3665 BE IT ENACTED BY THE PEOPLE OF THE S TATE OF OKLAHOMA:

3866 SECTION 1. NEW LAW A new section of law to be codified
3967 in the Oklahoma Statutes as Section 509.12 of Title 70, unless there
4068 is created a duplication in numbering, reads a s follows:

4269 A. A school district board of ed ucation may approve a request

4498 office as an officer, director, trustee , or agent of a national,
4599 statewide, or school district employee association . The employee
46100 requesting the leave shall provide the school district

49101 superintendent with proof of election and proof of the term of
50102 office for the national, statewide, or school district employee
51103 association. Proof of election shall include but not be limited to
52104 certification by the national, statewide, or school district
53105 employee association of the date of the election and the results of
54106 the election. Board of education approval for leave requested
55107 pursuant to this section shall have definitive begin ning and end
56108 dates.

58109 B. Leave granted pursuant to this section shall be leave
59110 without pay. The school employee on leave shall not be enti tled to
60111 maintain any benefits granted by the school district regardless of
61112 whether the benefit is paid by the employee on leave or the
62113 association for which the person is serving as an officer, director,
63114 trustee, or agent.

65115 C. During the leave period, the school employee's position with
66116 the school district shall be maintained without advancement on the
67117 minimum salary schedu le adopted pursuant to Section 5 -141 of Title
68118 70 of the Oklahoma Statutes and with no accrual of s ick leave,
69119 personal business leave, or personal leave. The employee on leave
70120 shall not accumulate service credit within the Teachers' Retirement
71121 System of Oklahoma. Following the term of leave granted pursuant to

72149 the provisions of this section, the employee granted leave may
73150 return to his or her former position or a comparable position.

75151 D. A school district employee granted leave pursuant to the
76152 provisions of this section shall be prohibited from accessin g school
77153 district office space .

79154 E. If a national, statewide, or school district employee
80155 association that serves as a school district employee organization
81156 established pursuant to Sect ion 509.2 of Title 70 of the Oklahoma
82157 Statutes fails to comply with the provisions of this section , the
83158 school district board of education shall no long er recognize the
84159 organization as a representative of employees .
160+SECTION 2. This act shall become effective July 1, 2022.
161+SECTION 3. It being immediately necessary for t he preservation
162+of the public peace, health or safety, an emergency is hereby
163+declared to exist, by reason whereof this act shall take effect and
164+be in full force from and after its passage and approval.
