49103 SECTION 1. NEW LAW A new section of law to be codified
50104 in the Oklahoma Statutes as Section 3231 of Title 70, unless there
51105 is created a duplication in numbering, reads as follows:

53106 A. This act shall be known and may be c ited as the “Oklahoma
54107 National Guard Educational Assistance Act”.

56108 B. As used in this act:

58109 1. “Oklahoma educational insti tution” means an institution of
59110 higher education within The Oklahoma State System of Higher
60111 Education;

62112 2. “Eligible Guard member” means a current member of the
63113 Oklahoma National Guard in good standing who has a high school
64114 diploma or who has completed General Educational Development (GED)
65115 requirements and who has secured admission to and enrolled in an
66116 Oklahoma educational institution;

68117 3. “Graduate program” means a program offered by an Oklahoma
69118 educational institution that leads to the award of a master’s
70119 degree;

72120 4. “Program” means the Oklahoma National Guard Educational
73121 Assistance Program established pursuant to the provisions of this
74122 section; and

76123 5. “Undergraduate program” means a program offered by an
77124 Oklahoma educational institution that leads to the award of an
78125 associate’s degree or a baccalaureate degree.

80153 C. There is hereby created the Oklahoma National Guard
81154 Educational Assistance Program to provide assistance to eligible
82155 Guard members who enroll in an Oklahoma educational institution.
83156 Subject to the availability of funds, t he amount of assistance shall
84157 be equivalent to the amount of resident tuition, mandatory fees, and
85158 academic service fees for courses in which the eligible Guard member
86159 is enrolled, not to exceed a max imum of eighteen (18) credit hours
87160 each semester.

89161 1. The amount of assistance provided to an eligible Guard
90162 member enrolled in an undergraduate program shall not exceed a

93163 maximum of one hundred twenty (120) credit hours in pursu it of an
94164 associate’s degree and/or a baccalaureate degree.

96165 2. Subject to the assistance for eligible Gua rd members
97166 enrolled in undergraduate programs being fully funded, assistance
98167 shall be provided to an eligible Guard member with a baccalaureate
99168 degree enrolled in a graduate program. The amount of assistance
100169 provided to an eligible Guard member enrolled i n a graduate program
101170 shall not exceed a maximum of forty (40) credit hours in pursuit of
102171 a master’s degree.

104172 3. Assistance provided pursuant to this section shall be
105173 granted without any limitation other than the amount of fun ds
106174 available for the Program an d the number of eligible Guard members
107175 who apply.

109203 4. Assistance allowed by this section shall not be allowed for
110204 courses taken in excess of the requireme nts for completion of a n
111205 undergraduate program or a graduate program, whichever is appli cable
112206 for the eligible Guard member.

114207 D. Assistance provided pursuant to this section shall be
115208 allocated to the Oklahoma educational institution from the Oklahoma
116209 National Guard Educational Assis tance Revolving Fund created
117210 pursuant to Section 2 of this act.

119211 E. To be eligible to apply for the Program, an eligible Guard
120212 member shall:

122213 1. Have at least one (1) year remaining on his or her
123214 enlistment contract at the beginning of any semester for which the
124215 member applies for assistance pursuant to this section;

126216 2. Agree in writing to complete his or her current service
127217 obligation in the Oklahoma Nationa l Guard; and

129218 3. Agree in writing to serve actively in good standing with the
130219 Oklahoma National Guard for not less tha n twenty-four (24) months
131220 after completion of the last s emester for which the member receives
132221 assistance pursuant to this section.

136222 F. To retain eligibility for the Program, an eligible Guard
137223 member shall:

139224 1. Maintain good academic standing and satisfacto ry academic
140225 progress according to standards of the Oklah oma educational
141226 institution in which the member is enrolled ;

143254 2. Maintain the requ irements for retention and degree
144255 completion as established by the Oklahoma educational institution in
145256 which the member is enrolled;

147257 3. Maintain a minimum grade point average of 2.0 on a 4.0
148258 scale; and

150259 4. Maintain satisfactory participation in the Oklahoma National
151260 Guard.

153261 G. An eligible Guard member seeking assistance pursuant to the
154262 provisions of this section shall submit an application on a form
155263 prescribed by the Military Department of the State of Oklahoma to
156264 the Educational Service Office of the Military Department prior to
157265 the semester for which assistance is sought. The eligible Guard
158266 member’s Commander or his or her designee shall confirm a member’s
159267 standing and eligibility to the Oklahoma educational institution in
160268 which the student is enrolled.

162269 H. The eligible Guard member’s Commander may deny an
163270 application submitted by an eligible Guard member for continued
164271 Program assistance if he or she fails to comply with the provisions
165272 of paragraph 1, 2, or 3 of subsection F of this section .

167273 I. An eligible Guard member who has received Program assistance
168274 pursuant to the provisions of th is section and who fails to comply
169275 with the provisions of paragraph 4 of subsection F of this section
170276 shall be required to repay an amount to be calculated as follows:

172304 1. Determine the total amount of assistance provided pursuant
173305 to the provisions of this section;

175306 2. Divide the amount determined in paragraph 1 of this
176307 subsection by twenty -four (24); and

181309 subsection by the number of months the member did not fulfill the
182310 requirements of paragraph 4 of subsection F of this section .
183311 Repayments shall be deposited into the Oklahoma National Guard
184312 Educational Assistance Revolving Fund created pursuant to Section 2
185313 of this act.

187314 J. An eligible Guard member who has received Program as sistance
188315 pursuant to the provisions of this section and who fails to comply
189316 with the provisions of paragraph 4 of subsection F of this section
190317 due to hardship circumstances may request a waiver from repayment.
191318 A waiver request shall be submitted in writing to the Adjutant
192319 General.

194320 K. By July 1 annually, the Oklahoma State Re gents for Higher
195321 Education shall notify th e Adjutant General o f the amount of funding
196322 available in the Okl ahoma National Guard Educati onal Assistance
197323 Revolving Fund created pursuant to Section 2 of this act.

199324 L. The Oklahoma State Regents for Higher Education shall
200325 promulgate rules to implement the provisions of this act including
201326 deadlines for submission of applications requir ed by subsection G of

205356 SECTION 2. NEW LAW A new section of law to be codified
206357 in the Oklahoma Statutes as Section 3232 of Title 70, unless there
207358 is created a duplication in num bering, reads as follows:

209359 There is hereby created in the State Treasury a revolving fund
210360 for the Oklahoma State Regents for Hig her Education to be designated
211361 the “Oklahoma National Guard Educational Assistance Revolving Fund”.
212362 The fund shall be a continuing fund, not subject to fiscal year
213363 limitations, and shall consist of all monies received by the
214364 Oklahoma State Regents for Higher Education from state
215365 appropriations. All monies accruing to the credit of the fund are
216366 hereby appropriated and may be budgeted and expended by the Oklahoma
217367 State Regents for Higher Education for the purpose of providing
218368 assistance to eligible Guard me mbers pursuant to th e provisions of
219369 Section 1 of this act . Expenditures from the fund shall be made
220370 upon warrants issued by the State Treasurer against claims filed as

223371 prescribed by law with the Director of the Office of Management and
224372 Enterprise Services for approval and payment.

226373 SECTION 3. This act shall become effective July 1, 2022.
