6565 An Act relating to insurance; defining terms;

7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. NEW LAW A new section of law to be codified
7777 in the Oklahoma Statutes a s Section 6060.8c of Title 36, unless
7878 there is created a duplication in numbering, reads as follows :
7979 A. For the purposes of this section :
8080 1. “Health benefit plan” means any plan or arrangement as
8181 defined in subsection C of Section 6060.4 of Title 36 of the
8282 Oklahoma Statutes;
8383 2. “Iatrogenic infertility” means an impairment of fertility by
8484 surgery, radiation, chemotherapy , or other medical treatment for
8585 diagnosis of cancer; and

137137 3. “Retrieval” means ovulation induction and procedure to
138138 obtain the eggs or s perm. It does not include subsequent storage,
139139 disposition, fertilization, or subsequent transplantation.
140140 B. Any health benefit plan including the State and Education
141141 Employees Group Health Insurance Plan, that is offered, issued, or
142142 renewed in this state on or after the effective date of this act
143143 shall provide coverage for retrieval of eggs or spe rm in a covered
144144 person who will receive a medically n ecessary treatment including
145145 surgery, chemotherapy, and radiation, that has been medically
146146 determined to cause iatrogenic infertility.
147147 C. The coverage pro vided by this section shall be subject to
148148 the same annual deductibles, cop ayments, or coinsurance limits as
149149 established for all cove red benefits under the health benefit plan.
150150 SECTION 2. This act shall become effective January 1, 2023.
