56	53		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
57	54		SECTION 1. NEW LAW A new section of law to be codified
58	55		in the Oklahoma Statutes as Section 5-140.1 of Title 70, unless
59	56		there is created a duplication in numb ering, reads as follows:
60	57		A. The Educators’ Professional Liabilit y Insurance Program
61	58		shall be created for full-time and part-time personnel employed by a
62	59		public school district and a public charter school. The program
63	60		shall provide liability coverage for employees up to One Million
64	61		Dollars ($1,000,000.00) in coverage per occurrence.
	62	+	B. The program shall be administered by the Office of
	63	+	Management and Enterprise Services (OMES). OMES shall promulgate
	64	+	rules to implement the provisions of t his act. OMES may contract

91		-	B. The program shall be administered by the Office of
92		-	Management and Enterprise Services (OMES). OMES shall promulgate
93		-	rules to implement the provisions of t his act. OMES may contract
94	92		liability insurance from a licensed insurer, create a self-insured
95	93		risk pool, or use a combination of both. The insurance carrier
96	94		providing any portion of coverage provided under this act shall be
97	95		selected by a competitive process.
98	96		C. The Legislature shall provide an annual appropriation to
99	97		cover the costs and any associated premiums for the program.
100	98		D. The State Department of Edu cation shall provide to eligible
101	99		employees upon hiring and annually thereafter written notice of the
102	100		Educators' Professional Liability Insurance Program. The notice
103	101		shall specifically inform em ployees that coverage is provided
104	102		automatically as part of the ir employment.
105	103		E. Nothing in this section shall be constru ed to exempt a local
106	104		school district from an y current obligations or dut ies nor amend or
107	105		alter The Governmental Tort Claims Act provided in S ections 151
108	106		through 172 of Title 51 of the Oklahoma Stat utes.
109	107		SECTION 2. It being immediately nece ssary for the preservation
110	108		of the public peace, health or safety, an emergency is hereby
111	109		declared to exist, by reason whereof this act shall take effect and
112	110		be in full force from and after its pass age and approval.
