7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -740.17, is
7777 amended to read as follows:
7878 Section 1-740.17. A. The State Department of Health Oklahoma
7979 Department of Commerce shall make grants, from funds appropriated by
8080 the Legislature specifically for this purpose, to a grant -
8181 supervising entity for the purpose of reimbursing private
8282 organizations in Oklahoma for the reasonable expenses of programs
8383 providing the following services:
8484 1. Providing information on, referral to and assistan ce in
8585 securing the services of relevant existing programs or agencies that
8686 assist women in Oklahoma to carry their children to term, and/or
8787 providing services that assist women to carry their children to te rm

139139 including, but not limited to, agencies and pro grams that will
140140 provide medical attention for the pregnant woman for the durat ion of
141141 her pregnancy, nutritional sup port services, housing assistance,
142142 adoption services, education and employment assistance a nd parenting
143143 education and support services;
144144 2. Providing women in Oklahoma, in person and through community
145145 outreach, information and/or services that encourage a nd assist them
146146 to carry their children to term; and
147147 3. Providing services including, but no t limited to, healthcare
148148 services to mothers and i nfants for the purpose of reducing the
149149 rates of maternal mortality and infant mortality in this state by
150150 three percent (3%) within five (5) years of the effective date of
151151 this act July 1, 2021; provided, however, no funds shall be provided
152152 to an organization that provides, or whose affiliates provide,
153153 abortion services.
154154 B. To be eligible for a service grant, an organization shall :
155155 1. Be registered with the Oklahoma Secretary of State as a not -
156156 for-profit corporation located in Oklahoma;
157157 2. Have the grant amount approved by a grant -supervising
158158 entity;
159159 3. For services described in paragraphs 1 and 2 of subsection A
160160 of this section, provide each pregnant woman counseled with accurate
161161 information on the develo pmental characteristics of unborn children

214214 738.3 of Title 63 of the Oklaho ma Statutes;
215215 4. Assure that the gran t’s sole purposes are to assist and
216216 encourage women to carry their children to term and to maximize
217217 their potentials thereafter o r to reduce the rates of maternal
218218 mortality and infant mortality in this state as provided in
219219 paragraph 3 of subsection A of th is section; and
220220 5. Assure that none of the funds provided pursuant to the
221221 Choosing Childbirth Act, nor any other funds or servic es provided by
222222 the organization, are used to encourage or counsel a woman to have
223223 an abortion not necessary to prevent her deat h, to provide her such
224224 an abortion or to refer her for such an abortion.
225225 SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.18, is
226226 amended to read as follows:
227227 Section 1-740.18. The State Department of Health Oklahoma
228228 Department of Commerce shall make grants to a grant -supervising
229229 entity under the Choosing Ch ildbirth Act from funds a ppropriated by
230230 the Legislature specifically for this purpose. The State Department
231231 of Health Department shall annually monitor and review the grant -
232232 supervising entity to assure that the grant -supervising entity
233233 carefully adheres to the purposes and requir ements of the Choosing
234234 Childbirth Act, and it shall cease funding a grant -supervising
235235 entity that fails to do so if the Department proves specific
236236 findings of noncompliance, subject to judicial review.

288288 SECTION 3. This act shall become effective July 1, 2022.
289289 SECTION 4. It being immediately necessary for the preservation
290290 of the public peace, health or safety, an emergency is hereby
291291 declared to exist, by reason whereof th is act shall take effect and
292292 be in full force from and after its passage and app roval.
