75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. NEW LAW A new section of law to be codified
77	77	in the Oklahoma Statutes a s Section 6060.8c of Title 36, unless
78	78	there is created a duplication in numbering, reads as follows :
79	79	A. For the purposes of this section :
80	80	1. “Health benefit plan” means any plan or arrangement as
81	81	defined in subsection C of Section 6060.4 of Title 36 of the
82	82	Oklahoma Statutes;
83	83	2. “Iatrogenic infertility” means an impairment of fertility by
84	84	surgery, radiation, chemotherapy , or other medical treatment for
85	85	diagnosis of cancer; and

137	137	3. “Retrieval” means ovulation induction and procedure to
138	138	obtain the eggs or s perm. It does not include subsequent storage,
139	139	disposition, fertilization, or subsequent transplantation.
140	140	B. Any health benefit plan including the State and Education
141	141	Employees Group Health Insurance Plan, that is offered, issued, or
142	142	renewed in this state on or after the effective date of this act
143	143	shall provide coverage for retrieval of eggs or spe rm in a covered
144	144	person who will receive a medically n ecessary treatment including
145	145	surgery, chemotherapy, and radiation, that has been medically
146	146	determined to cause iatrogenic infertility.
147	147	C. The coverage pro vided by this section shall be subject to
148	148	the same annual deductibles, cop ayments, or coinsurance limits as
149	149	established for all cove red benefits under the health benefit plan.
150	150	SECTION 2. This act shall become effective January 1, 2023.
