5653 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5754 SECTION 1. NEW LAW A new section of law to be codified
5855 in the Oklahoma Statutes as Section 5-140.1 of Title 70, unless
5956 there is created a duplication in numb ering, reads as follows:
6057 A. The Educators’ Professional Liabilit y Insurance Program
6158 shall be created for full-time and part-time personnel employed by a
6259 public school district and a public charter school. The program
6360 shall provide liability coverage for employees up to One Million
6461 Dollars ($1,000,000.00) in coverage per occurrence.
62+B. The program shall be administered by the Office of
63+Management and Enterprise Services (OMES). OMES shall promulgate
64+rules to implement the provisions of t his act. OMES may contract

91-B. The program shall be administered by the Office of
92-Management and Enterprise Services (OMES). OMES shall promulgate
93-rules to implement the provisions of t his act. OMES may contract
9492 liability insurance from a licensed insurer, create a self-insured
9593 risk pool, or use a combination of both. The insurance carrier
9694 providing any portion of coverage provided under this act shall be
9795 selected by a competitive process.
9896 C. The Legislature shall provide an annual appropriation to
9997 cover the costs and any associated premiums for the program.
10098 D. The State Department of Edu cation shall provide to eligible
10199 employees upon hiring and annually thereafter written notice of the
102100 Educators' Professional Liability Insurance Program. The notice
103101 shall specifically inform em ployees that coverage is provided
104102 automatically as part of the ir employment.
105103 E. Nothing in this section shall be constru ed to exempt a local
106104 school district from an y current obligations or dut ies nor amend or
107105 alter The Governmental Tort Claims Act provided in S ections 151
108106 through 172 of Title 51 of the Oklahoma Stat utes.
109107 SECTION 2. It being immediately nece ssary for the preservation
110108 of the public peace, health or safety, an emergency is hereby
111109 declared to exist, by reason whereof this act shall take effect and
112110 be in full force from and after its pass age and approval.
