8787 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
8888 SECTION 1. NEW LAW A new section of law to be codified
8989 in the Oklahoma Statutes as Section 1702 of Title 82, unless there
9090 is created a duplication in numbering, rea ds as follows:
9191 A. This act shall be known and may be cited as the “Oklahoma
9292 Water Economic Impact Study Act ”.

145145 1. “Instream flow” means the water flow required to maintain
146146 the functions and resilience of freshwater stream syst ems and the
147147 needs of communities that depend on th e healthy ecosystems ; and
148148 2. “Instream flow study” means a study to develop the instream
149149 flow determinations and biological assessments needed to maintain
150150 instream flows and support a sound ecological envi ronment.
151151 C. There is hereby created in the State Treasury a revolving
152152 fund for the Oklahoma Water Resources Board to be designated the
153153 “Oklahoma Water Economic Impact Study Fund ” for the purpose of
154154 conducting instream flow studies . The revolving fund shall be a
155155 continuing fund, not subject to fiscal year limitations, and shall
156156 consist of all monies received by the Oklahoma Water Resources Board
157157 from the appropriations, apportionments, donations, federal grants,
158158 and fee revenues designated for the p urposes of implementing the
159159 provisions of this act. All monies accruing to the credit of the
160160 fund may be budgeted and expended by the Secretary of Energy and
161161 Environment, in agreement w ith the Executive Director of the
162162 Oklahoma Water Resources Board, the Executive Director of the
163163 Department of Wildlife Conservation, the Secretary of Agriculture ,
164164 and the Secretary of Commerce . Expenditures from the fund shall be
165165 made upon warrants issued by the State Treasurer against claims
166166 filed as prescribed by law with the Di rector of the Office of
167167 Management and Enterprise Services for approval and payment.

219219 D. Upon agreement of the Secretary of Energy and Environment,
220220 the Executive Director of the Oklahoma Water Resources Board, the
221221 Executive Director of the Department of Wildlife Conservation, the
222222 Secretary of Agriculture , and the Secretary of Commerce , the Board
223223 may conduct an instream flow study on any body of water agreed upon
224224 by the entities to enable the protection, conservation, recreation al
225225 use, and economic developme nt of water resources and to protect the
226226 rights of the citizens of this state to use water for riparian and
227227 domestic use, as authorized pursuant to Section 105.2 of Title 82 of
228228 the Oklahoma Statutes. Such study shall include the identification
229229 of the methodology and metric to be measured by the instream flow
230230 study and any biological assessments that are to be made during the
231231 study, and shall include recommendations for the completion of
232232 instream flow determinati ons in the body of water that is the
233233 subject of the study.
234234 E. The Oklahoma Water Resource s Board shall work in cooperation
235235 with the Department of Commerce to conduct an instream flow study
236236 required pursuant to this section. A final copy of the completed
237237 instream flow study shall be submitted to the Governor, the
238238 President Pro Tempore of the Senate , the Speaker of the House of
239239 Representatives, the Secretary of Energy and Environment, and the
240240 Department of Wildlife Conservation. The Oklahoma Water Resources
241241 Board shall promulgate rules to implement t he provisions of this
242242 act.

297297 There is hereby appropriat ed to the Oklahoma Water Resources
298298 Board any monies not otherwise appropriated from the General Revenue
299299 Fund of the State Treasury for the fiscal year ending June 30, 20 23,
300300 the sum of Three Million Dollars ($3,0 00,000.00) to transfer to the
301301 Oklahoma Water Economic Impact Study Fund created pursuant to
302302 Section 1 of this act.
303303 SECTION 3. This act shall become effective Nove mber 1, 2022.
