9191 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
9292 SECTION 1. NEW LAW A n ew section of law to be codif ied
9393 in the Oklahoma Statutes as Section 57-101 of Title 11, unless there
9494 is created a duplication in numb ering, reads as follows:

147147 1. “Camp” means to reside temporarily in a place, with shelter ;
148148 and
149149 2. “Shelter” includes a tent, tarpaulin, lean-to, sleeping bag,
150150 bedroll, blankets, or any form of temporary, semipermanent, or
151151 permanent shelter, other than clothing or any handheld device,
152152 designed to protect a person from weather conditions that threat en
153153 personal health and safety .
154154 B. A person commits an offense if the person intentionally or
155155 knowingly camps in a public place without the effective consent of
156156 the officer or agency having the legal duty or author ity to manage
157157 the public place.
158158 C. The actor’s intent or knowledge may be established through
159159 evidence of activities associated with sustaining a living
160160 accommodation that are conducted in a public place including:
161161 1. Cooking;
162162 2. Making a fire;
163163 3. Storing personal belongings for an extended period;
164164 4. Digging; or
165165 5. Sleeping.
166166 D. Consent given by an officer or agency of a political
167167 subdivision is not effective for purposes of subsection B of this
168168 section, unless given to authorize the person to camp for:
169169 1. Recreational purposes;

221221 2. Purposes of sheltering homeless indi viduals, if the prope rty
222222 on which the camping occurs is subject to a plan approved under the
223223 laws of this state, and the camping occurs in a manner that complies
224224 with the plan; or
225225 3. Purposes related to providing emergency she lter during a
226226 disaster declared under the laws of this state.
227227 E. An offense committed under this section shall be a
228228 misdemeanor.
229229 F. This section does not preempt an ordinance, order, rule, or
230230 other regulation adopted by a state agency or political subdivision
231231 relating to prohibiting camping in a public place or affect the
232232 authority of a state agency or political subdivision to adopt or
233233 enforce an ordinance, order, rule, or other regulation relating to
234234 prohibiting camping in a public place if the ordinance , order, rule,
235235 or other regulation:
236236 1. Is compatible with and equal to or more stringent than the
237237 offense prescribed by this section; or
238238 2. Relates to an issue not specifically addressed by this
239239 section.
240240 G. Except as provided by subsection H of this section, before
241241 or at the time a peace officer issues a citation to a person for an
242242 offense under this section, the peace officer must make a reasonable
243243 effort to:

295295 1. Advise the person of an alternative place at whi ch the
296296 person may lawfully camp; and
297297 2. Contact, if reasonable and appr opriate, an appropriate
298298 official of the political subdivision in which the public place is
299299 located, or an appropriate nonprofit organization operating within
300300 that political subdivision , and request the official or organization
301301 to provide the person with:
302302 a. information regarding the prevention of human
303303 trafficking, or
304304 b. any other services that would reduce the likelihood of
305305 the person suspected of committing th e offense
306306 continuing to camp in the public place.
307307 H. Subsection G of this section does not apply if the peace
308308 officer determines there is an imminent threat to the health or
309309 safety of any person to the extent that compliance with that
310310 subsection is impracticable.
311311 I. If the person is arrested or detained solely for an offense
312312 under this section, a pe ace officer enforcing this section shall
313313 ensure that the person’s personal property not designated as
314314 contraband under other law is preserved by:
315315 1. Permitting the person to remove all t he property from the
316316 public place at the time of the person’s departure; or
317317 2. Taking custody of the property and allowing the person to
318318 retrieve the property after the person is rel eased from custody.

370370 J. A fee may not be charged for the storage or relea se of
371371 property pursuant to paragraph 2 of subsection I of this section.
372372 SECTION 2. NEW LAW A new section of law to be codified
373373 in the Oklahoma Statutes as Section 57-102 of Title 11, unless there
374374 is created a duplication in numb ering, reads as follows:
375375 A. A political subdivision may not designate a property to be
376376 used by homeless individuals to camp unless the local housing
377377 authority with authorized jurisdiction approves a plan described by
378378 subsection C of this s ection.
379379 B. Not later than thirty (30) days after the date the local
380380 housing authority wi th appropriate jurisd iction receives a plan
381381 submitted by a political su bdivision under this section, the
382382 authority shall make a final determination regarding approval of the
383383 plan.
384384 C. A plan submitted for approval under this section shall
385385 describe each of the following with re spect to a proposed property:
386386 1. The availability of local health care for proposed new
387387 campers, including access to Medicaid services and mental health
388388 services;
389389 2. The availability of indigent services for proposed new
390390 campers;
391391 3. The availability of reasonably affordable public
392392 transportation for proposed new campers;
393393 4. Local law enforcement resources in the area; and

445445 5. The steps the applicant has taken to coordina te with the
446446 local mental health au thority to provide for any proposed new
447447 campers.
448448 D. An applicant shall respond to reasonable requests for
449449 additional information made by the authority regarding the proposed
450450 property or plan.
451451 E. The local housing authority having appropriate jurisdiction
452452 may not approve a plan descr ibed by subsection C of this section if
453453 the authority determines that a property proposed under the plan is
454454 a public park.
455455 F. In this section:
456456 1. “Camp” has the meaning assigned by Section 1 of this act;
457457 and
458458 2. “Proposed new campers” means homeless individuals the
459459 applicant intends to allow to camp at the property.
460460 SECTION 3. NEW LAW A new sect ion of law to be codified
461461 in the Oklahoma Statutes as Section 57-103 of Title 11, unless there
462462 is created a duplication in numbering, reads as follows:
463463 A. As used in this section:
464464 1. “Local entity” means:
465465 a. the governing body of a mu nicipality or county,
466466 b. an officer or employee of or a division, department,
467467 or other body that is pa rt of a municipality or
468468 county, including a sheriff, mu nicipal police

520520 department, municipal attorney, or county attorney,

522522 c. a district attorney;
523523 2. “Policy” includes a formal, written rule, ordinance, order,
524524 or policy and an informal, u nwritten policy; and
525525 3. “Public camping ban” means a law, rule, ordina nce, order, or
526526 other regulation that prohibits camping in a public place.
527527 B. A local entity may not adopt or enforce a policy under which
528528 the entity prohibits or discourages the enforcement of a ny public
529529 camping ban.
530530 C. In compliance with subsection A of this section, a local
531531 entity may not prohibit or discourage a peace officer or prosecutin g
532532 attorney who is employed by or otherwise under the direction or
533533 control of the entity from enforcing a public camping ban.
534534 D. This section does not prohibit a poli cy that encourages
535535 diversion or a provision of services in lieu of citation or a rrest.
536536 E. The Attorney General may bring an action in a district court
537537 in the county in which the principal office of the entity is located
538538 to enjoin a violation of this section.
539539 F. A local entity may not receive state grant funds, and state
540540 grant funds for the local entity shall be denied, for the state
541541 fiscal year following the year in which a final judicial
542542 determination in an action brought under subsection E of this

595595 subsection B of this section.
596596 G. A local entity that has not violated subsection B of this
597597 section may not be denied state grant funds, regardl ess of whether
598598 the entity is a part of another entity tha t is in violation of t hat
599599 subsection.
600600 SECTION 4. NEW LAW A new section of law to be codified
601601 in the Oklahoma Statutes as Sectio n 57-104 of Title 11, unless there
602602 is created a duplication in numbering, reads as follows:
603603 A political subdivision that design ated a property to be used by
604604 homeless individuals to camp before the effective date of this act
605605 may apply on or after that date for approval of a plan as provided
606606 by this act.
607607 SECTION 5. This act shall become effective July 1, 2022.
608608 SECTION 6. It being immediately necessary for the pre servation
609609 of the public peace, health or safety, an emergency is hereby
610610 declared to exist, by reason whereof thi s act shall take effect and
611611 be in full force from and after its passage and approval.
