51103 SECTION 1. AMENDATORY 59 O.S. 202 1, Section 328.15, is

54105 Section 328.15. A. Pursuant to and in compliance with Article
55106 I of the Administrative Procedure s Act, the Board of D entistry shall
56107 have the power to formulate, ado pt, and promulgate rules as may be
57108 necessary to regulate the practice of dentistry in this state and to
58109 implement and enforce the provisions of the State Dental Act.

60110 B. The Board is autho rized and empowered t o:

62111 1. Examine and test the qualifications of a pplicants for a
63112 license or permit to be i ssued by the Board;

65113 2. Affiliate by contract or cooperative agreement with another
66114 state or combination of states for the purpose of conducting
67115 simultaneous regional e xaminations of applicants for a license to
68116 practice dentistry, dental hygiene, or a dent al specialty;

70117 3. Maintain a list of the name, current mailing address and
71118 principal office official address of all persons who hold a license
72119 or permit issued by the B oard;

74120 4. Account for all receipts and expendit ures of the monies of

214353 17. Writing a labor atory prescription to a dental laboratory or
215354 dental laboratory technician for the con struction, reproduction or
216355 repair of any appliance or str ucture to be worn in the human mouth;

218356 18. Owning, maintaining, or operating an office or offices by
219357 holding a financial interest in same for the practice of den tistry;

228362 B. The fact that a person uses any dental degree, or
229363 designation, or any card, device, directory, poster, sign or other
230364 media representing ones elf to be a dentist shall be prima facie
231365 evidence that the person is engaged in the practice of dentistry;
232366 provided that nothing in this section shall be so const rued as to
233367 prevent the following:

235368 1. Physicians or surgeons, who are licensed under the laws of
236369 this state, from administering any kind of treatment coming within
237370 the province of medicine or surgery;

239371 2. The practice of dentistry in the discharge of their the
240372 person’s official duties by dentists in the United States Army, the
241373 United States Navy, the United Sta tes Air Force, the United States
242374 Marine Corps, the United States Coast Guard, the United States

245403 3. Dental schools or col leges, as now conducted and approved,
246404 or as may be approved, and t he practice of dentistry by students in
247405 dental schools, colleges or hospitals, approved by the Board, when
248406 acting under the direction and supervision of licensed dentists or
249407 dentists holding properly issued permits acting as instructors;

251408 4. Acts of a dental clinician or other participant at a dental
252409 educational meeting or at an accredited dental college, when no fee
253410 is charged to or paid by a patient;

255411 5. The practice of dental hygiene, as d efined herein, by a
256412 person granted a license by the Board;

258413 6. The performing of acts by a dental assistant or oral
259414 maxillofacial surgery assistant who performs the act s under the
260415 direct supervision or direct visual supervision of a dentist and in
261416 accordance with the provisions of the State Dental Act and the rules
262417 promulgated by the Board; or

264418 7. The fabrication of dental appliances pursuant to a
265419 laboratory prescription of a dentist, by a dental laboratory

268420 technician in a dental laboratory using inert mate rials and
269421 mechanical devices for the fabrication of any restoratio n, appliance
270422 or thing to be worn in the human mouth.

275452 Section 328.21. A. No person shall practice dentistry or
276453 dental hygiene without first applying for and obtaining a license
277454 from the Board of Dentistry.

279455 B. Application shall be made to the Board in writing and shall
280456 be accompanied by the fee established by the rules of the Board,
281457 together with satisfactory proof that the applicant:
282-
283458 1. Is of good moral character;
284-
285459 2. Is twenty-one (21) years of age, or over, at the time of
286460 making application to practice dentistry or eighteen (18) years of
287461 age, or over, if the applicant is to practic e dental hygiene;
288-
289462 3. Has passed a written theoretical examination and a clinical
290463 examination approved b y the Board; and
291-
292464 4. Has passed a written j urisprudence examinat ion over the
293465 rules and laws affecting dentistry in this state.

295466 C. An application from a candidate who desires to secure a
296467 license from the Board to practice dentistry or dental hygiene in
297468 this state shall be accompanied by satisfacto ry proof that the
298469 applicant:

300470 1. Is a graduate of an accredited dental college, if the
301471 applicant is to practic e dentistry;
302-
303472 2. Is a graduate of an accredited dental hygiene program, if
304473 the applicant is to pract ice dental hygiene; and
305-
306474 3. Has passed all portions of the National Board Dental
307475 Examination or the National Board Dental Hygiene Examination.

311503 D. Pursuant to Section 328.15 of this title, the Board may
312504 affiliate as a member state, and accept regional ex ams from the
313505 Commission on Dental Competency Assessments (CDCA), or the Western
314506 Regional Examining Board (WREB), or the Central Regional Dental
315507 Testing Service (CRDTS) if the following requirements are included:
316-
317508 1. For dental licensing the following components:
318-
319509 a. a fixed prosthetic component of the preparation of an
320510 anterior all porcelain crown and the preparation of a
321511 three-unit posterior bridge,
322-
323512 b. a periodontal component on a live patient or manikin,
324-
325513 c. an endodontic component,
326-
327514 d. an anterior class III and posterior class II
328515 restorative component on a li ve patient or manikin,
329-
330516 e. a diagnosis and trea tment planning section as approved
331517 by the Board, as specif ied in Section 328.15 of this
332518 title, and
333-
334519 f. the Board may determine equivalencies based on
335520 components of other exams for the purpose of
336521 credentialing; or
337-
338522 2. For dental hygienists licensing the following components:
339-
340523 a. clinical patient treatments with an evaluation of
341524 specific clinical skills, and
342-
343525 b. evaluation of the candidate’s compliance with
344526 professional standards during the treatment as

355559 supragingival deposit removal.

357560 E. When the applicant and the accompanying proof are fo und
358561 satisfactory, the Board shall notify the applicant to appear for the
359562 jurisprudence examination at the t ime and place to be fixed by the
360563 Board. A dental stu dent or a dental hygiene student in their the
361564 student’s last semester of a dental or dental hygiene program,
362565 having met all other requir ements, may make application and take the
363566 jurisprudence examination with a letter from the dean of the dental
364567 school or director of th e hygiene program stating that the applicant
365568 is a candidate for graduation within the next six ( 6) months.

367569 F. The Board shall require every applicant for a license to
368570 practice dentistry or dental hygiene to submit, for the files of the
369571 Board, a copy of a dental degree or dental hygiene degree, an
370572 official transcript, a recent photograph duly identif ied and
371573 attested, and any other information as required by the Board.
372-
373574 G. Any applicant who f ails to pass the jurisprudence
374575 examination may apply for a second e xamination, in which case the
375576 applicant shall pay a reexamination fee as established by the
376577 statutes or rules of the State Dental Act.

378605 H. A dentist or dental hygienist currently licensed i n another
379606 state having met the qualifications in paragraphs 1 through 3 of
380607 subsections B and C of this section may apply for a license by
381608 credentials upon meeting t he following:

383609 1. A dentist holding a general dentist license in good standing
384610 and having practiced for at least five hundred (500) hours within
385611 the previous five (5) years immediately prior to application and
386612 having passed a regional examination substant ially equivalent to the
387613 requirements for this state may apply for licensure by credentials;
388-
389614 2. A dental hygienist holding a dental hygiene license in good
390615 standing and having practiced for at least four hundred twenty (420)
391616 hours within the previous five (5) years immediately prior to
392617 application and having passed a regional examination substanti ally
393618 equivalent to the requirements for Oklahoma this state may apply for
394619 licensure by credentials. Applicants for credentialing must
395620 include:

399621 a. a letter of good stan ding from all states in which the
400622 applicant has ever been licensed, and

402623 b. any other requirements as set forth by the rules;

404624 3. An applicant applying for a dental or dental hygiene license
405625 by credentials shall only be required to pass the jurisprudence
406626 portion of the examination requirements a s set forth in paragraph 4
407627 of subsection B of this section; or

409655 4. A dental hygienist applying for credentialing for advanced
410656 procedures by providing proof of passage of the advanced procedure
411657 in a CDCA, WREB or CRDTS exam.

413658 I. There shall be two type s of advanced procedure available for
414659 dental hygienists upon completion of a Commission on Dental
415660 Accreditation (CODA) approved program or course that has been
416661 approved by the Board:
417-
418662 1. Administration of nitrous oxide; a nd
419-
420663 2. Administration of local anesthesia.
421-
422664 J. All licensees and permit holders shall dis play their the
423665 current permit or license in a visible place within the dental
424666 office or treatment facility.
425-
426667 K. The Board shall have the authority to temporarily change
427668 requirements of an examinatio n due to availability or changes in the
428669 examination format, not to exceed one (1) year.
429-
430670 L. During a year in which governmental officials h ave declared
431671 a health pandemic, a state or federal disaster, or other natural or
432672 man-made disaster, the Board shall h ave the authority through a
433673 resolution to change or make a llowances in requirements of all
434674 candidates for licensure and issue temporary lic enses for extended
435675 periods of time or as needed until the event passes. The resolutio n
436676 shall have a beginning and an end date and shall automatically
437677 expire no less than thir ty (30) days after the end of the disaster
438678 is declared by governmental officials.

442706 M. Every licensee or permit holder shall have an official
443707 address and email address listed with the Board. Every licensee or
444708 permit holder shall update the address within t hirty (30) calendar
445709 days of moving. Official notification of any action of the Board
446710 adverse to a licensee or permit holder including but not limited to
447711 notification of license or permit cancellation due to nonrenewal,
448712 notice of a formal complaint , or a decision of the hearing panel or
449713 board, shall be served to the license e or permit holder by
450714 registered mail at the official address, in person, to the
451715 licensee’s or permit holder’s attorney, by agreement of the
452716 individual, by a process server, or by an Investigator of the Board
453717 pursuant to Section 2004 of Titl e 12 of the Oklahoma Statutes .

455718 SECTION 4. AMENDATORY 59 O.S. 2021, Section 328.23a, is
456719 amended to read as follows:

458720 Section 328.23a. A. There is established a special voluntee r
459721 license for dentists and a special volunteer license for dental
460722 hygienists who are retired from active practice or out-of-state
461723 licensees in active practice who are i n the Oklahoma Medical Reserve
462724 Corps or assisting with emergency management, emergency o perations
463725 or hazard mitigation in response to any emergency, man -made disaster
464726 or natural disaster, or participating in public health initiatives,
465727 disaster drills and community service events that are endorsed by a
466728 city or county health department or the State Department of Health
467729 and wish to donate their expertise for the dental care and treatment

469758 license may also be issued for any live patient trainin g approved by
470759 the Board. The special volunteer license shall be:

472760 1. Issued by the Board of Dentistry to eligible person s;
473-
474761 2. Issued without the payment of an application fee, license
475762 fee or renewal fee;
476-
477763 3. Issued or renewed without any continuing education
478764 requirements for a period less than one (1) calendar year; and
479-
480765 4. Issued for one (1) calendar year or part thereof.

482766 B. A dentist or dental hygienist must meet the following

10101622 automatically canceled by reason of failure, neglect or refusal to
10111623 secure the renewal certificate may be reinstated by the Board at any
10121624 time within one (1) year from the date of the expiration of the
10131625 license, upon payment of the annual renewal fee and a penalty fee
10141626 established by the rules of the Board. If the dentist, dental
10151627 hygienist, dental assistant, or oral maxillofacial surgery assistant
10161628 does not apply for renewal of the license or permit and pay the
10171629 required fees within one (1) year afte r the license has expired,
10181630 then the dentist, dental hygienist, dental assistant or oral
10191631 maxillofacial surgery assistant shall be required to file an
10201632 application for and take the examination or other requirements
10211633 provided for in the State Dental Act or the rules promulgated by the
