AS INTRODUCED 
 
An Act relating to crime and punishment; a mending 21 
O.S. 2021, Sections 1198 and 1217, which relate to 
interference with performance of firemen duties; 
modifying misdemeanor offense; providing penalty; 
modifying felony offense; and providing an effective 
date. 
 
 
 
 
BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: 
SECTION 1.     AMENDATORY     21 O.S. 20 21, Section 1198, is 
amended to read as follows: 
Section 1198. Every A person who, at any burning of a building, 
is guilty of any disobedience to disobeys a lawful orders order of 
any public a peace officer or fireman, or of any resistance to or 
interference during the performance of th eir duties or interferes 
with the lawful efforts of any fireman or company of firemen to 
extinguish the same, or of any engages in disorderly conduct 
calculated to prevent the s ame from being extinguished, or who 
forbids, prevents or dissuades others from assisting to extinguish 
the same, is guilty of a mi sdemeanor punishable by imprisonment in

the county jail for a term not to exceed six (6) months, or by a 
fine not to exceed F ive Hundred Dollars ($500.00), or by both . 
SECTION 2.     AMENDATORY     21 O.S. 20 21, Section 1217, is 
amended to read as follow s: 
Section 1217. Any person or persons acting in concert with each 
other who knowingly, and willfully interfere with, molest, or 
assault and with intent to do bodily harm, commits any assault, 
battery or assault and battery, aggravated assault and battery or 
any assault with a firearm or other deadly weapon upon a firemen in 
the performance of their duties, or wh o knowingly and willfully 
obstruct, interfere with or impede the progress of firemen to reach 
the destination of a fire, upon conviction, shall be deemed guilty 
of a felony and shall be punished therefor by imprisonment in the 
State Penitentiary custody of the Department of Corrections for a 
term not exceeding ten (10) years nor less tha n two (2) years. 
SECTION 3.  This act shall become effective November 1, 2022.
