5954 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6055 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -730, is
6156 amended to read as follows:
6257 Section 1-730. A. As used in this article:
6358 1. “Abortion” means the use or prescription of any instrument,
6459 medicine, drug, or any other substance or device intentionally to
6560 terminate the pregnancy of a female kn own to be pregnant wi th an
6661 intention other than to increase the probabilit y of a live birth, to
6762 preserve the life or health of the child after live birth, to remove
63+an ectopic pregnancy, or to remove a dead unborn child who died as

95-an ectopic pregnancy, or to remove a dead unborn child who died as
9690 the result of a spontane ous miscarriage, acci dental trauma, or a
9791 criminal assault on the pregnant female or her unborn child;
9892 2. “Attempt to perform an abortion ” means an act, or an
9993 omission of a statutorily required act, that under the circu mstances
10094 as the actor believes them t o be constitutes a su bstantial step in a
10195 course of conduct planned to culm inate in the performance of an
10296 abortion;
10397 3. “Certified technician ” means a Registered Diagnostic Medical
10498 Sonographer who is certified in obstetr ics and gynecology by the
10599 American Registry for Diagnostic Medical Sonography (ARDMS) or a
106100 Nurse Midwife or Adv ance Practice Nurse Practitioner in Obstetrics
107101 with certification in obstetrical ultrasonography;
108102 4. “Unborn child” or “unborn person” means the unborn offspring
109103 of human beings from the moment of conce ption, through pregnancy,
110104 and until live birth includ ing the human conceptus, zygote, morula,
111105 blastocyst, embryo and fetus;
112106 5. “Unemancipated minor” means any person less than eighteen
113107 (18) years of age who is not or has not been marr ied or who is under
114108 the care, custody, and control of the person’s parent or parents,
115109 guardian, or juvenile court of competent jurisdiction;
116110 6. “Viable” means potentially able to live outside of the womb
117111 of the mother upon premature birth, whether resulti ng from natural
118112 causes or an abortion;

146139 7. “Conception” means the fertilization of the ovum of a female
147140 individual by the sperm of a male individual;
148141 8. 7. “Health” means physical or mental health;
149142 9. 8. “Department” means the State Department of Health; and
150143 10. 9. “Inducing an abortion” means the administration by any
151144 person, including the pregnant woman, of any substance designed or
152145 intended to cause an expulsion of the unborn child, effecting an
153146 abortion as defined above.
154147 B. Nothing contained herein shall be construed in any manner to
155148 include any contraceptive device or medication or sterilization
156149 procedure.
157150 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1 -732, is
158151 amended to read as follows:
159152 Section 1-732. A. No person shall perform o r induce an
160153 abortion upon a pregnant woman after such time as her unborn child
161154 has become viable if more than thirty ( 30) days have elapsed since
162155 the probable beginning of the last menstrual period of the pregna nt
163156 woman, based upon either information provi ded by her or by an
164157 examination by her attending physician, unless such abortion is
165158 necessary to prevent the death of the pregnant w oman or to prevent
166159 impairment to her heal th.
167160 B. An unborn child shall be presu med to be viable if more than
168161 twenty-four (24) weeks have elapsed since the probable beginning of
169162 the last menstrual period of the pregnant woman, based upon either

198190 physician. If it is the judgment of the attending physician that a
199191 particular unborn child is not viable where the presumption of
200192 viability exists as to that particular unborn child, then he shall
201193 certify in writing the precise medical criter ia upon which he has
202194 determined that the particular unborn child is not viable befo re an
203195 abortion may be performed or induced.
204196 C. No abortion of a viable an unborn child after the time
205197 period specified by subsection A of this section shall be performed
206198 or induced except after writ ten certification by the attending
207199 physician that in his the best medical judgment of the physician the
208200 abortion is necessary to prevent the death of the pregnant woman or
209201 to prevent an impairment to her health. The physician shall further
210202 certify in writing the medi cal indications for such abortion and the
211203 probable health consequences if the abortion is not performed or
212204 induced.
213205 D. C. The physician who shall perform or induce an abortion
214206 upon a pregnant woman after such time as her unborn child has become
215207 viable the time period specified by subsection A of thi s section
216208 shall utilize the available method or technique of abort ion most
217209 likely to preserve the life and health of the unborn child, unless
218210 he shall first certify the physician first certifies in writing that
219211 in his the best medical judgment of the physician such method or
220212 technique shall present presents a significantly greater danger t o

249240 method or technique.
250241 E. D. An abortion of a viable an unborn child after the time
251242 period specified by subsection A of this section shall be performed
252243 or induced only when there is in attendance a physician other than
253244 the physician performing or inducing the a bortion who shall take
254245 control of and provide immediate medical care for the child. During
255246 the performance or inducing of the abortion, the physician
256247 performing it, and subsequent to it, the physician required by this
257248 section to be in attendance, shall ta ke all reasonable steps in
258249 keeping with good medical practice, consistent with the procedure
259250 used, to preserve the life and health of the child, in the same
260251 manner as if the child had been born naturally or spontaneously.
261252 The requirement of the attendance of a second physician may be
262253 waived when in the best judgment of the attending physician a
263254 medical emergency exists and further delay would result in a serious
264255 threat to the life or physical health of the pregnant woman.
265256 Provided that, under such emergen cy circumstances and waiver, the
266257 attending physician shall have the duty to take all reasonable steps
267258 to preserve the life and health of the child before, during and
268259 after the abortion procedure, unless such steps shall, in the best
269260 medical judgment of the physician, present a significantly great er
270261 danger to the life or health of the pregnant woman.

298288 F. E. Any person violating subsection A of this section shall
299289 be guilty of homicide.
300290 SECTION 3. AMENDATORY 63 O.S. 2 021, Section 1-734, is
301291 amended to read as follows:
302292 Section 1-734. A. No person shall purposely take the life of a
303293 child born as a result of an abortion or attempted abortion which is
304294 alive when partially or totally removed from the uterus of the
305295 pregnant woman.
306296 B. No After the time period specified by subsection A of
307297 Section 1-732 of this title, no person shall purposely take the l ife
308298 of a viable child who is alive while inside the uterus of the
309299 pregnant woman and may be removed alive therefrom without creating
310300 any significant danger to her life or healt h.
311301 C. Any person who performs, induces, or part icipates in the
312302 performance or inducing of an abortion shall take all reasonable
313303 measures to preserve the life of a child who is alive when partially
314304 or totally removed from the ute rus of the pregnant woman, so long as
315305 the measures do not create any signif icant danger to her life or
316306 health.
317307 D. Any person violating this section shall be guilty of
318308 homicide.

348337 Section 1-737.8. For the purposes of the Oklahoma Unborn Child
349338 Protection from Dismemberment Abortion Act:
350339 1. “Abortion” means the use or prescription of any instrument,
351340 medicine, drug, or any other subst ance or device:
352341 a. to purposely kill the unborn child of a woman kn own to
353342 be pregnant, or
354343 b. to purposely terminate the pregn ancy of a woman known
355344 to be pregnant, with a purpose other than:
356345 (1) after viability the time period specified by
357346 subsection A of Section 1-732 of this title, to
358347 produce a live birth and preserve th e life and
359348 health of the child born alive, or
360349 (2) to remove a dead unborn child;
361350 2. “Attempt to perform an abortion ” means to do or omit to do
362351 anything that, under the circumstances as the actor believes them to
363352 be, is an act or omission constituting a su bstantial step in a
364353 course of conduct planned t o culminate in the actor performing an
365354 abortion. Such substantial steps include, but are not limited to:
366355 a. agreeing with an individual to per form an abortion on
367356 that individual or on some other person, wheth er or
368357 not the term “abortion” is used in the agreement, and
369358 whether or not the agreement is contingent on another
370359 factor such as receipt of payment or a determinat ion
371360 of pregnancy, or

399387 b. scheduling or planning a time to perform an abortion
400388 on an individual, whether or not the term “abortion”
401389 is used, and whether or not the performance is
402390 contingent on another factor such as receipt of
403391 payment or a determination of p regnancy.
404392 This definition shall not be construed to require that an abortion
405393 procedure actually must be initiated for an attempt to occur;
406394 3. “Dismemberment abortion” means, with the purpose of causing
407395 the death of an unborn child, purposely to dismember a living unborn
408396 child and extract him or her one piece at a time from the uterus
409397 through use of clamps, grasping forceps, tongs, scissors or similar
410398 instruments that, through the convergence of two rigid levers,
411399 slice, crush, and/or grasp a portion of the unborn child’s body to
412400 cut or rip it off. This definition does not include an abortion
413401 which uses suction to dismember the body of the deve loping unborn
414402 child by sucking fetal parts into a collection container;
415403 4. “Physician” means a person licensed to p ractice medicine and
416404 surgery or osteopathic medicine and surgery, or otherwise legally
417405 authorized to perform an abortion;
418406 5. “Purposely” means the following: A person acts purposely
419407 with respect to a material element of an offense when:
420408 a. if the element involves the nature of his or her
421409 conduct or a result thereof, it is his or her

449436 conscious objective to engage in conduct of that
450437 nature or to cause such a result, and
451438 b. if the element involves the attendant circumstances,
452439 he or she is aware of the existe nce of such
453440 circumstances or he or she believes or hopes that they
454441 exist;
455442 6. “Serious health risk to the unborn child ’s mother” means
456443 that in reasonable medical judgment she has a condition that so
457444 complicates her medical condition that it necessitates th e abortion
458445 of her pregnancy to avert her death or to avert serious risk of
459446 substantial and irreversible physical impairment of a major bodil y
460447 function, not including psychological or emotional conditions. No
461448 such condition may be determined to exist if it is based on a claim
462449 or diagnosis that the woman will engage in conduct which she intends
463450 to result in her death or in substantial and irrev ersible physical
464451 impairment of a major bodily function; and
465452 7. “Woman” means a female human being whether or not sh e has
466453 reached the age of ma jority.
467454 SECTION 5. AMENDATORY 63 O.S. 20 21, Section 1-740.16, is
468455 amended to read as follows:
469456 Section 1-740.16. As used in the Choosing Childbirth Act:
470457 1. “Abortion” means the use or prescription of any instrument,
471458 medicine, drug or any other substance or device to intentionally:

499485 a. kill the unborn child of a woman known to be pregnan t,
500486 or
501487 b. terminate the pregnancy of a woman known to be
502488 pregnant, with an intention other than:
503489 (1) after viability of the unborn child the time
504490 period specified by subsection A of Section 1-732
505491 of this title, to produce a live birth and
506492 preserve the life and health of the child born
507493 alive, or
508494 (2) to remove a dead unborn child;
509495 2. “Unborn child” means an individual organism of the species
510496 Homo sapiens from fertilization until birth; and
511497 3. “Grant-supervising entity” means a private entity which
512498 approves all grants provided under the Choosing Childbirth Act and
513499 which:
514500 a. is organized as a not-for-profit corporation in
515501 Oklahoma and as a 501(c)3 entity under the federal
516502 Internal Revenue Code, and
517503 b. does not encourage or counsel any woman to have an
518504 abortion not necessary to prevent her death, to
519505 provide her such an abortion or to r efer her for such
520506 an abortion, and does not accept funds or services
521507 knowingly from any entity which performs abortions or
522508 receives money for abortions.

550535 SECTION 6. AMENDATORY 63 O.S. 2021, Section 1-745.3, is
551536 amended to read as follows:
552537 Section 1-745.3. The Legislature of the State of Okla homa finds
553538 that:
554539 1. Pain receptors (noci ceptors) are present throug hout the
555540 unborn child’s entire body by no later than sixteen (16) week s after
556541 fertilization and nerves link these receptors to the brain ’s
557542 thalamus and subcortical plate by no later than t wenty (20) weeks;
558543 2. By eight (8) weeks after fertilization, the un born child
559544 reacts to touch. After twenty (20) weeks, the unborn child reacts
560545 to stimuli that would be recognized as painful if applied to an
561546 adult human, for example by recoiling;
562547 3. In the unborn child, application of such pai nful stimuli is
563548 associated with significant increases in stress hormones known as
564549 the stress response;
565550 4. Subjection to such painful stimuli is associated with long -
566551 term harmful neurodevelopmental effects, such as altered pain
567552 sensitivity and, possibly, e motional, behavioral, and l earning
568553 disabilities later in life;
569554 5. For the purposes of surgery on unborn children, fetal
570555 anesthesia is routinely administered and is associated with a
571556 decrease in stress hormones comp ared to their level when painful
572557 stimuli are applied without such an esthesia;

600584 6. The position, asserted by some medical experts, that the
601585 unborn child is incapable of experiencing pain until a point later
602586 in pregnancy than twenty (20) weeks after fertiliz ation
603587 predominately rests on the assumpti on that the ability to expe rience
604588 pain depends on the cerebral cortex and requires nerve connecti ons
605589 between the thalamus and the cortex. However, recent medical
606590 research and analysi s, especially since 2007, provid es strong
607591 evidence for the conclusion tha t a functioning cortex is n ot
608592 necessary to experience pain;
609593 7. Substantial evidence indicates th at children born missing
610594 the bulk of the cerebral cortex, those with hydranencephaly,
611595 nevertheless experience pain;
612596 8. In adults, stimulation or ablation of t he cerebral cortex
613597 does not alter pain perception, while stimulation or ablation of the
614598 thalamus does;
615599 9. Substantial evidence indicates that structures used for pain
616600 processing in early development differ from t hose of adults, using
617601 different neural elem ents available at specific times during
618602 development, such as the subcortical plate, to fulfill th e role of
619603 pain processing;
620604 10. The position, asserted by some, that the unborn child
621605 remains in a coma-like sleep state that precludes the unborn child
622606 from experiencing pain is inconsi stent with the documented reaction
623607 of unborn children to painful stimu li and with the experience of

651634 fetal surgeons who have found it necessary to sedate the unborn
652635 child with anesthesia to prevent the unborn child from thrashing
653636 about in reaction to invasi ve surgery;
654637 11. Consequently, there is substantial medical evidence t hat an
655638 unborn child is capable of experiencing pain by twenty (20) weeks
656639 after fertilization;
657640 12. It is the purpose of the State of Oklahoma this state to
658641 assert a compelling state interest in pro tecting the lives of unborn
659642 children from the stage at which substantial medical evidence
660643 indicates that they are capable of feeling pain; and
661644 13. Oklahoma’s compelling state interest i n protecting the
662645 lives of unborn children f rom the stage at which subs tantial medical
663646 evidence indicates that they are capable of feeling pain is intended
664647 to be separate from and independent of Oklahoma ’s compelling state
665648 interest in protecting the lives o f unborn children from the stage
666649 of viability after the time period specified by subsection A of
667650 Section 1-732 of this title, and neither state interest is intended
668651 to replace the other.
669652 SECTION 7. AMENDATORY 63 O.S. 2021, Section 1 -756, is
670653 amended to read as follows:
671654 Section 1-756. A. As used in this section:
672655 1. “Abortion” means the use or prescription of any instrument,

701683 (a) to intentionally kill the unborn child of a woman
702684 known to be pregnant ;, or
703685 (b) to intentionally terminate the pregnancy of a woman
704686 known to be pregnant, with an inten tion other than to
705687 remove a dead unborn child or, after viability the
706688 time period specified by subsection A of Section 1-732
707689 of this title, to produce a live birth and preserve
708690 the life and health of the child born alive;
709691 2. “Medical emergency” means a condition which, in reasonable
710692 medical judgment, so complicates the medical condition of the
711693 pregnant woman as to necessitate the immediate abortion of her
712694 pregnancy to avert her d eath or for which a delay will creat e
713695 serious risk of substantial and irrevers ible physical impairment of
714696 a major bodily function, not including psychological or emotional
715697 conditions. No condition shall be deemed a medical emergency if
716698 based on a claim or diagnosis that the woman will engag e in conduct
717699 which she intends to result i n her death or in substantial and
718700 irreversible physical impairment of a major bodily function; and
719701 3. “Medication abortion” means the use or prescription of an
720702 abortion-inducing drug or drugs dispensed with the in tent to cause
721703 the death of the unborn chil d.
722704 B. 1. Any private office, freestanding outpatient clinic,
723705 hospital or other facility or clinic in which medication abortions
724706 that use mifepristone are provided shall conspic uously post a sign

754735 “NOTICE TO PATIENTS HAVING MEDICATION ABORTIONS WHICH USE
755736 MIFEPRISTONE: Mifepristone, also known as RU-486 or Mifeprex, alone
756737 is not always effective in ending a p regnancy. It may be possible
757738 to reverse its intended effect if the second pill or tablet has not

807787 C. 1. Except in the case of a medical emergency, a medication
808788 abortion that uses mifepristone shall no t be provided or induced or
809789 attempted to be provided or induced without informing the female, by
810790 telephone or in person, by the physician who is to dispense or
811791 provide the abortion drug or drugs, by a referring physician or by
812792 an agent of either physician at least seventy-two (72) hours before
813793 the abortion:
814794 a. that it may be possible to reverse the intended
815795 effects of a medication abortion that uses
816796 mifepristone if the woman change s her mind but that
817797 time is of the essenc e, and

875854 substantial and irre versible physical impair ment of a major bodily

905883 of this title is enacted, the State Board of Medical Licensure and
906884 Supervision shall cause to be publishe d, in English and in each
907885 language which is the primary lang uage of two percent (2%) or more
908886 of the state’s population, in print and on the website required to
909887 be developed and maintained under Section 1 -738.11 of Title 63 of
910888 the Oklahoma Statutes, compreh ensible materials designed to inform
911889 the female of the possi bility of reversing the effects of a
912890 medication abortion th at uses mifepristone, also known as RU -486 or
913891 Mifeprex, and information on resources that may be available t o help
914892 her reverse its effect s. The website shall include the Abortion
915893 Pill Reversal 24-hour Hotline number 877-558-0333 and the Abortion
916894 Pill Reversal website address https://www.abortionpillreversal.com .
917895 F. Any person who knowingly or recklessly provid es or induces
918896 or attempts to provide or induce an abortion in violation of this
919897 section shall be guilty of a felony. No penalty may be assessed
920898 against the female to whom the medication abortion is provided or
921899 induced or attempted to be provided or induce d. No penalty or civil
922900 liability may be assessed for failure to comply with subsection C of
923901 this section unless the State Board of Medical Licensur e and
924902 Supervision has made the information available on the website at the
925903 time the physician or the physici an’s agent is required to inf orm
926904 the female.

954931 G. Any private office, freestanding outpati ent clinic or other
955932 facility or clinic that fails to post a sign required in subsection
956933 B of this section in knowing, reckless or negligent violation of
957934 this act Section 1-751 et seq. of this titl e shall be assessed a
958935 fine of Ten Thousand Dolla rs ($10,000.00) by the State Board of
959936 Medical Licensure and Supervision. Each day on which a medication
960937 abortion that uses mifepristone, other than a medication abortion
961938 that is necessary to prevent the deat h of the pregnant female, is
962939 provided in any private office, freestanding outpatient clinic or
963940 other facility or clinic during which the required sign is n ot
964941 posted during a portion of business hours when patients or
965942 perspective prospective patients are present is a separate
966943 violation.
967944 H. 1. Any person upon whom an abortion has been performed
968945 without this section having been complied with, the father of the
969946 unborn child who was the subject of such an abortion, or, if the
970947 female had not attained the age of eighteen (18) years at the time
971948 of the medication abortion or has died as a result of the medication
972949 abortion, the grandparent of such an unborn child may maintain an
973950 action against the person who provided the medication abortion in
974951 knowing or reckless vi olation of this section for actual and
975952 punitive damages. An y person upon whom an abortion has been
976953 attempted without this section having been complied with may
977954 maintain an action against the person who attempted to provide the

1006982 and punitive damages. No damages may be awarded a plaintiff if the
1007983 pregnancy resulted from the p laintiff’s criminal conduct.
1008984 2. If judgment is rendered in favor of the plaintiff in any
1009985 action described in this sub section, the court shall also render
1010986 judgment for a reasonab le attorney’s attorney fee in favor of the
1011987 plaintiff against the defendant. If judgmen t is rendered in favor
1012988 of the defendant and the court finds that the plaintiff ’s suit was
1013989 frivolous and brought in bad faith, the court shall also render
1014990 judgment for a reasonable attorney’s attorney fee in favor of the
1015991 defendant against the plaintiff.
1016992 I. In every civil or criminal proceeding or action brought
1017993 under this section, the court shall rule whether the anonymity of
1018994 any female to whom a medication abortion has b een provided or
1019995 attempted shall be preserved from public disclosure i f she does not
1020996 give her consent to such disclosure. The court, upon motion or sua
1021997 sponte, shall make such a ruling and, upon d etermining that her
1022998 anonymity should be preserved, shall iss ue orders to the parties,
1023999 witnesses and counsel and shall direct the sealing of the record and
10241000 exclusion of individuals from courtrooms or hearing rooms to the
10251001 extent necessary to safeguard her id entity from public disclosure.
10261002 Each such order shall be acc ompanied by specific written findings
10271003 explaining why the anonymity of the female should be prese rved from
10281004 public disclosure, why the order is essential to that end, how the

10611036 section shall do so under a pseudonym. This section may not be
10621037 construed to conceal the identity of the plain tiff or of witnesses
10631038 from the defendant.
10641039 J. If any one or more provision, section, subsectio n, sentence,
10651040 clause, phrase or word o f this act Section 1-751 et seq. of this
10661041 title or the application thereof to any per son or circumstance is
10671042 found to be unconstitutional , the same is hereby declar ed to be
10681043 severable and the ba lance of this act Section 1-751 et seq. of this
10691044 title shall remain effective notwithstan ding such
10701045 unconstitutionality. The Legislature h ereby declares that it would
10711046 have passed this act Section 1-751 et seq. of this title , and each
10721047 provision, section, subsection, sentenc e, clause, phrase or word
10731048 thereof, irrespective of the f act that any one or more provision,
10741049 section, subsection, sentence, clause, phrase or word be declared
10751050 unconstitutional.
10761051 SECTION 8. This act shall become effective November 1, 2022.
