91	91	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
92	92	SECTION 1. NEW LAW A n ew section of law to be codif ied
93	93	in the Oklahoma Statutes as Section 57-101 of Title 11, unless there
94	94	is created a duplication in numb ering, reads as follows:

147	147	1. “Camp” means to reside temporarily in a place, with shelter ;
148	148	and
149	149	2. “Shelter” includes a tent, tarpaulin, lean-to, sleeping bag,
150	150	bedroll, blankets, or any form of temporary, semipermanent, or
151	151	permanent shelter, other than clothing or any handheld device,
152	152	designed to protect a person from weather conditions that threat en
153	153	personal health and safety .
154	154	B. A person commits an offense if the person intentionally or
155	155	knowingly camps in a public place without the effective consent of
156	156	the officer or agency having the legal duty or author ity to manage
157	157	the public place.
158	158	C. The actor’s intent or knowledge may be established through
159	159	evidence of activities associated with sustaining a living
160	160	accommodation that are conducted in a public place including:
161	161	1. Cooking;
162	162	2. Making a fire;
163	163	3. Storing personal belongings for an extended period;
164	164	4. Digging; or
165	165	5. Sleeping.
166	166	D. Consent given by an officer or agency of a political
167	167	subdivision is not effective for purposes of subsection B of this
168	168	section, unless given to authorize the person to camp for:
169	169	1. Recreational purposes;

221	221	2. Purposes of sheltering homeless indi viduals, if the prope rty
222	222	on which the camping occurs is subject to a plan approved under the
223	223	laws of this state, and the camping occurs in a manner that complies
224	224	with the plan; or
225	225	3. Purposes related to providing emergency she lter during a
226	226	disaster declared under the laws of this state.
227	227	E. An offense committed under this section shall be a
228	228	misdemeanor.
229	229	F. This section does not preempt an ordinance, order, rule, or
230	230	other regulation adopted by a state agency or political subdivision
231	231	relating to prohibiting camping in a public place or affect the
232	232	authority of a state agency or political subdivision to adopt or
233	233	enforce an ordinance, order, rule, or other regulation relating to
234	234	prohibiting camping in a public place if the ordinance , order, rule,
235	235	or other regulation:
236	236	1. Is compatible with and equal to or more stringent than the
237	237	offense prescribed by this section; or
238	238	2. Relates to an issue not specifically addressed by this
239	239	section.
240	240	G. Except as provided by subsection H of this section, before
241	241	or at the time a peace officer issues a citation to a person for an
242	242	offense under this section, the peace officer must make a reasonable
243	243	effort to:

295	295	1. Advise the person of an alternative place at whi ch the
296	296	person may lawfully camp; and
297	297	2. Contact, if reasonable and appr opriate, an appropriate
298	298	official of the political subdivision in which the public place is
299	299	located, or an appropriate nonprofit organization operating within
300	300	that political subdivision , and request the official or organization
301	301	to provide the person with:
302	302	a. information regarding the prevention of human
303	303	trafficking, or
304	304	b. any other services that would reduce the likelihood of
305	305	the person suspected of committing th e offense
306	306	continuing to camp in the public place.
307	307	H. Subsection G of this section does not apply if the peace
308	308	officer determines there is an imminent threat to the health or
309	309	safety of any person to the extent that compliance with that
310	310	subsection is impracticable.
311	311	I. If the person is arrested or detained solely for an offense
312	312	under this section, a pe ace officer enforcing this section shall
313	313	ensure that the person’s personal property not designated as
314	314	contraband under other law is preserved by:
315	315	1. Permitting the person to remove all t he property from the
316	316	public place at the time of the person’s departure; or
317	317	2. Taking custody of the property and allowing the person to
318	318	retrieve the property after the person is rel eased from custody.

371	371	property pursuant to paragraph 2 of subsection I of this section.
372	372	SECTION 2. NEW LAW A new section of law to be codified
373	373	in the Oklahoma Statutes as Section 57-102 of Title 11, unless there
374	374	is created a duplication in numb ering, reads as follows:
375	375	A. A political subdivision may not designate a property to be
376	376	used by homeless individuals to camp unless the local housing
377	377	authority with authorized jurisdiction approves a plan described by
378	378	subsection C of this s ection.
379	379	B. Not later than thirty (30) days after the date the local
380	380	housing authority wi th appropriate jurisd iction receives a plan
381	381	submitted by a political su bdivision under this section, the
382	382	authority shall make a final determination regarding approval of the
383	383	plan.
384	384	C. A plan submitted for approval under this section shall
385	385	describe each of the following with re spect to a proposed property:
386	386	1. The availability of local health care for proposed new
387	387	campers, including access to Medicaid services and mental health
388	388	services;
389	389	2. The availability of indigent services for proposed new
390	390	campers;
391	391	3. The availability of reasonably affordable public
392	392	transportation for proposed new campers;
393	393	4. Local law enforcement resources in the area; and

446	446	local mental health au thority to provide for any proposed new
447	447	campers.
448	448	D. An applicant shall respond to reasonable requests for
449	449	additional information made by the authority regarding the proposed
450	450	property or plan.
451	451	E. The local housing authority having appropriate jurisdiction
452	452	may not approve a plan descr ibed by subsection C of this section if
453	453	the authority determines that a property proposed under the plan is
454	454	a public park.
455	455	F. In this section:
456	456	1. “Camp” has the meaning assigned by Section 1 of this act;
457	457	and
458	458	2. “Proposed new campers” means homeless individuals the
459	459	applicant intends to allow to camp at the property.
460	460	SECTION 3. NEW LAW A new sect ion of law to be codified
461	461	in the Oklahoma Statutes as Section 57-103 of Title 11, unless there
462	462	is created a duplication in numbering, reads as follows:
463	463	A. As used in this section:
464	464	1. “Local entity” means:
465	465	a. the governing body of a mu nicipality or county,
466	466	b. an officer or employee of or a division, department,
467	467	or other body that is pa rt of a municipality or
468	468	county, including a sheriff, mu nicipal police

523	523	2. “Policy” includes a formal, written rule, ordinance, order,
524	524	or policy and an informal, u nwritten policy; and
525	525	3. “Public camping ban” means a law, rule, ordina nce, order, or
526	526	other regulation that prohibits camping in a public place.
527	527	B. A local entity may not adopt or enforce a policy under which
528	528	the entity prohibits or discourages the enforcement of a ny public
529	529	camping ban.
530	530	C. In compliance with subsection A of this section, a local
531	531	entity may not prohibit or discourage a peace officer or prosecutin g
532	532	attorney who is employed by or otherwise under the direction or
533	533	control of the entity from enforcing a public camping ban.
534	534	D. This section does not prohibit a poli cy that encourages
535	535	diversion or a provision of services in lieu of citation or a rrest.
536	536	E. The Attorney General may bring an action in a district court
537	537	in the county in which the principal office of the entity is located
538	538	to enjoin a violation of this section.
539	539	F. A local entity may not receive state grant funds, and state
540	540	grant funds for the local entity shall be denied, for the state
541	541	fiscal year following the year in which a final judicial
542	542	determination in an action brought under subsection E of this

597	597	section may not be denied state grant funds, regardl ess of whether
598	598	the entity is a part of another entity tha t is in violation of t hat

600	600	SECTION 4. NEW LAW A new section of law to be codified
601	601	in the Oklahoma Statutes as Sectio n 57-104 of Title 11, unless there
602	602	is created a duplication in numbering, reads as follows:
603	603	A political subdivision that design ated a property to be used by
604	604	homeless individuals to camp before the effective date of this act
605	605	may apply on or after that date for approval of a plan as provided
606	606	by this act.
607	607	SECTION 5. This act shall become effective July 1, 2022.
608	608	SECTION 6. It being immediately necessary for the pre servation
609	609	of the public peace, health or safety, an emergency is hereby
610	610	declared to exist, by reason whereof thi s act shall take effect and
611	611	be in full force from and after its passage and approval.
