7373 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7474 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -1939, is
7575 amended to read as follows:
7676 Section 1-1939. A. The owner and licensee are may be liable to
7777 a resident for any intentional or negligent act or omission of their
7878 agents or employees which injures the resident if the act or
7979 omission occurs within t he scope of the employment or agency . In
8080 addition, any state employee that aids, abets, assists, or conspires
8181 with an owner or licensee to perform an act that causes injury to a
8282 resident shall be individually liable.
8383 B. A resident may maintain an action under the Nursing Home
8484 Care Act for any other type of relief, including injunctive and
8585 declaratory relief, permitted by law.

137137 C. Any damages recoverable under this section , including
138138 minimum damages as provided by this section, may be recovered in any
139139 action which a court may authorize to be brought as a c lass action.
140140 The remedies provided in this section, are in addition to and
141141 cumulative with any other legal remedies available to a resident.
142142 Exhaustion of any available administrative remedies shall not be
143143 required prior to commencement of suit hereunder.
144144 D. Any waiver by a resident or the legal representative of the
145145 resident of the right to commence an action under this sectio n,
146146 whether oral or in writing, shall be null and void, and without
147147 legal force or effect.
148148 E. Any party to an action brought under this section shall be
149149 entitled to a trial by jury and any waiver of the right to a trial
150150 by a jury, whether oral or in writin g, prior to the commencement of
151151 an action, shall be null and void, and without l egal force or
152152 effect.
153153 F. A licensee or its agents or employees shall not transfer,
154154 discharge, evict, harass, dismiss or retaliate against a resident, a
155155 resident’s guardian or an employee or agent who makes a report,
156156 brings, or testifies in, an action unde r this section, or files a
157157 complaint because of a r eport, testimony or complaint.
158158 G. Any person, institution , or agency, under the Nursing Home
159159 Care Act, participating in good faith in the making of a report, or
160160 in the investigation of such a report shall not be deemed to have

212212 violated any privileged comm unication and shall have immunity from
213213 any liability, civil or criminal, or any other proceedings, civil or
214214 criminal, as a consequence of making such report. The good faith of
215215 any persons required , or permitted to report cases of suspected
216216 resident abuse or neglect under this act shall be presumed.
217217 H. A facility employee or agent who becomes aware of abuse,
218218 neglect or exploitat ion of a resident prohibited by the Nursing Home
219219 Care Act shall immediately rep ort the matter to the facility
220220 administrator. A fa cility administrator who becomes aware of abuse,
221221 neglect, or exploitation of a resident shall immediately act to
222222 rectify the problem and shall make a report of the incident and its
223223 correction to the Depart ment.
224224 I. 1. The facility shall be responsible for reporting the
225225 following serious incidents to the Department within twenty -four
226226 (24) hours:
227227 a. communicable diseases,
228228 b. deaths by unusual occurrence , including accidental
229229 deaths or deaths other than by na tural causes, and
230230 deaths that may be attributed to a medical device,
231231 c. missing residents. In addition, the facility shall
232232 make a report to local law enforcement agencies withi n
233233 two (2) hours if the resident is still missing,
234234 d. situations arising where a rape or a criminal act is
235235 suspected. Such situati ons shall also be reported to

287287 local law enforcement immediately. The facility shall
288288 make every effort to preserve the scene o f the
289289 suspected rape or crime until local law enforcement
290290 has arrived, and
291291 e. resident abuse, neglect, and misappropriation of the
292292 property of a resident.
293293 2. All other incident reports shall be made in accordance with
294294 federal law.
295295 3. All initial written r eports of incidents or situations shall
296296 be mailed to the Department within fiv e (5) working days after the
297297 incident or situation. The final report shall be filed with the
298298 Department when the full investigation is complete.
299299 SECTION 2. This act shall become effective November 1, 2022.
