73	73	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
74	74	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -1939, is
75	75	amended to read as follows:
76	76	Section 1-1939. A. The owner and licensee are may be liable to
77	77	a resident for any intentional or negligent act or omission of their
78	78	agents or employees which injures the resident if the act or
79	79	omission occurs within t he scope of the employment or agency . In
80	80	addition, any state employee that aids, abets, assists, or conspires
81	81	with an owner or licensee to perform an act that causes injury to a
82	82	resident shall be individually liable.
83	83	B. A resident may maintain an action under the Nursing Home
84	84	Care Act for any other type of relief, including injunctive and
85	85	declaratory relief, permitted by law.

137	137	C. Any damages recoverable under this section , including
138	138	minimum damages as provided by this section, may be recovered in any
139	139	action which a court may authorize to be brought as a c lass action.
140	140	The remedies provided in this section, are in addition to and
141	141	cumulative with any other legal remedies available to a resident.
142	142	Exhaustion of any available administrative remedies shall not be
143	143	required prior to commencement of suit hereunder.
144	144	D. Any waiver by a resident or the legal representative of the
145	145	resident of the right to commence an action under this sectio n,
146	146	whether oral or in writing, shall be null and void, and without
147	147	legal force or effect.
148	148	E. Any party to an action brought under this section shall be
149	149	entitled to a trial by jury and any waiver of the right to a trial
150	150	by a jury, whether oral or in writin g, prior to the commencement of
151	151	an action, shall be null and void, and without l egal force or
152	152	effect.
153	153	F. A licensee or its agents or employees shall not transfer,
154	154	discharge, evict, harass, dismiss or retaliate against a resident, a
155	155	resident’s guardian or an employee or agent who makes a report,
156	156	brings, or testifies in, an action unde r this section, or files a
157	157	complaint because of a r eport, testimony or complaint.
158	158	G. Any person, institution , or agency, under the Nursing Home
159	159	Care Act, participating in good faith in the making of a report, or
160	160	in the investigation of such a report shall not be deemed to have

212	212	violated any privileged comm unication and shall have immunity from
213	213	any liability, civil or criminal, or any other proceedings, civil or
214	214	criminal, as a consequence of making such report. The good faith of
215	215	any persons required , or permitted to report cases of suspected
216	216	resident abuse or neglect under this act shall be presumed.
217	217	H. A facility employee or agent who becomes aware of abuse,
218	218	neglect or exploitat ion of a resident prohibited by the Nursing Home
219	219	Care Act shall immediately rep ort the matter to the facility
220	220	administrator. A fa cility administrator who becomes aware of abuse,
221	221	neglect, or exploitation of a resident shall immediately act to
222	222	rectify the problem and shall make a report of the incident and its
223	223	correction to the Depart ment.
224	224	I. 1. The facility shall be responsible for reporting the
225	225	following serious incidents to the Department within twenty -four
226	226	(24) hours:
227	227	a. communicable diseases,
228	228	b. deaths by unusual occurrence , including accidental
229	229	deaths or deaths other than by na tural causes, and
230	230	deaths that may be attributed to a medical device,
231	231	c. missing residents. In addition, the facility shall
232	232	make a report to local law enforcement agencies withi n
233	233	two (2) hours if the resident is still missing,
234	234	d. situations arising where a rape or a criminal act is
235	235	suspected. Such situati ons shall also be reported to

288	288	make every effort to preserve the scene o f the
289	289	suspected rape or crime until local law enforcement
290	290	has arrived, and
291	291	e. resident abuse, neglect, and misappropriation of the
292	292	property of a resident.
293	293	2. All other incident reports shall be made in accordance with
294	294	federal law.
295	295	3. All initial written r eports of incidents or situations shall
296	296	be mailed to the Department within fiv e (5) working days after the
297	297	incident or situation. The final report shall be filed with the
298	298	Department when the full investigation is complete.
299	299	SECTION 2. This act shall become effective November 1, 2022.
