56109 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

58110 SECTION 1. NEW LAW A new section of law to be codified
59111 in the Oklahoma Statutes as Section 1703 of Title 47, unless there
60112 is created a duplication in numbering, reads as follows:

62113 A. A person, as defined in Section 1701 of Title 47 of the
63114 Oklahoma Statutes, may operate a fully autonomous vehicle on the
64115 public roads of this state without a hum an driver provided that the
65116 automated driving system is engaged and the ve hicle meets the
66117 following conditions:

68118 1. If a failure of the automated driving syst em occurs that
69119 renders that system unable to perform the entire dynamic driving
70120 task relevant to its intended operational design domain, the fully
71121 autonomous vehicle will achieve a minimal risk condition;
72-
73122 2. The fully autonomous vehicle is capable of oper ating in
74123 compliance with the applicable traffic and motor vehicle safety laws
75124 and regulations of this state, unless an exemption has been granted
76125 by the Department of Public Safety or its designee; and
77-
78126 3. When required by federal law, the vehicle bears the required
79127 manufacturer’s certification label indicating that at the t ime of
80128 its manufacture it has been certified to be in compliance with all
81129 applicable Federal Motor Vehicle Saf ety Standards including

85159 B. Prior to operating a fully autonomous vehicle on the public
86160 roads of this state without a human driv er, a person shall submit to
87161 the Department of Public Safety a law enforcement interaction plan
88162 that contains, but shall not be limited to, information that
89163 describes:

93164 1. How to communicate with a fleet support specialist who is
94165 available during the time s the vehicle is in operation;

96166 2. How to safely remove the fully a utonomous vehicle from the
97167 roadway;

99168 3. How to recognize whether the fully autonomous vehicle is in
100169 autonomous mode and steps to safely tow the vehicle; and

102170 4. Any additional informatio n the manufacturer or owner deems
103171 necessary regarding the hazardous co nditions or public safety risks
104172 associated with the operat ion of the fully autonomous vehicle.

106173 C. The Department is authorized to promulgate rules regarding
107174 the contents of the law enfor cement interaction plan described in
108175 subsection B of this section.

117209 Safety that the fully autonomous vehicle is c overed by insurance or
118210 proof of self-insurance of at least One Million Dollars
119211 ($1,000,000.00) which shall satisfy the requirements of the
120212 Compulsory Insurance Law pursuant to Section 7-600 et seq. of Title
121213 47 of the Oklahoma Statutes.

130219 the accident when required by Section 10-107 or 10-108 of Title 47

149260 provision of the Oklahoma Transportation Network Company Services
150261 Act pursuant to Section 1010 et seq. of Title 47 of the Oklahoma
151262 Statutes that reasonably applies only to a human driver would not
152263 apply to the operation of a fully autonomous vehicle with the
153264 automated driving system engaged on an on -demand autonomous vehicle

156266 SECTION 5. NEW LAW A ne w section of law to be codified
157267 in the Oklahoma Stat utes as Section 1707 of Title 47, unless there
158268 is created a duplication in n umbering, reads as follows:

160269 A. A fully autonomous vehi cle shall be properly registered in
161270 accordance with the Oklahoma Vehicle L icense and Registration Act
162271 pursuant to Section 1 101 et seq. of Title 47 of the Oklahoma
163272 Statutes. If a fully autonomous vehicle is registered in this
164273 state, the vehicle shall be identifi ed on the registration as a
165274 fully autonomous vehicle.

167275 B. A fully autonomous vehicle shall be properly titled in
168276 accordance with the Oklahoma Vehicle License and Registration Act.
169277 If a fully autonomous vehicle is titled in this state, the vehicle
170278 shall be identified on the title as a fully autonomous vehicle.

178309 A. A person may operate a motor vehicle equipped with an
179310 automated driving system capable of performing the entire dynamic
180311 driving task if:

182312 1. Such automated driving system will issue a request to
183313 intervene whenever the automated driving system is not capable of
184314 performing the entire dynamic driving task with the e xpectation that
185315 the person will respond appropriately to such a request; and

187316 2. The automated driving sy stem is capable of being oper ated in
188317 compliance with Sections 11 -101 through 11-1404 of Title 47 of the
189318 Oklahoma Statutes unless an exemption has be en granted by the
190319 Department of Public Safety.

192320 B. Nothing in this act prohibits or restricts a human driver
193321 from operating a fully autonomous vehicle equipped with controls
194322 that allow for the human driver to control all or part of the
195323 dynamic driving task .

197324 SECTION 7. NEW LAW A new section of law to be c odified
198325 in the Oklahoma Statutes as Section 1709 of Title 47, unless there

201327 A fully autonomous vehicle that is also a commerci al motor
202328 vehicle pursuant to Sections 161A through 230.34b of Title 47 of the
203329 Oklahoma Statutes may operate pursuant to state laws governing th e

214365 exclusively by the automated drivin g system for all trips is not
215366 subject to motor vehicle equipment laws or regulations of this stat e

219369 driver seated in the vehicle; and

226372 in the Oklahoma Statutes as Section 1711 of Title 47, unless there

229374 Unless otherwise provided in this title and notwithstanding any
230375 other provision of law, fully auto nomous vehicles and automated
231376 driving systems are governed exclusively by this act. The
232377 Department of Public Safety and the Department of Transportation a re
233378 authorized to promulgate administrative rules to implement the
234379 provisions of this act.

236380 SECTION 10. AMENDATORY 47 O.S. 2021, Section 6-102, is

239409 Section 6-102. A. A nonresident who is sixteen (16) years of
240410 age or older may operate a motor vehicle in this state as authorized
241411 by the class, restriction s, and endorsements specified on the
242412 license, if the nonresident is:

244413 1. Properly licensed in the home state or country to oper ate a
245414 commercial or noncommercial motor vehicle an d who has immediate
246415 possession of a valid driver license issued by the home sta te or
247416 country; or

249417 2. A member of the Armed Forces of the United States or the
250418 spouse or dependent of such member who has been issued and is in
251419 possession of a valid driver license issued by an overseas component
252420 of the Armed Forces of the United States.

254421 B. A resident who is at least fifteen (15) years of age may
255422 operate a vehicle in this state without a driver license, if the
256423 resident is:

258424 1. Operating a vehicle pursuant to sub section B of Section 6-
259425 105 of this title; or

261426 2. Taking the driving skills exam ination as required by Section
262427 6-110 of this title, when accompanied by a D river License Examiner

268430 C. Any person, while in the performance of official duties, may
269431 operate any class of motor vehicle if the person possesses any class

270459 of valid Oklahoma driver license or a valid dr iver license issued by
271460 another state, if the person is:

273461 1. A member of the Armed Forces of the United States who is on
274462 active duty;

276463 2. A member of the military reserves, not including United
277464 States reserve technician technicians;

279465 3. A member of the National Guard w ho is on active duty ,
280466 including National Guard military technicians;

282467 4. A member of the National Guard who is on part -time National
283468 Guard training, including National Guard military technicians; or

285469 5. A member of the United States Coast Guard who is on a ctive
286470 duty.

288471 D. The Commissioner of Public Safety is hereby authorized to
289472 adopt rules as may be necessary to enter into reciproci ty agreements
290473 with foreign countries. The rules shall specify that the dri ver
291474 license standards of the foreign country shall b e comparable to
292475 those of this state. The rules shall also require foreign drivers,
293476 who are operating a motor vehicle in Oklahoma under such a
294477 reciprocity agreement, t o comply with the compulsory motor vehicle
295478 liability insurance and financial responsibili ty laws of this stat e.

297479 E. When an automated driving system, as defined by Section 1701
298480 of this title, installed on a motor vehic le is engaged, the
299481 following shall apply:

303511 traffic or motor vehicle laws, and shall be deemed to satisfy

312516 SECTION 11. AMENDATORY 47 O.S. 2021, Section 1701, is

317519 A. “Driving automation system” “Automated driving system or
318520 ADS” means hardware and software that are collectively capable of
319521 performing part or the entire dynamic task on a sustained basis,
320522 regardless of whether it is li mited to a specific operational design
321523 domain. The term driving automation system is used generally to
322524 describe any system capable of le vel 1-5 driving automation, as
323525 specified in SAE International Recommended Practice J3016 including,
324526 but not limited to, core vehicle functions as listed in this
325527 section.

327528 B. “Dynamic driving task” or “DDT” means all of the real -time
328529 operational and tactical functions required to operate a vehicle in
329530 on-road traffic, excluding the strategic functions such as trip
330531 scheduling and selection of destinations and waypoints and inclu ding

356574 D. “Fully autonomous vehicle” means a motor vehicle equipped

360577 E. “Human driver” means a natural person in the vehicle with a
361578 valid license to operate a motor vehicle who controls all or part of
362579 the dynamic driving task.

364580 F. “Minimal risk condition” means a condition to which a
365581 person, human driver, or an ADS may bring a vehicle after performing
366582 the DDT fallback in order to reduce the risk of a crash when a given
367583 trip cannot or should not be completed.

369611 G. “On-demand autonomous vehicle network” means a
370612 transportation service network that uses a software application or
371613 other digital means to dispatch or otherwise enable the
372614 prearrangement of transportation with fully autonomous vehicles for
373615 purposes of transporting passengers or goods including for-hire
374616 transportation and transportation of passengers or goods for
375617 compensation.

377618 H. “Operational design doma in” or “ODD” means operating
378619 conditions under which a gi ven automated driving system is
379620 specifically designed to function including, but not limited to,
380621 environmental, geographical, and time-of-day restrictions, and the
381622 requisite presence or absence of cer tain traffic or roadway
382623 characteristics.

384624 I. “Person” means a natural person, corporation, business
385625 trust, estate, trust, partnershi p, limited liability company,
386626 association, joint venture, governmental agency, public corporation,
387627 or any other legal or com mercial entity.

389628 J. “Request to intervene ” means notification by an automated
390629 driving system to a human driver that the human drive r should
391630 promptly begin or resume performance of part or all of the dynamic
392631 driving task.

400662 SECTION 12. AMENDATORY 47 O.S. 2021, Section 1702, is

403664 Section 1702. A. Only the State of Oklahoma may enact a law or
404665 take any other action to regulate the operation of motor vehicles
405666 equipped with driving automation automated driving systems in
406667 Oklahoma.

408668 B. Pursuant to subsection A of this section, the State of

411670 1. Preempts the authority of a county or municipal ity to
412671 prohibit, restrict or regulate the operation of motor vehicles
413672 equipped with driving automation automated driving systems on the
414673 basis of those vehicles being equipped with driving automation
415674 automated driving systems; and

417675 2. Supersedes any existin g law or ordinance of a county or
418676 municipality that prohibits, restricts or regulates the testing or
419677 operation of motor vehicles equipped with driving automation
420678 automated driving systems.

422679 SECTION 13. This act shall become effective November 1, 2022.
