81	81	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
82	82	SECTION 1. AMENDATORY 60 O.S. 2021, Section 121, is
83	83	amended to read as follows:
84	84	Section 121. No alien or any person who is not a citizen of the
85	85	United States shall a cquire title to or own land in the State of
86	86	Oklahoma this state either directly or indir ectly through a business
87	87	entity or trust, except as hereinafter provided, but he or she shall
88	88	have and enjoy in the State of Oklahoma this state such rights as to
89	89	personal property as are, or shall be accor ded a citizen of the
90	90	United States under the laws of the nation to which such alien

142	142	belongs, or by the treaties of such nation with the United States,
143	143	except as the same may be affected by the provisions of this act
144	144	Section 121 et seq. of this title or the Constitution of this state.
145	145	Prior to closing of a sale of or transfer of title to land, a
146	146	closing company shall obtain from an y person whose name will appear
147	147	on the legal title to the land or any person authorized to enter
148	148	into a contract for the land on behalf of a lawfully recognized
149	149	business entity an affidavit attesting under penalty of perjury that
150	150	the person or business entity is obtaining the land in compliance
151	151	with the requirements of this articl e and that no funding source is
152	152	being used in the sale or transfer in violation of this section or
153	153	any other state or federal law. Pursuant to authority granted in
154	154	Section 858-208 of Title 59 of the Oklahoma Statu tes, the Oklahoma
155	155	Real Estate Commission shall promulgate an affidavit form to comply
156	156	with the requirements of this section.
157	157	SECTION 2. AMENDATORY 60 O.S. 2021, Section 122, is
158	158	amended to read as follows:
159	159	Section 122. This article shall not ap ply to lands now owned in
160	160	this state by aliens so long as they are held by the pr esent owners,
161	161	nor to any alien who is or shall take up bona fide residence in this
162	162	state: and; provided, that any alien who is or shall becom e a bona
163	163	fide resident of the State of Oklahoma, or any lawfully recognized
164	164	business entity, the majority of the vo ting stock or equivalent
165	165	controlling equity in terest of which is owned by one or more

217	217	resident aliens, shall have the right to acquire and ho ld lands in
218	218	this state upon the sa me terms as citizens of the State of Oklahoma
219	219	during the continuance of such bona fide residence of such alien in
220	220	this state: Provided, that if any such resident alien shall cease
221	221	to be a bona fide inhabitant of this stat e, such alien shall have
222	222	five (5) years from the time he or she ceased to be such bona fide
223	223	resident in which to alienate such lands.
224	224	SECTION 3. AMENDATORY 60 O.S. 2021, Section 125, is
225	225	amended to read as follows:
226	226	Section 125. It shall be the duty of t he Attorney General or
227	227	the district attorney of the county where the land is situate, when
228	228	he shall be informed or have reason to believe that any lands in the
229	229	state are being held contrary to the provisions of this act, or the
230	230	provisions of the Constituti on of this state, to institute suit in
231	231	behalf of the State of Oklahoma in the district court of the county
232	232	in which said lands are situate, pr aying for the escheat of the same
233	233	in behalf of the state, and proceed therein as in cases provided by
234	234	law for escheats of lands or property where such property has no
235	235	known owner: Provided, that before any such suit is instituted, the
236	236	Attorney General, or district attorney aforesaid, as the case may
237	237	be, shall give thirty (30) days ’ notice by registered letter of his
238	238	intention to sue, directed to the owner of the lands, at his last -
239	239	known post office address o r to the persons who last rendered the
240	240	same for taxes, or to any known agents of the owner; proof of having
