27149 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLA HOMA:

29150 SECTION 1. AMENDATORY 70 O.S. 202 1, Section 3311.5, is
30151 amended to read as follows :

32152 Section 3311.5. A. On and after November 1, 2007, the Council
33153 on Law Enforcement Education and Training (CLEET), pursuant to its
34154 authority granted by Section 3311 of this title, shall include in
35155 its required basic training courses for law enforcement
36156 certification a minimum of four (4) hours of education and training
37157 relating to recognizing and managing a person appearing to req uire
38158 mental health treatment or services. The Council shall further
39159 offer a minimum of four (4) hours of education and trainin g on
40160 specific mental health issues pursuant to Section 3311.4 of this
41161 title to meet the annual requirement for continuing educati on in the
42162 areas of mental health issues.

44189 B. By January 1, 2008, CLEET, pursuan t to its authority granted
45190 by Sections 3311 and 3311.4 of this title, shall include in its
46191 required courses of study for law enforcement certification a

49192 minimum of six (6) hours of evidence-based sexual assault and sexual
50193 violence training. A portion of t he sexual assault and sexual
51194 violence training shall include instructi on presented by a certified
52195 sexual assault service provider.

54196 C. By January 1, 2012, every active full -time peace officer,
55197 previously certified by CLEET pursuant to Section 3311 of this
56198 title, shall be required to attend and complete the evidence-based
57199 sexual assault and sexual violence training provided in subsection B
58200 of this section.

60201 D. CLEET shall promulga te rules to enforce the provisions of
61202 subsections B and C of this section and s hall, with the assistance
62203 of certified sexual as sault service provider s, establish a
63204 comprehensive integrated curriculum for the teaching of evidence -
64205 based sexual assault and se xual violence issues.

66206 E. The Council is required to update that block of train ing or
67207 course materials relating to legal issues , concepts, and state laws
68208 annually, but not later than ninety (90) days following the
69209 adjournment of any legislative session.

71210 F. By January 1, 2009, CLEET, pursuant to its authority granted
72211 by Sections 3311 and 3311.4 of this title, shall include in its

76240 G. By January 1, 2012, CLEET, pu rsuant to its authority granted
77241 by Sections 3311 and 3311.4 of this title, shal l establish and
78242 include in its required courses of study for law enfor cement
79243 certification a minimum of eight (8) hours of evidence -based
80244 domestic violence and stalking investig ation training. The training
81245 should include, at a minimum, the importance of r eporting domestic
82246 violence incidents, determinin g the predominant aggr essor, evidence-
83247 based investigation of domestic violence and stalking, lethality
84248 assessment, and personal s afety planning necessary at the pretrial
85249 stages of a potential criminal case. A portion of the training
86250 shall include instruct ion presented by an ex pert victim advocate
87251 selected from recommendations provided by the Office of the Attorney
88252 General or the Domestic Violence Fatality Review Board. The
89253 training shall be developed in coll aboration with the Domestic

92254 Violence Fatality Re view Board, and where applicable, shall replace
93255 existing domestic violence and stalking courses currently required.

95256 H. By January 1, 2012, the evidence-based domestic violence and
96257 stalking investigation curr iculum developed in collaboration with
97258 the Domestic Violence Fatality Review Board shall be submitted to
98259 the Council for approval.

100260 I. CLEET shall establish the training provide d in subsection G
101261 of this section as a part of CLEET ’s peace officer continuing

102288 education program and develop a plan to train f ull-time peace
103289 officers previously certified by CLEET pursuant to Section 3311 of
104290 this title where applicable. The Office of the Attorney General
105291 shall provide a list of expert victim advocates that are avai lable
106292 to assist in the training.

108293 J. The Council is authorized to pay for and send training staff
109294 and employees to one or more training and education courses in
110295 jurisdictions outside this state for the purpose of expanding
111296 curriculum, training skill develo pment, and general knowledge within
112297 the field of law enforcement educa tion and training.

114298 K. On and after November 1, 2013, CLEET, pursuant to its
115299 authority granted by Section 3 311 of this title, shall include in
116300 its required basic training courses for law enforcement
117301 certification a minimum of two (2) hours of education and training
118302 relating to recognizing and managing a person experiencing dementia
119303 or Alzheimer’s disease.

121304 L. By November 1, 2019, CLEET shall establish appropriate
122305 training resources focuse d on protocol for handling and processing
123306 sexual assault calls. The t raining shall include, but not be
124307 limited to:

126308 1. How to handle the sexual assault call upon first contact;

128309 2. Determining when the assault occurred;

130310 3. Where to take the victim;

132311 4. Questioning witnesses and collecting evidence; an d

136338 5. Informing and as sisting the victim in accessing resources,
137339 help and information.

139340 M. The Council shall promulgate rules to evaluate and approve
140341 municipalities and counties that are deemed capable of con ducting
141342 separate basic law enforcement training academies in their
142343 jurisdiction and to certify officers successfully completing such
143344 academy training courses. Upon application to the Council, any
144345 municipality with a population of sixty -five thousand (65,000) or
145346 more or any county with a population of f ive hundred thousand
146347 (500,000) or more shall be authorized to operate a basic law
147348 enforcement academy. In addition, upon applica tion and approval
148349 from the Council, a municipality with a population under sixt y-five
149350 thousand (65,000) or a county with a popu lation under five hund red
150351 thousand (500,000) may be authorized to operate a basic law
151352 enforcement academy; provided, however, the Council may approve no
152353 more than two such applications per year. The Council shall approve
153354 an application when the municipali ty or county making th e
154355 application meets the criteria for a separate training academy and
155356 demonstrates to the satisfaction of th e Council that the academy has
156357 sufficient resources to conduct the training, th e instructional
157358 staff is appropriately trained a nd qualified to teach the course
158359 materials, the curriculum is composed of comparable or higher
159360 quality course segments to the CLE ET academy curriculum, and the
160361 facilities where the academy will be conducted a re safe and

161388 sufficient for law enforcement train ing purposes. Any mun icipality
162389 or county authorized to operate a basic law enforcement academy
163390 after November 1, 2007, shall not be eligible to receive funds
164391 pursuant to subsection E of Section 1313.2 of Tit le 20 of the
165392 Oklahoma Statutes. The Council sha ll not provide any fun ding for
166393 the operation of any separate training academy authorized by this
167394 subsection.

169395 N. Any municipality or county that, prior to November 1, 2007,
170396 was authorized to conduct a basic l aw enforcement academy shall
171397 continue to receive funding pursuant to s ubsection E of Section
172398 1313.2 of Title 20 of the Oklahoma Statutes.

174399 O. The Council shall promulgate rules to evalu ate and approve
175400 an application submitted by the Department of Corrections for a
176401 separate training academy. Pursuant to the promulgated rules, the

179402 Council shall approve a separate training academy once the
180403 Department:

182404 1. Has met the criteria for a separate trai ning academy;

184405 2. Demonstrates to the sati sfaction of the Council that the
185406 academy has sufficient resources to conduct the training;

187407 3. Has the instructional staff appropriately trained and
188408 qualified to teach the course materials ;

190409 4. Has the curriculum composed of comparable or higher quality
191410 course segments to the CLEET academy curriculum ; and

193437 5. Has the facilities where the academy will be conducted that
194438 are safe and sufficient for law enforcement training purposes.

196439 The Council shall not provide any fu nding for the operation of
197440 any separate training academy authorized by this subsection.

199441 SECTION 2. This act shall become effective November 1, 2022.
