87	87	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
88	88	SECTION 1. NEW LAW A new section of law to be codified
89	89	in the Oklahoma Statutes as Section 1702 of Title 82, unless there
90	90	is created a duplication in numbering, rea ds as follows:
91	91	A. This act shall be known and may be cited as the “Oklahoma
92	92	Water Economic Impact Study Act ”.

145	145	1. “Instream flow” means the water flow required to maintain
146	146	the functions and resilience of freshwater stream syst ems and the
147	147	needs of communities that depend on th e healthy ecosystems ; and
148	148	2. “Instream flow study” means a study to develop the instream
149	149	flow determinations and biological assessments needed to maintain
150	150	instream flows and support a sound ecological envi ronment.
151	151	C. There is hereby created in the State Treasury a revolving
152	152	fund for the Oklahoma Water Resources Board to be designated the
153	153	“Oklahoma Water Economic Impact Study Fund ” for the purpose of
154	154	conducting instream flow studies . The revolving fund shall be a
155	155	continuing fund, not subject to fiscal year limitations, and shall
156	156	consist of all monies received by the Oklahoma Water Resources Board
157	157	from the appropriations, apportionments, donations, federal grants,
158	158	and fee revenues designated for the p urposes of implementing the
159	159	provisions of this act. All monies accruing to the credit of the
160	160	fund may be budgeted and expended by the Secretary of Energy and
161	161	Environment, in agreement w ith the Executive Director of the
162	162	Oklahoma Water Resources Board, the Executive Director of the
163	163	Department of Wildlife Conservation, the Secretary of Agriculture ,
164	164	and the Secretary of Commerce . Expenditures from the fund shall be
165	165	made upon warrants issued by the State Treasurer against claims
166	166	filed as prescribed by law with the Di rector of the Office of
167	167	Management and Enterprise Services for approval and payment.

219	219	D. Upon agreement of the Secretary of Energy and Environment,
220	220	the Executive Director of the Oklahoma Water Resources Board, the
221	221	Executive Director of the Department of Wildlife Conservation, the
222	222	Secretary of Agriculture , and the Secretary of Commerce , the Board
223	223	may conduct an instream flow study on any body of water agreed upon
224	224	by the entities to enable the protection, conservation, recreation al
225	225	use, and economic developme nt of water resources and to protect the
226	226	rights of the citizens of this state to use water for riparian and
227	227	domestic use, as authorized pursuant to Section 105.2 of Title 82 of
228	228	the Oklahoma Statutes. Such study shall include the identification
229	229	of the methodology and metric to be measured by the instream flow
230	230	study and any biological assessments that are to be made during the
231	231	study, and shall include recommendations for the completion of
232	232	instream flow determinati ons in the body of water that is the
233	233	subject of the study.
234	234	E. The Oklahoma Water Resource s Board shall work in cooperation
235	235	with the Department of Commerce to conduct an instream flow study
236	236	required pursuant to this section. A final copy of the completed
237	237	instream flow study shall be submitted to the Governor, the
238	238	President Pro Tempore of the Senate , the Speaker of the House of
239	239	Representatives, the Secretary of Energy and Environment, and the
240	240	Department of Wildlife Conservation. The Oklahoma Water Resources
241	241	Board shall promulgate rules to implement t he provisions of this
242	242	act.

301	301	Oklahoma Water Economic Impact Study Fund created pursuant to
302	302	Section 1 of this act.
303	303	SECTION 3. This act shall become effective Nove mber 1, 2022.
