4449 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4550 SECTION 1. AMENDATORY 63 O.S. 2021, S ection 1-2515, is
4651 amended to read as follows:
4752 Section 1-2515. A. Notwithstanding any other provision of this
4853 title, Emergency Medical Services emergency medical services (EMS)
4954 Regions regions, Ambulance Service ambulance service districts or
5055 municipalities are hereby authorized to regulate and control,
5156 pursuant to duly enacted ordinance or regulation, Ambulance Service
5257 ambulance service transports originating within the jurisdiction of
5358 such EMS Regions regions, Ambulance Service ambulance service
5459 districts or municipalities.
5560 B. Any ordinance or regulation ad opted pursuant to subsection A
5661 of this section shall meet and may exceed, but shall not be in
57-contravention of, the st andards promulgated by the State Board of
58-Health for Ambulance Service ambulance service transports.

90+Health for Ambulance Service ambulance service transports.
8591 C. 1. Any ordinance or regulation a dopted by an EMS Region
8692 region, Ambulance Service ambulance service district or a
8793 municipality may establish a sole -provider system for stretcher van
8894 and/or Ambulance Service ambulance service transports; provided,
8995 however, any such designated or contracte d sole-provider which is
9096 not an EMS Region region, Ambulance Service ambulance service
9197 district, municipality, or other public e ntity shall be selected by
9298 competitive bidding.
9399 2. A contract entered into pursuant to such bidding shall be
94100 with the lowest and best bidder and may be for an initial term of
95101 such duration as deemed operationally and fiscally prudent by the
96102 contracting agency. The term of such sole -provider contract shall
97103 be made public at the time bids are solicited, which solicitation
98104 shall be not less than sixty (60) days prior to the cont ract start
99105 date.
100106 D. Any EMS Region region, Ambulance Service ambulance service
101107 district or municipality m ay establish a sole-provider system for
102108 stretcher van and/or Ambulance Service ambulance service transports
103109 and may allow additional geographic or political subdivisions to
104110 join such a system a t any time. Whenever such a geographic or
105111 political subdivision joins such a sol e-provider system, competiti ve
106112 bidding shall not be required and provision f or servicing the new
107-jurisdiction may be accomplished by amending the existing sole -
108-provider contract. Furthermore, in the event the expansion of the

140+jurisdiction may be accomplished by amending the existing sole -
141+provider contract. Furthermore, in the event the expansion of the
135142 service area of the EMS Region region, Ambulance Service ambulance
136143 service district or the municipality is substan tial (in the sole
137144 opinion of the governing body of the EMS Region region, Ambulance
138145 Service ambulance service district or municipality), the existing
139146 sole-provider contract may be extended for a peri od sufficient to
140147 allow reasonable opportunity for recover y of capital costs of
141148 expansion, as determined by the contracting agency.
142149 E. The provisions of this section shall not be construed or
143150 applied to limit the operation of any emergency medical service
144151 district established a nd operating pursuant to Section 9C of Article
145152 10 of the Oklahoma Constituti on; provided, however, that, upon
146153 invitation and approval of a majority of the voters of the distri ct,
147154 any such district is hereby authorized to join by appro priate
148155 agreement any system established by an EMS Region region, Ambulance
149156 Service ambulance service district or a municipa lity pursuant to the
150157 provisions of this section.
151158 F. The following types of patient transports shal l be exempt
152159 from regulation by EMS Regions regions, Ambulance Service ambulance
153160 service districts or municipalities:
154161 1. Any ambulance owned or operated by, or under contract to
155162 perform ambulance transport services for, the Federal or State state
156163 government, or any agency thereof;
157-2. Any ambulance owned and operated by a hospital, or under
158-contract or agreement with a hospital, and in use to transport a

191+2. Any ambulance owned and operated by a hospital, or under
192+contract or agreement with a hospital, and in use to transport a
185193 patient of the owner -hospital, which patient has been admitted to
186194 and not been discharged from the owner -hospital, to or from another
187195 hospital or medical care facility at which the pati ent receives a
188196 diagnostic or therapeutic procedure not available at the owner -
189197 hospital;
190198 3. Any ambulance en gaged in a routine transport call to
191199 transport a patient from a hospital, nursing home, or dialysis
192200 center located within an EMS Region region, Ambulance Service
193201 ambulance service district or municipality to any location outside
194202 the EMS Region region, Ambulance Service ambulance service district
195203 or municipality;
196204 4. Any ambulance engaged in the transport of a patient from a
197205 location outside an EMS Region region, Ambulance Service ambulance
198206 service district or municipality to a location inside an EMS Region
199207 region, Ambulance Service ambulance service district or
200208 municipality; or
201209 5. Any ambulance engaged i n the interstate transport of a
202210 patient.
203211 SECTION 2. This act shall become effective November 1, 2022.
