An Act relating to the 9/11 Freedom Flag; authorizing 
certain flag to be flown commemorating the September 
11, 2001, terror attacks on the United States; 
amending 21 O.S. 2021, Section 375, which relates to 
flag placement prohibitions; authorizing placement of 
certain commemorative flag; providing for 
codification; and declaring an emergency . 
 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     NEW LAW     A new section of law to be codified 
in the Oklahoma Statutes as Section 93. 3 of Title 25, unless th ere 
is created a duplication in numbering, reads as follows: 
In memory of the September 11, 2001, terrorist attacks on the 
World Trade Center, Pentagon, and the plane crash victims of the 
United Airlines Flight 93, the 9/11 Freedom Flag that commemorat es 
this day in American history , shall be authorized to be flown on 
flagpoles throughout the state in remembrance.

SECTION 2.     AMENDATORY     21 O.S. 2021, Section 375, is 
amended to read as follows: 
Section 375.  A.  It shall be unlawful and constitute a 
misdemeanor for any person to place, hoist, raise or display any 
flag, standard, colors or ensign upon or over any publicly own ed 
tax-supported property or premises except roads, streets, hi ghways, 
stadiums or arenas in the State of Oklaho ma, except: 
1.  The flag, standard, colors or ensign of the United States of 
America; 
2. The flag of any nation formerly having dominion over t he 
land now comprising the State of Oklahoma or any portion of said 
land; 
3.  The official flag of any of the fi fty states of the United 
States; 
4.  An Alfred P. Murrah Federal Building commemorative flag; 
5.  The official flag of any municipality in this state; 
6.  The Boy Scouts of America flag; 
7.  The Girl Scouts United States of America flag; 
8.  The American Red Cross flag; 
9.  The American Ex-Prisoner of War flag; 
10.  The POW/MIA flag; and 
11.  The 9/11 Freedom Flag; and 
12.  Such other flags as may be approved by the governing board 
or agency having control over said public property.

B.  Any person convicted of a violation of this section shall be 
punished by a fine of not less than Fifty Dolla rs ($50.00) nor more 
than Five Hundred Dollars ($500.00), or by imprisonment in the 
county jail for not less than thirty (30) days nor more than six (6) 
months, or by both such fine and imprisonment. 
SECTION 3.  It being immediately neces sary for the preservation 
of the public peace, health or safety, an emergency is hereby 
declared to exist, by reason whereof this act shall take effect and 
be in full force from and after its passage an d approval.
