2957 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:

3158 SECTION 1. NEW LAW A new section of law not to be
3259 codified in the Oklahoma Statutes reads as follows:

3460 This act shall be known as the "Address Confidentiality for
3561 Child Survivors and Their Families Act".

3762 SECTION 2. AMENDATORY 22 O.S. 2021, Section 60.14, is
3863 amended to read as follows :

4495 assailants or probable assailants from finding t hem. The purpose of
4596 this section is to enab le state and local agencies to respond to
4697 requests for public records without disclosing the location of a

4998 victim of domestic abu se, sexual assault, or stalking, human
5099 trafficking, or child abduction, to enable interagency cooperation
51100 with the Attorney General in providing address confidentiality f or
52101 victims of domestic abuse, sexual assault, or stalking, human
53102 trafficking, or child abduction, and to enable state and local
54103 agencies to accept an address designated b y the Attorney General by
55104 a program participant as a substitute mailing address.

57105 B. As used in this section:

59106 1. "Address" means a residential s treet address, school
60107 address, or work address of an indi vidual, as specified on the
61108 application of an individu al to be a program participant under this
62109 section;

64110 2. "Program participant" means a person certified as a program
65111 participant under this section ;

67112 3. "Domestic abuse" means an act as defined in Section 60.1 of
68113 this title and includes a threat of such acts committed against an
69114 individual in a domes tic situation, regardless of whether these acts
70115 or threats have been reported to law enforcement offic ers; and

72143 4. "Stalking" means an act as defined in Sectio n 60.1 of this
73144 title regardless of whether the acts ha ve been reported to law
74145 enforcement;

76146 5. "Human trafficking" means human trafficking , human
77147 trafficking for labor, and human traf ficking for commercial sex as
78148 defined in paragraphs 4 through 6 of subsec tion A of Section 748 of
79149 Title 21 of the Oklahoma Stat utes; and

81150 6. "Child abduction" means the abduction of a person pursuant
82151 to Section 1119 of Title 21 of the Oklahoma Statutes .

84152 C. The Address Confidentiality Program shall be staffed by
85153 unclassified employees, who have been subjected to a criminal
86154 history records search.

88155 D. 1. An adult person, a parent or guardian acting on behalf
89156 of a minor, or a guardian acting on behalf of an incapa citated
90157 person, as defined by Sectio n 1-111 of Title 30 of the Ok lahoma

93158 Statutes, may apply to the Attorney General to have an address
94159 designated by the Attorney General serve as the address of the
95160 person or the address of the minor or incapacitated person . The
96161 Attorney General shall approve an application if it is fil ed in the
97162 manner and on the form prescribed by the Attorney General and if it
98163 contains:

100164 a. a sworn statement by the applicant that the applica nt

103193 (1) that the applicant, or the minor or incapacitated
104194 person on whose behalf the ap plication is made,
105195 is a victim of domestic abuse, sexual assault, or
106196 stalking, human trafficking, o r child abduction,

109198 (2) that the applicant fears for the safety of self
110199 or children, or the safety of the minor or
111200 incapacitated person on whose behalf the
112201 application is made,

114202 b. a designation of the Attorney General as agent for
115203 purposes of service of process and for the purpose of
116204 receipt of mail,

118205 c. the mailing address where the applicant can be
119206 contacted by the Attorney General, and the phone
120207 number or numbers where the applicant can be called by
121208 the Attorney General,

123209 d. the new address or addresses that the applicant
124210 requests not be disclos ed for the reason that
125211 disclosure will increase the risk of domestic abuse,
126212 sexual assault, or stalking, human trafficking, or
127213 child abduction, and

129214 e. the signature of the applicant and application
130215 assistant who assisted in the preparation of the

136245 2. An adult or minor child who resides with the ap plicant who
137246 also needs to be a program participant in o rder to ensure the safety
138247 of the applicant may apply. Each adult living in the househ old must
139248 complete a separate application. An adult may apply on behalf of a
140249 minor.

142250 3. Applications shall be filed with the Office of the Attorney
143251 General.

145252 4. Upon filing a properly completed application, the Attorney
146253 General shall certify the applicant as a program participant.
147254 Applicants shall be certified for four (4) years following the date
148255 of filing unless the certification is withdrawn or invalidated
149256 before that date. The Attorney General shall by rule establish a
150257 renewal procedure.

152258 5. A person who falsely attests in an application that
153259 disclosure of the address of the applicant would endanger the safety
154260 of the applicant or the safety of the children of the appl icant or
155261 the minor or incapacitated person on whose behalf the application is
156262 made, or who knowingly provides false or incorrect information upon
157263 making an application, may be found guilty of perjury u nder Sections
158264 500 and 504 of Title 21 of the Oklahoma S tatutes.

160265 E. 1. If the program participant obtains a name change, the
161266 participant loses certification as a program participant.

163294 2. The Attorney General may cancel the certification of a
164295 program participant if there is a change in the residential address,
165296 unless the program participant provides th e Attorney General notice
166297 no later than seven (7) days after the change occurs .

168298 3. The Attorney General may cancel certification of a program
169299 participant if mail forwarded by the Attorney General to the address
170300 of the program participant is returned as no ndeliverable.

172301 4. The Attorney General shall cancel certification of a program
173302 participant who applies using false information.

175303 F. 1. A program participant may request that state and local
176304 agencies use the addre ss designated by the Attorney General as the
177305 address of the participant. When creatin g a new public record,

180306 state and local agencies shall accept the address designated by the
181307 Attorney General as a substitute address for the program
182308 participant, unless th e Attorney General has determined that:

184309 a. the agency has a bona fide statutory or adm inistrative
185310 requirement for the use of the address which would
186311 otherwise be confidenti al under this section, and
187-
188312 b. this address will be used only for those statutory and
189313 administrative purposes.

191314 2. A program participant may use the address designated by the
192315 Attorney General as a work address.

194316 3. The Office of the Attorney General shall forward all first
195317 class, certified and registered mail to the appropriate program

197346 required to track or other wise maintain records of any mail received
198347 on behalf of a participant unless the mail is certified or
199348 registered mail.

201349 G. The Attorney General may not make any records i n a file of a
202350 program participant available for inspection or copying, other than
203351 the address designated by the Attorney General, except under the
204352 following circumstances:

206353 1. If directed by a court or der, to a person identified in the
207354 order; or

209355 2. To verify the participation of a specific program
210356 participant to a state or local agency , in which case the Attorney
211357 General may only confirm information supplied by the requeste r.

213358 No employee of a state or local agency shall knowingly and
214359 intentionally disclose a program participant 's actual address unl ess
215360 disclosure is permitted by law.

217361 H. The Attorney General shall designate state and local
218362 agencies, federal government, federa lly recognized tribes, and
219363 nonprofit agencies to assist persons in applying to be pr ogram
220364 participants. A volunteer or employe e of a designated entity that
221365 provides counseling, referral, shelter, or other services to victims

224366 of domestic abuse, sexual assa ult, or stalking, human trafficking,
225367 or child abduction, and has been trained by the Attorney General

227396 counseling rendered by the Office of the Attorney General or an
228397 application assistant to applicants shall in no way be construed as
229398 legal advice.

231399 I. The Attorney General may enter into agreements with the
232400 federal government and federally recognized tribes in the State of
233401 Oklahoma this state or other entities for purposes of the
234402 implementation of the Addr ess Confidentiality Program, including the
235403 use and acceptance of the subs titute address designated by the
236404 Attorney General.

238405 J. Effective July 1, 2008, all adm inistrative rules promulgated
239406 by the Office of the Secretary of State to implement this program
240407 shall be transferred to and b ecome part of the administrative rules
241408 of the Office of the Attorney General. The Offic e of Administrative
242409 Rules in the Office of the Secretary of State shall provide adequate
243410 notice in "The Oklahoma Register " of the transfer of such rules, and
244411 shall place the transferred rules under the Administrat ive Code
245412 section of the Attorney General. Such rules shall continue in force
246413 and effect as rules of the Office of the Attorney General from and
247414 after July 1, 2008, and any amendment, repeal or addition to the
248415 transferred rules shall be under the jurisdict ion of the Attorney
249416 General. The Attorney General shall adopt and promulgate rules to
250417 implement this program , as applicable.

252418 K. Beginning July 1, 2008, the Director of the Address
253419 Confidentiality Program shall cease to be a position within the

254447 Office of the Secretary of State. All unexpended fun ds, property,
255448 records, personnel, and outst anding financial obligations and
256449 encumbrances related to the position and the Office of Address
257450 Confidentiality Program with the Office of the Secretary of State
258451 shall be transferred to the Office of the Attorney General. All
259452 personnel shall retain their employment position and status as
260453 unclassified employees, any leave, sick and annual time earned, and
261454 any retirement and longevity benefits which have accrued during
262455 tenure with the Office of the Secretary of Stat e.

264456 SECTION 3. This act shall become effective November 1, 2022.
