5960 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
6061 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -133, is

6263 Section 1-133. A. As used in this section:
6364 1. “Health care entity” means:
6465 a. a health plan that, either a s an individual or group,

93+b. a health care provider that offers or renders medical

9696 covered entity under 45 C.F.R., Section 160.103 ;
9797 2. “Health information exchange ” means the electronic movement
9898 of health-related information among organizations according to
9999 nationally recognized standards for purpos es including, but not
100100 limited to, payment, treatment, and administration; and
101101 2. 3. “Health information exchange organization ” means an
102102 entity whose primary business act ivity is health information
103103 exchange; and
104104 3. “Oklahoma State Health I nformation Network and Exchange” or
105105 “OKSHINE” means a health information exchange organization charged
106106 with facilitating the exchange of health information to and from
107107 authorized individuals and health care organizations in this state
108108 and.
109109 B. The State of Oklahoma shall serve as or shall designate the
110110 state-designated state designated entity for health information
111111 exchange.
112112 B. The Oklahoma Health Care Authority (OHCA) shall establish a
113113 health information exchange certification with input from
114114 stakeholders. Such certific ation shall be required in order for a
115115 health information exchan ge organization to qu alify as an Oklahoma
116116 Statewide Health Information Exchange (OKHIE). Until such time as
117-the health information exchange certification is established by
118-OHCA, an OKHIE shall mean either OKSHINE or a health informatio n

143+the health information exchange certification is established by
144+OHCA, an OKHIE shall mean either OKSHINE or a health information
146145 exchange organization that was previous ly certified by the Oklahoma
147146 Health Information Exchange Trust.
148147 C. The Oklahoma State Health Information Network and Exchange
149148 (OKSHINE) shall be or ganized for the purpose of improving the health
150149 of residents of this state by:
151150 1. Promoting efficient and e ffective communication among
152151 multiple health care providers including, but not limited to,
153152 hospitals, physicians, payers, employers, pharmacies, lab oratories,
154153 and other health care entities or health information exchange
155154 networks and organizations;
156155 2. Creating efficiencies in health care costs by eliminating
157156 redundancy in data capture and storage and reducing administrative,
158157 billing, and data collect ion costs;
159158 3. Creating the ability to monitor community health status; and
160159 4. Providing reliable information to health care consumers and
161160 purchasers regarding the quality of health care.
162161 C. Beginning July 1, 2023, a ll health care entities licensed by
163162 and located in this state shall report data to and utilize the state
164163 designated entity. The Oklahoma Health Care Authority may, as
165164 provided by rules promulgated by the Oklahoma Health Care Authority
166165 Board, allow exemptions from the requirement provided by this
167166 subsection on the basis of financial hardship, size, or
168-technological capability of a health care entity or such other ba ses
169-as may be provided by rules promulgated by the Board.

193+technological capability of a health care entity or such other ba ses
194+as may be provided by rules promulgated by the Board.
197195 D. 1. A person who participates in the services or information
198196 provided by OKSHINE or an OKHIE the state designated entity shall
199197 not be liable in any action f or damages or costs of any nature that
200198 result solely from the person’s use or failure to use either an
201199 OKHIE or OKSHINE information or data from the state designated
202200 entity that was entered or retrieved under relevant state or federal
203201 privacy laws, rules, regulations, or policies including , but not
204202 limited to, the Health Insurance Portability and Accountability Act
205203 of 1996.
206204 2. A person shall not be subject to antitrust or unfair
207205 competition liability based on participation in OKSHINE or an OKHIE
208206 with the state designated entity as long as the participation
209207 provides an essential governmental function for the p ublic health
210208 and safety and enjoys state action immunity.
211209 3. Participating in an OKHIE shall qualify as meeting any
212210 requirement to send data to OKSHIN E.
213211 E. 1. A person who provides information and data to OKSHINE
214212 the state designated entity retains a property right in the
215213 information or data, but grants to the other participants or
216214 subscribers a nonexclusive license to retrieve and use that
217215 information or data under relevant state or federal privacy laws,
218-rules, regulations, or policies including , but not limited to, the
219-Health Insurance Portability and Accountability Act of 1996.

242+rules, regulations, or policies including , but not limited to, the
243+Health Insurance Portability and Accountability Act of 1996.
247244 2. All processes or software developed , designed, or purchased
248245 by OKSHINE shall remain the property of OKSHINE subject to use by
249246 participants or subscribers.
250247 F. Patient-specific protected health information shall only be
251248 disclosed in accordance with the patient’s authorization or in
252249 compliance with relevant state or federal privacy laws, rules,
253250 regulations, or policies including , but not limited to, the Health
254251 Insurance Portability and Acco untability Act of 1996.
255252 G. The Oklahoma Health Care Authority Board shall promulgate
256253 rules to implement the provisions of this section.
257254 SECTION 2. This act shall become effecti ve July 1, 2022.
258255 SECTION 3. It being immediately necessary for the preservation
259256 of the public peace, health or safety, an emergency is hereby
260257 declared to exist, by reason whereof this act shall take effect and
261258 be in full force from and aft er its passage and approval.
