60 | 55 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -730, is |

63 | 58 | | 1. “Abortion” means the use or prescription of any instrument, |
---|

108 | 102 | | 4. “Unborn child” or “unborn person” means the unborn offspring |

157 | 150 | | SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -732, is |

208 | 200 | | abortion is necessary to prevent the death of the pregnant woman or |

209 | 201 | | to prevent an impairment to her health. The physician shall further |

213 | 205 | | D. C. The physician who shall perform or induce an abortion |

255 | 246 | | the performance or inducing of the abortion, the physician |

256 | 247 | | performing it, and subsequent to it, the physician required by this |

257 | 248 | | section to be in attendance, shall ta ke all reasonable steps in |
---|
258 | 249 | | keeping with good medical practice, consistent with the procedure |
---|
259 | 250 | | used, to preserve the life and health of the child, in the same |
---|
260 | 251 | | manner as if the child had been born naturally or spontaneously. |
---|
261 | 252 | | The requirement of the attendance of a second physician may be |
---|
262 | 253 | | waived when in the best judgment of the attending physician a |
---|
263 | 254 | | medical emergency exists and further delay would result in a serious |
---|
264 | 255 | | threat to the life or physical health of the pregnant woman. |
---|
265 | 256 | | Provided that, under such emergen cy circumstances and waiver, the |
---|
266 | 257 | | attending physician shall have the duty to take all reasonable steps |
---|
267 | 258 | | to preserve the life and health of the child before, during and |
---|
268 | 259 | | after the abortion procedure, unless such steps shall, in the best |
---|
269 | 260 | | medical judgment of the physician, present a significantly great er |
---|
270 | 261 | | danger to the life or health of the pregnant woman. |

313 | 303 | | measures to preserve the life of a child who is alive when partially |

314 | 304 | | or totally removed from the ute rus of the pregnant woman, so long as |

315 | 305 | | the measures do not create any signif icant danger to her life or |
---|

409 | 397 | | through use of clamps, grasping forceps, tongs, scissors or similar |

410 | 398 | | instruments that, through the convergence of two rigid levers, |
---|
411 | 399 | | slice, crush, and/or grasp a portion of the unborn child’s body to |
---|
412 | 400 | | cut or rip it off. This definition does not include an abortion |
---|
413 | 401 | | which uses suction to dismember the body of the deve loping unborn |
---|
414 | 402 | | child by sucking fetal parts into a collection container; |
---|
415 | 403 | | 4. “Physician” means a person licensed to p ractice medicine and |
---|
416 | 404 | | surgery or osteopathic medicine and surgery, or otherwise legally |
---|
417 | 405 | | authorized to perform an abortion; |
---|
418 | 406 | | 5. “Purposely” means the following: A person acts purposely |
---|

461 | 448 | | such condition may be determined to exist if it is based on a claim |
---|
462 | 449 | | or diagnosis that the woman will engage in conduct which she intends |

463 | 450 | | to result in her death or in substantial and irrev ersible physical |

464 | 451 | | impairment of a major bodily function; and |

465 | 452 | | 7. “Woman” means a female human being whether or not sh e has |

515 | 501 | | Oklahoma and as a 501(c)3 entity under the federal |

516 | 502 | | Internal Revenue Code, and |
---|
517 | 503 | | b. does not encourage or counsel any woman to have an |
---|
518 | 504 | | abortion not necessary to prevent her death, to |
---|
519 | 505 | | provide her such an abortion or to r efer her for such |
---|
520 | 506 | | an abortion, and does not accept funds or services |
---|
521 | 507 | | knowingly from any entity which performs abortions or |
---|

967 | 944 | | H. 1. Any person upon whom an abortion has been performed |

968 | 945 | | without this section having been complied with, the father of the |
---|
969 | 946 | | unborn child who was the subject of such an abortion, or, if the |
---|
970 | 947 | | female had not attained the age of eighteen (18) years at the time |
---|
971 | 948 | | of the medication abortion or has died as a result of the medication |
---|
972 | 949 | | abortion, the grandparent of such an unborn child may maintain an |
---|
973 | 950 | | action against the person who provided the medication abortion in |

974 | 951 | | knowing or reckless vi olation of this section for actual and |

1065 | 1040 | | clause, phrase or word o f this act Section 1-751 et seq. of this |

1066 | 1041 | | title or the application thereof to any per son or circumstance is |
---|
1067 | 1042 | | found to be unconstitutional , the same is hereby declar ed to be |
---|
1068 | 1043 | | severable and the ba lance of this act Section 1-751 et seq. of this |

1069 | 1044 | | title shall remain effective notwithstan ding such |
---|
1070 | 1045 | | unconstitutionality. The Legislature h ereby declares that it would |

1071 | 1046 | | have passed this act Section 1-751 et seq. of this title , and each |

1072 | 1047 | | provision, section, subsection, sentenc e, clause, phrase or word |

1073 | 1048 | | thereof, irrespective of the f act that any one or more provision, |

---|
1076 | 1051 | | SECTION 8. This act shall become effective November 1, 2022. |
