8383 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8484 SECTION 1. AMENDATORY 10A O.S. 2021, Section 2 -8-104, is
8585 amended to read as follows:
8686 Section 2-8-104. A. When a person meets the definition of a
8787 juvenile sex offender pursuant to Section 2 -8-102 of this title, the
8888 district attorney may make an application to shall include the
8989 juvenile in the juvenile sex offender registry. Upon the
9090 application of inclusion of the juvenile on the juvenile sex
9191 offender registry by the district attorney , the court shall appoint

143143 two persons who are qualified sex offender treatment profess ionals
144144 to evaluate the juvenile and report to the court on the treatment
145145 prognosis and likelihood that the juvenil e offender represents an
146146 ongoing serious or aggressive thre at to the public or children under
147147 sixteen (16) years of age . One appointee shall be currently
148148 licensed as a physician or psychologist in Oklahoma this state with
149149 a minimum of two hundred (200) hours of cl inical experience in
150150 juvenile sex offender treatment. Other criteria for qualifying as a
151151 sex offender treatment professional shall include, but not be
152152 limited to, current licensure as a medical or mental h ealth
153153 professional with a minimum of two hundred ( 200) hours of clinical
154154 experience in juvenile sex offender tr eatment, or current licensure
155155 as a medical or mental health professional with a min imum of two (2)
156156 years’ combined clinical experience in child a buse treatment, child
157157 or adolescent anger manageme nt treatment, juvenile delinquency or
158158 criminal behavior treat ment, sexual abuse treatment, child or
159159 adolescent psychology, or therapeutic social work. A list of sex
160160 offender treatment professionals meeting the established crite ria
161161 shall be provided to eac h district court by the Office of Juvenile
162162 Affairs. Where professionals are appointed to conduct an evaluation
163163 in such cases, the court may set reasonable compensation and order
164164 the payment out of the cour t fund. In the event two qualified sex
165165 offender treatment professionals are not available to the court to
166166 evaluate the juvenile sex offender, the Office of Juvenile Affairs

218218 may, at the court’s request, select additional qualified sex
219219 offender treatment pr ofessionals employed b y the agency to assist
220220 with the evaluation report.
221221 B. The court shall, after considerati on of the evaluation
222222 report required by subsection A of this section, make a findin g of
223223 whether the juvenile offender represents an ongoing serio us or
224224 aggressive threat to the public or children under sixteen (16) years
225225 of age. If the court finds the juve nile represents does not
226226 represent such threat, the court shall order the juvenile to
227227 register be removed from registration on the juvenile sex o ffender
228228 registry as provided in this act the Juvenile Sex Offender
229229 Registration Act.
230230 C. The court, in its discretion, may order information on any
231231 juvenile sex offender released from the juvenile sex o ffender
232232 registry to any person or t o the public at large when the evaluation
233233 report considered by the co urt indicates a likelihood of an ongoing
234234 serious or aggressive threat to the public or children under sixteen
235235 (16) years of age. If the court orders re lease of this information
236236 to the public at large, it shall promptly be made available for
237237 public inspection or copying pursuant to rules promulgated by the
238238 Office of Juvenile Affairs. If the court orders the release of this
239239 information through community n otification, the notification shall
240240 be carried out by the local law enforcement authority applicable to
241241 the person’s residence.

293293 D. The court may rev iew the treatment prognosis of any
294294 registered juvenile sex offender at any time and may, in its
295295 discretion, order release of additional inform ation from the
296296 juvenile sex offender registry, as deemed appropriate for the
297297 protection of the public.
298298 SECTION 2. AMENDATORY 10A O.S. 2021, Section 2 -8-108, is
299299 amended to read as follows:
300300 Section 2-8-108. When a registered juvenile sex offender
301301 reaches twenty-one (21) years of age or is otherwise released from
302302 the custody of the Office of Ju venile Affairs, the district
303303 attorney, the victim or representative of the victim may petition
304304 the court to transfer the person ’s registration to the adult sex
305305 offender registry maintained by the Department of C orrections,
306306 subject to the provisions of Sect ion 581 et seq. of Title 57 of the
307307 Oklahoma Statutes. After notice, if the court determines at a
308308 hearing that the person who is registered on the juvenile sex
309309 offender registry is likely to or does pose an ongo ing serious or
310310 aggressive threat to the publi c or children under sixteen (16) years
311311 of age, the court shall order that the delinquent act be deemed an
312312 adult criminal conviction for the purpose of registrati on,
313313 notification, and public information access pu rsuant to Section 581
314314 et seq. of Title 57 of the Oklahoma Statutes. If no petition is
315315 filed within ninety (90) one hundred eighty (180) days following the
316316 twenty-first birthday of the person or the date of release from

368368 custody, or if the court determines the person is not likely to or
369369 does not pose an ongoing serious or aggressive threat to the public
370370 or children under sixteen (16) year s of age, the juvenile’s name and
371371 information shall be deleted from the juvenile sex offender
372372 registry, and the person may not be included in the adult sex
373373 offender registry.
374374 SECTION 3. This act shall become effective November 1, 2022.
