61	89		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
62	90		SECTION 1. AMENDATORY 29 O.S. 20 21, Section 2-108.1, is
63	91		amended to read as follows:
64	92		Section 2-108.1. “Domesticated animal” means an animal kept for
65	93		pleasure or for utility, that has adapte d to life in association
66	94		with and to the use of human beings, and shall not include animals

97	149		SECTION 2. AMENDATORY 29 O.S. 20 21, Section 2-109, is
98	150		amended to read as follows:
99	151		Section 2-109. “Endangered” refers to any wildlife species or
100	152		subspecies in the wild or in captivity whose prospects of survival
101	153		and reproduction are in immediate jeopardy and includes those
102	154		species listed as endangered by the federal gover nment, as well as
103	155		any species or subspecies identi fied as threatened by Oklahoma
104	156		statute Statutes or Commission resolution.
105	157		SECTION 3. AMENDATORY 29 O.S. 2021, Section 2-110, is
106	158		amended to read as follows:
107	159		Section 2-110. “Fishing” is defined as the taking or attempting
108	160		to take fish or other aquatic dwelling organisms by hook and line,
109	161		seine, trap or such other means as may be designated as legal by the
110	162		provisions of this Code or by the Oklahoma Wildlife Conservation
111	163		Commission or as designated by the Oklahoma Statutes.
112	164		SECTION 4. AMENDATORY 29 O.S. 20 21, Section 2-116.1, is
113	165		amended to read as follows:
114	166		Section 2-116.1. “Game warden” is a duly CLEET-certified
115	167		authorized employee of the Department whose primary duties are the
116	168		enforcement of duty is to enforce the wildlife conservation laws of
117	169		Oklahoma this state. Whenever the word “ranger” appears in this

147	223		SECTION 5. AMENDATORY 29 O.S. 2021, Section 2-135, is
148	224		amended to read as follows:
149	225		Section 2-135. “Threatened” refers to any wildlife species or
150	226		subspecies in the wild o r in captivity that, although not presently
151	227		threatened with extinction , are in such small numbers throu ghout
152	228		their range that they may become an endangered species within the
153	229		foreseeable future or that they may be endangered if their
154	230		environment deteriorat es. Threatened species and subspecies include
155	231		those species and subsp ecies listed as “threatened” by the federal
156	232		government as well as any species or subspecies identified as
157	233		threatened by Oklahoma statutes Statutes or Commission resolution.
158	234		SECTION 6. AMENDATORY 29 O.S. 20 21, Section 3-103, is
159	235		amended to read as follows:
160	236		Section 3-103. A. The Wildlife Conservation Commission shall
161	237		constitute an advisory, administrative and policymaking board for
162	238		the protection, restoration, perpetuation, conservation,
163	239		supervision, maintenance, enhancement, and ma nagement of wildlife in
164	240		this state as provided in the Oklahoma Wildlife Conservation Code.
165	241		B. The Director shall consult with the Commission regarding the
166	242		administration of the affairs of the Department of Wildlife
167	243		Conservation. The Commission is authori zed and empowered to require
168	244		from the Director complete reports and information relative to the

196	296		affairs of the Department at the time and in the manner the
197	297		Commission may deem advisable.
198	298		C. The Commission shall meet in regular session at least nine
199	299		times per year not to exceed one meeting per mon th with not more
200	300		than two consecutive calendar months between meetings and in special
201	301		sessions as may be called by the Chair or a majority of the
202	302		Commission. The Commission may hold any regular or special session
203	303		at any location within this state. Should a location be chosen
204	304		other than Commission headquarters in Ok lahoma City for a regular or
205	305		special meeting, notice shall be posted at Commission headquarters
206	306		in Oklahoma City and advertised in the local newspaper o f the city
207	307		in which the meeting is to be h eld, at least one time during each of
208	308		the two (2) weeks prior to the meeting. The advertisements shall
209	309		include time, date, and address of location of the meeting.
210	310		D. In addition to the other powers and duties pre scribed by
211	311		law, the Commission shall:
212	312		1. Institute an affirmative action plan for hiring women and
213	313		minorities throughout the agency;
214	314		2. Elect a chair, vice-chair, and secretary, who shall perform
215	315		the duties required of them by statutes, rules of the Comm ission,
216	316		and the Constitution of the State of Oklahoma. The chair, vice-
217	317		chair, and secretary shall recei ve no extra compensation;
218	318		3. 2. Appoint a Director, and determine the qualifications of
219	319		the Director and all assistants and employees. A Commissioner shall

264	389		9. 8. Prescribe the manner of cooperation with the Oklahoma
265	390		Tourism and Recreation Department, colleges and universities within
266	391		the state, other state agencies, any agency of the fede ral
267	392		government, and any city, town, school district, or any other agency
268	393		or organization in study of conservation and propagation of wildlife
269	394		and in the establishment, maintenance, and operation of visual

298	447		fishing facilities, in the study and propagation of wildlife;
299	448		10. 9. Supervise the letting of all contracts and purchases for
300	449		the Department, with all purchases of personal proper ty to be made
301	450		through the Office of Management and Enterprise Services;
302	451		11. 10. Authorize all claims or expenditures prior to incurring
303	452		payment except as otherwise provided in this Code;
304	453		12. 11. Prescribe rules on the use of Department -owned vehicles
305	454		by the Director, department heads and other essential employees a s
306	455		the Commission deems necessary in order to perform their duties;
307	456		13. 12. Prescribe rules for the sale of all regular or special
308	457		licenses;
309	458		14. 13. Publicize and encourage the conservation and
310	459		appreciation of wildlife and all other natural resources;
311	460		15. 14. Regulate the seasons and harvest of wildlife;
312	461		16. 15. Promulgate rules to sell fishing and hunting licenses
313	462		via the Internet;
314	463		17. 16. Annually report to the Governor and the Legislature on
315	464		the complete operation, activities, and plans of the Depart ment,
316	465		together with such recommendations for future activities as the
317	466		Commission may deem to be in the best interest of the state; and
318	467		18. 17. Provide the Governor and the Legislature with an a nnual
319	468		inventory of all property and equipment.

347	520		SECTION 7. AMENDATORY 29 O.S. 20 21, Section 3-105, is
348	521		amended to read as follows:
349	522		Section 3-105. A. Immediately upon the appointment of the
350	523		Director, he shall become vested with the duties and powers of the
351	524		management and control of the Depart ment under such provisions,
352	525		orders, rules and regulations as may be prescribed by the
353	526		Commission, and in addition thereto shall have the following
354	527		specific powers and duties:
355	528		1. To manage and control, under the supervision of the
356	529		Commission, all wildlife refuges and real or personal properties
357	530		which are held, operated or maintained by the Department .;
358	531		2. To appoint and employ such assistants, department heads,
359	532		rangers, clerical help and other e mployees as the Commission may
360	533		deem necessary, subject to the approval of the Commission. The
361	534		Director shall fix and determine the salaries and wages to be paid
362	535		under and subject to the rules and regulations as pr omulgated by the
363	536		Commission; and the Direc tor shall supervise and direct all
364	537		employees of either the Com mission or the Department and may
365	538		suspend, discharge, station or transfer them at any time that, in
366	539		his judgment, the Commission or the state will be be st served
367	540		thereby.;
368	541		3. To approve or disa pprove and pay all legal claims for
369	542		services rendered or expen ses incurred by rangers and other
370	543		employees of the Department in accordance with the schedules

399	596		Commission.;
400	597		4. To establish and maintain a proper system of bookkeeping and
401	598		accounting under the supervision of the State Auditor and
402	599		Inspector.;
403	600		5. To promote and manage wildlife propagation by raising and
404	601		distributing the same over the state a t the direction of the
405	602		Commission; to capture, propagate, transport, buy, sell or exchange
406	603		any species of fish, game, furbearing animals and protected birds
407	604		needed for stocking the lands or waters of the state; and to feed,
408	605		provide and care for such fish, animals and birds.; and
409	606		6. To make a complaint and cause proceedings to be commenced
410	607		against any person for violation of any of the laws for the
411	608		conservation of wildlife with the sanction of the district attorney
412	609		of the county in which such proceedings ar e brought, and shall not
413	610		be required to give security for costs. The Director may also
414	611		appear in behalf of the people in any court of competent
415	612		jurisdiction in any prosecution for a violation of any of the laws
416	613		for the protection of wildlife, and may pros ecute the same in the
417	614		same manner and with the same authority as the district attorney of
418	615		the county where such proceedings are pending in cases where such
419	616		attorney is unable to be present or refuses to prosecute such case.
420	617		7. To make emergency purchases of equipment, materials and
421	618		supplies under rules and regulations prescribed by the Commission.

449	670		B. All duties and authority imposed or conferred upon the
450	671		former Wildlife Conservation Director by any statute, rule or
451	672		regulation of the Commission are hereby imposed and conferred upon
452	673		the Director until such time as the Commission or the Legislature
453	674		shall, by appropriate measure, change such duties or authority
454	675		imposed by said the Commission.
455	676		SECTION 8. AMENDATORY 29 O.S. 2021, Sectio n 3-201, is
456	677		amended to read as follows:
457	678		Section 3-201. A. All things being equal, veterans of World
458	679		War II, the Korean, the Vietnam and Persian Gulf Wars shall be
459	680		appointed as game wardens when vacancies occur.
460	681		B. All persons appointed game wardens shal l be peace officers
461	682		and have the full powers of pe ace officers of the State of Oklahoma
462	683		this state in the enforcement of the provisions of this Code and are
463	684		authorized to:
464	685		1. Enforce all state laws on Department-owned or Department-
465	686		managed lands;
466		-	2. Enforce all other laws of this state ;
	687	+	2. Enforce all other laws of this state through coordination
	688	+	and cooperation with other law enforcement officers and law
	689	+	enforcement agencies;
467	690		3. Make arrests for wildlife conservation violations and
468	691		nonconservation-related crimes with the same power and authori ty as
469	692		sheriffs are vested with and in cooperation with other law
470	693		enforcement officers and agencies;

	746	+	part thereof, killed, take n, shipped or in any possession contrary
500	747		to the law, and the wildl ife or parts thereof may be disposed of as
501	748		determined by the Director or any court of competent jurisdiction;
502	749		5. Make a complaint and cause proceedings to be commenced
503	750		against any person fo r violation of any of the laws for the
504	751		protection and propagation of wildlife, with the sanction of the
505	752		prosecuting or district attorney of the county in which the
506	753		proceedings are brought, and shall not be required to give security
507	754		for costs;
508	755		6. Be an authorized agent of the Commission or Department under
509	756		Section 3-202 of this title in addition to duties as a game war den;
510	757		and
511	758		7. Assist in enforcement of the state fire laws, upon request
512	759		of the Oklahoma Department of Agriculture, Food, and Forestry.
513	760		C. 1. Pursuant to the provisions of this subsection, a game
514	761		warden may operate a vehicle owned or leased by the Departm ent upon
515	762		a roadway during the hours of darkness without lighted headlamps,
516	763		clearance lamps, or other illuminating devices. As used in this
517	764		paragraph, “roadway” shall include any street or highway in this
518	765		state except an interstate highway, a limited acces s highway, a
519	766		state trunk highway, or any street or highway within the limits of
520	767		an incorporated area.
521		-	2. Pursuant to the provisions of this subsection, a game warden
522		-	may operate a vessel upon any waters of this state during the hours

	819	+	2. Pursuant to the provisions of this subsection, a game warden
	820	+	may operate a vessel upon any waters of this state during the hours
550	821		of darkness without t he illuminating devices required by Section
551	822		4207 of Title 63 of the Oklahoma Statutes.
552	823		3. A game warden may operate a vehicle or vessel with out the
553	824		illuminating devices specified in this subsection only if the
554	825		operation:
555	826		a. is made in the performance of t he duties of the game
556	827		warden pursuant to the provisions of the Code, and
557	828		b. (1) will aid in the accomplishment of a lawful arrest
558	829		for any violation of the Code or any rule or
559	830		regulation promulgated thereto, or
560	831		(2) will aid in ascertaining whether a violati on of
561	832		the Code or any rule or regulation promulgated
562	833		thereto has been or is about to be committed.
563	834		D. Any person who refuses to stop a vehic le or boat when
564	835		requested to do so by a game warden in the perform ance of the duties
565	836		of the game warden is guilty o f a misdemeanor and upon conviction is
566	837		punishable by a fine of not less than One Hundred Dollars ($100.00)
567	838		nor more than Five Hundred Dollars ($500.00).
568	839		E. Any game warden who solicits or accepts any bribe or money
569	840		or other thing of value in connection wi th the performance of duty
570	841		as a game warden shall be guilty of a felony and, upon conviction,
571	842		shall be sentenced to a term not less than two (2) years nor more
572		-	than seven (7) years in the custody of the Depa rtment of Corrections
573		-	and shall be summarily remo ved from office.

601	896		F. Pursuant to the provisions of subsection B of this section
602	897		and the Oklahoma Wildlife Conservation Code, a game warden sh all not
603	898		have authority to use or place a game or wildlife camera o n private
604	899		property without the permission of the owner or controller of the
605	900		property or pursuant to a warrant issued by a court of competent
606	901		jurisdiction.
607	902		SECTION 9. AMENDATORY 29 O.S. 20 21, Section 7-204, is
608	903		amended to read as fo llows:
609	904		Section 7-204. All wildlife found in this state is the property
610		-	of the state people of this state, and the authority to ~~oversee~~ all
	905	+	of the state people of this state, and the authority to manage all
611	906		wildlife is pursuant to the Legislature.
612	907		SECTION 10. REPEALER 29 O.S. 20 21, Section 3-313, is
613	908		hereby repealed.
614	909		SECTION 11. This act shall become effective November 1, 202 2.
