7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1061, is
7777 amended to read as follows:
7878 Section 1061. Every authority shall have all powers necessary
7979 or convenient to carry out and effectuate the purpose s and
8080 provisions of this act, Section 1051 et seq. of this title including
8181 the following powers in addition to others herein specifically
8282 granted:
8383 (a) To sue and to be sued; to have a seal and to alter the same
8484 at pleasure; to have perpetual succession; to make and execute
8585 contracts and other instruments necessary or convenient to the
8686 exercise of the powers of the authority; and to make and from time
8787 to time amend and repeal bylaws, rules , and regulations.

139139 (b) Within its area of operation: to prepare, carr y out, and
140140 operate projects and to provide for the acquisition, construction,
141141 reconstruction, improvement, extension, alteration , or repair of any
142142 project or any part thereof. Provided, however, that a public
143143 hearing to consider a proposed project requiri ng construction,
144144 purchasing, leasing, or renting of more than twenty new housing
145145 units shall be held together by the authority and governing body,
146146 and any such project must be found to be in the public interest by a
147147 majority of the members constituting said the authority and a
148148 majority of the members cons tituting said governing body as a
149149 condition precedent to the implementation of any such project.
150150 Notice of the public hearing required by this provision shall be
151151 given by publication in a newspaper of gene ral circulation within
152152 the jurisdiction of the aut hority at least ten (10) days and not
153153 more than thirty (30) days prior to said the hearing; provided that
154154 an additional public hearing shall be held by the authority before
155155 the same shall select any locatio n for any contiguous or
156156 noncontiguous area of land on which the authority proposes to
157157 construct more than twenty additional new housing units, and such
158158 the hearing shall have as its subject the location of the proposed
159159 additional units. Notice of the publ ic hearing required by this
160160 provision shall be giv en in a newspaper of general circulation
161161 within the jurisdiction of the authority at least ten (10) days and
162162 not more than thirty (30) days prior to said the hearing and three

214214 members of the Commission must concur in the selection of any such
215215 location, except that the aforesaid proviso concerning an additional
216216 public hearing shall not apply to a location in an approved urban
217217 renewal project area.
218218 (c) To undertake and carry out studies and analyses of housing
219219 needs within its area of operation and ways of me eting such needs,
220220 including data with respect to population and family groups and the
221221 distribution thereof according to income g roups, the amount and
222222 quality of available housing , and its distribution accor ding to
223223 rental and sale prices, employment, wages , and other factors
224224 affecting the local housing needs and the meeting thereof, and to
225225 make the results of such studies and analyses available to the
226226 public and the building, housing , and supply industries; a nd to
227227 engage in research and disseminate informati on on housing and slum
228228 clearance.
229229 (d) To utilize, contract with, act through, assist , and
230230 cooperate or deal with any person, agency, institution, or
231231 organization, public or private, for the provision of ser vices,
232232 privileges, works, or facilities for or in connection with its
233233 projects; and, notwithstanding anything to the contrary contained in
234234 this act Section 1051 et seq. of this title or in any other
235235 provision of law, to agree to any conditions attached to federal
236236 financial assistance relating to the deter mination of prevailing
237237 salaries or wages or payment of not less than prevailing salaries or

289289 wages or compliance with labor standards, in the development or
290290 administration of projects, and to include in any contract awarded
291291 or entered into in connection wit h a project stipulations requiring
292292 that the contractor and all subcontractors comply with requirements
293293 as to minimum salaries or wages and maximum hours of labor, and
294294 comply with any conditions attached to the financial aid of the
295295 project. Construction, r estitution, improvement, extension,
296296 alteration, or major repair of any project or any part thereof shall
297297 be open to competitive bidding: provided, however, nothing in th is
298298 section shall prevent a local hou sing authority from requesting
299299 proposals from property owners and/or developers to provide certain
300300 kinds of housing to the housing authority either presently existing
301301 or to be developed; provided, that the local authorit y establish
302302 safeguards relating to l aws and regulations of the United States
303303 wherein the same has entered into contracts with the authority to
304304 provide financial assistance in acquiring the same; provided,
305305 further, that no authority shall discriminate in it s seeking, or in
306306 the award, of any contract for services, acquisition of real or
307307 personal property, construction of buildings, dwelling unit s,
308308 streets, utilities, site grading, landscaping , and repairs to any of
309309 its holdings or upon property that the author ity plans to acquire,
310310 to include renovations, solely based on the race, sex, color,
311311 religious beliefs, or national origin of a person or fi rm; except an
312312 Indian authority may give preference in its awarding of a contract

364364 in all forms so long as the services to be performed, or the
365365 construction of buildings, dwellings, site improvements, rep airs, or
366366 renovation is to be performed or carried out on a federally
367367 recognized tribal reservation or former reservations and only then
368368 upon land held in trust by, or owned by, the respective Indian
369369 tribe; and provided, further, that all previously listed
370370 restrictions and regulations concerning public hearing s and
371371 locations of said the projects are complied with in their entirety.
372372 (e) To lease, rent, sell , or lease with option to purchase any
373373 dwelling, accommodations, lands, buildings, structures , or
374374 facilities embraced in any project and, subject to the limitatio ns
375375 contained in this act Section 1051 et seq. of this title with
376376 respect to the rental of or charges for dwellings in housing
377377 projects, to establish and revise the rents or charges therefor; to
378378 own, hold, and improve real or personal property; to purchase,
379379 lease, obtain options upon, acquir e by gift, grant, bequest, devise ,
380380 or otherwise any real or personal property or any interest therein;
381381 to acquire by the exercise of the power of eminent domain an y real
382382 property or interest therein; to sell, lease, exchange, transfer,
383383 assign, pledge, or dispose of any real or personal property or any
384384 interest therein,; provided, however, that before any such personal
385385 property shall be sold it shall be advertised fo r sale in a
386386 newspaper of general circulation within the jurisdiction of the
387387 authority, and such the advertisement shall state the time and place

439439 where written bids shall be received, or public auction shall be
440440 held, that such the property shall be sold to the highest bidder,
441441 and that the authority may, within its discretion, reject all bids
442442 and readvertise such the property for sale in the event any
443443 property, real or personal, acquired by the authority, by e minent
444444 domain or otherwise, is later found to be i n excess of its needs, or
445445 unsuitable or unuseable unusable for any reason, such the property
446446 shall, before being sold, leased, exchanged, transferred, assigned,
447447 pledged, or disposed of in any other manner, be first offered to
448448 those persons, individuals, groups, organizations, corporations,
449449 municipalities, or their successors from whom it was first procured
450450 by the authority, at the same price as paid by the authority at the
451451 time of acquiring same, and except that lands acquired by the
452452 authority may be sold to other governmental agencies for public
453453 purposes, as long as such the parcel of land does not exceed one
454454 percent (1%) of the total land held by the authority and the sale is
455455 made within ninety (90) days of the effective date of this act April
456456 25, 1969; to make loans for the provisions of housing for occupancy
457457 by persons of low income; to insure or provide for th e insurance of
458458 any real or personal property or operations of the authority against
459459 any risks or hazards; to procure or agree to the procurement of
460460 government insurance or guarantees of the payment of any bonds or
461461 parts thereof issued by the authority , including the power to pay
462462 premiums on any such insurance; provided, however, that

514514 notwithstanding any provisions in this law, the authority may
515515 develop programs for the sale of individual homes and/or two -family
516516 units to low income families or to families wh o have at one time
517517 qualified as low income families under this act Section 1051 et seq.
518518 of this title, under terms which the housing authority may establish
519519 under conditions acceptable to bo ndholders, other lenders , and the
520520 federal government.
521521 (f) To invest any funds held in reserves or sin king funds or any
522522 funds not required for immediate disbursemen t in property or
523523 securities in which public funds in the custody of a county
524524 treasurer or the State Treasurer of the State of Oklahoma may be
525525 legally invested; to redeem its bonds at the redemption pr ice
526526 established therein or to purchase its bonds at less than such
527527 redemption price, all bonds so redeemed or purchased to be
528528 cancelled.
529529 (g) Within its area of operation: to determine where slum areas
530530 exist or where there is unsafe, unsanitary , or overcrowded housing;
531531 to make studies and recommendations relati ng to the problem of
532532 clearing, replanning , and reconstruction of slum areas and the
533533 problem of eliminating unsafe, unsanitary , or overcrowded housing
534534 and providing dwelling accommodations for persons of low income; and
535535 to cooperate with the state or any st ate public body in action taken
536536 in connection with such those problems. Provided, however, the
537537 authority shall not have the power to relocate any persons to other

589589 areas until housing has been provide d for such those persons under
590590 this act Section 1051 et seq. of this title.
591591 (h) Acting through one or more commissioners or other persons
592592 designated by the authority: to conduct examinations and
593593 investigations and to hear testimony and take proof under oath at
594594 public hearings on any matter material for its information; to
595595 administer oaths, issue subpoenas req uiring the attendance of
596596 witnesses or the production of books and papers , and to issue
597597 commissions for the examination of witnesses who are outside of the
598598 state or unable to attend befo re the authority, or excused from
599599 attendance; to make available to appr opriate agencies, including
600600 those charged with the duty of abating or requiring the correction
601601 of nuisances or like conditions or of demolishing unsafe or
602602 unsanitary structures within i ts area of operation, its findings and
603603 recommendations with regard to a ny building or property where
604604 conditions exist which are dangerous to the public health, morals,
605605 safety, or welfare.
606606 (i) To exercise all or any part or combination of powers herein
607607 granted.
608608 The powers of an authority shall not include: (1) the power to
609609 appropriate funds of a city or county; (2) the power to levy taxes
610610 and assessments; (3) the power to zon e or rezone; or (4) the power
611611 to make exceptions to zoning ordinances or building r egulations of a
612612 city or county.

664664 No provision by law with respect to the acquisition, operation ,
665665 or disposition of property by other public bodies shall be
666666 applicable to an authority unless the Legislature shall specifically
667667 so state.
668668 SECTION 2. This act shall become effective November 1, 2022.
