29	57		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

31	58		SECTION 1. NEW LAW A new section of law not to be
32	59		codified in the Oklahoma Statutes reads as follows:
33		-
34	60		This act shall be known as the "Address Confidentiality for
35	61		Child Survivors and Their Families Act".
36		-
37	62		SECTION 2. AMENDATORY 22 O.S. 2021, Section 60.14, is
38	63		amended to read as follows :

40	64		Section 60.14. A. The Legislature finds that persons
41	65		attempting to escape from actua l or threatened domestic violence,
42	66		sexual assault, or stalking, human trafficking, or child abduction,

44	95		assailants or probable assailants from finding t hem. The purpose of
45	96		this section is to enab le state and local agencies to respond to
46	97		requests for public records without disclosing the location of a

49	98		victim of domestic abu se, sexual assault, or stalking, human
50	99		trafficking, or child abduction, to enable interagency cooperation
51	100		with the Attorney General in providing address confidentiality f or
52	101		victims of domestic abuse, sexual assault, or stalking, human
53	102		trafficking, or child abduction, and to enable state and local
54	103		agencies to accept an address designated b y the Attorney General by
55	104		a program participant as a substitute mailing address.

57	105		B. As used in this section:

59	106		1. "Address" means a residential s treet address, school
60	107		address, or work address of an indi vidual, as specified on the
61	108		application of an individu al to be a program participant under this
62	109		section;

64	110		2. "Program participant" means a person certified as a program
65	111		participant under this section ;

67	112		3. "Domestic abuse" means an act as defined in Section 60.1 of
68	113		this title and includes a threat of such acts committed against an
69	114		individual in a domes tic situation, regardless of whether these acts
70	115		or threats have been reported to law enforcement offic ers; and

72	143		4. "Stalking" means an act as defined in Sectio n 60.1 of this
73	144		title regardless of whether the acts ha ve been reported to law
74	145		enforcement;

76	146		5. "Human trafficking" means human trafficking , human
77	147		trafficking for labor, and human traf ficking for commercial sex as
78	148		defined in paragraphs 4 through 6 of subsec tion A of Section 748 of
79	149		Title 21 of the Oklahoma Stat utes; and

81	150		6. "Child abduction" means the abduction of a person pursuant
82	151		to Section 1119 of Title 21 of the Oklahoma Statutes .

84	152		C. The Address Confidentiality Program shall be staffed by
85	153		unclassified employees, who have been subjected to a criminal
86	154		history records search.

88	155		D. 1. An adult person, a parent or guardian acting on behalf
89	156		of a minor, or a guardian acting on behalf of an incapa citated
90	157		person, as defined by Sectio n 1-111 of Title 30 of the Ok lahoma
91		-

93	158		Statutes, may apply to the Attorney General to have an address
94	159		designated by the Attorney General serve as the address of the
95	160		person or the address of the minor or incapacitated person . The
96	161		Attorney General shall approve an application if it is fil ed in the
97	162		manner and on the form prescribed by the Attorney General and if it
98	163		contains:

100	164		a. a sworn statement by the applicant that the applica nt

106	196		stalking, human trafficking, o r child abduction,

110	199		or children, or the safety of the minor or
111	200		incapacitated person on whose behalf the
112	201		application is made,

114	202		b. a designation of the Attorney General as agent for
115	203		purposes of service of process and for the purpose of
116	204		receipt of mail,

118	205		c. the mailing address where the applicant can be
119	206		contacted by the Attorney General, and the phone
120	207		number or numbers where the applicant can be called by
121	208		the Attorney General,

123	209		d. the new address or addresses that the applicant
124	210		requests not be disclos ed for the reason that
125	211		disclosure will increase the risk of domestic abuse,
126	212		sexual assault, or stalking, human trafficking, or
127	213		child abduction, and

129	214		e. the signature of the applicant and application
130	215		assistant who assisted in the preparation of the

136	245		2. An adult or minor child who resides with the ap plicant who
137	246		also needs to be a program participant in o rder to ensure the safety
138	247		of the applicant may apply. Each adult living in the househ old must
139	248		complete a separate application. An adult may apply on behalf of a
140	249		minor.

142	250		3. Applications shall be filed with the Office of the Attorney
143	251		General.

145	252		4. Upon filing a properly completed application, the Attorney
146	253		General shall certify the applicant as a program participant.
147	254		Applicants shall be certified for four (4) years following the date
148	255		of filing unless the certification is withdrawn or invalidated
149	256		before that date. The Attorney General shall by rule establish a
150	257		renewal procedure.

152	258		5. A person who falsely attests in an application that
153	259		disclosure of the address of the applicant would endanger the safety
154	260		of the applicant or the safety of the children of the appl icant or
155	261		the minor or incapacitated person on whose behalf the application is
156	262		made, or who knowingly provides false or incorrect information upon
157	263		making an application, may be found guilty of perjury u nder Sections
158	264		500 and 504 of Title 21 of the Oklahoma S tatutes.

160	265		E. 1. If the program participant obtains a name change, the
161	266		participant loses certification as a program participant.

163	294		2. The Attorney General may cancel the certification of a
164	295		program participant if there is a change in the residential address,
165	296		unless the program participant provides th e Attorney General notice
166	297		no later than seven (7) days after the change occurs .

168	298		3. The Attorney General may cancel certification of a program
169	299		participant if mail forwarded by the Attorney General to the address
170	300		of the program participant is returned as no ndeliverable.

172	301		4. The Attorney General shall cancel certification of a program
173	302		participant who applies using false information.

175	303		F. 1. A program participant may request that state and local
176	304		agencies use the addre ss designated by the Attorney General as the
177	305		address of the participant. When creatin g a new public record,

180	306		state and local agencies shall accept the address designated by the
181	307		Attorney General as a substitute address for the program
182	308		participant, unless th e Attorney General has determined that:

184	309		a. the agency has a bona fide statutory or adm inistrative
185	310		requirement for the use of the address which would
186	311		otherwise be confidenti al under this section, and
187		-
188	312		b. this address will be used only for those statutory and
189	313		administrative purposes.

191	314		2. A program participant may use the address designated by the
192	315		Attorney General as a work address.

194	316		3. The Office of the Attorney General shall forward all first
195	317		class, certified and registered mail to the appropriate program

197	346		required to track or other wise maintain records of any mail received
198	347		on behalf of a participant unless the mail is certified or
199	348		registered mail.

201	349		G. The Attorney General may not make any records i n a file of a
202	350		program participant available for inspection or copying, other than
203	351		the address designated by the Attorney General, except under the
204	352		following circumstances:

206	353		1. If directed by a court or der, to a person identified in the
207	354		order; or

209	355		2. To verify the participation of a specific program
210	356		participant to a state or local agency , in which case the Attorney
211	357		General may only confirm information supplied by the requeste r.
212		-
213	358		No employee of a state or local agency shall knowingly and
214	359		intentionally disclose a program participant 's actual address unl ess
215	360		disclosure is permitted by law.
216		-
217	361		H. The Attorney General shall designate state and local
218	362		agencies, federal government, federa lly recognized tribes, and
219	363		nonprofit agencies to assist persons in applying to be pr ogram
220	364		participants. A volunteer or employe e of a designated entity that
221	365		provides counseling, referral, shelter, or other services to victims

224	366		of domestic abuse, sexual assa ult, or stalking, human trafficking,
225	367		or child abduction, and has been trained by the Attorney General

228	397		application assistant to applicants shall in no way be construed as
229	398		legal advice.

231	399		I. The Attorney General may enter into agreements with the
232	400		federal government and federally recognized tribes in the State of
233	401		Oklahoma this state or other entities for purposes of the
234	402		implementation of the Addr ess Confidentiality Program, including the
235	403		use and acceptance of the subs titute address designated by the
236	404		Attorney General.

238	405		J. Effective July 1, 2008, all adm inistrative rules promulgated
239	406		by the Office of the Secretary of State to implement this program
240	407		shall be transferred to and b ecome part of the administrative rules
241	408		of the Office of the Attorney General. The Offic e of Administrative
242	409		Rules in the Office of the Secretary of State shall provide adequate
243	410		notice in "The Oklahoma Register " of the transfer of such rules, and
244	411		shall place the transferred rules under the Administrat ive Code
245	412		section of the Attorney General. Such rules shall continue in force
246	413		and effect as rules of the Office of the Attorney General from and
247	414		after July 1, 2008, and any amendment, repeal or addition to the
248	415		transferred rules shall be under the jurisdict ion of the Attorney
249	416		General. The Attorney General shall adopt and promulgate rules to
250	417		implement this program , as applicable.

252	418		K. Beginning July 1, 2008, the Director of the Address
253	419		Confidentiality Program shall cease to be a position within the

254	447		Office of the Secretary of State. All unexpended fun ds, property,
255	448		records, personnel, and outst anding financial obligations and
256	449		encumbrances related to the position and the Office of Address
257	450		Confidentiality Program with the Office of the Secretary of State
258	451		shall be transferred to the Office of the Attorney General. All
259	452		personnel shall retain their employment position and status as
260	453		unclassified employees, any leave, sick and annual time earned, and
261	454		any retirement and longevity benefits which have accrued during
262	455		tenure with the Office of the Secretary of Stat e.

264	456		SECTION 3. This act shall become effective November 1, 2022.
