147147 Section 6-190. A. The board of education of each school
148148 district shall employ and contract in writing, as required in
149149 Section 6-101 of this title, only with persons certified to teach by
150150 the State Board of Education in accordance with the Oklahoma Teacher
151151 Preparation Act, except as otherwise provided for by Section 6 -101
152152 of this title and by other law.
153153 B. The Board shall issue a certificate to teach to any person
154154 who:
155155 1. Has successfully completed th e teacher education program
156156 required by the Commission for Educat ional Quality and
157157 Accountability;
158158 2. Has graduated from an accredited i nstitution of higher
159159 education that has approval or accreditation for teacher education;
160160 3. Has met all other requirem ents as may be established by the
161161 Board;
162162 4. Has made the necessa ry application and paid the competency
163163 examination fee in an amount and as prescribed by the Commission;
164164 5. Has successfully completed the competency examination
165165 required in Section 6 -187 of this title; and
166166 6. Beginning November 1, 2001, has on file with the Board a
167167 current Oklahoma criminal history record from the Oklahoma State
168168 Bureau of Investigation as well as a national criminal history
169169 record check as defined in Section 150.9 of Title 74 of the Oklahoma
170170 Statutes. Upon receipt of the Oklahoma crimin al history record, the

222222 Board may issue a temporary certificate which sha ll be effective
223223 until receipt of the national fingerprint -based criminal history
224224 record. The person applying for a cer tificate shall be responsible
225225 for the cost of the criminal histor y records.
226226 C. The Board shall issue a certificate to teach to any perso n
227227 who:
228228 1. Holds an out-of-state certificate and meets the requirements
229229 set forth in subsection G of this section;
230230 2. Holds certification from the National Board for Professional
231231 Teaching Standards;
232232 3. Holds an out-of-country certificate and meets the
233233 requirements set forth in subsection F of this section; or
234234 4. Has successfully completed a competency examination used i n
235235 the majority of other states or comparable customized exam and meets
236236 the requirements set forth in subsection H of this section.
237237 D. Beginning July 1, 2004, any person applying for initial
238238 Oklahoma certification shall have on file with the Board a curren t
239239 Oklahoma criminal history record from the Oklahoma State Bureau of
240240 Investigation as well as a national criminal history record check as
241241 defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
242242 receipt of the Oklahoma criminal history record, the Board may issue
243243 a temporary certificate which shall be effect ive until receipt of
244244 the national fingerprint -based criminal history rec ord. The person

296296 applying for a certificate shall be responsible for the cost of the
297297 criminal history records.
298298 E. Any person holding a valid certificate, issued prior to
299299 January 1, 1997, shall be a certified teacher for purposes of the
300300 Oklahoma Teacher Preparation Act, subject to any professional
301301 development requirements prescribed by the Oklahoma Teacher
302302 Preparation Act or by the State Board of Education.
303303 F. 1. The Board shall issue a certificate to teach to a person
304304 who holds a valid out -of-country certificate and meets any
305305 requirements established by the Board. The certificate to teach
306306 shall only be for those subject areas and grade levels most closely
307307 aligned to the subject areas and grade levels recognized on the out-
308308 of-country certificate.
309309 2. A person who meets the requirements of paragraph 1 of this
310310 subsection shall not be required to take any competency examinat ions
311311 in those subject areas and grade levels most closely aligned to the
312312 subject areas and grade levels recognized on the out -of-country
313313 certificate.
314314 3. A person who meets the requirements of paragraph 1 of this
315315 subsection shall have on file with the Boar d a current Oklahoma
316316 criminal history record check from the Oklah oma State Bureau of
317317 Investigation as well as a national criminal history record check as
318318 defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon

375375 4. The Board shall promulgate rules es tablishing a process by
376376 which out-of-country certificates will be review ed and evaluated for
377377 purposes of awarding a certificate to teach pursuant to this
378378 subsection.
379379 G. 1. The Board shall i ssue a certificate to teach to a person
380380 who holds a valid out -of-state certificate. The certificate to
381381 teach shall only be for those sub ject areas and grade levels most
382382 closely aligned to the subject areas and grade levels recognized on
383383 the out-of-state certificate.
384384 2. A person who meets the requirements of paragraph 1 of this
385385 subsection shall not be required to take any competency examin ations
386386 in those subject areas and grade levels most closely aligned to the
387387 subject areas and grade levels recognized on the out-of-state
388388 certificate.
389389 3. A person who meets the require ments of this subsection shall
390390 have on file with the Board a current Okl ahoma criminal history

448448 person applying for a ce rtificate shall be responsible for the cost

450450 H. 1. The Board shall issue a certificate to teach to a person
451451 who has successfully completed a competency exam used in a majority
452452 of the other states. The certificate to teach shall only be for
453453 those subject areas and grade levels that corre spond with a
454454 certification area used in Oklahoma this state.
455455 2. A person who meets the requirements of paragraph 1 of this
456456 subsection shall have on file with the Board a current Oklahoma
457457 criminal history record check from the Oklahoma State Bureau of
458458 Investigation as well as a national criminal history record check as
459459 defined in Section 150.9 of Title 74 of the Oklahoma Statutes. U pon
460460 receipt of the Oklahoma criminal history record check, the Bo ard may
461461 issue a temporary certificate which shall be effectiv e until receipt
462462 of the national fingerprint -based criminal history record check.
463463 The person applying for a certificate shall be r esponsible for the
464464 cost of the criminal history record checks.
465465 I. The Board shall issue a Each school district board of

468468 of advanced, lead, and master teaching certificate certificates to

521521 1. Has successfully compl eted the requirements of this
522522 subsection;
523523 2. Has a minimum of five (5) years of experience as a teacher;
524524 3. Participates in a meaningful individualized program of
525525 professional development, as p rovided for in Section 6-101.10 of
526526 this title;
527527 4. Has earned a “highly effective” or “superior” rating
528528 pursuant to Section 6 -101.16 of this title; and
529529 5. May have a teaching load of not more than seventy -five
530530 percent (75%) student instruction to allow th e teacher to mentor
531531 other teachers.
532532 J. 1. The Board shall i ssue a master teaching certificate to
533533 any person who upon application:
534534 a. has successfully completed the requirements of this
535535 subsection,
536536 b. has a minimum of seven (7) years of experience as a
537537 teacher, and
538538 c. (1) has earned a “superior” rating pursuant to
539539 Section 6-101.16 of this title, or
540540 (2) has earned a “highly effective” rating pursuant
541541 to Section 6-101.16 of this title and holds or
542542 has held a National Board certification from the
543543 National Board for Professional Teaching

596596 2. Teachers with a m aster teaching certificate may assume
597597 leadership roles that include but are n ot limited to:
598598 a. the planning and delivery of professional development
599599 activities designed to improve instructional
600600 strategies,
601601 b. the facilitation of an instructional leadership team
602602 within the building or school district in which the
603603 lead teacher is assigned, and
604604 c. the mentoring of other teachers and participation in
605605 evaluations of other teachers.
606606 3. Teachers with a master teaching certificate may have a
607607 teaching load of not m ore than fifty percent (50%) student
608608 instruction to allow the lead teacher to spend time on:
609609 a. co-teaching,
610610 b. co-planning,
611611 c. peer reviews, and
612612 d. other duties mutually agreed upon by the
613613 superintendent and the master teacher, and may be used
614614 to satisfy the qualitative evaluation component for
615615 teachers as required by Section 6 -101.16 of this title
616616 by performing the duties set forth in this paragraph
617617 teachers employed by the school district.

669669 1. The framework established pursuant to this subsectio n shall
670670 provide for identification of high quality teachers employed by the
671671 school district including at a minimum:
672672 a. a teacher observation component which may be the same
673673 as that used by the district for its written policy of
674674 evaluation and corresponding professi onal development
675675 adopted pursuant to Section 6-101.10 of this title.
676676 Districts may adopt an alternative observation rubric
677677 if the State Department of Education verifies it shows
678678 evidence of validity and reliability, and
679679 b. a student performance component that includes student
680680 growth measures. The student performance component
681681 may include summative or formative pre- and post-
682682 tests, value-added measures, student learning
683683 objectives, and student portfolios.
684684 2. The framework established pursuant to th is subsection may
685685 include additional factors including but not limited to student
686686 surveys, teacher leadership responsibilities, teacher mentorship
687687 responsibilities, family surveys, demonstrati on of district core
688688 values, teacher peer survey s, and contributions to the broader
689689 school community.
690690 J. The State Department of Education shall evaluate frameworks
691691 submitted by school districts pursuant to sub section I of this
692692 section to determine whether the y show evidence of validity and

745745 and validate frameworks biannually.
746746 K. Teachers with advanced, lead, or master teaching
747747 certificates employed by a school district that has adopted an
748748 alternative observati on rubric approved by the State Department of
749749 Education pursuant to subparagraph a of paragraph 1 of subsection I
750750 of this section may be exempt from the written policy of evaluation
751751 and corresponding professional development adopted by the school
752752 district board of education pursuant to Section 6-101.10 of this
753753 title.
754754 L. A school district that receives approval for its framework
755755 adopted pursuant to subsection I of this section may recommend
756756 teachers to the State Board of Education for advanced, lead, or
757757 master teaching certificates prior to the beginning of the school
758758 year and prior to the beginning of the second semester.
759759 M. Teachers with advanced, lead, or master teaching
760760 certificates may be placed into professional development cohor ts and
761761 provided additional training opportunities from the S tate Department
762762 of Education.
763763 K. N. The State Board of Education shall adopt rules to
764764 implement a renewal schedule and associated fees for advanced, lead,
765765 and master teaching certificates. The rules shall allow a teach er

819819 teaching certificate.
820820 L. O. The terms of the contracts issued to those holding
821821 advanced, lead, and master teaching certifi cates shall include the
822822 following:
823823 1. Advanced: an additional five (5) days to be us ed to
824824 strengthen instructional leadership. A person with an advanced
825825 teaching certificate shall receive an annual salary supplement of at
826826 least Three Thousand Dollars ($ 3,000.00) or the district’s daily
827827 rate of pay, whichever is higher, in addition to t he salary for
828828 which the teacher qualifies pursuant to Section 18 -114.14 of this
829829 title. The salary supplement amount shall be matched by an equal
830830 amount from the Teacher Em powerment Revolving Fund created pursuant
831831 to Section 2 of this act. A person with an advanced teaching
832832 certificate who is employed by a school district with an average
833833 daily attendance of less than one thousand students or a school
834834 district that receives funds pursuant to Title I, Part A of the
835835 Elementary and Secondary Education Act of 1965 (ESEA) as
836836 reauthorized by P.L. No. 114-95, also known as the Every Student
837837 Succeeds Act (ESSA), shall receive an addition al salary supplement
838838 of One Thousand Five Hundr ed Dollars ($1,500.00);
839839 2. Lead: an additional t en (10) days to be used to strengthen
840840 instructional leadership. A person with a lead teaching certificate
841841 shall receive an annual salary supplement of at least Three Thousand

905905 of Two Thousand Five Hundred Dollars ($2,500.00); and
906906 2. 3. Master: an additional fifteen (15) days to be used to
907907 strengthen leadership. A person with a master teaching certificat e
908908 shall receive an annual salary supplement of at least Five Thousand
909909 Dollars ($5,000.00) Ten Thousand Dollars ($10,000.00) or the
910910 district’s daily rate of pay, whichever is higher, in addition to
911911 the salary for which the teacher qualifies pursuant to Section 18 -
912912 114.14 of this title . The salary supplement amount shall be matched
913913 by an equal amount from the Teacher Empowerment Revolving Fund
914914 created pursuant to Section 2 of this act. A person with a master
915915 teaching certificate who is employed by a school district with an
916916 average daily attendance of less than one thousand students or a

969969 the Elementary and Secondary Education Act of 1965 (ESEA) as
970970 reauthorized by P.L. No. 114-95, also known as the Every Student
971971 Succeeds Act (ESSA), shall receive an addition al salary supplement
972972 of Five Thousand Dollars ($5,000.00).
973973 If a person with a an advanced, lead, or master teaching
974974 certificate changes school districts during the life of the
975975 certificate, the terms of the contracts required in this subsection
976976 shall be subject to approval by the new employing school district.
977977 M. 1. Any person who is eligible for a lead or master teaching
978978 certificate described in this section shall make application for the
979979 following school year with the State Board of Education. The
980980 application shall include a reco mmendation from the local board of
981981 education and determination that the applicant has met the statutory
982982 criteria. In reviewing an application, the local school board of
983983 education and the superintendent shall consider the ability of the
984984 school district to fulfill the additional requirements described in
985985 subsections I and J of this section before making a recommendation
986986 to the State Board of Education.
987987 2. The State Department of Education shall develop an
988988 application to implement the provisions of this subs ection and make
989989 it available to school districts.
990990 N. P. Beginning in the 2021-2022 2022-2023 school year, the
991991 Department shall make the teaching certificates provided for in this

10481048 O. For the 2019-2020 and 2020-2021 school years, the Department
10491049 shall identify school districts to implement the tea ching
10501050 certificates provided for in this section on a pilot program basis
10511051 with the assistance of public -private partnerships, funding fro m
10521052 philanthropic organizations or federal grants.
10531053 P. The Department shall seek funding necessary for the
10541054 administration of this section. If funding Q. Funding for the
10551055 administration of the advanced, lead, and master teaching
10561056 certificates listed in subsections I and J including salary
10571057 supplements required by subsection O of this section shall be
10581058 provided on a first come, f irst served basis subject to availability
10591059 of funding. If funding for the administration of the advanced,
10601060 lead, and master teaching certificates is not available, the
10611061 Department shall not be required to ful fill the requirements listed
10621062 in subsections L, M, N and O and P of this section.
10631063 Q. R. The State Board of Education shall promulgate rules to
10641064 implement the provisions of this act section.

11161116 SECTION 2. NEW LAW A new section of law to be codified
11171117 in the Oklahoma Statutes as Section 6-190.2 of Title 70, unless
11181118 there is created a duplication in numbering, reads as follows:
11191119 There is hereby created in the State Treasury a revolving fund
11201120 for the State Department of Education to be designated the “Teacher
11211121 Empowerment Revolving Fund”. The fund shall be a continuing fund,
11221122 not subject to fiscal year limitations, and shall consist of all
11231123 monies received by the State Department of Education from
11241124 appropriations from the General Revenue Fund and the Oklahoma
11251125 Education Lottery Trust Fund . All monies accruing to the credit of
11261126 the fund are hereby appropriated and may be budgeted and expended by
11271127 the State Department of Education for the purpose of providing
11281128 matching salary supplement funds pursuant to t he provisions of
11291129 subsection O of Section 6-190 of Title 70 of the Oklahoma Statutes .
11301130 Expenditures from the fund shall be made upon warrants issued by the
11311131 State Treasurer against claims filed as prescribed by law with the
11321132 Director of the Office of Manageme nt and Enterprise Services for
11331133 approval and payment.
11341134 SECTION 3. This act shall become effective July 1, 2022.
11351135 SECTION 4. It being immediately necessary for the preservation
11361136 of the public peace, health or safety, an emergency is hereby
11371137 declared to exist, by reason whereof this act shall take effect and
11381138 be in full force from and after its passage and approval.
