75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1061, is
77	77	amended to read as follows:
78	78	Section 1061. Every authority shall have all powers necessary
79	79	or convenient to carry out and effectuate the purpose s and
80	80	provisions of this act, Section 1051 et seq. of this title including
81	81	the following powers in addition to others herein specifically
82	82	granted:
83	83	(a) To sue and to be sued; to have a seal and to alter the same
84	84	at pleasure; to have perpetual succession; to make and execute
85	85	contracts and other instruments necessary or convenient to the
86	86	exercise of the powers of the authority; and to make and from time
87	87	to time amend and repeal bylaws, rules , and regulations.

139	139	(b) Within its area of operation: to prepare, carr y out, and
140	140	operate projects and to provide for the acquisition, construction,
141	141	reconstruction, improvement, extension, alteration , or repair of any
142	142	project or any part thereof. Provided, however, that a public
143	143	hearing to consider a proposed project requiri ng construction,
144	144	purchasing, leasing, or renting of more than twenty new housing
145	145	units shall be held together by the authority and governing body,
146	146	and any such project must be found to be in the public interest by a
147	147	majority of the members constituting said the authority and a
148	148	majority of the members cons tituting said governing body as a
149	149	condition precedent to the implementation of any such project.
150	150	Notice of the public hearing required by this provision shall be
151	151	given by publication in a newspaper of gene ral circulation within
152	152	the jurisdiction of the aut hority at least ten (10) days and not
153	153	more than thirty (30) days prior to said the hearing; provided that
154	154	an additional public hearing shall be held by the authority before
155	155	the same shall select any locatio n for any contiguous or
156	156	noncontiguous area of land on which the authority proposes to
157	157	construct more than twenty additional new housing units, and such
158	158	the hearing shall have as its subject the location of the proposed
159	159	additional units. Notice of the publ ic hearing required by this
160	160	provision shall be giv en in a newspaper of general circulation
161	161	within the jurisdiction of the authority at least ten (10) days and
162	162	not more than thirty (30) days prior to said the hearing and three

214	214	members of the Commission must concur in the selection of any such
215	215	location, except that the aforesaid proviso concerning an additional
216	216	public hearing shall not apply to a location in an approved urban
217	217	renewal project area.
218	218	(c) To undertake and carry out studies and analyses of housing
219	219	needs within its area of operation and ways of me eting such needs,
220	220	including data with respect to population and family groups and the
221	221	distribution thereof according to income g roups, the amount and
222	222	quality of available housing , and its distribution accor ding to
223	223	rental and sale prices, employment, wages , and other factors
224	224	affecting the local housing needs and the meeting thereof, and to
225	225	make the results of such studies and analyses available to the
226	226	public and the building, housing , and supply industries; a nd to
227	227	engage in research and disseminate informati on on housing and slum
228	228	clearance.
229	229	(d) To utilize, contract with, act through, assist , and
230	230	cooperate or deal with any person, agency, institution, or
231	231	organization, public or private, for the provision of ser vices,
232	232	privileges, works, or facilities for or in connection with its
233	233	projects; and, notwithstanding anything to the contrary contained in
234	234	this act Section 1051 et seq. of this title or in any other
235	235	provision of law, to agree to any conditions attached to federal
236	236	financial assistance relating to the deter mination of prevailing
237	237	salaries or wages or payment of not less than prevailing salaries or

289	289	wages or compliance with labor standards, in the development or
290	290	administration of projects, and to include in any contract awarded
291	291	or entered into in connection wit h a project stipulations requiring
292	292	that the contractor and all subcontractors comply with requirements
293	293	as to minimum salaries or wages and maximum hours of labor, and
294	294	comply with any conditions attached to the financial aid of the
295	295	project. Construction, r estitution, improvement, extension,
296	296	alteration, or major repair of any project or any part thereof shall
297	297	be open to competitive bidding: provided, however, nothing in th is
298	298	section shall prevent a local hou sing authority from requesting
299	299	proposals from property owners and/or developers to provide certain
300	300	kinds of housing to the housing authority either presently existing
301	301	or to be developed; provided, that the local authorit y establish
302	302	safeguards relating to l aws and regulations of the United States
303	303	wherein the same has entered into contracts with the authority to
304	304	provide financial assistance in acquiring the same; provided,
305	305	further, that no authority shall discriminate in it s seeking, or in
306	306	the award, of any contract for services, acquisition of real or
307	307	personal property, construction of buildings, dwelling unit s,
308	308	streets, utilities, site grading, landscaping , and repairs to any of
309	309	its holdings or upon property that the author ity plans to acquire,
310	310	to include renovations, solely based on the race, sex, color,
311	311	religious beliefs, or national origin of a person or fi rm; except an
312	312	Indian authority may give preference in its awarding of a contract

364	364	in all forms so long as the services to be performed, or the
365	365	construction of buildings, dwellings, site improvements, rep airs, or
366	366	renovation is to be performed or carried out on a federally
367	367	recognized tribal reservation or former reservations and only then
368	368	upon land held in trust by, or owned by, the respective Indian
369	369	tribe; and provided, further, that all previously listed
370	370	restrictions and regulations concerning public hearing s and
371	371	locations of said the projects are complied with in their entirety.
372	372	(e) To lease, rent, sell , or lease with option to purchase any
373	373	dwelling, accommodations, lands, buildings, structures , or
374	374	facilities embraced in any project and, subject to the limitatio ns
375	375	contained in this act Section 1051 et seq. of this title with
376	376	respect to the rental of or charges for dwellings in housing
377	377	projects, to establish and revise the rents or charges therefor; to
378	378	own, hold, and improve real or personal property; to purchase,
379	379	lease, obtain options upon, acquir e by gift, grant, bequest, devise ,
380	380	or otherwise any real or personal property or any interest therein;
381	381	to acquire by the exercise of the power of eminent domain an y real
382	382	property or interest therein; to sell, lease, exchange, transfer,
383	383	assign, pledge, or dispose of any real or personal property or any
384	384	interest therein,; provided, however, that before any such personal
385	385	property shall be sold it shall be advertised fo r sale in a
386	386	newspaper of general circulation within the jurisdiction of the
387	387	authority, and such the advertisement shall state the time and place

439	439	where written bids shall be received, or public auction shall be
440	440	held, that such the property shall be sold to the highest bidder,
441	441	and that the authority may, within its discretion, reject all bids
442	442	and readvertise such the property for sale in the event any
443	443	property, real or personal, acquired by the authority, by e minent
444	444	domain or otherwise, is later found to be i n excess of its needs, or
445	445	unsuitable or unuseable unusable for any reason, such the property
446	446	shall, before being sold, leased, exchanged, transferred, assigned,
447	447	pledged, or disposed of in any other manner, be first offered to
448	448	those persons, individuals, groups, organizations, corporations,
449	449	municipalities, or their successors from whom it was first procured
450	450	by the authority, at the same price as paid by the authority at the
451	451	time of acquiring same, and except that lands acquired by the
452	452	authority may be sold to other governmental agencies for public
453	453	purposes, as long as such the parcel of land does not exceed one
454	454	percent (1%) of the total land held by the authority and the sale is
455	455	made within ninety (90) days of the effective date of this act April
456	456	25, 1969; to make loans for the provisions of housing for occupancy
457	457	by persons of low income; to insure or provide for th e insurance of
458	458	any real or personal property or operations of the authority against
459	459	any risks or hazards; to procure or agree to the procurement of
460	460	government insurance or guarantees of the payment of any bonds or
461	461	parts thereof issued by the authority , including the power to pay
462	462	premiums on any such insurance; provided, however, that

514	514	notwithstanding any provisions in this law, the authority may
515	515	develop programs for the sale of individual homes and/or two -family
516	516	units to low income families or to families wh o have at one time
517	517	qualified as low income families under this act Section 1051 et seq.
518	518	of this title, under terms which the housing authority may establish
519	519	under conditions acceptable to bo ndholders, other lenders , and the
520	520	federal government.
521	521	(f) To invest any funds held in reserves or sin king funds or any
522	522	funds not required for immediate disbursemen t in property or
523	523	securities in which public funds in the custody of a county
524	524	treasurer or the State Treasurer of the State of Oklahoma may be
525	525	legally invested; to redeem its bonds at the redemption pr ice
526	526	established therein or to purchase its bonds at less than such
527	527	redemption price, all bonds so redeemed or purchased to be
528	528	cancelled.
529	529	(g) Within its area of operation: to determine where slum areas
530	530	exist or where there is unsafe, unsanitary , or overcrowded housing;
531	531	to make studies and recommendations relati ng to the problem of
532	532	clearing, replanning , and reconstruction of slum areas and the
533	533	problem of eliminating unsafe, unsanitary , or overcrowded housing
534	534	and providing dwelling accommodations for persons of low income; and
535	535	to cooperate with the state or any st ate public body in action taken
536	536	in connection with such those problems. Provided, however, the
537	537	authority shall not have the power to relocate any persons to other

590	590	this act Section 1051 et seq. of this title.
591	591	(h) Acting through one or more commissioners or other persons
592	592	designated by the authority: to conduct examinations and
593	593	investigations and to hear testimony and take proof under oath at
594	594	public hearings on any matter material for its information; to
595	595	administer oaths, issue subpoenas req uiring the attendance of
596	596	witnesses or the production of books and papers , and to issue
597	597	commissions for the examination of witnesses who are outside of the
598	598	state or unable to attend befo re the authority, or excused from
599	599	attendance; to make available to appr opriate agencies, including
600	600	those charged with the duty of abating or requiring the correction
601	601	of nuisances or like conditions or of demolishing unsafe or
602	602	unsanitary structures within i ts area of operation, its findings and
603	603	recommendations with regard to a ny building or property where
604	604	conditions exist which are dangerous to the public health, morals,
605	605	safety, or welfare.
606	606	(i) To exercise all or any part or combination of powers herein
607	607	granted.
608	608	The powers of an authority shall not include: (1) the power to
609	609	appropriate funds of a city or county; (2) the power to levy taxes
610	610	and assessments; (3) the power to zon e or rezone; or (4) the power
611	611	to make exceptions to zoning ordinances or building r egulations of a
612	612	city or county.
