51	103		SECTION 1. AMENDATORY 59 O.S. 202 1, Section 328.15, is

54	105		Section 328.15. A. Pursuant to and in compliance with Article
55	106		I of the Administrative Procedure s Act, the Board of D entistry shall
56	107		have the power to formulate, ado pt, and promulgate rules as may be
57	108		necessary to regulate the practice of dentistry in this state and to
58	109		implement and enforce the provisions of the State Dental Act.

60	110		B. The Board is autho rized and empowered t o:
61		-
62	111		1. Examine and test the qualifications of a pplicants for a
63	112		license or permit to be i ssued by the Board;
64		-
65	113		2. Affiliate by contract or cooperative agreement with another
66	114		state or combination of states for the purpose of conducting
67	115		simultaneous regional e xaminations of applicants for a license to
68	116		practice dentistry, dental hygiene, or a dent al specialty;

70	117		3. Maintain a list of the name, current mailing address and
71	118		principal office official address of all persons who hold a license
72	119		or permit issued by the B oard;

74	120		4. Account for all receipts and expendit ures of the monies of
75	121		the Board, including annually preparing and publishing a stateme nt
76	122		of receipts and expenditures of the Board for each fiscal year;

78	123		5. Within limits prescribed in the State Dental Act, se t all

211	324		casts of malposed teeth for treatment of the malposed teeth in the
212	325		human mouth, without instructions;

215	354		dental laboratory technician for the con struction, reproduction or
216	355		repair of any appliance or str ucture to be worn in the human mouth;

218	356		18. Owning, maintaining, or operating an office or offices by
219	357		holding a financial interest in same for the practice of den tistry;

225	360		Act requiring a vali d license or permit to perform while the person
226	361		does not hold such valid license or permit issued by the Board.

228	362		B. The fact that a person uses any dental degree, or
229	363		designation, or any card, device, directory, poster, sign or other
230	364		media representing ones elf to be a dentist shall be prima facie
231	365		evidence that the person is engaged in the practice of dentistry;
232	366		provided that nothing in this section shall be so const rued as to
233	367		prevent the following:
234		-
235	368		1. Physicians or surgeons, who are licensed under the laws of
236	369		this state, from administering any kind of treatment coming within
237	370		the province of medicine or surgery;
238		-
239	371		2. The practice of dentistry in the discharge of their the
240	372		person’s official duties by dentists in the United States Army, the
241	373		United States Navy, the United Sta tes Air Force, the United States
242	374		Marine Corps, the United States Coast Guard, the United States
243	375		Public Health Service, or the United States Veterans Administration;

246	404		or as may be approved, and t he practice of dentistry by students in
247	405		dental schools, colleges or hospitals, approved by the Board, when
248	406		acting under the direction and supervision of licensed dentists or
249	407		dentists holding properly issued permits acting as instructors;

251	408		4. Acts of a dental clinician or other participant at a dental
252	409		educational meeting or at an accredited dental college, when no fee
253	410		is charged to or paid by a patient;

255	411		5. The practice of dental hygiene, as d efined herein, by a
256	412		person granted a license by the Board;

258	413		6. The performing of acts by a dental assistant or oral
259	414		maxillofacial surgery assistant who performs the act s under the
260	415		direct supervision or direct visual supervision of a dentist and in
261	416		accordance with the provisions of the State Dental Act and the rules
262	417		promulgated by the Board; or
263		-
264	418		7. The fabrication of dental appliances pursuant to a
265	419		laboratory prescription of a dentist, by a dental laboratory
266		-

268	420		technician in a dental laboratory using inert mate rials and
269	421		mechanical devices for the fabrication of any restoratio n, appliance
270	422		or thing to be worn in the human mouth.

272	423		SECTION 3. AMENDATORY 5 9 O.S. 2021, Section 328.21, is

275	452		Section 328.21. A. No person shall practice dentistry or
276	453		dental hygiene without first applying for and obtaining a license
277	454		from the Board of Dentistry.

279	455		B. Application shall be made to the Board in writing and shall
280	456		be accompanied by the fee established by the rules of the Board,
281	457		together with satisfactory proof that the applicant:
282		-
283	458		1. Is of good moral character;
284		-
285	459		2. Is twenty-one (21) years of age, or over, at the time of
286	460		making application to practice dentistry or eighteen (18) years of
287	461		age, or over, if the applicant is to practic e dental hygiene;
288		-
289	462		3. Has passed a written theoretical examination and a clinical
290	463		examination approved b y the Board; and
291		-
292	464		4. Has passed a written j urisprudence examinat ion over the
293	465		rules and laws affecting dentistry in this state.

295	466		C. An application from a candidate who desires to secure a
296	467		license from the Board to practice dentistry or dental hygiene in
297	468		this state shall be accompanied by satisfacto ry proof that the
298	469		applicant:
299		-
300	470		1. Is a graduate of an accredited dental college, if the
301	471		applicant is to practic e dentistry;
302		-
303	472		2. Is a graduate of an accredited dental hygiene program, if
304	473		the applicant is to pract ice dental hygiene; and
305		-
306	474		3. Has passed all portions of the National Board Dental
307	475		Examination or the National Board Dental Hygiene Examination.

311	503		D. Pursuant to Section 328.15 of this title, the Board may
312	504		affiliate as a member state, and accept regional ex ams from the
313	505		Commission on Dental Competency Assessments (CDCA), or the Western
314	506		Regional Examining Board (WREB), or the Central Regional Dental
315	507		Testing Service (CRDTS) if the following requirements are included:
316		-
317	508		1. For dental licensing the following components:
318		-
319	509		a. a fixed prosthetic component of the preparation of an
320	510		anterior all porcelain crown and the preparation of a
321	511		three-unit posterior bridge,
322		-
323	512		b. a periodontal component on a live patient or manikin,
324		-
325	513		c. an endodontic component,
326		-
327	514		d. an anterior class III and posterior class II
328	515		restorative component on a li ve patient or manikin,
329		-
330	516		e. a diagnosis and trea tment planning section as approved
331	517		by the Board, as specif ied in Section 328.15 of this
332	518		title, and
333		-
334	519		f. the Board may determine equivalencies based on
335	520		components of other exams for the purpose of
336	521		credentialing; or
337		-
338	522		2. For dental hygienists licensing the following components:
339		-
340	523		a. clinical patient treatments with an evaluation of
341	524		specific clinical skills, and
342		-
343	525		b. evaluation of the candidate’s compliance with
344	526		professional standards during the treatment as

357	560		E. When the applicant and the accompanying proof are fo und
358	561		satisfactory, the Board shall notify the applicant to appear for the
359	562		jurisprudence examination at the t ime and place to be fixed by the
360	563		Board. A dental stu dent or a dental hygiene student in their the
361	564		student’s last semester of a dental or dental hygiene program,
362	565		having met all other requir ements, may make application and take the
363	566		jurisprudence examination with a letter from the dean of the dental
364	567		school or director of th e hygiene program stating that the applicant
365	568		is a candidate for graduation within the next six ( 6) months.

367	569		F. The Board shall require every applicant for a license to
368	570		practice dentistry or dental hygiene to submit, for the files of the
369	571		Board, a copy of a dental degree or dental hygiene degree, an
370	572		official transcript, a recent photograph duly identif ied and
371	573		attested, and any other information as required by the Board.
372		-
373	574		G. Any applicant who f ails to pass the jurisprudence
374	575		examination may apply for a second e xamination, in which case the
375	576		applicant shall pay a reexamination fee as established by the
376	577		statutes or rules of the State Dental Act.

378	605		H. A dentist or dental hygienist currently licensed i n another
379	606		state having met the qualifications in paragraphs 1 through 3 of
380	607		subsections B and C of this section may apply for a license by
381	608		credentials upon meeting t he following:

383	609		1. A dentist holding a general dentist license in good standing
384	610		and having practiced for at least five hundred (500) hours within
385	611		the previous five (5) years immediately prior to application and
386	612		having passed a regional examination substant ially equivalent to the
387	613		requirements for this state may apply for licensure by credentials;
388		-
389	614		2. A dental hygienist holding a dental hygiene license in good
390	615		standing and having practiced for at least four hundred twenty (420)
391	616		hours within the previous five (5) years immediately prior to
392	617		application and having passed a regional examination substanti ally
393	618		equivalent to the requirements for Oklahoma this state may apply for
394	619		licensure by credentials. Applicants for credentialing must
395	620		include:

399	621		a. a letter of good stan ding from all states in which the
400	622		applicant has ever been licensed, and
401		-
402	623		b. any other requirements as set forth by the rules;

404	624		3. An applicant applying for a dental or dental hygiene license
405	625		by credentials shall only be required to pass the jurisprudence
406	626		portion of the examination requirements a s set forth in paragraph 4
407	627		of subsection B of this section; or

413	658		I. There shall be two type s of advanced procedure available for
414	659		dental hygienists upon completion of a Commission on Dental
415	660		Accreditation (CODA) approved program or course that has been

516	819		C. The Board of Dentistry shall have jurisdiction over
517	820		dentists, dental hygienists, dental assis tants and dental
518	821		technicians who volunteer their professional services in the st ate.
519	822		Dental assistants and dental technicians shall work under the direct
520	823		supervision of a dentist.

522	824		D. Dental assistants may be issued a volunteer permit at the
523	825		request of an entity that provides dental services to the needy.
524	826		Volunteers in a volunteer i nitiative who are not dentists or dental
525	827		hygienists shall be named and provided on a list to the Board by the
526	828		entity hosting the volunteer initiative with any other requirement s

549	873		any patient with clear instructions for any and all follow-up care.

552	875		based on documentation of failure to partic ipate according to state

645	1026		2. “Poses a reasonable threat” means the nature of criminal
646	1027		conduct for which the person was convicted involved an act or thr eat

1012	1624		time within one (1) year from the date of the expiration of the
1013	1625		license, upon payment of the annual renewal fee and a penalty fee
1014	1626		established by the rules of the Board. If the dentist, dental
1015	1627		hygienist, dental assistant, or oral maxillofacial surgery assistant
1016	1628		does not apply for renewal of the license or permit and pay the
1017	1629		required fees within one (1) year afte r the license has expired,
1018	1630		then the dentist, dental hygienist, dental assistant or oral
1019	1631		maxillofacial surgery assistant shall be required to file an
1020	1632		application for and take the examination or other requirements
1021	1633		provided for in the State Dental Act or the rules promulgated by the
1022	1634		Board before again commencing practice.

1024	1635		G. The Board, by rule, shall provide for the remittance of fees
1025	1636		otherwise required by the State Dental Act while a dentist or dental
1026	1637		hygienist is on active duty with any of the Armed Forces of the
