59 | 60 | | BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA: |

60 | 61 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -133, is |
---|
61 | 62 | | amended to read as follows: |

62 | 63 | | Section 1-133. A. As used in this section: |
---|
63 | 64 | | 1. “Health care entity” means: |
---|
64 | 65 | | a. a health plan that, either a s an individual or group, |
---|
65 | 66 | | provides for, or pays the cost of, medical care, |
---|
95 | 95 | | c. any further individual or association defined as a |
---|
96 | 96 | | covered entity under 45 C.F.R., Section 160.103 ; |
---|
97 | 97 | | 2. “Health information exchange ” means the electronic movement |
---|
98 | 98 | | of health-related information among organizations according to |
---|
99 | 99 | | nationally recognized standards for purpos es including, but not |
---|
100 | 100 | | limited to, payment, treatment, and administration; and |
---|
101 | 101 | | 2. 3. “Health information exchange organization ” means an |
---|
102 | 102 | | entity whose primary business act ivity is health information |
---|
103 | 103 | | exchange; and |
---|
104 | 104 | | 3. “Oklahoma State Health I nformation Network and Exchange” or |
---|
105 | 105 | | “OKSHINE” means a health information exchange organization charged |
---|
106 | 106 | | with facilitating the exchange of health information to and from |
---|
107 | 107 | | authorized individuals and health care organizations in this state |
---|
108 | 108 | | and. |
---|
109 | 109 | | B. The State of Oklahoma shall serve as or shall designate the |
---|
110 | 110 | | state-designated state designated entity for health information |
---|
111 | 111 | | exchange. |
---|
112 | 112 | | B. The Oklahoma Health Care Authority (OHCA) shall establish a |
---|
113 | 113 | | health information exchange certification with input from |
---|
114 | 114 | | stakeholders. Such certific ation shall be required in order for a |
---|
115 | 115 | | health information exchan ge organization to qu alify as an Oklahoma |
---|
116 | 116 | | Statewide Health Information Exchange (OKHIE). Until such time as |
---|
146 | 145 | | exchange organization that was previous ly certified by the Oklahoma |
---|
147 | 146 | | Health Information Exchange Trust. |
---|
148 | 147 | | C. The Oklahoma State Health Information Network and Exchange |
---|
149 | 148 | | (OKSHINE) shall be or ganized for the purpose of improving the health |
---|
150 | 149 | | of residents of this state by: |
---|
151 | 150 | | 1. Promoting efficient and e ffective communication among |
---|
152 | 151 | | multiple health care providers including, but not limited to, |
---|
153 | 152 | | hospitals, physicians, payers, employers, pharmacies, lab oratories, |
---|
154 | 153 | | and other health care entities or health information exchange |
---|
155 | 154 | | networks and organizations; |
---|
156 | 155 | | 2. Creating efficiencies in health care costs by eliminating |
---|
157 | 156 | | redundancy in data capture and storage and reducing administrative, |
---|
158 | 157 | | billing, and data collect ion costs; |
---|
159 | 158 | | 3. Creating the ability to monitor community health status; and |
---|
160 | 159 | | 4. Providing reliable information to health care consumers and |
---|
161 | 160 | | purchasers regarding the quality of health care. |
---|
162 | 161 | | C. Beginning July 1, 2023, a ll health care entities licensed by |
---|
163 | 162 | | and located in this state shall report data to and utilize the state |
---|
164 | 163 | | designated entity. The Oklahoma Health Care Authority may, as |
---|
165 | 164 | | provided by rules promulgated by the Oklahoma Health Care Authority |
---|
166 | 165 | | Board, allow exemptions from the requirement provided by this |
---|
167 | 166 | | subsection on the basis of financial hardship, size, or |
---|
197 | 195 | | D. 1. A person who participates in the services or information |
---|
198 | 196 | | provided by OKSHINE or an OKHIE the state designated entity shall |
---|
199 | 197 | | not be liable in any action f or damages or costs of any nature that |
---|
200 | 198 | | result solely from the person’s use or failure to use either an |
---|
201 | 199 | | OKHIE or OKSHINE information or data from the state designated |
---|
202 | 200 | | entity that was entered or retrieved under relevant state or federal |
---|
203 | 201 | | privacy laws, rules, regulations, or policies including , but not |
---|
204 | 202 | | limited to, the Health Insurance Portability and Accountability Act |
---|
205 | 203 | | of 1996. |
---|
206 | 204 | | 2. A person shall not be subject to antitrust or unfair |
---|
207 | 205 | | competition liability based on participation in OKSHINE or an OKHIE |
---|
208 | 206 | | with the state designated entity as long as the participation |
---|
209 | 207 | | provides an essential governmental function for the p ublic health |
---|
210 | 208 | | and safety and enjoys state action immunity. |
---|
211 | 209 | | 3. Participating in an OKHIE shall qualify as meeting any |
---|
212 | 210 | | requirement to send data to OKSHIN E. |
---|
213 | 211 | | E. 1. A person who provides information and data to OKSHINE |
---|
214 | 212 | | the state designated entity retains a property right in the |
---|
215 | 213 | | information or data, but grants to the other participants or |
---|
216 | 214 | | subscribers a nonexclusive license to retrieve and use that |
---|
217 | 215 | | information or data under relevant state or federal privacy laws, |
---|
247 | 244 | | 2. All processes or software developed , designed, or purchased |
---|
248 | 245 | | by OKSHINE shall remain the property of OKSHINE subject to use by |
---|
249 | 246 | | participants or subscribers. |
---|
250 | 247 | | F. Patient-specific protected health information shall only be |
---|
251 | 248 | | disclosed in accordance with the patient’s authorization or in |
---|
252 | 249 | | compliance with relevant state or federal privacy laws, rules, |
---|
253 | 250 | | regulations, or policies including , but not limited to, the Health |
---|
254 | 251 | | Insurance Portability and Acco untability Act of 1996. |
---|
255 | 252 | | G. The Oklahoma Health Care Authority Board shall promulgate |
---|
256 | 253 | | rules to implement the provisions of this section. |
---|
257 | 254 | | SECTION 2. This act shall become effecti ve July 1, 2022. |
---|
258 | 255 | | SECTION 3. It being immediately necessary for the preservation |
---|
259 | 256 | | of the public peace, health or safety, an emergency is hereby |
---|
260 | 257 | | declared to exist, by reason whereof this act shall take effect and |
---|
261 | 258 | | be in full force from and aft er its passage and approval. |
