8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. NEW LAW A new section of law to be codified
8585 in the Oklahoma Statutes as Section 1-899.2 of Title 63, unless
8686 there is created a duplication in numbering, reads as follows:
8787 A. The State Department of Health shall r egulate intermediate
8888 care facilities for individuals with intellectual disabilities with
8989 sixteen or fewer beds (ICF s/IID-16) as distinct facilities and shall
9090 not regulate ICFs/IID-16 under the Nursing Home Care Act or any
9191 other act that governs a different type of facility.

143143 B. The State Department of Health shall enforce applicable
144144 federal laws and regulations governi ng intermediate care facilities
145145 for individuals with intellectual disabilities (ICFs/IID) and hired
146146 or contracted staff of ICFs/IID including, but not limited to,
147147 regulations of the Centers for Medicare and Medicaid Services.
148148 C. The administrator of an ICF/IID-16 shall meet the
149149 qualifications of Section 2 of this act.
150150 D. The State Commissioner of H ealth shall promulgate rules to
151151 implement this section with input from experienced professionals
152152 currently working in ICFs/IID-16 in this state. Such rules may
153153 include but not be limited to licensure, licensure fees, staffing,
154154 quality of resident care, minimum standards for facilities,
155155 inspections, penalties, and violations. Such rules shall be
156156 separate and distinct from rules regulating faciliti es under the
157157 Nursing Home Care Act or any other act that governs a different type
158158 of facility.
159159 SECTION 2. NEW LAW A new section of law to be codified
160160 in the Oklahoma Statutes as Section 330.53a of Title 63, unless
161161 there is created a duplication in numbering, reads as follows:
162162 The administrator of an intermediate care facility for
163163 individuals with intellectual disabilities with sixteen or fewer
164164 beds (ICF/IID-16) shall be:
165165 1. A nursing facility administrator licensed by the Oklahoma
166166 State Board of Examiners for Long-Term Care Administrators; or

218218 2. An assisted living facility administrator licensed by the
219219 Oklahoma State Board of Examiners for Long -Term Care Administrators
220220 with not less than three (3) years of experience working with
221221 individuals with intellectual disabilities in a professional
222222 setting.
223223 SECTION 3. AMENDATORY 6 3 O.S. 2021, Section 1 -1902, is
224224 amended to read as follows:
225225 Section 1-1902. As used in the Nursing Home Care Act:
226226 1. “Abuse” means the willful inflictio n of injury, unreasonable
227227 confinement, intimidation or punishment, with resulting physical
228228 harm, impairment or mental anguish;
229229 2. “Access” means the right of a person to enter a facility to
230230 communicate privately and without unreasonable restriction when
231231 invited to do so by a resident. The sta te or local “ombudsman”, as
232232 that term is defined by the Aging S ervices Division of the
233233 Department of Human Servic es pursuant to the Older Americans ’ Act,
234234 42 U.S.C.A., Section 3001 et seq., as amended, and a case manag er
235235 employed by the Department of Mental Health and Substance Abuse
236236 Services or one of its contract age ncies shall have right of access
237237 to enter a facility, communicate privately and without unreasonable
238238 restriction with any resident who consents to the com munication, to
239239 seek consent to communic ate privately and without restriction with
240240 any resident, and to observe all areas of the facility that directly
241241 pertain to the patient care of the resident without infringing upon

293293 the privacy of the other residents wi thout first obtaining their
294294 consent;
295295 3. “Administrator” means the person licensed by the State of
296296 Oklahoma this state who is in charge of a facility. An
297297 administrator must devote at least one -third (1/3) of such person ’s
298298 working time to on-the-job supervision of the facility; provided
299299 that this requirement shall not apply to an administrator of an
300300 intermediate care facility for individuals with intellectual
301301 disabilities with sixteen or fewer beds (ICF/IID -16), in which case
302302 the person licensed by the stat e may be in charge of more than one
303303 such ICF/IID-16 facility, if such facilities are located within a
304304 circle that has a map radius of not more than fifteen (15) forty
305305 (40) miles, the total number of facilities and beds does not exceed
306306 sixteen facilities an d sixty-four beds, and each such ICF/IID-16
307307 facility is supervised by a qualifie d professional. The facilities
308308 may be free-standing in a community or may be on campus with a
309309 parent institution. The ICF/IID -16 facility may be independently
310310 owned and operated or may be part of a l arger institutional
311311 operation;
312312 4. “Advisory Board” means the Long-Term Care Facility Advisory
313313 Board;
314314 5. “Adult companion home ” means any home or establishm ent,
315315 funded and certified by the Department of Human Services, which
316316 provides homelike residential accommodations and suppor tive

368368 assistance to three or fe wer adults with intellectual or
369369 developmental disabilities;
370370 6. “Board” means State Board of Health;
371371 7. “Commissioner” means State Commissioner of Health;
372372 8. “Department” means the State Department o f Health;
373373 9. “Facility” means a nursing facility and a specialized home;
374374 provided, this term shall not include a residential care home or an
375375 adult companion home;
376376 10. “Nursing facility” means a home, an establishment or an
377377 institution, a distinct part of which is primarily engag ed in
378378 providing:
379379 a. skilled nursing care and related services for
380380 residents who require medical or nursing care,
381381 b. rehabilitation services for the rehabilitation of
382382 injured, disabled, or sick persons, or
383383 c. on a regular basis, heal th-related care and serv ices
384384 to individuals who becaus e of their mental or physical
385385 condition require care and services beyond the level
386386 of care provided by a residential care home and which
387387 can be made available to them only thro ugh a nursing
388388 facility.
389389 “Nursing facility” does not mean, for purposes of Sectio n 1-851.1 of
390390 this title, a facility constr ucted or operated by an entity
391391 described in paragraph 7 of su bsection B of Section 6201 of Title 74

444444 continuum of care facili ty, as such term is defined un der the
445445 Continuum of Care and Assisted Liv ing Act, to the extent that the
446446 facility constructed or opera ted by an entity described in paragraph
447447 7 of subsection B of Section 6201 of Title 74 of the Oklaho ma
448448 Statutes contains suc h a nursing care component;
449449 11. a. “Specialized facility ” means any home, establishment,
450450 or institution which offers or provides inpati ent
451451 long-term care services on a twenty -four-hour basis to
452452 a limited category of persons requirin g such services,
453453 including but not limited to a facili ty providing
454454 health or habilitation servic es for individuals with
455455 intellectual or developmental disabilit ies, but.
456456 b. Specialized facility does not mean, for:
457457 (1) for purposes of Section 1-851.1 of this title, a
458458 facility constructed or operated by an entity
459459 described in paragraph 7 of subsection B of
460460 Section 6201 of Title 74 of the Oklahoma Statutes
461461 or the nursing care component of a continuu m of
462462 care facility, as such term is d efined under the
463463 Continuum of Care and Assisted Li ving Act, to the
464464 extent that the facility constructed or operated
465465 by an entity described in paragraph 7 of
466466 subsection B of Section 6201 of Title 74 of the

520520 (2) an intermediate care facility for individuals
521521 with intellectual disabilities with sixteen or
522522 fewer beds (ICF/IID-16);
523523 12. “Residential care home ” means any home, establishment, or
524524 institution licensed pursuant to the provisions of the Reside ntial
525525 Care Act other than a hotel, motel, fraterni ty or sorority house, or
526526 college or university dormitory, which offers o r provides
527527 residential accommodations, food service, and supportive assistance
528528 to any of its residents or houses any resident requirin g supportive
529529 assistance. The residents shall be p ersons who are ambulatory and
530530 essentially capable of managing their own affairs, but who do not
531531 routinely require nursing care; provided, the term “residential care
532532 home” shall not mean a hotel, motel, frat ernity or sorority house,
533533 or college or university dormitory, if the facility operates in a
534534 manner customary to its descri ption and does not house any person
535535 who requires supportive assistance from the facility in order to
536536 meet an adequate level of daily l iving;
537537 13. “Licensee” means the person, a corpora tion, partnership, or
538538 association who is the owner of the facility which is licensed by
539539 the Department pursuant to the provisions of the Nursing Home Care
540540 Act;
541541 14. “Maintenance” means meals, shelter, and l aundry services;

593593 15. “Neglect” means failure to provide goods and/or services
594594 necessary to avoid physical harm, mental an guish, or mental illness;
595595 16. “Owner” means a person, corporation, partnership,
596596 association, or other entity which owns a facility or leases a
597597 facility. The person or entity that sta nds to profit or lose as a
598598 result of the financial success or failure of the operation shall be
599599 presumed to be the owner of the facility. Notwithstanding the
600600 foregoing, any nonstate governmental entity tha t has acquired and
601601 owns or leases a facility and t hat has entered into an agreement
602602 with the Oklahoma Health Care Authorit y to participate in the
603603 nursing facility supplemental payment program ( “UPL Owner”) shall be
604604 deemed the owner of such facility and sha ll be authorized to obtain
605605 management services fro m a management services provider (“UPL
606606 Manager”), and to delegate, alloc ate and assign as between the UPL
607607 Owner and UPL Manager, compensation, profits, losses, liabilities,
608608 decision-making authority and res ponsibilities, including
609609 responsibility for the em ployment, direction, supervision and
610610 control of the facility ’s administrator and staff;
611611 17. “Personal care” means assistance with meals, dressing,
612612 movement, bathing or other personal needs or maintenance, or general
613613 supervision of the physical and mental well-being of a person, who
614614 is incapable of maintaining a private, indep endent residence, or who
615615 is incapable of managing his or her person, whether or not a
616616 guardian has been appointed for such person;

668668 18. “Resident” means a person resid ing in a facility due to
669669 illness, physical or mental infirmity, or advanced age;
670670 19. “Representative of a resident” means a court-appointed
671671 guardian or, if there is no court -appointed guardian, the parent of
672672 a minor, a relative, or other person, designate d in writing by the
673673 resident; provided, that any owner, operator, administrator or
674674 employee of a facility subject to the provisions of the Nursing Home
675675 Care Act, the Residential Care Act, or the Group Homes for the
676676 Developmentally Disabled or Physically Ha ndicapped Persons Persons
677677 with Developmental or Physical Disabilities Act shall not be
678678 appointed guardian or limited guardian of a resident of the facility
679679 unless the owner, operator, administrator or employee is the spouse
680680 of the resident, or a relative of the resident wi thin the second
681681 degree of consanguinity and is otherwise eligible fo r appointment;
682682 and
683683 20. “Supportive assistance” means the service rendered to any
684684 person which is less than the service provided by a nurs ing facility
685685 but which is sufficient to enable the person to meet an adequate
686686 level of daily living. Supportive assis tance includes but is not
687687 limited to housekeeping, assistance in the preparation of meals,
688688 assistance in the safe storage, distribution, a nd administration of
689689 medications, and assistance i n personal care as is necess ary for the
690690 health and comfort of such p erson. Supportive assistance shall not
691691 include medical service.
