162 | 235 | | 1. “Certified teacher” means a teacher who has been issued a |

164 | 237 | | Oklahoma Teacher Preparation Act and rules of the Board ; |
---|
165 | 238 | | 2. “Charter school” means a public school establi shed by |
---|
166 | 239 | | contract pursuant to this act to provide learning that will improve |
---|
167 | 240 | | student achievement and as defined in the Elementary and Secondary |
---|
168 | 241 | | Education Act of 1965, 20 U.S.C. 8 065; and |
---|
169 | 242 | | 3. “Parent” means the natural or adoptive parent or legal |
---|
170 | 243 | | guardian of a minor child. |
---|
171 | 244 | | SECTION 2. NEW LAW A new section of law to be codified |
---|
209 | 306 | | school. The surety bond or letter of credit amount may be adjusted |

217 | 314 | | SECTION 3. NEW LAW A new section of law to be codified |

220 | 317 | | A. A certified teacher or consortium of certified teachers |
---|
221 | 318 | | seeking to establish a professional teacher c harter school pursuant |
---|
222 | 319 | | to this act shall submit a written application to the State Board of |
---|
223 | 320 | | Education. The Board shall make the application available on its |
---|
224 | 321 | | website, and applications may be submitted online. The Board shall |
---|
225 | 322 | | not charge an application fee. The application shall include: |
---|
226 | 323 | | 1. The name of the applicant(s) accompanied by copies of |
---|
227 | 324 | | certificates to teach issued by the B oard and proof that the |
---|
258 | 380 | | 3. The designated point of cont act between the professional |
---|
259 | 381 | | teacher charter school and State Board of Education. |
---|
260 | 382 | | B. 1. The State Board of Education may disapprove an |
---|
261 | 383 | | application that does not meet one or more of the requirements set |
---|
262 | 384 | | forth in this section or Section 4 of this act. |
---|
263 | 385 | | 2. The State Board of Education shall approve an application |
---|
264 | 386 | | that meets the requirements of this section and Section 4 of this |
---|
265 | 387 | | act within thirty (30) days of receipt of the application and grant |
---|
266 | 388 | | the applicant a charter contract . If an application that meet s the |
---|
267 | 389 | | requirements of this section and Section 4 of this act is not |
---|
268 | 390 | | approved within thirty ( 30) days of receipt, the appli cant(s) shall |
---|
269 | 391 | | have a cause of action in district court. The court may award costs |
---|
270 | 392 | | and reasonable attorney fees to the prevailing party. |
---|
271 | 393 | | C. A professional teacher charter school established pursuant |
---|
272 | 394 | | to the provisions of this act may be organized as a sole |
---|
273 | 395 | | proprietorship or any other business entity authorized to do |
---|
274 | 396 | | business in this state. |
---|
275 | 397 | | D. A professional teacher charter school shall be govern ed by |
---|
276 | 398 | | the certified teacher or consortium of certified teachers who |
---|
277 | 399 | | applied for the school pursuant to this section and shall have |
---|
304 | | - | exclusive control over curriculum selection, development, and |
---|
305 | | - | delivery. Provided, however, a professional teacher charter school |
---|
306 | | - | may have a non-teacher advisory board. |
---|
307 | | - | E. A professional teacher charter school contract shall be a |
---|
308 | | - | continuing contract. |
---|
| 454 | + | E. The term of a professional teacher charter school contract |
---|
| 455 | + | shall be five (5) years from the first day of operation. A |
---|
| 456 | + | professional teacher charter school co ntract may be renewed for |
---|
| 457 | + | successive five-year terms of duration. |

310 | 459 | | granted a professional teacher char ter school contract pursuant to |

314 | 463 | | of this act may apply to the State Board of Education to assume the |

315 | 464 | | terms of the charter contract. The State Board of Education shall |
---|
316 | 465 | | approve the transfer of the charter contract if the applicati on |
---|
317 | 466 | | meets the requirements of this section and Section 4 of this act . |

362 | 536 | | Education pursuant to Section 11-103.6 of Title 70 of the Oklahoma |

364 | 538 | | 4. Shall post on its websi te information regarding curriculum |

365 | 539 | | and instructional materials to be used by charter school students |
---|
366 | 540 | | and teachers; |
---|
367 | 541 | | 5. Shall adopt bylaws that: |

368 | 542 | | a. ensure compliance with all federal regulations and |
---|
369 | 543 | | state and local rules and statutes relating to health, |
---|
370 | 544 | | safety, civil rights, and insurance , and |
---|
371 | 545 | | b. require that the charter school be as equally free and |
---|
372 | 546 | | open to all students as traditional public schools; |
---|
373 | 547 | | 6. Shall have independent control over curriculum and personnel |
---|
374 | 548 | | decisions; |
---|
375 | 549 | | 7. May enter into contracts, sue, and be sued; and |
---|
376 | 550 | | 8. Shall not levy taxes or issue bonds. |
---|
405 | 604 | | Charter Schools Act except as provided for in this act. A |
---|
406 | 605 | | professional teacher charter school shall no t: |
---|
407 | 606 | | 1. Be required to participate in the testing required by the |
---|
408 | 607 | | Oklahoma School Testing Program Act ; however, the charter school may |
---|
409 | 608 | | choose to participate; |
---|
410 | 609 | | 2. Be required to participate in the accountability system |
---|
411 | 610 | | established pursuant to Section 1210.54 5 of Title 70 of the O klahoma |
---|
412 | 611 | | Statutes; however, the charter school may choose to participate; |
---|
413 | 612 | | 3. Be required to employ persons who have a valid certificate |
---|
414 | 613 | | issued by and in accordance with the rules of the State Bo ard of |
---|
415 | 614 | | Education; |
---|
416 | 615 | | 4. Be required to com ply with the minimum salary and benefits |
---|
417 | 616 | | set forth in Section 18 -114.14 of Title 70 of the Oklahoma Statutes; |
---|
418 | 617 | | 5. Be required to comply with employer -employee bargaining |
---|
419 | 618 | | provisions set forth in Sections 5 09.1 through 509.10 of Title 70 of |
---|
453 | 680 | | geographic boundaries of each professional teacher charter school |
---|
454 | 681 | | shall be the borders of the state. |
---|
455 | 682 | | 2. Any student between the age s of five (5) on or before |
---|
456 | 683 | | September 1 and twenty-one (21) years on or before September 1 shall |
---|
457 | 684 | | be eligible to submit an enrollment application to a professional |
---|
458 | 685 | | teacher charter school. |
---|
459 | 686 | | 3. A professional teacher charter school shall not limit |
---|
460 | 687 | | enrollment or discriminate based on race, sex, or religion. |
---|
461 | 688 | | 4. The State Board of Education shall not restrict the number |
---|
462 | 689 | | of students a professional teacher charter school may enroll. |
---|
463 | 690 | | 5. A professional teacher charter school may establish |
---|
464 | 691 | | enrollment criteria based on objective academic standards and |
---|
465 | 692 | | educational emphasis. |
---|
466 | 693 | | 6. By July 1 each year, a professional teacher charter school |
---|
467 | 694 | | shall determine and post on its website the capacity for each grade |
---|
468 | 695 | | level offered by the school . If capacity is insufficient to enroll |
---|
469 | 696 | | all eligible students, the school shall select students through a |
---|
470 | 697 | | lottery selection process. |
---|
471 | 698 | | D. A professional teacher charter school may provide student |
---|
472 | 699 | | transportation. |
---|
502 | 754 | | A. There is hereby created in the State Treasury a revol ving |
---|
503 | 755 | | fund for the State Department of Education to be designated the |
---|
504 | 756 | | “Professional Teacher Charter Student Revolving Fund”. The fund |
---|
505 | 757 | | shall be a continuing fund, not subject to fiscal year limitations, |
---|
506 | 758 | | and shall consist of all monies received by the State Department of |
---|
507 | 759 | | Education from the surety bond or irrevoca ble letter of credit |
---|
508 | 760 | | required by subsection B of Section 2 of this act. All monies |
---|
509 | 761 | | accruing to the credit of the fund are hereby appropriated and may |
---|
510 | 762 | | be budgeted and expended by the State Department of Education for |
---|
511 | 763 | | the purpose set forth in subsection B o f this section. Expenditures |
---|
512 | 764 | | from the fund shall be made upon warrants issued by the State |
---|
513 | 765 | | Treasurer against claims filed as prescribed by law with the |
---|
514 | 766 | | Director of the Office of Management and Enterp rise Services for |
---|
515 | 767 | | approval and payment. |
---|
516 | 768 | | B. 1. In the event that a professional teacher charter school |
---|
517 | 769 | | established pursuant to the Professional Teacher Charter Act created |
---|
518 | 770 | | in Section 1 of this ac t permanently ceases operations prior to the |
---|
519 | 771 | | end of a school year, the surety bond or irrevocable letter of |
---|
520 | 772 | | credit required by subsection B of Section 2 of this act shall be |
---|
521 | 773 | | paid to the Professional Teacher Charter Student Revolving Fund |
---|
522 | 774 | | created in subsection A of this section. The State Department of |
---|
553 | | - | 2. a. If a professional teacher charter school is |
---|
