---|

151 | 151 | | 7. 6. "Board" means the State Board of Health; |

152 | 152 | | 8. 7. "Commissioner" means the State Commissioner of Health; |

153 | 153 | | 9. 8. "Department" means the State Department of Health; |

154 | 154 | | 10. 9. "Habilitation" means procedures and interventio ns |
---|
155 | 155 | | designed to assist a menta lly ill, drug-dependent or alcohol- |

233 | 233 | | Affairs as a medical foster home in which care i s |

234 | 234 | | provided exclusively to thr ee or fewer veterans. |

300 | 300 | | for the convenience and accessibility of the |

301 | 301 | | residents to each residential buildin g or unit, |
---|
302 | 302 | | (4) any out-of-doors premise or thoroug hfare is |
---|
303 | 303 | | adequately maintained to ensure the health a nd |
---|
304 | 304 | | safety of the residents, and |
---|
305 | 305 | | (5) the buildings or units are within one hundred |
---|
306 | 306 | | seventy-five (175) feet of the buildi ng housing |
---|
307 | 307 | | the main kitchen and di ning room. The units or |
---|
308 | 308 | | buildings must be located in the most convenient |
---|
309 | 309 | | and accessible location for r esidents; |
---|
310 | 310 | | provided, however, the leasing of rooms directly or |
---|
311 | 311 | | indirectly to residents of a home shall not void the |
---|

374 | 374 | | services necessary to avoid phys ical harm, mental ang uish, or mental |
---|
375 | 375 | | illness; |

376 | 376 | | 16. 15. "Operator" means the person who is not the |
---|
377 | 377 | | administrator but who manages the home; |
---|
378 | 378 | | 17. 16. "Owner" means a person, corporation, partnersh ip, |
---|
379 | 379 | | association, or other entity w hich owns or leases a home or part of |
---|
380 | 380 | | a home, directly or indirectly, to residents. The person or entity |
---|
381 | 381 | | that stands to profit or lose as a result of the financial success |
---|
382 | 382 | | or failure of the operation shall be presumed to be the owner of the |
---|
383 | 383 | | home; |

384 | 384 | | 18. 17. "Personal care" means assistance with meals, dres sing, |

444 | 444 | | 20. 19. "Representative of a resident " means a court-appointed |

445 | 445 | | guardian, or if there is no court -appointed guardian, a relative or |
---|
446 | 446 | | other person designated in writing by the resident. No owner, |
---|
447 | 447 | | agent, employee, or person with a pecuniary inter est in the |
---|
448 | 448 | | residential facility or relative thereo f shall be a representative |
---|
449 | 449 | | of a resident unless the person is appointed by the court; |
---|
450 | 450 | | 21. 20. "Supportive assistance" means the service rendered to |
---|
451 | 451 | | any person which is su fficient to enable the person to m eet an |
---|
452 | 452 | | adequate level of dail y living. Supportive assistance includes, but |
---|
453 | 453 | | is not limited to, housekeeping, assistance in the preparation of |
---|
454 | 454 | | meals, assistance in the safe storage, distribution and |
---|
455 | 455 | | administration of medica tions, and assistance in personal care as |
---|
456 | 456 | | necessary for the hea lth and comfort of th e person. The term |
---|
457 | 457 | | "supportive assistance " shall not be interpreted or applied so as to |
---|
458 | 458 | | prohibit the participation of residents in housekeeping or meal |
---|
459 | 459 | | preparation tasks as a part of the written treatment plan for the |
---|
460 | 460 | | training, habilitation or rehabilitat ion of the resident, prepared |
---|
461 | 461 | | with the participation of the resident, the mental health or drug or |
---|

750 | 750 | | to observe all areas of a home that directly perta in to the care of |

751 | 751 | | a resident of a home. |

752 | 752 | | G. Following any inspection by the D epartment, pursuant to the |

753 | 753 | | provisions of this section, all repo rts relating to the inspection |

754 | 754 | | shall be filed in the county office of the Department of Human |

821 | 821 | | care per resident that are needed for care for various types of |
---|
822 | 822 | | homes or areas within homes. Minimum personnel ratio requirements |
---|
823 | 823 | | for all homes shall be based only on average daily census; |
---|
824 | 824 | | 3. All sanitary conditions within the home and its |
---|
825 | 825 | | surroundings, including water supply, sewage disposal, food |
---|
826 | 826 | | handling, and general hygiene, which shall ensure the h ealth and |
---|
827 | 827 | | comfort of residents; |
---|
828 | 828 | | 4. Diet-related needs of each resident based on sound |
---|
829 | 829 | | nutritional practice and on r ecommendations which may be m ade by the |
---|
830 | 830 | | physicians attending the resident; |
---|
831 | 831 | | 5. Equipment essential to the health and welfare of the |
---|
832 | 832 | | residents; and |
