7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1-820, is
8181 amended to read as follows:
8282 Section 1-820. As used in the Residential Care Act:
8383 1. "Abuse" means the willful infliction of injury, unreasonable
8484 confinement, intimidation or punishment, with resulting physical
8585 harm, impairment or mental ang uish;
8686 2. "Access" means the right of a person to enter a home to
8787 communicate privately and without unreasonable restriction;

139139 3. "Administrator" means the person who is in charge of a home
140140 and who devotes at least one-third (1/3) of his or her full workin g
141141 time to on-the-job supervision of the home;
142142 4. "Adult companion home " means any home or establishment,
143143 funded and certified by the Department of Human Services, which
144144 provides homelike residential accomm odations and supportive
145145 assistance to three or few er developmentally disabled adult s;
146146 5. "Advisory Board" means the Long-Term Care Facility Advisory
147147 Board;
148148 6. "Ambulatory" means any resident who is capable of self -
149149 movement, including in and out of wheelc hairs, to all areas of the
150150 home;
151151 7. 6. "Board" means the State Board of Health;
152152 8. 7. "Commissioner" means the State Commissioner of Health;
153153 9. 8. "Department" means the State Department of Health;
154154 10. 9. "Habilitation" means procedures and interventio ns
155155 designed to assist a menta lly ill, drug-dependent or alcohol-
156156 dependent person eighteen (18) years of age or older to achieve
157157 greater physical, mental and social development by enhancing the
158158 well-being of the person and teaching skills which increase the
159159 possibility that the residen t will make progressi vely independent
160160 and responsible decisions ab out social behavior, quality of life,
161161 job satisfaction and personal relationships;
162162 11. 10. "Home" means a residential care hom e;

214214 12. 11. "Residential care home ":
215215 a. means any establishment or institution which offers,
216216 provides or supports residential accommodati ons, food
217217 service, and supportive assistance to any of its
218218 residents or houses any residents requiring supportive
219219 assistance who are not related to the o wner or
220220 administrator of the home by blood or marr iage. A
221221 residential care home shall not include:
222222 (1) an adult companion home,
223223 (2) a group home,
224224 (3) a hotel,
225225 (4) a motel,
226226 (5) a residential mental health facility operated by
227227 the Department of Mental Healt h and Substance
228228 Abuse Services,
229229 (6) a fraternity or a sorority house,
230230 (7) college or university dormito ry, or
231231 (8) a home or facility approved and annually reviewed
232232 by the United States Department of Veterans
233233 Affairs as a medical foster home in which care i s
234234 provided exclusively to thr ee or fewer veterans.
235235 The residents of a residential care home shall be
236236 ambulatory and essentially capable of participating in

288288 their own activities of daily living, but shall not
289289 routinely require nursing services, and
290290 b. may consist of a series of units o r buildings which
291291 are not connected or part of the same structure if:
292292 (1) such buildings or units are owned by the same
293293 owner or operator,
294294 (2) all residents of the units or buildings are fully
295295 capable of ambulation to and from the buildings
296296 or units,
297297 (3) the location and const ruction of the buildings or
298298 units ensure the health, safety, and protection
299299 from fire hazards and other hazards and provide
300300 for the convenience and accessibility of the
301301 residents to each residential buildin g or unit,
302302 (4) any out-of-doors premise or thoroug hfare is
303303 adequately maintained to ensure the health a nd
304304 safety of the residents, and
305305 (5) the buildings or units are within one hundred
306306 seventy-five (175) feet of the buildi ng housing
307307 the main kitchen and di ning room. The units or
308308 buildings must be located in the most convenient
309309 and accessible location for r esidents;
310310 provided, however, the leasing of rooms directly or
311311 indirectly to residents of a home shall not void the

363363 application of the provisions of the R esidential Care
364364 Act or rules promulgated pursuant thereto.
365365 The State Board Commissioner of Health shall promulgate r ules for
366366 such residential homes pursuant to the provisions of Section 1 -836
367367 of this title;
368368 13. 12. "Licensee" means a person, corporation, partnership, or
369369 association who is the owner of a home which is licensed pursuant to
370370 the provisions of the Residential C are Act;
371371 14. 13. "Maintenance" means meals, shelter, and laundry
372372 services;
373373 15. 14. "Neglect" means failure to provide goods and/or
374374 services necessary to avoid phys ical harm, mental ang uish, or mental
375375 illness;
376376 16. 15. "Operator" means the person who is not the
377377 administrator but who manages the home;
378378 17. 16. "Owner" means a person, corporation, partnersh ip,
379379 association, or other entity w hich owns or leases a home or part of
380380 a home, directly or indirectly, to residents. The person or entity
381381 that stands to profit or lose as a result of the financial success
382382 or failure of the operation shall be presumed to be the owner of the
383383 home;
384384 18. 17. "Personal care" means assistance with meals, dres sing,
385385 movement, bathing or other personal needs or maintenance, or general
386386 supervision of the physical and mental well -being of a person, who

438438 is incapable of maintaining a private, independent residence, or who
439439 is unable to manage all activities of daily l iving without
440440 assistance, whether or not a guardian has been appointed for the
441441 person;
442442 19. 18. "Resident" means a person of legal age, residing in a
443443 home due to illness, p hysical or mental infirmity, or ad vanced age;
444444 20. 19. "Representative of a resident " means a court-appointed
445445 guardian, or if there is no court -appointed guardian, a relative or
446446 other person designated in writing by the resident. No owner,
447447 agent, employee, or person with a pecuniary inter est in the
448448 residential facility or relative thereo f shall be a representative
449449 of a resident unless the person is appointed by the court;
450450 21. 20. "Supportive assistance" means the service rendered to
451451 any person which is su fficient to enable the person to m eet an
452452 adequate level of dail y living. Supportive assistance includes, but
453453 is not limited to, housekeeping, assistance in the preparation of
454454 meals, assistance in the safe storage, distribution and
455455 administration of medica tions, and assistance in personal care as
456456 necessary for the hea lth and comfort of th e person. The term
457457 "supportive assistance " shall not be interpreted or applied so as to
458458 prohibit the participation of residents in housekeeping or meal
459459 preparation tasks as a part of the written treatment plan for the
460460 training, habilitation or rehabilitat ion of the resident, prepared
461461 with the participation of the resident, the mental health or drug or

513513 alcohol services case manager assigned to the resident, and the
514514 administrator of the facility or a designee ; and
515515 22. 21. "Transfer" means a change in locati on of living
516516 arrangements of a resident from one home to another home.
517517 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -829, is
518518 amended to read as follows:
519519 Section 1-829. A. Every home for which a license has b een
520520 issued shall be inspected by a duly appointed representative of the
521521 State Department of Health pursuant to rules promulgated by the
522522 State Board Commissioner of Health with the advice and counsel of
523523 the Long-Term Care Facility Advisory Board. Inspection reports
524524 shall be prepared on forms prescribed by the Department with the
525525 advice and counsel of the Advisory Board .
526526 B. 1. The Department shall at least one time a year and
527527 whenever it deems necessary inspect, survey, and eva luate each home
528528 to determine compliance with appli cable licensure rules.
529529 2. An inspection, investigation, survey , or evaluation shall be
530530 either announced or unannounced. The State Board of Health
531531 Commissioner shall promulgate rules determining the criter ia when an
532532 inspection, investigation, survey or ev aluation shall be unannounced
533533 or may be announced by the Depart ment. Any licensee, applicant for
534534 a license or operator of any unlicensed facility shall be deemed to
535535 have given consent to any duly authorize d employee, agent of the
536536 Department to enter and i nspect the home in accordance with the

588588 provisions of the Reside ntial Care Act. Refusal to permit such
589589 entry or inspection shall constitute grounds for the denial,
590590 nonrenewal, suspension, or revocation of a license as well as
591591 emergency transfer of all resi dents.
592592 3. Any employee of the Department who discloses to any
593593 unauthorized person, prior to an inspection, information regarding
594594 an unannounced residential care home inspection that is required
595595 pursuant to the provisions of the Reside ntial Care Act shall, upon
596596 conviction thereof, be guilty of a misdemeanor. In addit ion, such
597597 action shall be construed to be a misuse of office and punishable as
598598 a violation of rules pro mulgated by the Ethics Commission.
599599 One person may be invited from a s tatewide organization of older
600600 adults or persons with disabilities by the Department to act as a
601601 citizen observer in any inspection.
602602 C. The Department shall maintain a log, updated at le ast
603603 monthly and available for public ins pection, which shall at a
604604 minimum detail:
605605 1. The name of the home and date of inspection, investigation,
606606 survey, or evaluation;
607607 2. Any deficiencies, lack of compliance, or violation noted at
608608 the inspection, investi gation, survey, or evaluation;
609609 3. The date a notice of violation, li cense denial, nonrene wal,
610610 suspension, or revocation was issued or other enforcement action
611611 occurred;

663663 4. The date a plan of correction was submitted and the date the
664664 plan was approved;
665665 5. The date corrections were completed, a s verified by an
666666 inspection; and
667667 6. If the inspection or investigation was made pursuant to the
668668 receipt of a complaint, the date such complaint was received and the
669669 date the complainant was notified of the results o f the inspection
670670 or investigation.
671671 D. The Department may require the residential care hom e to
672672 submit periodic reports. The Department shall have access to books,
673673 records and other documents maintained by the home to the extent
674674 necessary to implement the provisions of the Residential Care Act
675675 and the rules promulgated by t he Board Commissioner pursuant
676676 thereto.
677677 E. The Department shall make at least one a nnual report on each
678678 home in the state. The report shall include all conditions and
679679 practices not in compliance wit h the provisions of the Res idential
680680 Care Act or rules pr omulgated pursuant th ereto within the last year
681681 and, if a violation is corrected, or is subject to an approved plan
682682 of correction. The Department shall send a copy of the report to
683683 any person upon receiving a written request. The Department may
684684 charge a reasonable fee to cov er the cost of copying and mailing the
685685 report.

737737 F. A state or local ombudsman as that term is defined by the
738738 Special Unit on Aging within the Department of Human Services
739739 pursuant to the Older Americans ' Act, 42 U.S.C.A., Section 3001 et
740740 seq., as amended, or case manager employed by the Department of
741741 Mental Health and Substance Abuse Services or one of its contract
742742 agencies is authorized to accompany and shall be notified by the
743743 Department of any inspection conducted of any home license d pursuant
744744 to the provisions of the Residential Care Act. Any state or local
745745 ombudsman is authorized to enter any home licensed pursuant to the
746746 provisions of the Residential Care Act, communicate pri vately and
747747 without unreasonable restriction with any res ident of a home who
748748 consents to such communication, to seek consent to communicate
749749 privately and without restriction with any resident of a home, and
750750 to observe all areas of a home that directly perta in to the care of
751751 a resident of a home.
752752 G. Following any inspection by the D epartment, pursuant to the
753753 provisions of this section, all repo rts relating to the inspection
754754 shall be filed in the county office of the Department of Human
755755 Services in which the home is located and with th e Department of
756756 Mental Health and Substance Abuse Services.

810810 Section 1-836. A. The State Board Commissioner of Health shall
811811 promulgate rules to enf orce the provisions of the Re sidential Care
812812 Act. Such rules shall regulate:
813813 1. Location and construction of the home , including plumbing,
814814 heating, lighting, ventilation, and other physical conditions which
815815 shall ensure the health, safety, and comfort of residents and
816816 protection from fire hazards;
817817 2. Number of all personnel, including management and
818818 supervisory personnel, having responsibili ty for any part of the
819819 care given to residents. The Department shall establish staffing
820820 ratios for homes which shal l specify the number of staff hours of
821821 care per resident that are needed for care for various types of
822822 homes or areas within homes. Minimum personnel ratio requirements
823823 for all homes shall be based only on average daily census;
824824 3. All sanitary conditions within the home and its
825825 surroundings, including water supply, sewage disposal, food
826826 handling, and general hygiene, which shall ensure the h ealth and
827827 comfort of residents;
828828 4. Diet-related needs of each resident based on sound
829829 nutritional practice and on r ecommendations which may be m ade by the
830830 physicians attending the resident;
831831 5. Equipment essential to the health and welfare of the
832832 residents; and

884884 6. Rehabilitation programs for those residents who would
885885 benefit from such programs.
886886 B. 1. In order to fur ther ensure minimum standards for homes,
887887 a certificate of training as specified shall be required of all:
888888 a. administrators, who shall obtai n a residential care
889889 administrator certificate of training, and
890890 b. direct care staff responsible for administration of
891891 medication to residents, w ho shall obtain a
892892 residential care certificate of training.
893893 2. The certificate will be developed and administe red by an
894894 institution of higher learning with the advice of the State
895895 Commissioner of Health and of the Long-Term Care Facility Advisory
896896 Board.
897897 a. (1) For residential care home administrators the
898898 training shall consist of a minimum of fifty (50)
899899 hours which shall include at least fifteen (15)
900900 hours of training in the administration of
901901 medication and shall also inc lude, but not be
902902 limited to, training in:
903903 (a) administration,
904904 (b) supervision,
905905 (c) reporting,
906906 (d) record keeping,
907907 (e) independent or daily living skills,

960960 (g) public relations concerning the issues
961961 associated with the operation of residential
962962 care homes and programs.
963963 (2) An individual applying for certification as an
964964 administrator may at any time present the
965965 institution of higher education with
966966 documentation of prior education and work
967967 experience for consideration for p ossible credit
968968 toward certification.
969969 (3) Any person employed as an administrator after
970970 July 1, 1988, shall have completed the training
971971 specified by this division.
972972 (4) Thereafter, annually, at least sixteen (16) hours
973973 of training in the subjects specified b y this
974974 division shall be requ ired for such
975975 administrator.
976976 (5) A certified administrator may make a written
977977 request to the Commissioner to be place d in an
978978 inactive status for up to five (5) subsequent
979979 calendar years. Such inactive status shall allow
980980 the administrator to waive the educ ational
981981 requirements for the period of the request. Such

10361036 certificate is reactivated. The reques t to
10371037 reactivate the certificate shall be made in
10381038 writing to the Commissioner. Such administrator
10391039 shall then be required to complete sixteen (16)

10411041 this division.
10421042 b. All direct care staff who are responsible for
10431043 administration of medication to residen ts shall be
10441044 required to begin training in the administration of
10451045 medication within ninety (90) days of employment with
10461046 the home and to satisfactorily complete at least

11161116 e. human relations, and
11171117 f. such other training relevant to residential care
11181118 programs and operations.
11191119 4. The requirement of certification and the training specified
11201120 pursuant to the provisions of this subsection shall be in cluded in
11211121 the rules promulgated by the Board Commissioner.
11221122 5. Failure of the owner or ad ministrator to ensure the training
11231123 required pursuant to this subsection is received shall constitute a
11241124 violation of the Residen tial Care Act and shall be grounds for
11251125 revocation of licensure. Proof of successful completion of such
11261126 training for the residential care home administrator and direct ca re
11271127 staff shall be required prior to issuance or renewal of a license
11281128 issued pursuant to the provisions of the Residential Care Act. The
11291129 Department shall not renew any license for any residential care home
11301130 if the training required by this subsection has no t been completed.

11891189 participants;
11901190 2. The range of services to be provided by a center based on
11911191 the type of participants to be served;
11921192 3. Staff to participant ratios;
11931193 4. Staff and volunteer qualifications;
11941194 5. Staff training;
11951195 6. Food services;
11961196 7. Participant records and care plans;
11971197 8. Antidiscrimination policies;
11981198 9. Sanitary and fire standards; and
11991199 10. Any other requirements necessary to ensu re the safety and
12001200 well-being of frail elderly and disabled adults.
12011201 B. Centers to be licensed shall include all adult day care
12021202 centers. Sheltered workshops and senior recreational centers which
12031203 do not receive participa nt fees for services are not required to be
12041204 licensed. It shall be unlawful to operate a center without fi rst
12051205 obtaining a license for such operation as required by the Adult Day
12061206 Care Act, regardless of other licenses held by the operator.

12581258 Organizations operating more than one center shall ob tain a license

12601260 C. The license for operation of a cent er shall be issued by the
12611261 State Department of Health. The license shall:
12621262 1. Not be transferable or assignable;
12631263 2. Be posted in a conspicuous place on the licensed premises;
12641264 3. Be issued only for the premises name d in the application;

12661266 4. Expire thirty-six (36) months from the date of issuance,
12671267 provided an initial license shall expire one hundred eighty (180)
12681268 days after the date of issuance. Lic enses may be issued for a
12691269 period of more than twelve (12) months, but not more than thirty-six
12701270 (36) months, for the licensing period immediately following November
12711271 1, 2021, in order to permit an equitable distribution of license
12721272 expiration dates to all mon ths of the year.
12731273 D. A center shall m eet the safety, sanitation an d food service
12741274 standards of the State De partment of Health.
12751275 E. Local health, fire and building codes relating to adult day
12761276 care centers shall be classified as an education use group.
12771277 F. The issuance or renewal of a license af ter notice of a
12781278 violation has been sent shall not constitute a waiver by the State
12791279 Department of Health of its power to subsequently revoke the license
12801280 or take other enforcement action for any violations of the Adult Da y
12811281 Care Act committed prior to issuanc e or renewal of the license.

13351335 Section 1-890.6. A. The Continuum of Care and Assisted Living
13361336 Act shall not apply to residential care homes, adult companion
13371337 homes, domiciliary care units operated by the Department of Veterans
13381338 Affairs, the private residences of persons with developmental
13391339 disabilities receivi ng services provided by the Developmental
13401340 Disabilities Services Division of the Department of Human Services
13411341 or through the Home- and Community-Based Waiver or the Alternative
13421342 Disposition Plan Waiver of the Oklahoma Health Care Authority, or to
13431343 hotels, motels, boardinghouses, rooming houses, a home or facility
13441344 approved and annually reviewed by the United States Department of
13451345 Veterans Affairs as a medical foster home in which care is provided
13461346 exclusively to three or fewer veterans, or other places that furni sh
13471347 board or room to their residents. The Continuum of Care and
13481348 Assisted Living Act shall not apply to facilities not chargi ng or
13491349 receiving periodic compensation fo r services rendered and not
13501350 receiving any county, state or federal assistance.
13511351 B. The State Commissioner of Health may ban admissions to, or
13521352 deny, suspend, refuse to renew or revoke the license of, any
13531353 continuum of care facility or assisted living center which fails to
13541354 comply with the Continuum of Care and Assisted Living Act or rules
13551355 promulgated by the State Board of Health Commissioner.

14071407 C. Any person who has been determined by the Commissioner to
14081408 have violated any provision of the Continuum of Care and Assisted
14091409 Living Act or any rule promulgated hereunder shall be liable for an
14101410 administrative penalty of not more than Five Hundred Dollars
14111411 ($500.00) for each day that the violation occurs.
14121412 D. 1. The State Department of Health shall develop a
14131413 classification system of violations, taking into consideration the
14141414 recommendations of the Long -Term Care Facility Advisory Board
14151415 pursuant to Section 1 -1923 of this title, which shall gauge the
14161416 severity of the violation and specif y graduated penalties based on:
14171417 a. no actual harm with the potential for minimal harm,
14181418 b. no actual harm with the potential for more than
14191419 minimal harm,
14201420 c. actual harm that is not immediate jeopardy, and
14211421 d. immediate jeopardy to resident health and safety.
14221422 2. Upon discovery of one or more violat ions, the Department
14231423 shall provide a statement of deficiencies containing the violations.
14241424 The continuum of care facility or assisted living center shall be
14251425 required to correct these violations and submit a plan of c orrection
14261426 that details how the facility or center will correct each violation,
14271427 ensure that the violation will not occur in the futur e and a period
14281428 to correct each violation not to exceed sixty (60) days.
14291429 3. No fine shall be assessed for any violation that is not
14301430 classified as actual harm or imm ediate jeopardy, unless the

14831483 correct the violation within the period set forth in the accepted
14841484 plan of correction. Fines may be assessed at any time for a ny
14851485 violations that are classified as act ual harm or immediate jeopardy.
14861486 4. Any new violation unrelated to the original violation an d
14871487 not classified as actual harm or immediate jeopardy that is
14881488 discovered upon a revisitation of a continuum of care facility or
14891489 assisted living center shall constit ute a new action and shall not
14901490 be included in the original citation or assessment of fines o r
14911491 penalties; provided, that a preexisting violation not corrected in
14921492 compliance with the approved plan of correction shall b e considered
14931493 still in effect.
14941494 E. If a continuum of care facility's failure to comply with the
14951495 Continuum of Care and Assisted Living Act or rules involves nursing
14961496 care services, the Commissioner shall have authority to exercise
14971497 additional remedies provided under the Nursing Home Care Act. If a
14981498 continuum of care facility's failure to comply with the Continuum of
14991499 Care and Assisted Livin g Act or rules involves adult day care
15001500 services, then the Commissioner shall have authority to exercise
15011501 additional remedies provided under the Adult Day Care Act.
15021502 F. In taking any action to deny, suspend, deny renewal, or
15031503 revoke a license, or to impose an administrative fee, the
15041504 Commissioner shall comply with requirements of the Administrative
15051505 Procedures Act.

15601560 1. "Abuse" means the willful infliction of injury, unreasonable

15631563 2. "Access" means the right of a person to enter a facility to
15641564 communicate privately and without unre asonable restriction when
15651565 invited to do so by a resident. The state or local "ombudsman", as
15661566 that term is defined by the Aging Services Division of the
15671567 Department of Human Servic es pursuant to the Older Americans ' Act,
15681568 42 U.S.C.A., Section 3001 et seq., a s amended, and a case manager
15691569 employed by the Department of Mental Health and Substance Abuse
15701570 Services or one of its contract agencies sh all have right of access
15711571 to enter a facility, communicate privately and without unreasonable
15721572 restriction with any resid ent who consents to the communication, to
15731573 seek consent to communicate privately and without restr iction with
15741574 any resident, and to observe all areas of the facility that directly
15751575 pertain to the patient care of the resident without infringing upon
15761576 the privacy of the other residents without first obtaining their
15771577 consent;
15781578 3. "Administrator" means the person licensed by the State of
15791579 Oklahoma who is in charge of a facility. An administ rator must

16431643 independently owned and operated or may be part of a larger
16441644 institutional operation;
16451645 4. "Advisory Board" means the Long-Term Care Facility Advisory
16461646 Board;
16471647 5. "Adult companion home" means any home or establishm ent,
16481648 funded and certified by the Department of Human Services, which
16491649 provides homelike residential accommodations and supportive
16501650 assistance to three or fewer adults with inte llectual or
16511651 developmental disabilities;

17931793 to the extent that the facility constructed or operated by an entity
17941794 described in paragraph 7 of s ubsection B of Section 6201 of Title 74
17951795 of the Oklahoma Statu tes contains such a nursing care component;
17961796 12. 11. "Residential care home" means any home, establishment,
17971797 or institution licensed pursuant to the provisi ons of the
17981798 Residential Care Act other th an a hotel, motel, fraternity or
17991799 sorority house, or college or un iversity dormitory, which offers or
18001800 provides residential accommodations, food service, and supportive
18011801 assistance to any of its residents or houses any resident requiring
18021802 supportive assistance . The residents shall be persons who are

18631863 is licensed by the Department pursuant to the provisions of the
18641864 Nursing Home Care Act;
18651865 14. 13. "Maintenance" means meals, shelter, and laundry
18661866 services;
18671867 15. 14. "Neglect" means failure to provide goods and/or
18681868 services necessary to avoid physical harm, mental anguish, o r mental
18691869 illness;
18701870 16. 15. "Owner" means a person, corporation, partnership,
18711871 association, or othe r entity which owns a facility or leases a
18721872 facility. The person or entity that stands to profit or lose as a
18731873 result of the financial success or failure of the operation shall be
18741874 presumed to be the owner of the facility. Notwithstanding the
18751875 foregoing, any nonstate governmental entity that has a cquired and
18761876 owns or leases a facility and that has entered into an agreement
18771877 with the Oklahoma Health Care Authority to participate in the
18781878 nursing facility supplemental payment program ( "UPL Owner") shall be

19371937 17. 16. "Personal care" means assistance with meals, dressing,
19381938 movement, bathing or other personal needs or maintenance, or general
19391939 supervision of the physical and mental well -being of a person, who
19401940 is incapable of maintaining a private, indep endent residence, or who

19431943 18. 17. "Resident" means a person residing in a facility due to
19441944 illness, physical or mental infirmity , or advanced age;
19451945 19. 18. "Representative of a resident " means a court-appointed
19461946 guardian or, if there is no court -appointed guardian, the parent of
19471947 a minor, a relative, or other person, designated in writing by the
19481948 resident; provided, that any owner, operat or, administrator or
19491949 employee of a facility subject to the provisions of the Nursing Home
19501950 Care Act, the Residential Care Ac t, or the Group Homes for the
19511951 Developmentally Disabled or Physically Handicapped Persons Act shall

20082008 20. 19. "Supportive assistance" means the service rendered to
20092009 any person which is less than the service provided by a nursing
20102010 facility but which is sufficient to enable the person to meet an
20112011 adequate level of daily living. Supportive assistance includes but
20122012 is not limited to housekeeping, assistance in the preparation of
20132013 meals, assistance in the safe storage, distribution, and
20142014 administration of medications, and assistance i n personal care as is
20152015 necessary for the health and comfort of such person. Supportive
20162016 assistance shall not include med ical service.
20172017 SECTION 7. AMENDATORY 63 O.S. 2021, Section 1 -1911, is
20182018 amended to read as follows:
20192019 Section 1-1911. A. 1. Every building, institution, or
20202020 establishment for which a license ha s been issued, including any
20212021 facility operated by the Oklahoma Department of Veterans Affairs,
20222022 shall be periodically inspected by a duly appointed representative
20232023 of the State Department of Health, pursuant to rules promulgated by
20242024 the State Board Commissioner of Health with the advice and counsel
20252025 of the Long-Term Care Facility Advisory Board, created in Section 1 -
20262026 1923 of this title.
20272027 2. Inspection reports shall be prepared on form s prescribed by

20802080 B. 1. The Department, whenever it deems necessary, shall
20812081 inspect, survey, and evaluate every facility , including any facility
20822082 operated by the Oklahoma Department of Veter ans Affairs, to
20832083 determine compliance with applicable licensure and certificatio n
20842084 requirements and standards. All inspections of facilities shall be
20852085 unannounced. The Department may have as many unannoun ced
20862086 inspections as it deems necessary.
20872087 2. The Department shall conduct at least one unannounced
20882088 inspection per calendar year of all nursing facilities operated by
20892089 the Oklahoma Department of Veterans Affairs.
20902090 3. Any employee of the State Department of Hea lth who discloses
20912091 to any unauthorized person, prior t o an inspection, information
20922092 regarding an unannounced nursing home inspection r equired pursuant
20932093 to the provisions of this section shall, upon conviction thereof, be
20942094 guilty of a misdemeanor. In addition, such action shall be
20952095 construed to be a misuse of off ice and punishable as a violation of
20962096 rules promulgated by the Ethics Commission .
20972097 4. a. The Department may periodically visit a facility for
20982098 the purpose of consultation and may notify the
20992099 facility in advance of such a visit. An inspection,
21002100 survey, or evaluation, other than an inspection of
21012101 financial records or a consultation visit, s hall be
21022102 conducted without prior notice to the facility.

21542154 b. One person shall be invited by the Department from a
21552155 statewide organization of the elderly to act as a
21562156 citizen observer in unannounced inspections. The
21572157 individual may be a state or local ombudsman as
21582158 defined by the Aging Services Division of the
21592159 Department of Human Services, acting pursuant to the
21602160 provisions of the Old er Americans Act of 1965, Public
21612161 Law No. 89-73, 42 U.S.C.A., Section 3001 et seq., as
21622162 amended.
21632163 c. The citizen observer shall be reim bursed for expenses
21642164 in accordance with the provisions of the State Travel
21652165 Reimbursement Act.
21662166 d. An employee of a state or un it of a local government
21672167 agency, charged with inspect ing, surveying, and
21682168 evaluating facilities, who aids, abets, assists,
21692169 conceals, or conspires with a facility administrator
21702170 or employee in violation of the provisions of the
21712171 Nursing Home Care Act shall be guilty, upon conviction
21722172 thereof, of a misdemeanor and shall be subject to
21732173 dismissal from employment.
21742174 C. The Department shall hold o pen meetings, as part of its
21752175 routine licensure survey, in each of the licensed facilities to
21762176 advise and to facilitate commun ication and cooperation between
21772177 facility personnel an d the residents of facilities in their mutual

22302230 facility, residents, residents ' relatives, friends, residents '
22312231 representatives, and employ ees from appropriate state and federal
22322232 agencies shall be encouraged to attend these meetings to contribute
22332233 to this process.
22342234 D. 1. The Department shall require periodic reports and shall
22352235 have access to books, records, and other documents maintained by the
22362236 facility to the extent necessary to implement the pr ovisions of the
22372237 Nursing Home Care Act and the rules promulgated pursuant theret o.
22382238 2. Any holder of a license or applicant for a license shall be
22392239 deemed to have given consent to any authorized officer, e mployee, or
22402240 agent of the Department to enter and insp ect the facility in
22412241 accordance with the provisions of the Nursing Home Care Act .
22422242 Refusal to permit said entry or inspection, except for good cause,
22432243 shall constitute grounds for remedial action or admini strative
22442244 penalty or both such action and penalty as p rovided in the Nursing
22452245 Home Care Act.
22462246 E. The Department shall maintain a file on each facility in the
22472247 state. All conditions and practices not in compliance with
22482248 applicable standards shall be specifical ly stated. If a violation
22492249 is corrected or is subject to an approved plan of correction, such
22502250 action shall be contained in the file. Upon receiving a written
22512251 request for a copy of the file documents, the Department shall send

23052305 SECTION 8. AMENDATORY 63 O.S. 2021, Section 1 -1923.1, is

23072307 Section 1-1923.1. The State Department of Health shall:
23082308 1. Establish a Residents and Family State Council which shall
23092309 be composed of fifteen (15) members who are, or who have been within
23102310 the last twelve (12) months, residents, family members, resident
23112311 volunteer representatives or guardians of residents of nursin g
23122312 facilities licensed pursuant to the Nu rsing Home Care Act, but shall
23132313 not include persons representing residents in facilities for the
23142314 developmentally disabled. The Council shall annually elect a chair
23152315 and vice-chair, and shall meet at least quarterly. Meetings shall
23162316 be conducted in the vario us areas of the state with at least one
23172317 meeting in each of the four quadrants of the state to allow for
23182318 participation by family members and residents where possible. The
23192319 members of the Council shall be reimbursed pu rsuant to the State
23202320 Travel Reimbursement Act. The Council may present recommendations
23212321 to the Long-Term Care Facility Advisory Board created in Section 1-
23222322 1923 of this title and shall have the power and dut y to advise the
23232323 State Department of Health concerni ng the development and
23242324 improvement of services to and care and treatment of residents of
23252325 facilities subject to the provisions of the Nursing Hom e Care Act
23262326 and make recommendations to the Department as nece ssary and

23862386 shall develop reasonable rules and regulations that establish
23872387 appropriate criteria for the transfer of residents initiated by a
23882388 facility or a residential care home, including notice and hearings
23892389 if the resident is aggrieved by the decision. The primary purpose
23902390 and emphasis of the departmental rules and regulations shall be the
23912391 preservation of the health, welfare, and safety of t he residents.
23922392 The process of developing these rules and regulations shall
23932393 include the consideration of advice and comments from the Long-Term
23942394 Care Facility Advisory Board, representatives of nursing homes,
23952395 residential care homes, and representatives of sta tewide
23962396 organizations for the eld erly.
23972397 SECTION 10. AMENDATORY 63 O.S. 2021, Section 1 -1929, is
23982398 amended to read as follows:

24652465 nursing home and residential care home industries, and
24662466 representatives of statewide organizations for the elderly.
24672467 SECTION 11. AMENDATORY 74 O.S. 2021, Se ction 3905, is
24682468 amended to read as follows:
24692469 Section 3905. The following statutory entities and their
24702470 successors shall be terminated on July 1, 2014, and all powers,
24712471 duties and functions shall be abolish ed one (1) year thereafter:
