83	83	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
84	84	SECTION 1. NEW LAW A new section of law to be codified
85	85	in the Oklahoma Statutes as Section 1-899.2 of Title 63, unless
86	86	there is created a duplication in numbering, reads as follows:
87	87	A. The State Department of Health shall r egulate intermediate
88	88	care facilities for individuals with intellectual disabilities with
89	89	sixteen or fewer beds (ICF s/IID-16) as distinct facilities and shall
90	90	not regulate ICFs/IID-16 under the Nursing Home Care Act or any
91	91	other act that governs a different type of facility.

143	143	B. The State Department of Health shall enforce applicable
144	144	federal laws and regulations governi ng intermediate care facilities
145	145	for individuals with intellectual disabilities (ICFs/IID) and hired
146	146	or contracted staff of ICFs/IID including, but not limited to,
147	147	regulations of the Centers for Medicare and Medicaid Services.
148	148	C. The administrator of an ICF/IID-16 shall meet the
149	149	qualifications of Section 2 of this act.
150	150	D. The State Commissioner of H ealth shall promulgate rules to
151	151	implement this section with input from experienced professionals
152	152	currently working in ICFs/IID-16 in this state. Such rules may
153	153	include but not be limited to licensure, licensure fees, staffing,
154	154	quality of resident care, minimum standards for facilities,
155	155	inspections, penalties, and violations. Such rules shall be
156	156	separate and distinct from rules regulating faciliti es under the
157	157	Nursing Home Care Act or any other act that governs a different type
158	158	of facility.
159	159	SECTION 2. NEW LAW A new section of law to be codified
160	160	in the Oklahoma Statutes as Section 330.53a of Title 63, unless
161	161	there is created a duplication in numbering, reads as follows:
162	162	The administrator of an intermediate care facility for

219	219	Oklahoma State Board of Examiners for Long -Term Care Administrators
220	220	with not less than three (3) years of experience working with
221	221	individuals with intellectual disabilities in a professional
222	222	setting.
223	223	SECTION 3. AMENDATORY 6 3 O.S. 2021, Section 1 -1902, is
224	224	amended to read as follows:
225	225	Section 1-1902. As used in the Nursing Home Care Act:
226	226	1. “Abuse” means the willful inflictio n of injury, unreasonable
227	227	confinement, intimidation or punishment, with resulting physical
228	228	harm, impairment or mental anguish;
229	229	2. “Access” means the right of a person to enter a facility to
230	230	communicate privately and without unreasonable restriction when
231	231	invited to do so by a resident. The sta te or local “ombudsman”, as
232	232	that term is defined by the Aging S ervices Division of the
233	233	Department of Human Servic es pursuant to the Older Americans ’ Act,
234	234	42 U.S.C.A., Section 3001 et seq., as amended, and a case manag er
235	235	employed by the Department of Mental Health and Substance Abuse
236	236	Services or one of its contract age ncies shall have right of access
237	237	to enter a facility, communicate privately and without unreasonable
238	238	restriction with any resident who consents to the com munication, to
239	239	seek consent to communic ate privately and without restriction with
240	240	any resident, and to observe all areas of the facility that directly
241	241	pertain to the patient care of the resident without infringing upon

293	293	the privacy of the other residents wi thout first obtaining their
294	294	consent;
295	295	3. “Administrator” means the person licensed by the State of
296	296	Oklahoma this state who is in charge of a facility. An
297	297	administrator must devote at least one -third (1/3) of such person ’s
298	298	working time to on-the-job supervision of the facility; provided
299	299	that this requirement shall not apply to an administrator of an
300	300	intermediate care facility for individuals with intellectual
301	301	disabilities with sixteen or fewer beds (ICF/IID -16), in which case
302	302	the person licensed by the stat e may be in charge of more than one
303	303	such ICF/IID-16 facility, if such facilities are located within a
304	304	circle that has a map radius of not more than fifteen (15) forty
305	305	(40) miles, the total number of facilities and beds does not exceed
306	306	sixteen facilities an d sixty-four beds, and each such ICF/IID-16
307	307	facility is supervised by a qualifie d professional. The facilities
308	308	may be free-standing in a community or may be on campus with a
309	309	parent institution. The ICF/IID -16 facility may be independently
310	310	owned and operated or may be part of a l arger institutional
311	311	operation;
312	312	4. “Advisory Board” means the Long-Term Care Facility Advisory
313	313	Board;
314	314	5. “Adult companion home ” means any home or establishm ent,
315	315	funded and certified by the Department of Human Services, which
316	316	provides homelike residential accommodations and suppor tive

369	369	developmental disabilities;
370	370	6. “Board” means State Board of Health;
371	371	7. “Commissioner” means State Commissioner of Health;
372	372	8. “Department” means the State Department o f Health;
373	373	9. “Facility” means a nursing facility and a specialized home;
374	374	provided, this term shall not include a residential care home or an
375	375	adult companion home;
376	376	10. “Nursing facility” means a home, an establishment or an
377	377	institution, a distinct part of which is primarily engag ed in
378	378	providing:
379	379	a. skilled nursing care and related services for
380	380	residents who require medical or nursing care,
381	381	b. rehabilitation services for the rehabilitation of
382	382	injured, disabled, or sick persons, or
383	383	c. on a regular basis, heal th-related care and serv ices
384	384	to individuals who becaus e of their mental or physical
385	385	condition require care and services beyond the level
386	386	of care provided by a residential care home and which
387	387	can be made available to them only thro ugh a nursing
388	388	facility.
389	389	“Nursing facility” does not mean, for purposes of Sectio n 1-851.1 of
390	390	this title, a facility constr ucted or operated by an entity
391	391	described in paragraph 7 of su bsection B of Section 6201 of Title 74

445	445	Continuum of Care and Assisted Liv ing Act, to the extent that the
446	446	facility constructed or opera ted by an entity described in paragraph
447	447	7 of subsection B of Section 6201 of Title 74 of the Oklaho ma
448	448	Statutes contains suc h a nursing care component;
449	449	11. a. “Specialized facility ” means any home, establishment,
450	450	or institution which offers or provides inpati ent
451	451	long-term care services on a twenty -four-hour basis to
452	452	a limited category of persons requirin g such services,
453	453	including but not limited to a facili ty providing
454	454	health or habilitation servic es for individuals with
455	455	intellectual or developmental disabilit ies, but.
456	456	b. Specialized facility does not mean, for:
457	457	(1) for purposes of Section 1-851.1 of this title, a
458	458	facility constructed or operated by an entity
459	459	described in paragraph 7 of subsection B of
460	460	Section 6201 of Title 74 of the Oklahoma Statutes
461	461	or the nursing care component of a continuu m of
462	462	care facility, as such term is d efined under the
463	463	Continuum of Care and Assisted Li ving Act, to the
464	464	extent that the facility constructed or operated
465	465	by an entity described in paragraph 7 of
466	466	subsection B of Section 6201 of Title 74 of the

523	523	12. “Residential care home ” means any home, establishment, or
524	524	institution licensed pursuant to the provisions of the Reside ntial
525	525	Care Act other than a hotel, motel, fraterni ty or sorority house, or
526	526	college or university dormitory, which offers o r provides
527	527	residential accommodations, food service, and supportive assistance
528	528	to any of its residents or houses any resident requirin g supportive
529	529	assistance. The residents shall be p ersons who are ambulatory and
530	530	essentially capable of managing their own affairs, but who do not
531	531	routinely require nursing care; provided, the term “residential care
532	532	home” shall not mean a hotel, motel, frat ernity or sorority house,
533	533	or college or university dormitory, if the facility operates in a
534	534	manner customary to its descri ption and does not house any person
535	535	who requires supportive assistance from the facility in order to
536	536	meet an adequate level of daily l iving;
537	537	13. “Licensee” means the person, a corpora tion, partnership, or
538	538	association who is the owner of the facility which is licensed by
539	539	the Department pursuant to the provisions of the Nursing Home Care
540	540	Act;
541	541	14. “Maintenance” means meals, shelter, and l aundry services;

593	593	15. “Neglect” means failure to provide goods and/or services
594	594	necessary to avoid physical harm, mental an guish, or mental illness;
595	595	16. “Owner” means a person, corporation, partnership,
596	596	association, or other entity which owns a facility or leases a
597	597	facility. The person or entity that sta nds to profit or lose as a
598	598	result of the financial success or failure of the operation shall be
599	599	presumed to be the owner of the facility. Notwithstanding the
600	600	foregoing, any nonstate governmental entity tha t has acquired and
601	601	owns or leases a facility and t hat has entered into an agreement
602	602	with the Oklahoma Health Care Authorit y to participate in the
603	603	nursing facility supplemental payment program ( “UPL Owner”) shall be
604	604	deemed the owner of such facility and sha ll be authorized to obtain
605	605	management services fro m a management services provider (“UPL
606	606	Manager”), and to delegate, alloc ate and assign as between the UPL
607	607	Owner and UPL Manager, compensation, profits, losses, liabilities,
608	608	decision-making authority and res ponsibilities, including
609	609	responsibility for the em ployment, direction, supervision and
610	610	control of the facility ’s administrator and staff;
611	611	17. “Personal care” means assistance with meals, dressing,
612	612	movement, bathing or other personal needs or maintenance, or general
613	613	supervision of the physical and mental well-being of a person, who
614	614	is incapable of maintaining a private, indep endent residence, or who
615	615	is incapable of managing his or her person, whether or not a
616	616	guardian has been appointed for such person;

668	668	18. “Resident” means a person resid ing in a facility due to
669	669	illness, physical or mental infirmity, or advanced age;
670	670	19. “Representative of a resident” means a court-appointed
671	671	guardian or, if there is no court -appointed guardian, the parent of
672	672	a minor, a relative, or other person, designate d in writing by the
673	673	resident; provided, that any owner, operator, administrator or
674	674	employee of a facility subject to the provisions of the Nursing Home
675	675	Care Act, the Residential Care Act, or the Group Homes for the
676	676	Developmentally Disabled or Physically Ha ndicapped Persons Persons
677	677	with Developmental or Physical Disabilities Act shall not be
678	678	appointed guardian or limited guardian of a resident of the facility
679	679	unless the owner, operator, administrator or employee is the spouse
680	680	of the resident, or a relative of the resident wi thin the second
681	681	degree of consanguinity and is otherwise eligible fo r appointment;
682	682	and
683	683	20. “Supportive assistance” means the service rendered to any
684	684	person which is less than the service provided by a nurs ing facility
685	685	but which is sufficient to enable the person to meet an adequate
686	686	level of daily living. Supportive assis tance includes but is not
687	687	limited to housekeeping, assistance in the preparation of meals,
688	688	assistance in the safe storage, distribution, a nd administration of
689	689	medications, and assistance i n personal care as is necess ary for the
690	690	health and comfort of such p erson. Supportive assistance shall not
691	691	include medical service.
