7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 59 O.S. 2021, Section 519.6, is
7979 amended to read as follows:
8080 Section 519.6. A. No health care services may be performed by
8181 a physician assistant unless a current lic ense is on file with and
8282 approved by the State Boa rd of Medical Licensure and Supervision.
8383 All practice agreements and any amendments shall be filed with the
8484 State Board of Medical Licensure and Supervision within ten (10)
8585 business days of being executed. Practice agreements may be filed
8686 electronically. The State Board of Medical Licensure and
8787 Supervision shall not charge a fee for filing or amendments of
8888 practice agreements.

140140 B. A physician assistant may have practice agre ements with
141141 multiple allopathic or osteopathic physicians. Each physician shall
142142 be in good standing with the State Board of Medical Licensure and
143143 Supervision or the State Board of Osteo pathic Examiners.
144144 C. The delegating physician need not be physically present nor
145145 be specifically consulted before each delegated patient care service
146146 is performed by a physician assistant, so long as the delegating
147147 physician and physician assistant are or can be easily in contact
148148 with one another by means of telecommunicati on. In all patient care
149149 settings, the delegating physician shall provide appropr iate methods
150150 of participating in health care services provided by the physician
151151 assistant including:
152152 a. being responsible for the formulation or approval of
153153 all orders and protocols, whether standing orders ,
154154 direct orders or any other orders or protocols, which
155155 direct the delivery of health care services provided
156156 by a physician assistant, and periodically rev iewing
157157 such orders and protocols,
158158 b. regularly reviewing the health ca re services provided
159159 by the physician assistant and any problems or
160160 complications encountered,
161161 c. being available physically or through telemedici ne or
162162 direct telecommunications for cons ultation, assistance
163163 with medical emergencies or patient referral,

216216 Such reviews shall take place at a site agreed upon
217217 between the delegating physician and physic ian
218218 assistant in the practice agreement which may also
219219 occur using electronic or virtual conferencing, and
220220 e. that it remains clear that the physician assistant is
221221 an agent of the delegating physician; but, in no event
222222 shall the delegating physician be an employee of the
223223 physician assistant.
224224 D. In patients with newly diagnosed complex illnesses, the
225225 physician assistant shall contact the delega ting physician within
226226 forty-eight (48) hours of th e physician assistant’s initial
227227 examination or treatment and sche dule the patient for appropriate
228228 evaluation by the delegating physician as directed by the physician.
229229 The delegating physician shall determi ne which conditions qualify as
230230 complex illnesses based on the clinical setting and the skill and
231231 experience of the physician assistant.
232232 E. 1. A physician assistant under the direction of a
233233 delegating physician may prescribe written and oral prescriptions
234234 and orders. The physician assistant may prescrib e drugs, including
235235 controlled medications in Schedules II through V pursuant to Section
236236 2-312 of Title 63 of the Oklahoma Statutes , and medical supplies and
237237 services as delegated by the delegating physician and as approved by
238238 the State Board of Medical Lic ensure and Supervision after

290290 consultation with the State Board of Pharmacy on the Physician
291291 Assistant Drug Formulary; provided, however, the physician assistant
292292 shall not prescribe or write orders for Sche dule II opioid drugs
293293 except as provided by paragrap h 2 of this subsection .
294294 2. A physician assistant may write an or der for a Schedule II
295295 drug for immediate or ongoing administration on site ; provided, that
296296 if the Schedule II drug is an opioid drug, the physician assistant
297297 may only write an order for immediate or ongoing administration in
298298 an inpatient hospital setting. Prescriptions and orders for
299299 Schedule II drugs written by a physician assistant must be included
300300 on a written protocol determined by the delegating physician and
301301 approved by the medical staf f committee of the facility or by direct
302302 verbal order of the dele gating physician. Physician ass istants may
303303 not dispense drugs, but may request, receive, and sign for
304304 professional samples and may distribute professional samples to
305305 patients.
306306 F. A physician assistant may perform health care services in
307307 patient care settings as authorized by the delega ting physician.
308308 G. Each physician assistant licensed under the Physician
309309 Assistant Act shall keep his or her license available for inspection
310310 at the primary place of business and shall, when engaged in
311311 professional activiti es, identify himself or herself as a physician
312312 assistant.

364364 H. A physician assistant shall be bound by the prov isions
365365 contained in Sections 725.1 through 725.5 of Title 59 of the
366366 Oklahoma Statutes.
367367 SECTION 2. AMENDATORY 63 O.S. 2021, Section 2 -312, is
368368 amended to read as follows:
369369 Section 2-312. A. A physician, podiatrist, optometrist or a
370370 dentist who has comp lied with the registration requirem ents of the
371371 Uniform Controlled Dangerous Substances Act, in good faith and in
372372 the course of such person ’s professional practice only, may
373373 prescribe and administer controlled dangerous substances, or may
374374 cause the same to be administered by medical or param edical
375375 personnel acting under the direction and supervision of the
376376 physician, podiatrist, optometrist or dentist, and only may dispense
377377 controlled dangerous substances pursuant to the provisions of
378378 Sections 355, 355.1 and 355.2 of Title 59 of the Oklahoma Statutes.
379379 B. A veterinarian who has complied with the registration
380380 requirements of the Uniform Controlled Dangerous Substances Act, in
381381 good faith and in the course of the professional practice of the
382382 veterinarian only, a nd not for use by a human being, ma y prescribe,
383383 administer, and dispense controlled dangerous substances and may
384384 cause them to be administered by an assistant or orderly under the
385385 direction and supervision of the veterinarian.
386386 C. An advanced practice nurs e who is recognized to prescribe by
387387 the Oklahoma Board of Nu rsing as an advanced registered nurse

439439 practitioner, clinical nurse specialist or certified nurse -midwife,
440440 who is subject to medical direction by a supervising physician,
441441 pursuant to Section 567.3a of Title 59 of the Oklahoma Statut es, and
442442 who has complied with the registration requirements of the Uniform
443443 Controlled Dangerous Substances Act, in good faith and in the course
444444 of professional practice only, may prescribe and administer Schedule
445445 III, IV and V controlled dangerous substanc es.
446446 D. An advanced pract ice nurse who is recognized to order,
447447 select, obtain and administer drugs by the Oklahoma Board of Nursing
448448 as a certified registered nurse anesthetist pursuant to Section
449449 353.1b of Title 59 of the Oklahoma Statutes and who has comp lied
450450 with the registratio n requirements of the Uniform Controlled
451451 Dangerous Substances Act, in good faith and in the course of such
452452 practitioner’s professional practice only, may order, select, obtain
453453 and administer Sched ules II through V controlled danger ous
454454 substances in a prean esthetic preparation or evaluation; anesthesia
455455 induction, maintenance or emergence; or postanesthesia care setting
456456 only. A certified registered nurse anesthetist may order, select,
457457 obtain and administer such drugs only during the perioperative or
458458 periobstetrical period.
459459 E. A physician assistant who is recognized to prescribe by the
460460 State Board of Medical Licensure and Supervision under the medical
461461 direction of a supervising physician, pursuant to subsection D of
462462 Section 519.6 of Title 59 of the Oklahoma S tatutes, and who has
