall meet
20242024 the same standards as required for commercial driver examiners of
20252025 the Department of Public Safety.
20262026 3. The Department of Public Safety shall require each third -
20272027 party examiner applicant and commercial school driver education
20282028 instructor applicant to sub mit to an electronic national criminal
20292029 history record check pursuant to Section 150.9 of Title 74 of the
20302030 Oklahoma Statutes. On or before December 1, 2022, the Departmen t
20312031 shall require each third-party examiner or commercial school driver
20322032 education instructor to submit to an electronic national criminal
20332033 history record check pursuant to Section 150.9 of Title 74 of the
20342034 Oklahoma Statutes. The fees for the background check shall be borne

20892089 F. The Department of Public Safety shall promulgate rules no
20902090 later than December 15, 2021, to:
20912091 1. Implement and administer the provisions of this section
20922092 based on requirements set forth in Section 383.75 of Title 49 of the
20932093 Code of Federal Regu lations;
20942094 2. Establish a process to inform any school, public transit
20952095 agency, examiner, or state, county or municipal government agency ,
20962096 who has been denied, within forty -five (45) days from the denial;
20972097 3. Create an appeal process for any school, public transit
20982098 agency, examiner, or state, county or municipal government agency
20992099 denied; and
21002100 4. If the initial application for approval was denied, limit
21012101 the number of times an in dividual school, public transit agency,
21022102 individual examiner applicant, or state, county or municipal
21032103 government agency may reapply in a calendar year to tw o
21042104 reapplications.
21052105 SECTION 3. This act shall become effective November 1, 2022.
