75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 63 O.S. 2021, Section 1 -740.17, is
77	77	amended to read as follows:
78	78	Section 1-740.17. A. The State Department of Health Oklahoma
79	79	Department of Commerce shall make grants, from funds appropriated by
80	80	the Legislature specifically for this purpose, to a grant -
81	81	supervising entity for the purpose of reimbursing private
82	82	organizations in Oklahoma for the reasonable expenses of programs
83	83	providing the following services:
84	84	1. Providing information on, referral to and assistan ce in
85	85	securing the services of relevant existing programs or agencies that
86	86	assist women in Oklahoma to carry their children to term, and/or
87	87	providing services that assist women to carry their children to te rm

140	140	provide medical attention for the pregnant woman for the durat ion of
141	141	her pregnancy, nutritional sup port services, housing assistance,
142	142	adoption services, education and employment assistance a nd parenting
143	143	education and support services;
144	144	2. Providing women in Oklahoma, in person and through community
145	145	outreach, information and/or services that encourage a nd assist them
146	146	to carry their children to term; and
147	147	3. Providing services including, but no t limited to, healthcare
148	148	services to mothers and i nfants for the purpose of reducing the
149	149	rates of maternal mortality and infant mortality in this state by
150	150	three percent (3%) within five (5) years of the effective date of
151	151	this act July 1, 2021; provided, however, no funds shall be provided
152	152	to an organization that provides, or whose affiliates provide,
153	153	abortion services.
154	154	B. To be eligible for a service grant, an organization shall :
155	155	1. Be registered with the Oklahoma Secretary of State as a not -
156	156	for-profit corporation located in Oklahoma;
157	157	2. Have the grant amount approved by a grant -supervising
158	158	entity;
159	159	3. For services described in paragraphs 1 and 2 of subsection A
160	160	of this section, provide each pregnant woman counseled with accurate
161	161	information on the develo pmental characteristics of unborn children

214	214	738.3 of Title 63 of the Oklaho ma Statutes;
215	215	4. Assure that the gran t’s sole purposes are to assist and
216	216	encourage women to carry their children to term and to maximize
217	217	their potentials thereafter o r to reduce the rates of maternal
218	218	mortality and infant mortality in this state as provided in
219	219	paragraph 3 of subsection A of th is section; and
220	220	5. Assure that none of the funds provided pursuant to the
221	221	Choosing Childbirth Act, nor any other funds or servic es provided by
222	222	the organization, are used to encourage or counsel a woman to have
223	223	an abortion not necessary to prevent her deat h, to provide her such
224	224	an abortion or to refer her for such an abortion.
225	225	SECTION 2. AMENDATORY 63 O.S. 2021, Section 1-740.18, is
226	226	amended to read as follows:
227	227	Section 1-740.18. The State Department of Health Oklahoma
228	228	Department of Commerce shall make grants to a grant -supervising
229	229	entity under the Choosing Ch ildbirth Act from funds a ppropriated by
230	230	the Legislature specifically for this purpose. The State Department
231	231	of Health Department shall annually monitor and review the grant -
232	232	supervising entity to assure that the grant -supervising entity
233	233	carefully adheres to the purposes and requir ements of the Choosing
234	234	Childbirth Act, and it shall cease funding a grant -supervising
235	235	entity that fails to do so if the Department proves specific
236	236	findings of noncompliance, subject to judicial review.

288	288	SECTION 3. This act shall become effective July 1, 2022.
289	289	SECTION 4. It being immediately necessary for the preservation
290	290	of the public peace, health or safety, an emergency is hereby
291	291	declared to exist, by reason whereof th is act shall take effect and
292	292	be in full force from and after its passage and app roval.
