93	93		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
94	94		SECTION 1. AMENDATORY 70 O.S. 2021, Section 6 -190, is

147	147		Section 6-190. A. The board of education of each school
148	148		district shall employ and contract in writing, as required in
149	149		Section 6-101 of this title, only with persons certified to teach by
150	150		the State Board of Education in accordance with the Oklahoma Teacher
151	151		Preparation Act, except as otherwise provided for by Section 6 -101
152	152		of this title and by other law.
153	153		B. The Board shall issue a certificate to teach to any person
154	154		who:
155	155		1. Has successfully completed th e teacher education program
156	156		required by the Commission for Educat ional Quality and
157	157		Accountability;
158	158		2. Has graduated from an accredited i nstitution of higher
159	159		education that has approval or accreditation for teacher education;
160	160		3. Has met all other requirem ents as may be established by the
161	161		Board;
162	162		4. Has made the necessa ry application and paid the competency
163	163		examination fee in an amount and as prescribed by the Commission;
164	164		5. Has successfully completed the competency examination
165	165		required in Section 6 -187 of this title; and
166	166		6. Beginning November 1, 2001, has on file with the Board a
167	167		current Oklahoma criminal history record from the Oklahoma State
168	168		Bureau of Investigation as well as a national criminal history
169	169		record check as defined in Section 150.9 of Title 74 of the Oklahoma
170	170		Statutes. Upon receipt of the Oklahoma crimin al history record, the

222	222		Board may issue a temporary certificate which sha ll be effective
223	223		until receipt of the national fingerprint -based criminal history
224	224		record. The person applying for a cer tificate shall be responsible
225	225		for the cost of the criminal histor y records.
226	226		C. The Board shall issue a certificate to teach to any perso n
227	227		who:
228	228		1. Holds an out-of-state certificate and meets the requirements
229	229		set forth in subsection G of this section;
230	230		2. Holds certification from the National Board for Professional
231	231		Teaching Standards;
232	232		3. Holds an out-of-country certificate and meets the
233	233		requirements set forth in subsection F of this section; or
234	234		4. Has successfully completed a competency examination used i n
235	235		the majority of other states or comparable customized exam and meets
236	236		the requirements set forth in subsection H of this section.
237	237		D. Beginning July 1, 2004, any person applying for initial
238	238		Oklahoma certification shall have on file with the Board a curren t
239	239		Oklahoma criminal history record from the Oklahoma State Bureau of
240	240		Investigation as well as a national criminal history record check as
241	241		defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
242	242		receipt of the Oklahoma criminal history record, the Board may issue
243	243		a temporary certificate which shall be effect ive until receipt of
244	244		the national fingerprint -based criminal history rec ord. The person

296	296		applying for a certificate shall be responsible for the cost of the
297	297		criminal history records.
298	298		E. Any person holding a valid certificate, issued prior to
299	299		January 1, 1997, shall be a certified teacher for purposes of the
300	300		Oklahoma Teacher Preparation Act, subject to any professional
301	301		development requirements prescribed by the Oklahoma Teacher
302	302		Preparation Act or by the State Board of Education.
303	303		F. 1. The Board shall issue a certificate to teach to a person
304	304		who holds a valid out -of-country certificate and meets any
305	305		requirements established by the Board. The certificate to teach
306	306		shall only be for those subject areas and grade levels most closely
307	307		aligned to the subject areas and grade levels recognized on the out-
308	308		of-country certificate.
309	309		2. A person who meets the requirements of paragraph 1 of this
310	310		subsection shall not be required to take any competency examinat ions
311	311		in those subject areas and grade levels most closely aligned to the
312	312		subject areas and grade levels recognized on the out -of-country
313	313		certificate.
314	314		3. A person who meets the requirements of paragraph 1 of this
315	315		subsection shall have on file with the Boar d a current Oklahoma
316	316		criminal history record check from the Oklah oma State Bureau of
317	317		Investigation as well as a national criminal history record check as
318	318		defined in Section 150.9 of Title 74 of the Oklahoma Statutes. Upon
319	319		receipt of the Oklahoma criminal history record check, the Board may

373	373		The person applying for a certificate shall be responsible for the
374	374		cost of the criminal history record checks.
375	375		4. The Board shall promulgate rules es tablishing a process by
376	376		which out-of-country certificates will be review ed and evaluated for
377	377		purposes of awarding a certificate to teach pursuant to this
378	378		subsection.
379	379		G. 1. The Board shall i ssue a certificate to teach to a person
380	380		who holds a valid out -of-state certificate. The certificate to
381	381		teach shall only be for those sub ject areas and grade levels most
382	382		closely aligned to the subject areas and grade levels recognized on
383	383		the out-of-state certificate.
384	384		2. A person who meets the requirements of paragraph 1 of this
385	385		subsection shall not be required to take any competency examin ations
386	386		in those subject areas and grade levels most closely aligned to the
387	387		subject areas and grade levels recognized on the out-of-state
388	388		certificate.
389	389		3. A person who meets the require ments of this subsection shall
390	390		have on file with the Board a current Okl ahoma criminal history
391	391		record check from the Oklahoma State Bureau of Investigation as well
392	392		as a national criminal hist ory record check as defined in Section
393	393		150.9 of Title 74 of the O klahoma Statutes. Upon receipt of the
394	394		Oklahoma criminal history record check, the Board may issue a

447	447		national fingerprint -based criminal history record check. The
448	448		person applying for a ce rtificate shall be responsible for the cost
449	449		of the criminal history reco rd checks.
450	450		H. 1. The Board shall issue a certificate to teach to a person
451	451		who has successfully completed a competency exam used in a majority
452	452		of the other states. The certificate to teach shall only be for
453	453		those subject areas and grade levels that corre spond with a
454	454		certification area used in Oklahoma this state.
455	455		2. A person who meets the requirements of paragraph 1 of this
456	456		subsection shall have on file with the Board a current Oklahoma
457	457		criminal history record check from the Oklahoma State Bureau of
458	458		Investigation as well as a national criminal history record check as
459	459		defined in Section 150.9 of Title 74 of the Oklahoma Statutes. U pon
460	460		receipt of the Oklahoma criminal history record check, the Bo ard may
461	461		issue a temporary certificate which shall be effectiv e until receipt
462	462		of the national fingerprint -based criminal history record check.
463	463		The person applying for a certificate shall be r esponsible for the
464	464		cost of the criminal history record checks.
465	465		I. The Board shall issue a Each school district board of
466	466		education may adopt and submit to the State Department of Education
467	467		for approval a framework providing qualifications for the issuance
468	468		of advanced, lead, and master teaching certificate certificates to
469	469		any person who upon application:

521	521		1. Has successfully compl eted the requirements of this
522	522		subsection;
523	523		2. Has a minimum of five (5) years of experience as a teacher;
524	524		3. Participates in a meaningful individualized program of
525	525		professional development, as p rovided for in Section 6-101.10 of
526	526		this title;
527	527		4. Has earned a “highly effective” or “superior” rating
528	528		pursuant to Section 6 -101.16 of this title; and
529	529		5. May have a teaching load of not more than seventy -five
530	530		percent (75%) student instruction to allow th e teacher to mentor
531	531		other teachers.
532	532		J. 1. The Board shall i ssue a master teaching certificate to
533	533		any person who upon application:
534	534		a. has successfully completed the requirements of this
535	535		subsection,
536	536		b. has a minimum of seven (7) years of experience as a
537	537		teacher, and
538	538		c. (1) has earned a “superior” rating pursuant to
539	539		Section 6-101.16 of this title, or
540	540		(2) has earned a “highly effective” rating pursuant
541	541		to Section 6-101.16 of this title and holds or
542	542		has held a National Board certification from the
543	543		National Board for Professional Teaching

596	596		2. Teachers with a m aster teaching certificate may assume
597	597		leadership roles that include but are n ot limited to:
598	598		a. the planning and delivery of professional development
599	599		activities designed to improve instructional
600	600		strategies,
601	601		b. the facilitation of an instructional leadership team
602	602		within the building or school district in which the
603	603		lead teacher is assigned, and
604	604		c. the mentoring of other teachers and participation in
605	605		evaluations of other teachers.
606	606		3. Teachers with a master teaching certificate may have a
607	607		teaching load of not m ore than fifty percent (50%) student
608	608		instruction to allow the lead teacher to spend time on:
609	609		a. co-teaching,
610	610		b. co-planning,
611	611		c. peer reviews, and
612	612		d. other duties mutually agreed upon by the
613	613		superintendent and the master teacher, and may be used
614	614		to satisfy the qualitative evaluation component for
615	615		teachers as required by Section 6 -101.16 of this title
616	616		by performing the duties set forth in this paragraph
617	617		teachers employed by the school district.

669	669		1. The framework established pursuant to this subsectio n shall
670	670		provide for identification of high quality teachers employed by the
671	671		school district including at a minimum:
672	672		a. a teacher observation component which may be the same
673	673		as that used by the district for its written policy of
674	674		evaluation and corresponding professi onal development
675	675		adopted pursuant to Section 6-101.10 of this title.
676	676		Districts may adopt an alternative observation rubric
677	677		if the State Department of Education verifies it shows
678	678		evidence of validity and reliability, and
679	679		b. a student performance component that includes student
680	680		growth measures. The student performance component
681	681		may include summative or formative pre- and post-
682	682		tests, value-added measures, student learning
683	683		objectives, and student portfolios.
684	684		2. The framework established pursuant to th is subsection may
685	685		include additional factors including but not limited to student
686	686		surveys, teacher leadership responsibilities, teacher mentorship
687	687		responsibilities, family surveys, demonstrati on of district core
688	688		values, teacher peer survey s, and contributions to the broader
689	689		school community.
690	690		J. The State Department of Education shall evaluate frameworks
691	691		submitted by school districts pursuant to sub section I of this
692	692		section to determine whether the y show evidence of validity and

745	745		and validate frameworks biannually.
746	746		K. Teachers with advanced, lead, or master teaching
747	747		certificates employed by a school district that has adopted an
748	748		alternative observati on rubric approved by the State Department of
749	749		Education pursuant to subparagraph a of paragraph 1 of subsection I
750	750		of this section may be exempt from the written policy of evaluation
751	751		and corresponding professional development adopted by the school
752	752		district board of education pursuant to Section 6-101.10 of this
753	753		title.
754	754		L. A school district that receives approval for its framework
755	755		adopted pursuant to subsection I of this section may recommend
756	756		teachers to the State Board of Education for advanced, lead, or
757	757		master teaching certificates prior to the beginning of the school
758	758		year and prior to the beginning of the second semester.
759	759		M. Teachers with advanced, lead, or master teaching
760	760		certificates may be placed into professional development cohor ts and
761	761		provided additional training opportunities from the S tate Department
762	762		of Education.
763	763		K. N. The State Board of Education shall adopt rules to
764	764		implement a renewal schedule and associated fees for advanced, lead,
765	765		and master teaching certificates. The rules shall allow a teach er
766	766		that no longer meets the requirements of a an advanced, lead, or

820	820		L. O. The terms of the contracts issued to those holding
821	821		advanced, lead, and master teaching certifi cates shall include the
822	822		following:
823	823		1. Advanced: an additional five (5) days to be us ed to
824	824		strengthen instructional leadership. A person with an advanced
825	825		teaching certificate shall receive an annual salary supplement of at
826	826		least Three Thousand Dollars ($ 3,000.00) or the district’s daily
827	827		rate of pay, whichever is higher, in addition to t he salary for
828	828		which the teacher qualifies pursuant to Section 18 -114.14 of this
829	829		title. The salary supplement amount shall be matched by an equal
830	830		amount from the Teacher Em powerment Revolving Fund created pursuant
831	831		to Section 2 of this act. A person with an advanced teaching
832	832		certificate who is employed by a school district with an average
833	833		daily attendance of less than one thousand students or a school
834	834		district that receives funds pursuant to Title I, Part A of the
835	835		Elementary and Secondary Education Act of 1965 (ESEA) as
836	836		reauthorized by P.L. No. 114-95, also known as the Every Student
837	837		Succeeds Act (ESSA), shall receive an addition al salary supplement
838	838		of One Thousand Five Hundr ed Dollars ($1,500.00);
839	839		2. Lead: an additional t en (10) days to be used to strengthen
840	840		instructional leadership. A person with a lead teaching certificate
841	841		shall receive an annual salary supplement of at least Three Thousand

902	902		the Elementary and Secondary Education Act of 1965 (ESEA) as
903	903		reauthorized by P.L. No. 114-95, also known as the Every Student
904	904		Succeeds Act (ESSA), shall receive an addition al salary supplement
905	905		of Two Thousand Five Hundred Dollars ($2,500.00); and
906	906		2. 3. Master: an additional fifteen (15) days to be used to
907	907		strengthen leadership. A person with a master teaching certificat e
908	908		shall receive an annual salary supplement of at least Five Thousand
909	909		Dollars ($5,000.00) Ten Thousand Dollars ($10,000.00) or the
910	910		district’s daily rate of pay, whichever is higher, in addition to
911	911		the salary for which the teacher qualifies pursuant to Section 18 -
912	912		114.14 of this title . The salary supplement amount shall be matched
913	913		by an equal amount from the Teacher Empowerment Revolving Fund
914	914		created pursuant to Section 2 of this act. A person with a master
915	915		teaching certificate who is employed by a school district with an
916	916		average daily attendance of less than one thousand students or a

968	968		school district that receives funds pursuant to Title I, Par t A of
969	969		the Elementary and Secondary Education Act of 1965 (ESEA) as
970	970		reauthorized by P.L. No. 114-95, also known as the Every Student
971	971		Succeeds Act (ESSA), shall receive an addition al salary supplement
972	972		of Five Thousand Dollars ($5,000.00).
973	973		If a person with a an advanced, lead, or master teaching
974	974		certificate changes school districts during the life of the
975	975		certificate, the terms of the contracts required in this subsection
976	976		shall be subject to approval by the new employing school district.
977	977		M. 1. Any person who is eligible for a lead or master teaching
978	978		certificate described in this section shall make application for the
979	979		following school year with the State Board of Education. The
980	980		application shall include a reco mmendation from the local board of
981	981		education and determination that the applicant has met the statutory
982	982		criteria. In reviewing an application, the local school board of
983	983		education and the superintendent shall consider the ability of the
984	984		school district to fulfill the additional requirements described in
985	985		subsections I and J of this section before making a recommendation
986	986		to the State Board of Education.
987	987		2. The State Department of Education shall develop an
988	988		application to implement the provisions of this subs ection and make
989	989		it available to school districts.
990	990		N. P. Beginning in the 2021-2022 2022-2023 school year, the
991	991		Department shall make the teaching certificates provided for in this

1044	1044		from their local employing school district board of education and
1045	1045		who meets the eligibility criteri a established in the school
1046	1046		district’s framework adopted pursuant to subsection I of this
1047	1047		section.
1048	1048		O. For the 2019-2020 and 2020-2021 school years, the Department
1049	1049		shall identify school districts to implement the tea ching
1050	1050		certificates provided for in this section on a pilot program basis
1051	1051		with the assistance of public -private partnerships, funding fro m
1052	1052		philanthropic organizations or federal grants.
1053	1053		P. The Department shall seek funding necessary for the
1054	1054		administration of this section. If funding Q. Funding for the
1055	1055		administration of the advanced, lead, and master teaching
1056	1056		certificates listed in subsections I and J including salary
1057	1057		supplements required by subsection O of this section shall be
1058	1058		provided on a first come, f irst served basis subject to availability
1059	1059		of funding. If funding for the administration of the advanced,
1060	1060		lead, and master teaching certificates is not available, the
1061	1061		Department shall not be required to ful fill the requirements listed
1062	1062		in subsections L, M, N and O and P of this section.
1063	1063		Q. R. The State Board of Education shall promulgate rules to
1064	1064		implement the provisions of this act section.

1116	1116		SECTION 2. NEW LAW A new section of law to be codified
1117	1117		in the Oklahoma Statutes as Section 6-190.2 of Title 70, unless
1118	1118		there is created a duplication in numbering, reads as follows:
1119	1119		There is hereby created in the State Treasury a revolving fund
1120	1120		for the State Department of Education to be designated the “Teacher
1121	1121		Empowerment Revolving Fund”. The fund shall be a continuing fund,
1122	1122		not subject to fiscal year limitations, and shall consist of all
1123	1123		monies received by the State Department of Education from
1124	1124		appropriations from the General Revenue Fund and the Oklahoma
1125	1125		Education Lottery Trust Fund . All monies accruing to the credit of
1126	1126		the fund are hereby appropriated and may be budgeted and expended by
1127	1127		the State Department of Education for the purpose of providing
1128	1128		matching salary supplement funds pursuant to t he provisions of
1129	1129		subsection O of Section 6-190 of Title 70 of the Oklahoma Statutes .
1130	1130		Expenditures from the fund shall be made upon warrants issued by the
1131	1131		State Treasurer against claims filed as prescribed by law with the
1132	1132		Director of the Office of Manageme nt and Enterprise Services for
1133	1133		approval and payment.
1134	1134		SECTION 3. This act shall become effective July 1, 2022.
1135	1135		SECTION 4. It being immediately necessary for the preservation
1136	1136		of the public peace, health or safety, an emergency is hereby
1137	1137		declared to exist, by reason whereof this act shall take effect and
1138	1138		be in full force from and after its passage and approval.
