8181 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8282 SECTION 1. AMENDATORY 70 O.S. 2021, Section 1 -111, is
8383 amended to read as follows:
8484 Section 1-111. A. Except as otherwise provided for by law, a
8585 school day shall consist of not less th an six (6) hours devoted to
8686 school activities. A district board of education may elect to
8787 extend the length of one (1) or more school days to more than six
8888 (6) hours and reduce the number of school days as long as the total
8989 amount of classroom instruction time is not less than one thousand

143143 B. A school day for nursery, early childhood educat ion,
144144 kindergarten, and alternative education programs shall be as
145145 otherwise defined by law or as defined by the State Board of
146146 Education. Except as otherwise provided for in this subsection, not
147147 more than one (1) school day shall be counted for attendance
148148 purposes in any twenty-four-hour period. Two (2) school days, each
149149 consisting of not less than six (6) hours, may be counted for
150150 attendance purposes in any twenty-four-hour period only if one of
151151 the school days is for the purpose of parent -teacher conferences
152152 held as provided for in Section 1-109 of this title.
153153 C. Students absent from s chool in which they are regularly
154154 enrolled may be considered as being in attendance if the reason for
155155 such absence is to participate in scheduled school activities under
156156 the direction and supervision of a regular member of the faculty or
157157 to participate in an online course approved by the district board of
158158 education. The State Board of Education shall adopt rules to
159159 provide for the implementation of supplemental online cour ses which
160160 shall include, but not be limited to, provisions addressing the
161161 following:

214214 2. A student admission process administered t hrough the
215215 district of residence, which provides the ability for the student to
216216 enroll in individual courses;
217217 3. A process by which students are not denied the opportunity
218218 to enroll in educationally appropriate courses by school districts.
219219 For the purposes of this section, “educationally appropriate ” means
220220 any instruction that i s not substantially a repeat of a course or
221221 portion of a course that the student has successfully completed,
222222 regardless of the grade of the student, and regardless of whether a
223223 course is similar to or identical to the instruction that is
224224 currently offered in the school district;
225225 4. Creation of a system which provides ongoing enrollment
226226 access for students throughout the school year;
227227 5. A grace period of fifteen (15) calendar days from the first
228228 day of an online course for student withdrawal from an online course
229229 without academic penalty;
230230 6. Mastery of competencies for course completion r ather than
231231 Carnegie units;
232232 7. Student participati on in extracurricular activities in
233233 accordance with school district eligibility rules and policies and
234234 any rules and policies of a private organization or association
235235 which provides the coordination, superv ision, and regulation of the
236236 interscholastic activ ities and contests of schools;

289289 online course providers, on a form developed by the State Department
290290 of Education; and
291291 9. A review process to id entify and certify online course
292292 providers and a uniform payment processing system.
293293 D. Each district board of education shall adopt policies and
294294 procedures that conform t o rules for online courses as adopted by
295295 the State Board. Such policies shall includ e criteria for approval
296296 of the course, the approp riateness of the course for a particular
297297 student, authorization for full-time students to enroll in online
298298 courses, and establishing fees or charges. No district shall be
299299 liable for payment of any fees or c harges for any online course for
300300 a student who has not complied with the district’s policies and
301301 procedures. School districts shall not deny students the
302302 opportunity to enroll in educationally appropriate courses and shall
303303 provide an admissions process wh ich includes input from the student,
304304 the parent or legal guardian of the student, and school faculty.
305305 E. Districts shall require students enrolled in online courses
306306 to participate in the Oklahoma School Testing Program Act. S tudents
307307 participating in onli ne courses from a remote site will be
308308 responsible for providing their own equipment and Internet acce ss,
309309 unless the district chooses to provide the equipment. Credit may
310310 not be granted for such courses except upon approval of the State
311311 Board of Education and the district board of education.

363363 F. Districts may provide students with opportunities for
364364 blended instruction. “Blended instruction” shall mean a combination
365365 of brick-and-mortar learning and virtual learning environments that
366366 includes elements of a student’s control over place, pace, and path
367367 of learning. A student in blended instruction may work on virtual
368368 courses at home or at school in a blended flex lab but shall
369369 participate in at least one unit or set of competencies as defined
370370 by Section 11-103.6 of this title at a physical school building in a
371371 traditional classroom setting which is the academi c equivalent of
372372 one (1) hour per day for each instructional day in th e school year
373373 as defined by Section 1-109 of this title.
374374 G. The school day for kinde rgarten may consist of six (6) hours
375375 devoted to school activities.
376376 H. 1. School districts may allow student s to enroll part time
377377 including students who are enrolled in a private school or who are
378378 being educated pursuant to the other means except ion provided for in
379379 subsection A of Section 10 -105 of this title. A student shall be
380380 considered “part time” if he or she is enrolled in courses,
381381 programs, or services for an amount of time that is less than the
382382 one thousand eighty (1,080) hours per year required by Section 1-109
383383 of this title.
384384 2. Each school district board of education shall adopt a p art-
385385 time student enrollment policy and post it on the district’s
386386 website.

438438 3. The State Board of Education shall pro mulgate rules to
439439 determine how part-time enrolled students shall be counted for
440440 purposes of calculation of State Aid pursuant to Section 18 -200.1 of
441441 this title.
442442 SECTION 2. AMENDATORY 70 O.S. 2021, Section 11 -103.6, as
443443 last amended by Section 4, Chapter 345, O.S.L. 2021, is amended to
444444 read as follows:
445445 Section 11-103.6. A. 1. The State Board of Education shal l
446446 adopt subject matter standards for in struction of students in the
447447 public schools of this state that are necessary to ensure there is
448448 attainment of desired levels of competencies in a variety of areas
449449 to include language, m athematics, science, social stud ies,
450450 communication, and health and physical education.
451451 2. School districts shall de velop and implement curriculum,
452452 courses, and instruction in order to ensure t hat students meet the
453453 skills and competencies as set forth in this section and in the
454454 subject matter standards adopted by the State Board of Education.
455455 3. All students shall gain literacy at the elementary and
456456 secondary levels. Students shall develop ski lls in reading,
457457 writing, speaking, computing, and critical thinking. For purposes
458458 of this section, critical thinking means a manner of analytical
459459 thinking which is logical and uses linear factual analysis to reach
460460 a conclusion. They shall learn about cultures and environments -
461461 their own and those of others wi th whom they share the earth. All

513513 students shall receive the instruction needed to lead healthy and
514514 physically active lifestyles. Students, therefore, shall study
515515 social studies, literature, la nguages, the arts, health,
516516 mathematics, and science. Such cur ricula shall provide for the
517517 teaching of a hands-on career exploration program in cooperation
518518 with technology center schools.
519519 4. The subject matter standards shall be designed to teach the
520520 competencies for which students shall be tested as provided in
521521 Section 1210.508 of this title and shall be designed to prepare all
522522 students for active citizenship, employment, and/or successful
523523 completion of postsecondary education without the need for remedial
524524 coursework at the postsecondary level.
525525 5. The subject matte r standards shall be designed wi th rigor as
526526 defined in paragraph 3 of s ubsection F of this section.
527527 6. The subject matter standar ds for English Language Arts shall
528528 give Classic Literature and no nfiction literature equal
529529 consideration to other literature. In addition, emphasis shall be
530530 given to the study of complete works of literature.
531531 7. At a minimum, the subject matter standard s for mathematics
532532 shall require mastery of the standard algorithms in mathematics,
533533 which is the most logical, efficient way of solving a problem that
534534 consistently works, and for students to attain f luency in Euclidian
535535 geometry.

587587 8. The subject matter stan dards for history, social studies and
588588 United States Government shal l include the content of the United
589589 States naturalization tes t, with an emphasis on the speci fic content
590590 of the test and the ideas a nd concepts it references. The United
591591 States naturalization test shall be made available in physical and
592592 electronic online formats as an optional assessment tool for
593593 teachers.
594594 9. The subject matter standards for Uni ted States Government
595595 shall include an emphasis on civics. For the purposes of this
596596 section, “civics” means the study of the rights and duties of
597597 Oklahoma and United States citizens and of how those governments
598598 work.
599599 10. The subject matter standards for health and physical
600600 education shall include but not be limited to the domains of
601601 physical, emotional, social, and intellectual health. Health
602602 literacy shall includ e the ability to obtain, process, and
603603 understand basic health information and services needed to make
604604 appropriate health decisions. Health shall also include the
605605 importance of proper nutrition and exercise, mental health and
606606 wellness, substance abuse, copi ng skills for understanding and
607607 managing trauma, establishing and maintaining positive
608608 relationships, and responsible decision making. Physical literacy
609609 shall include the ability to move with competence and confidence in

662662 benefit the healthy developm ent of the whole person.
663663 B. Subject to the provisions of subsection C of this section,
664664 in order to graduate from a public hi gh school accredited by the
665665 State Board of Education with a standard d iploma, students shall
666666 complete the following college prepara tory/work ready curriculum
667667 units or sets of competencies at the seconda ry level:
668668 1. Four units or sets of competencies of E nglish to include
669669 Grammar, Composition, Literature, or any English cour se approved for
670670 college admission requirements;
671671 2. Three units or sets of competencies of ma thematics, limited
672672 to Algebra I, Algebr a II, Geometry, Trigonometry, Math Analysis,
673673 Calculus, Advanced Placement Statistics, or any mathematics course
674674 with content and/or rigor above Algebra I and approved for college
675675 admission requirements;
676676 3. Three units or sets of competencies of laboratory science
677677 approved for college admission requirement s including one unit or
678678 set of competencies of life science meeting the standards for
679679 Biology I; one unit or set of competencies of physical science
680680 meeting the standards for Physical Science, Chemistry , or Physics;
681681 and one unit or set of competencies fr om the domains of physical
682682 science, life science, or earth and space scien ce such that the
683683 content and rigor is above Biology I or Phys ical Science;

742742 English language or two uni ts of computer technology approved for
743743 college admission requ irements, whether taught at a hi gh school or a
744744 technology center school , including computer programming, hardware,
745745 and business computer applications, such as word processing,
746746 databases, spreadsheets, and graphics, excluding keyboarding or
747747 typing courses;
748748 6. One additional unit or set o f competencies selected from
749749 paragraphs 1 through 5 of this subsection or career and technology
750750 education courses, concurrently enrolled courses, Advanced Placemen t
751751 courses, or International Baccalaureate courses approved for college
752752 admission requirements; and
753753 7. One unit or set of competencie s of fine arts, such as music,
754754 art, or drama, or one unit or set of competencies of speech.
755755 C. In lieu of the requirements of subsection B of this section
756756 which requires a college prep aratory/work ready curriculum, a
757757 student may enroll in the core curriculum as provided in subsection
758758 D of this section upon written approval of the parent or legal

810810 guardian of the student. For students under the age of eighteen
811811 (18) school districts shall require a parent or legal guardian of
812812 the student to meet with a designee of the school prior to
813813 enrollment in the core curriculum. The State Department of
814814 Education shall develop and distribute to school districts a form
815815 suitable for this purpose, which shall inc lude information on the
816816 benefits to students of completing the college preparatory/work
817817 ready curriculum as provided for in subsection B of this section.
818818 D. For those students subject to the requirements of subsection
819819 C of this section, in order to gradua te from a public high school
820820 accredited by the State Board of Education with a standard diploma,
821821 students shall complete the following core curriculum units or set s
822822 of competencies at the secondary level:
823823 1. Language Arts – 4 units or sets of competencies to consist
824824 of 1 unit or set of compet encies of grammar and composition, and 3
825825 units or sets of competencies which may include, but are not limited
826826 to, the following courses:
827827 a. American Literature,
828828 b. English Literature,
829829 c. World Literature,
830830 d. Advanced English Courses, or
831831 e. other English courses with content and/or rigor equal
832832 to or above grammar and composition;

886886 contextual methodology, and 2 units or sets of c ompetencies which
887887 may include, but are not limited to, the fol lowing courses:
888888 a. Algebra II,
889889 b. Geometry or Geometry taught in a contextual
890890 methodology,
891891 c. Trigonometry,
892892 d. Math Analysis or Precalculus,
893893 e. Calculus,
894894 f. Statistics and/or Probability,
895895 g. Computer Science or acceptance and successful
896896 completion of one (1) year of a full-time, three-hour
897897 career and technology progr am leading to an industry
898898 credential/certificate or college c redit. The State
899899 Board of Career and Technology Education shall
900900 promulgate rules to define the provisions of this
901901 section related to the accepted industry-valued
902902 credentials which are indust ry-endorsed or industry-
903903 aligned. The list of accepted indust ry-valued
904904 credentials shall be reviewed annually and updated at
905905 least every three (3) years by the Board,
906906 h. (1) contextual mathematics courses which enhance
907907 technology preparation, or

973973 grade upon approval of the State Board of Education

975975 j. any other mathematics course with content and/or rigor
976976 equal to or above Algebra I;
977977 3. Science – 3 units or sets of competencies to consist of 1
978978 unit or set of competencies of Biology I or Biology I taught in a
979979 contextual methodology, and 2 units or sets of competencies in the
980980 areas of life, physical, or earth science or technology which may

11911191 E. 1. In addition to the curriculum requirements of either
11921192 subsection B or D of this sectio n, in order to graduate from a
11931193 public high school accredited by the State Board of Education
11941194 students shall complete the requirements for a personal fi nancial
11951195 literacy passport as set forth in the Passport to Financial Literacy
11961196 Act and any additional course requirements or recommended elective
11971197 courses as may be established by the State Board of Education and
11981198 the district school board. School districts shall strongly
11991199 encourage students to complete two units or sets of competencies of
12001200 world languages and two units or sets of competencies of physical
12011201 and health education .
12021202 2. No student shall receive credit for high school graduation
12031203 more than once for completion of the same unit or set of
12041204 competencies to satisfy the curriculum requirements of this section.
12051205 3. A school district shall not be required to offer every
12061206 course listed in subsections B and D of this section but shall offer

12601260 F. For purposes of this section:
12611261 1. “Contextual methodology ” means academic content and skills
12621262 taught by utilizing real-world problems and project s in a way that
12631263 helps students understand the application of that knowledge;
12641264 2. “Qualified agricultural education courses” means courses
12651265 that have been determined by the State Board of Education to offer
12661266 the sets of competencies for one or more science co ntent areas and
12671267 which correspond to academic science courses. Qualified
12681268 agricultural education courses shall include, but are not limited
12691269 to, Horticulture, Plant and Soil Scien ce, Natural Resources and
12701270 Environmental Science, and Animal Science. The cours es shall be
12711271 taught by teachers certified in agricultural education and comply
12721272 with all rules of the Oklahoma Department of Career and Technology
12731273 Education;
12741274 3. “Rigor” means a level of difficulty that is thorough,
12751275 exhaustive and accurate and is appropriate for the grade level;
12761276 4. “Sets of competencies” means instruction in those skills and
12771277 competencies that are specified in the subject matter standards
12781278 adopted by the State Boa rd of Education and other skills and
12791279 competencies adopted by the Board, without r egard to specified

13321332 5. “Unit” means a Carnegie Unit as defined by the North Central
13331333 Association’s Commission on Schools.
13341334 G. 1. The State Board of E ducation shall adopt a plan to
13351335 ensure that rigor is maintained in the content, teac hing
13361336 methodology, level of expectations for student achievement, and
13371337 application of learning in all the courses taught to meet the
13381338 graduation requirements as specified in th is section.
13391339 2. The State Board of Education shall allow as much flexibility
13401340 at the district level as is possible without diminishing the rigor
13411341 or undermining the intent of providing these courses. To accomplish
13421342 this purpose, the State Department of Educ ation shall work with
13431343 school districts in reviewing and approving courses taught by
13441344 districts that are not specifically listed in subsections B and D of
13451345 this section. Options may include, but shall not be limited to,
13461346 courses taken by concurrent enrollment , advanced placement, or
13471347 correspondence, or courses bearing different titles.
13481348 3. The State Board of Education shall approve an advanced
13491349 placement computer science course to meet the requirements of course
13501350 competencies listed in paragraph 2 of subsection B of this section
13511351 if the course is taken in a student’s senior year and the student i s
13521352 concurrently enrolled in or has successfully completed Algebra II.
13531353 4. Technology center school districts may offer programs
13541354 designed in cooperation with institutions o f higher education which
13551355 have an emphasis on a focused field of career study upon appr oval of

14091409 these programs for up to one -half (1/2) of a school day and credit

14111411 and 6 of subsection B or D of this section shall be given if the
14121412 courses are taught by a teacher certified in the secondary subject
14131413 area; provided, credi t for units or sets of competencies pursuant to
14141414 subsection B of this section shall be approved for college admission
14151415 requirements.
14161416 5. If a student enrolls in a concurrent course, the school
14171417 district shall not be responsible for any costs incurred for tha t
14181418 course, unless the school district does not offer enough course
14191419 selection during the student’s secondary grade years to allow the
14201420 student to receive the courses needed to meet the graduation
14211421 requirements of this section. If the school district does not offer
14221422 the necessary course selection during the student’s secondary grade
14231423 years, it shall be responsible for the cost of resident tuition at
14241424 an institution in The Oklahoma State System of Higher Education,
14251425 fees, and books for the concurrent enrollment cour se, and providing
14261426 for transportation to and from the institution to the school site.
14271427 It is the intent of the Legislature that for students enrolled
14281428 in a concurrent enrollment course which is paid for by the school
14291429 district pursuant to this paragraph, the institution charge only the
14301430 supplementary and special service fees that are directly rel ated to

14871487 6. Credit for the units or sets of competencies required in
14881488 subsection B or D of this section shall be given when su ch units or
14891489 sets of competencies are taken prior to ninth grade if the teachers
14901490 are certified or authorized to teach the subjects for high school
14911491 credit and the required rigor is maintained.
14921492 7. The three units or sets of competencies in mathematics
14931493 required in subsection B or D of this section shall be completed in
14941494 the ninth through twelfth g rades. If a student completes any
14951495 required courses or sets of competencies in mathematics prior to
14961496 ninth grade, the student may take any other mathematics courses or
14971497 sets of competencies to fulfill the requirement to complete three
14981498 units or sets of compet encies in grades nine through twelve after
14991499 the student has satisfied the requirements of subsection B or D of
15001500 this section.
15011501 8. All units or sets of competencies required for graduation
15021502 may be taken in any sequence recommended by the school district.
15031503 H. As a condition of receiving accreditation from the State
15041504 Board of Education, all students in grades nine through twelve shall

15661566 that provide for the teaching and learning of the appropriate skills
15671567 and knowledge in the subject matter standards, as adopted by the
15681568 State Board of Education, may upon approval of the Boa rd, in
15691569 consultation with the Oklahoma Department of Career and Technology
15701570 Education if the courses are offered at a technology center school
15711571 district, be counted for academic credit and toward meeting the
15721572 graduation requirements of this section.
15731573 2. Internet-based courses offered by a technology center school
15741574 that are taught by a certifi ed teacher and provide for the teaching
15751575 and learning of the appropriate skills and knowledge in the subject
15761576 matter standards may, upon approval of the State Board of Educati on
15771577 and the independent district board of education, be counted for
15781578 academic credit and toward meeting the graduation requirements of
15791579 this section.

16391639 4. Courses offered by a supplemental education organization
16401640 that is accredited by a national accrediting body and that are
16411641 taught by a certified teacher and provide for the teaching and
16421642 learning of the appropria te skills and knowledge in the subject
16431643 matter standards may, upon approval of the State Board of Education
16441644 and the school district board of education, be counted for academi c
16451645 credit and toward meeting the graduation requirements of this
16461646 section.
16471647 J. The State Board of Education shall provide an option for
16481648 high school graduation based upon attainment of the desired levels
16491649 of competencies as required in tests pursuant to the pr ovisions of
16501650 Section 1210.508 of this title. Such option shall be in lieu of the
16511651 amount of course credits earned.
16521652 K. The State Board of Education shall prescribe, adopt, and
16531653 approve a promotion system based on the attainment by students of

17121712 M. Students who enter the ninth grade in or prior to the 2007-
17131713 08 school year who are enrolled in an alternative education program
17141714 and meet the requirements of their plans leading to high sch ool
17151715 graduation developed pursuant to Section 1210.568 of this title
17161716 shall be awarded a standard diploma.
17171717 N. Any student who completes the curriculum requirements of the
17181718 International Baccalaureate Diploma Program shall be awarded a
17191719 standard diploma.
17201720 O. Any student who successfully completes an advanced
17211721 mathematics or science course off ered pursuant to Section 1210.404
17221722 of this title shall be granted academic credit toward meeting the
17231723 graduation requirements pursuant to paragraph 2 or 3, as
17241724 appropriate, of subsection B or D of this section.
17251725 P. For purposes of this section, the courses ap proved for
17261726 college admission requirements shall be courses which are approved
17271727 by the Oklahoma State Regents for Higher Education for admission to
17281728 an institution within The O klahoma State System of Higher Education.

17801780 Q. Students who have been denied a stand ard diploma by the
17811781 school district in which the student is or was enrolled for failing
17821782 to meet the requirements of this section may re-enroll in the school
17831783 district that denied the student a standard diploma following the
17841784 denial of a standard diploma. The student shall be provided
17851785 remediation or intervention and the opportunity to complete the
17861786 curriculum units or sets of competencies required by this section to
17871787 obtain a standard diploma. Students who re-enroll in the school
17881788 district to meet the graduation requirements of this section shall
17891789 be exempt from the hourly instructional requirements of Section 1-
17901790 111 of this title and the six-period enrollment requirements of this
17911791 section.
17921792 R. The State Department of Education shall collect and report
17931793 data by school site and district on the number of students who
17941794 enroll in the core curriculum as provided in subsection D of this
17951795 section.
17961796 SECTION 3. This act shall become effec tive July 1, 2022.
17971797 SECTION 4. It being immediately necessary for the preservation
17981798 of the public peace, health or safety, an emergency is hereby
17991799 declared to exist, by reason whereof this act shall take effect and
18001800 be in full force from and a fter its passage and approval.
