154 | 154 | | B. A person commits an offense if the person intentionally or |
---|
155 | 155 | | knowingly camps in a public place without the effective consent of |
---|
156 | 156 | | the officer or agency having the legal duty or author ity to manage |
---|
157 | 157 | | the public place. |
---|
158 | 158 | | C. The actor’s intent or knowledge may be established through |
---|
159 | 159 | | evidence of activities associated with sustaining a living |
---|
160 | 160 | | accommodation that are conducted in a public place including: |
---|
161 | 161 | | 1. Cooking; |
---|
162 | 162 | | 2. Making a fire; |
---|
163 | 163 | | 3. Storing personal belongings for an extended period; |
---|
164 | 164 | | 4. Digging; or |
---|
165 | 165 | | 5. Sleeping. |
---|
166 | 166 | | D. Consent given by an officer or agency of a political |
---|
167 | 167 | | subdivision is not effective for purposes of subsection B of this |

227 | 227 | | E. An offense committed under this section shall be a |
---|
228 | 228 | | misdemeanor. |
---|
229 | 229 | | F. This section does not preempt an ordinance, order, rule, or |
---|
230 | 230 | | other regulation adopted by a state agency or political subdivision |
---|
231 | 231 | | relating to prohibiting camping in a public place or affect the |
---|
232 | 232 | | authority of a state agency or political subdivision to adopt or |
---|
233 | 233 | | enforce an ordinance, order, rule, or other regulation relating to |
---|
234 | 234 | | prohibiting camping in a public place if the ordinance , order, rule, |
---|
235 | 235 | | or other regulation: |
---|
236 | 236 | | 1. Is compatible with and equal to or more stringent than the |
---|
237 | 237 | | offense prescribed by this section; or |
---|
238 | 238 | | 2. Relates to an issue not specifically addressed by this |
---|
239 | 239 | | section. |
---|
240 | 240 | | G. Except as provided by subsection H of this section, before |
---|
241 | 241 | | or at the time a peace officer issues a citation to a person for an |
---|
242 | 242 | | offense under this section, the peace officer must make a reasonable |
---|

299 | 299 | | located, or an appropriate nonprofit organization operating within |

300 | 300 | | that political subdivision , and request the official or organization |
---|
301 | 301 | | to provide the person with: |
---|
302 | 302 | | a. information regarding the prevention of human |
---|
303 | 303 | | trafficking, or |
---|
304 | 304 | | b. any other services that would reduce the likelihood of |
---|
305 | 305 | | the person suspected of committing th e offense |
---|
306 | 306 | | continuing to camp in the public place. |
---|
307 | 307 | | H. Subsection G of this section does not apply if the peace |
---|
308 | 308 | | officer determines there is an imminent threat to the health or |
---|
309 | 309 | | safety of any person to the extent that compliance with that |
---|
310 | 310 | | subsection is impracticable. |
---|
311 | 311 | | I. If the person is arrested or detained solely for an offense |
---|
312 | 312 | | under this section, a pe ace officer enforcing this section shall |
---|
313 | 313 | | ensure that the person’s personal property not designated as |
---|
314 | 314 | | contraband under other law is preserved by: |
---|
315 | 315 | | 1. Permitting the person to remove all t he property from the |
---|
316 | 316 | | public place at the time of the person’s departure; or |
---|
317 | 317 | | 2. Taking custody of the property and allowing the person to |
---|
318 | 318 | | retrieve the property after the person is rel eased from custody. |
---|

375 | 375 | | A. A political subdivision may not designate a property to be |
---|
376 | 376 | | used by homeless individuals to camp unless the local housing |
---|
377 | 377 | | authority with authorized jurisdiction approves a plan described by |
---|
378 | 378 | | subsection C of this s ection. |
---|
379 | 379 | | B. Not later than thirty (30) days after the date the local |
---|
380 | 380 | | housing authority wi th appropriate jurisd iction receives a plan |
---|
381 | 381 | | submitted by a political su bdivision under this section, the |
---|
382 | 382 | | authority shall make a final determination regarding approval of the |
---|
383 | 383 | | plan. |
---|
384 | 384 | | C. A plan submitted for approval under this section shall |
---|
385 | 385 | | describe each of the following with re spect to a proposed property: |
---|
386 | 386 | | 1. The availability of local health care for proposed new |
---|
387 | 387 | | campers, including access to Medicaid services and mental health |
---|
388 | 388 | | services; |
---|
389 | 389 | | 2. The availability of indigent services for proposed new |
---|
390 | 390 | | campers; |
---|
391 | 391 | | 3. The availability of reasonably affordable public |
---|
392 | 392 | | transportation for proposed new campers; |
---|
393 | 393 | | 4. Local law enforcement resources in the area; and |
---|

452 | 452 | | may not approve a plan descr ibed by subsection C of this section if |

453 | 453 | | the authority determines that a property proposed under the plan is |
---|
454 | 454 | | a public park. |

455 | 455 | | F. In this section: |
---|
456 | 456 | | 1. “Camp” has the meaning assigned by Section 1 of this act; |
---|

458 | 458 | | 2. “Proposed new campers” means homeless individuals the |
---|
459 | 459 | | applicant intends to allow to camp at the property. |
