6565 An Act relating to election audits; creating the

7979 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8080 SECTION 1. NEW LAW A new sec tion of law to be codified
8181 in the Oklahoma Statutes as Section 3-130.1 of Title 26, unless
8282 there is created a duplication in numb ering, reads as follows:
8383 A. This act shall be known and may be cite d as the “Post-
8484 Election Forensic Audit Act of 2022”.
8585 B. The Governor, the President Pro Tempore of the Senate, and
8686 the Speaker of the House of Representatives shall appoint an
8787 independent third party to conduct a forensic audit of the general
8888 election that took place on Novemb er 3, 2020. Such independent

140140 third party shall be appointed no later than thirty (30) days after
141141 the effective date of this act.
142142 C. The independent third party appointed under subsection B of
143143 this section shall complete an audit for every precinct in:
144144 1. The three most populous counties as determined by the 2020
145145 federal decennial census ;
146146 2. The three least populous counties as de termined by the 2020
147147 federal decennial census; and
148148 3. Three counties randomly selected by the independent third
149149 party.
150150 D. Audits required by this section shall be completed no later
151151 than ninety (90) days after the date of the appointment of the
152152 independent third party. Upon completion, the independent third
153153 party shall submit a report to the Governor, the President Pro
154154 Tempore of the Senate, and the Speaker of the House of
155155 Representatives that identifies and details any anomaly or
156156 discrepancy in voter data, ballot data, or tabulation.
157157 E. Funding required to complete the require ments of this
158158 section shall be app ropriated by the Legislature from funds
159159 available from the Coronavirus Aid, Relief, and Economic Secu rity
160160 Act (CARES) or the American Rescue Plan Act of 2021 (ARPA).
161161 SECTION 2. It being immediately necessary for the preservation
162162 of the public peace, healt h or safety, an emergency is hereby
