76 | 76 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 1061, is |
---|
77 | 77 | | amended to read as follows: |

78 | 78 | | Section 1061. Every authority shall have all powers necessary |
---|
79 | 79 | | or convenient to carry out and effectuate the purpose s and |
---|
80 | 80 | | provisions of this act, Section 1051 et seq. of this title including |
---|
81 | 81 | | the following powers in addition to others herein specifically |
---|
82 | 82 | | granted: |

83 | 83 | | (a) To sue and to be sued; to have a seal and to alter the same |
---|
84 | 84 | | at pleasure; to have perpetual succession; to make and execute |

139 | 139 | | (b) Within its area of operation: to prepare, carr y out, and |
---|
140 | 140 | | operate projects and to provide for the acquisition, construction, |
---|
141 | 141 | | reconstruction, improvement, extension, alteration , or repair of any |
---|
142 | 142 | | project or any part thereof. Provided, however, that a public |
---|
143 | 143 | | hearing to consider a proposed project requiri ng construction, |
---|
144 | 144 | | purchasing, leasing, or renting of more than twenty new housing |
---|
145 | 145 | | units shall be held together by the authority and governing body, |
---|
146 | 146 | | and any such project must be found to be in the public interest by a |
---|
147 | 147 | | majority of the members constituting said the authority and a |
---|
148 | 148 | | majority of the members cons tituting said governing body as a |
---|
149 | 149 | | condition precedent to the implementation of any such project. |
---|
150 | 150 | | Notice of the public hearing required by this provision shall be |
---|
151 | 151 | | given by publication in a newspaper of gene ral circulation within |
---|
152 | 152 | | the jurisdiction of the aut hority at least ten (10) days and not |
---|
153 | 153 | | more than thirty (30) days prior to said the hearing; provided that |
---|
154 | 154 | | an additional public hearing shall be held by the authority before |
---|
155 | 155 | | the same shall select any locatio n for any contiguous or |
---|
156 | 156 | | noncontiguous area of land on which the authority proposes to |
---|
157 | 157 | | construct more than twenty additional new housing units, and such |
---|
158 | 158 | | the hearing shall have as its subject the location of the proposed |
---|
159 | 159 | | additional units. Notice of the publ ic hearing required by this |

218 | 218 | | (c) To undertake and carry out studies and analyses of housing |

219 | 219 | | needs within its area of operation and ways of me eting such needs, |

220 | 220 | | including data with respect to population and family groups and the |
---|
221 | 221 | | distribution thereof according to income g roups, the amount and |
---|
222 | 222 | | quality of available housing , and its distribution accor ding to |
---|
223 | 223 | | rental and sale prices, employment, wages , and other factors |
---|
224 | 224 | | affecting the local housing needs and the meeting thereof, and to |
---|
225 | 225 | | make the results of such studies and analyses available to the |
---|
226 | 226 | | public and the building, housing , and supply industries; a nd to |
---|
227 | 227 | | engage in research and disseminate informati on on housing and slum |
---|
228 | 228 | | clearance. |
---|
229 | 229 | | (d) To utilize, contract with, act through, assist , and |
---|
230 | 230 | | cooperate or deal with any person, agency, institution, or |
---|
231 | 231 | | organization, public or private, for the provision of ser vices, |
---|
232 | 232 | | privileges, works, or facilities for or in connection with its |
---|
233 | 233 | | projects; and, notwithstanding anything to the contrary contained in |
---|
234 | 234 | | this act Section 1051 et seq. of this title or in any other |
---|
235 | 235 | | provision of law, to agree to any conditions attached to federal |
---|
236 | 236 | | financial assistance relating to the deter mination of prevailing |
---|
237 | 237 | | salaries or wages or payment of not less than prevailing salaries or |
---|

295 | 295 | | project. Construction, r estitution, improvement, extension, |
---|
296 | 296 | | alteration, or major repair of any project or any part thereof shall |
---|
297 | 297 | | be open to competitive bidding: provided, however, nothing in th is |
---|
298 | 298 | | section shall prevent a local hou sing authority from requesting |
---|
299 | 299 | | proposals from property owners and/or developers to provide certain |
---|
300 | 300 | | kinds of housing to the housing authority either presently existing |
---|
301 | 301 | | or to be developed; provided, that the local authorit y establish |
---|
302 | 302 | | safeguards relating to l aws and regulations of the United States |
---|
303 | 303 | | wherein the same has entered into contracts with the authority to |
---|
304 | 304 | | provide financial assistance in acquiring the same; provided, |
---|
305 | 305 | | further, that no authority shall discriminate in it s seeking, or in |
---|
306 | 306 | | the award, of any contract for services, acquisition of real or |
---|
307 | 307 | | personal property, construction of buildings, dwelling unit s, |
---|
308 | 308 | | streets, utilities, site grading, landscaping , and repairs to any of |
---|
309 | 309 | | its holdings or upon property that the author ity plans to acquire, |
---|
310 | 310 | | to include renovations, solely based on the race, sex, color, |
---|
311 | 311 | | religious beliefs, or national origin of a person or fi rm; except an |
---|
312 | 312 | | Indian authority may give preference in its awarding of a contract |
---|

372 | 372 | | (e) To lease, rent, sell , or lease with option to purchase any |

374 | 374 | | facilities embraced in any project and, subject to the limitatio ns |
---|
375 | 375 | | contained in this act Section 1051 et seq. of this title with |

376 | 376 | | respect to the rental of or charges for dwellings in housing |
---|
377 | 377 | | projects, to establish and revise the rents or charges therefor; to |
---|
378 | 378 | | own, hold, and improve real or personal property; to purchase, |
---|
379 | 379 | | lease, obtain options upon, acquir e by gift, grant, bequest, devise , |
---|
380 | 380 | | or otherwise any real or personal property or any interest therein; |
---|
381 | 381 | | to acquire by the exercise of the power of eminent domain an y real |
---|
382 | 382 | | property or interest therein; to sell, lease, exchange, transfer, |
---|
383 | 383 | | assign, pledge, or dispose of any real or personal property or any |
---|

451 | 451 | | time of acquiring same, and except that lands acquired by the |

452 | 452 | | authority may be sold to other governmental agencies for public |

453 | 453 | | purposes, as long as such the parcel of land does not exceed one |
---|
454 | 454 | | percent (1%) of the total land held by the authority and the sale is |
---|
455 | 455 | | made within ninety (90) days of the effective date of this act April |
---|
456 | 456 | | 25, 1969; to make loans for the provisions of housing for occupancy |
---|
457 | 457 | | by persons of low income; to insure or provide for th e insurance of |
---|
458 | 458 | | any real or personal property or operations of the authority against |
---|
459 | 459 | | any risks or hazards; to procure or agree to the procurement of |
---|
460 | 460 | | government insurance or guarantees of the payment of any bonds or |
---|
461 | 461 | | parts thereof issued by the authority , including the power to pay |
---|
