179179 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
180180 SECTION 1. AMENDATORY 70 O.S. 2011, Section 3 -104, as
181181 last amended by Section 1, Chapter 271 , O.S.L. 2013 (70 O.S. Supp.
182182 2020, Section 3-104), is amended to rea d as follows:
183183 Section 3-104. The supervision of the public school system of
184184 Oklahoma shall be vested in the State Board of Education and,
185185 subject to limitations otherwise provided by law, the State Board of
186186 Education shall:
187187 1. Adopt policies and make rul es for the operation of t he
188188 public school system of the state;

240240 2. Appoint, prescribe the duties and fix the compensation of a
241241 secretary, an attorney and all other personnel necessary for the
242242 proper performance of the functions of the State Board of Educat ion.
243243 The secretary shall not be a member of the Board;
244244 3. Submit to the Governor a departmental budget based upon
245245 major functions of the Department as prepared by the State
246246 Superintendent of Public Instruction and supported by d etailed data
247247 on needs and proposed operations as pa rtially determined by the
248248 budgetary needs of local school districts filed with the State Board
249249 of Education for the ensuing fiscal year. Appropriations therefor
250250 shall be made in lump -sum form for each maj or item in the budget as
251251 follows:
252252 a. State Aid to schools,
253253 b. the supervision of all other functions of general and
254254 special education including general control, free
255255 textbooks, school lunch, Indian education and al l
256256 other functions of the Board and an amou nt sufficient
257257 to adequately staff and administer th ese services, and
258258 c. the Board shall determine the details by which the
259259 budget and the appropriations are administered.
260260 Annually, the Board shall make preparation s to
261261 consolidate all of the functions of t he Department in
262262 such a way that the budget can be based on two items,
263263 administration and aid to schools. A maximum amount

316316 the total appropriation;
317317 4. On the first day of December preceding each regular session
318318 of the Legislature, prepare and deliver to the Governor and the
319319 Legislature a report for the year ending June 30 immediately
320320 preceding the regular session of the Legislature. The report shall
321321 contain:
322322 a. detailed statistics and other information concerning
323323 enrollment, attendance, expenditures inc luding State
324324 Aid, and other pertinent data for all public schools
325325 in this state,
326326 b. reports from each and every division within the State
327327 Department of Education a s submitted by the State
328328 Superintendent of Public Instruction and an y other
329329 division, department, institution or other agency
330330 under the supervision of the Board,
331331 c. recommendations for the improvement of the public
332332 school system of the state,
333333 d. a statement of the receipts and expenditures of the
334334 State Board of Education f or the past year, and
335335 e. a statement of plans and recommendations for the
336336 management and improvement of public schools and such
337337 other information relating to the educational

389389 interests of the state as may be deemed necessary and
390390 desirable;
391391 5. Provide for the formulation and adopti on of curricula,
392392 courses of study and other instructional aids necessary for the
393393 adequate instruction of pupils in the public schools;
394394 6. Have authority in matter s pertaining to the licensure and
395395 certification of persons for instr uctional, supervisory and
396396 administrative positions and services in the public schools of the
397397 state subject to the provisions of Section 6 -184 of this title, and
398398 shall formulate rules gover ning the issuance and revocation of
399399 certificates for superintendents of schools, principals,
400400 supervisors, librarians, clerical employees, school nurses, school
401401 bus drivers, visiting teachers, classroom teachers and for other
402402 personnel performing instructio nal, administrative and supervisory
403403 services, but not including memb ers of boards of educatio n and other
404404 employees who do not work directly with pupils, and may charge and
405405 collect reasonable fees for the issuance of such certificates:
406406 a. the State Department of Education shall not issue a
407407 certificate to and shall revoke th e certificate of any
408408 person who has been convicted, whether upon a verdict
409409 or plea of guilty or upon a plea of nolo contendere,
410410 or received a suspended sentence or any probationary
411411 term for a crime or an attempt to commit a crime
412412 provided for in Section 84 3.5 of Title 21 of the

464464 Oklahoma Statutes if the offense involved sexual abuse
465465 or sexual exploitation as those terms are defined in
466466 Section 1-1-105 of Title 10A of the Oklahoma Statutes,
467467 Sections 741, 843.1, if the offense included sexual
468468 abuse or sexual exploitation, 865 et seq., 885, 888,
469469 891, 1021, 1021.2, 1021.3, 1040.13a, 1087, 1088,
470470 1111.1, 1114 or 1123 of Title 21 of the Oklahoma
471471 Statutes or who enters this state and who has been
472472 convicted, received a suspended sentence or re ceived a
473473 deferred judgment for a crime or attempted crime
474474 which, if committed or attempted in this state, would
475475 be a crime or an attempt to commit a crime provided
476476 for in any of said laws,
477477 b. all funds collected by the State Department of
478478 Education for the issuance of certificates to
479479 instructional, supervi sory and administrative
480480 personnel in the public schools of the state shall be
481481 deposited in the “Teachers’ Certificate Fund” in the
482482 State Treasury and may be expend ed by the State Board
483483 of Education to fina nce the activities of the State
484484 Department of Education necessary to administer the
485485 program, for consultative services, publication costs,
486486 actual and necessary travel expenses as provided in
487487 the State Travel Reimbu rsement Act incurred by persons

540540 necessary by the State Board of Education for the
541541 improvement of the preparation and certification of
542542 teachers in Oklahoma. Provided, any unobligated
543543 balance in the Teacher s’ Certificate Fund in excess of
544544 Ten Thousand Dollars ($10,000.00) o n June 30 of any
545545 fiscal year shall be transferred to the General
546546 Revenue Fund of the State of Oklahoma. Until July 1,
547547 1997, the State Board of Education shall have
548548 authority for approval of teacher education programs.
549549 The State Board of Education shall a lso have authority
550550 for the administration of teacher residency and
551551 professional development, subject to the provisions of
552552 the Oklahoma Teacher Preparation Act;
553553 7. Promulgate rules governi ng the classification, inspection,
554554 supervision and accrediting of al l public nursery, kinderg arten,
555555 elementary and secondary schools and on -site educational services
556556 provided by public school districts or state -accredited private
557557 schools in partial hospita lization programs, day treatment programs,
558558 and day hospital programs as defined in this act f or persons between
559559 the ages of three (3) and twenty -one (21) years of age in the state.
560560 However, no school shall be denied accreditation solely on the basis
561561 of average daily attendance.

613613 Any school district which maintains an eleme ntary school and
614614 faces the necessity of relocating its school facilities because of
615615 construction of a lake, either by state or federal authority, which
616616 will inundate the school facilities, shall be entitled to receive
617617 probationary accreditation from the St ate Board of Education fo r a
618618 period of five (5) years after the effective date of this act and
619619 any school district, otherwise qualified, shall be entitled to
620620 receive probationary accredita tion from the State Board of Education
621621 for a period of two (2) conse cutive years to attain th e minimum
622622 average daily attendance. The Head Start and public nurseries or
623623 kindergartens operated from Community Action Program funds shall not
624624 be subjected to the accrediting rules of the State Board of
625625 Education. Neither will t he State Board of Educati on make rules
626626 affecting the operation of the public nurseries and kindergartens
627627 operated from federal funds secured through Community Action
628628 Programs even though t hey may be operating in the public schools of
629629 the state. However, a ny of the Head Start or p ublic nurseries or
630630 kindergartens operated under federal regulations may make
631631 application for accrediting from the State Board of Education but
632632 will be accredited o nly if application for the approval of the
633633 programs is made. The st atus of no school distric t shall be changed
634634 which will reduce it to a lower classification until due notice has
635635 been given to the proper authorities thereof and an opportunity

687687 given to correct the conditions which otherwise would be the cause
688688 of such reduction.
689689 Private and parochial schools may be accredited and classified
690690 in like manner as public schools or, if an accrediting association
691691 is approved by the State Board of Education, by proc edures
692692 established by the State Board of E ducation to accept accredi tation
693693 by such accrediting association, if application is made to the State
694694 Board of Education for such accrediting;
695695 8. Be the legal agent of the State of Oklahoma to accept, in
696696 its discretion, the provisions of any Act of Congre ss appropriating
697697 or apportioning funds which are no w, or may hereafter be, provided
698698 for use in connection with any phase of the system of public
699699 education in Oklahoma. It shall prescribe such rules as it finds
700700 necessary to provide for the proper distribut ion of such funds in
701701 accordance with the state and federal laws;
702702 9. Be and is specifically hereby designated as the agency of
703703 this state to cooperate and deal with any officer, board or
704704 authority of the United Sta tes Government under any law of the
705705 United States which may require or recommend cooperation with any
706706 state board having charge of the administration of public schools
707707 unless otherwise provided by law;
708708 10. Be and is hereby designated as the “State Educational
709709 Agency” referred to in Public Law 396 of the 79th Congress of t he
710710 United States, which l aw states that said act may be cited as the

762762 “National School Lunch Act ”, and said State Board of Education is
763763 hereby authorized and directed to accept the terms an d provisions of
764764 said act and to enter into such agreements, not in c onflict with the
765765 Constitution of Oklahoma or the Constitution and Statutes of the
766766 United States, as may be necessary or appropriate to secure for the
767767 State of Oklahoma the benefits of the school lunch program
768768 established and refer red to in said act;
769769 11. Have authority to secure a nd administer the benefits of the
770770 National School Lunch Act, Public Law 396 of the 79th Congress of
771771 the United States, in the State of Oklahoma and is hereby autho rized
772772 to employ or appoint and fix the com pensation of such addition al
773773 officers or employees and to incur such expenses as may be necessary
774774 for the accomplishment of the above purpose, administer the
775775 distribution of any state funds appropriated by the Legi slature
776776 required as federal matching to re imburse on children’s meals;
777777 12. Accept and provid e for the administration of any land,
778778 money, buildings, gifts, donation or other things of value which may
779779 be offered or bequeathed to the schools under the superv ision or
780780 control of said Board;
781781 13. Have authority to require perso ns having administrative
782782 control of all school districts in Oklahoma to make such regular and
783783 special reports regarding the activities of the schools in said
784784 districts as the Board may dee m needful for the proper exercise of
785785 its duties and functions. Such authority shall include the right of

837837 the State Board of Education to withhold all state funds under its
838838 control, to withhold official recognition, including accrediting,
839839 until such required reports have been filed and accepted in the
840840 office of said Board and to revoke the certifi cates of persons
841841 failing or refusing to make such reports;
842842 14. Have general supervision of the school lunch program. The
843843 State Board of Education may sponsor wor kshops for personnel and
844844 participants in the school lunch program an d may develop, print and
845845 distribute free of charge or sell any materials, books and bulletins
846846 to be used in such school lunch programs. There is hereby created
847847 in the State Treasury a rev olving fund for the Board, to be
848848 designated the School Lunch Worksho p Revolving Fund. The fu nd shall
849849 consist of all fees derived from or on behalf of any participant in
850850 any such workshop sponsored by the State Board of Education, or from
851851 the sale of any materials, books and bulletins, and such fu nds shall
852852 be disbursed for expenses of such worksho ps and for developing,
853853 printing and distributing of such materials, books and bulletins
854854 relating to the school lunch program. The fund shall be
855855 administered in accordance with Section 155 of Title 62 of t he
856856 Oklahoma Statutes;
857857 15. Prescribe all forms for school district and county officers
858858 to report to the State Board of Education where required. The State
859859 Board of Education shall also prescribe a list of appropri ation
860860 accounts by which the funds of schoo l districts shall be budge ted,

912912 accounted for and ex pended; and it shall be the duty of the State
913913 Auditor and Inspector in prescribing all budgeting, accounting and
914914 reporting forms for school funds to conform to suc h lists;
915915 16. Provide for the establishmen t of a uniform system of p upil
916916 and personnel accoun ting, records and reports;
917917 17. Have authority to provide for the health and safety of
918918 school children and school personnel while under the jurisdiction of
919919 school authorities;
920920 18. Provide for the supervis ion of the transportation of
921921 pupils;
922922 19. Have authority, upon request of the local school board, to
923923 act in behalf of the public schools of the state in the purchase of
924924 transportation equipment;
925925 20. Have authority and is hereby required to perform all dut ies
926926 necessary to the admin istration of the public s chool system in
927927 Oklahoma as specified in the Oklahoma School Code; and, in addition
928928 thereto, those duties not specifically mentioned herein if not
929929 delegated by law to any other agency or official;
930930 21. Administer the State Public C ommon School Building
931931 Equalization Fund established by Section 32 of Article X of the
932932 Oklahoma Constitution. Any monies as may be appropriated or
933933 designated by the Legislature, other than ad valorem taxes, any
934934 other funds identified by the State Departmen t of Education, which
935935 may include, but not be limited to, grants -in-aid from the federal

988988 shall fall to the state by esch eat, penalties for unlawful holding
989989 of real estate by corporations, and capital gains on asse ts of the
990990 permanent school funds, shall be deposited in the State Public
991991 Common School Building Equalization Fund. The fund shall be used to
992992 aid school districts and charter schools in acquiring buildings ,
993993 subject to the limitatio ns fixed by Section 32 of Article X of the
994994 Oklahoma Constitution. It is hereby declared that the term
995995 “acquiring buildings” as used in Section 32 of Article X of the
996996 Oklahoma Constitution shall mean acquiring or improving school
997997 sites, constructing, repai ring, remodeling or equip ping buildings,
998998 or acquiring school furniture, fixtures, or equipment. For charter
999999 schools, the fund shall only be used to acquire buildings in which
10001000 students enrolled in the charter school will be attend ing. It is
10011001 hereby declared that the term “school districts” as used in Section
10021002 32 of Article X of the Oklahoma Constitution shall mean school
10031003 districts and charter schools created pursuant to the provisions of
10041004 the Oklahoma Charter Schools Act. If suffici ent monies are
10051005 available in the fund, the Board sha ll solicit proposals for grants

10771077 schools shall be allocated the greater of ten percent (10%) of the

11511151 paragraph. The cost of administering the fund shall be paid from
11521152 monies appropriated to the State Board of Education for the
11531153 operation of the State Department of Education;
11541154 22. Recognize that the Director of the Oklahoma Department of
11551155 Corrections shall be the administrative authority for the schools
11561156 which are maintained in the state reformatories and shall appoint
11571157 the principals and teachers in such schools. Prov ided, that rules

12151215 Statistical Services Revolving Fund. The fund shall consist of all

12171217 United States Government, and other sour ces for the purpose of
12181218 furnishing or financing statistical services and for any other
12191219 purpose as designated by the Legislature. The State Board of
12201220 Education is hereby authorized to enter into agreements with school

12231223 projects. The Statistical Services Revolving Fund shall be
12241224 administered in accordance wit h Section 155 of Title 62 of the
12251225 Oklahoma Statutes.

13661366 provide to the State Department of Education financial recor ds
13671367 documenting any state fu nds retained by the spon sor for
13681368 administrative services rendered for the previous year.
13691369 B. 1. The weighted average daily membership for the firs t year
13701370 of operation of a charter school shall be determined initially by
13711371 multiplying the actual enrollment of students as of August 1 by
13721372 1.333. The charter school shall receive revenue equal to that which
13731373 would be generated by the estimated weighted avera ge daily
13741374 membership calculated pursuant to this paragraph. At midyear, the
13751375 allocation for the charter school shall be adjusted using the first
13761376 quarter weighted average daily membership for the charter school
13771377 calculated pursuant to subsection A of this sec tion.
13781378 2. For the purpose of calculating weighted average daily
13791379 membership pursuant to Section 18-201.1 of this title and State Aid
13801380 pursuant to Section 18-200.1 of this title, the weighted average
13811381 daily membership for the first year of operation and each y ear
13821382 thereafter of a full -time virtual charter school shall be determined
13831383 by multiplying the actual enrollment of students as of August 1 by

14421442 C. A charter school shall be eligible to receive any oth er aid,
14431443 grants or revenues allowed to other schools. A charter school
14441444 sponsored by the board of education of a technology center school
14451445 district, a higher education institution, the State Board of
14461446 Education, or a federally recog nized Indian tribe shall be
14471447 considered a local educ ation agency for purposes of funding. A
14481448 charter school sponsored by a board of education of a school
14491449 district shall be co nsidered a local education agency for purposes
14501450 of federal funding.
14511451 D. A charter school, in addition to the mo ney received from the
14521452 state, may receive money from any other source. Any unexpended
14531453 funds may be reserved and used for future purposes. The gov erning
14541454 body of a charter school shall not levy taxes or issue bonds. If
14551455 otherwise allowed by law, the governi ng body of a charter sch ool may
14561456 enter into private contracts for the purposes of borrowing money
14571457 from lenders. If the governing body of the chart er school borrows
14581458 money, the charter school shall be solely responsible for repayin g

15121512 E. Any charter school which chooses to lease property shall be
15131513 eligible to receive current government lease rates.
15141514 F. Except as otherwise provide d in this subsection, each
15151515 charter school shall pay to the Charter School Closure Reimbursement
15161516 Revolving Fund created in subsection G of this section an amount
15171517 equal to Five Dollars ($5.00) per student based on average daily
15181518 membership, as defined by para graph 2 of Section 18 -107 of this
15191519 title, during the first nine (9) weeks of the school year. Each
15201520 charter school shall complete the payment every school year within
15211521 thirty (30) days after the first nine (9) weeks of the school year.
15221522 If the Charter School Closure Reimbursement Revo lving Fund has a
15231523 balance of One Million Dollars ($1,000,000.00) or more on July 1, no
15241524 payment shall be required the following school year.
15251525 G. There is hereby created in the State Treasury a revolving
15261526 fund for the State Departmen t of Education to be design ated the
15271527 “Charter School Closure Reimbursement Revolving Fund ”. The fund
15281528 shall be a continuing fund, not subject to fiscal year limitations,
15291529 and shall consist of all monies received by the State Department of
15301530 Education from charter schools as provided in subsection F of this
15311531 section. All monies accruing to the credit of said fund are hereby
15321532 appropriated and may be budgeted and expended by the Stat e

16781678 B. Each statewide virtual charter school which has been

17461746 year, less up to five percent (5%) of the State Aid allocation,
17471747 which may be retained by the Statewide Virtual Charter School Board
17481748 State Board of Education for administrative expenses and to support
17491749 the mission of the Board. A statewide virtual charter school shall
17501750 be eligible for any other funding any other charter school is
17511751 eligible for as provided for in Section 3-142 of this title. Each
17521752 statewide virtual charter school shall be considered a separate
17531753 local education agency for purposes of reporting and accountability.
17541754 E. A virtual charter school shall be subject to the same
17551755 reporting requirements, financial aud its, audit procedures and audit

18121812 F. A virtual charter school governing body shall be responsible
18131813 for the policies that govern the operational decisions of the
18141814 virtual charter school . The governing body of a virtual charter
18151815 school shall be subject to the same conflict of interest
18161816 requirements as a member of a local school board including, but not
18171817 limited to, Sections 5 -113 and 5-124 of this title. Members
18181818 appointed to the governing body of a virtual charter s chool after
18191819 July 1, 2019, shall be subject to the same instruction and
18201820 continuing education requirements as a member of a local school
18211821 board and pursuant to Section 5 -110 of this title, complete twelve
18221822 (12) hours of instruction w ithin fifteen (15) months o f appointment
18231823 to the governing body, and pursuant to Section 5 -110.1 of this
18241824 title, attend continuing education.
18251825 G. Students enrolled full -time in a statewide virtual charter
18261826 school sponsored by the Statewide Virtual Charter Sch ool Board State
18271827 Board of Education shall not be authorized to participate in any
18281828 activities administered by the Oklahoma Secondary Schools Activities
18291829 Association. However, the students may participate in intramural
18301830 activities sponsored by a statewide virt ual charter school, an
18311831 online provider for the char ter school or any other outside
18321832 organization.

18841884 H. 1. Beginning with the 2021 -2022 school year, public school
18851885 students who wish to enroll in a virtual charter school shall be
18861886 considered a transfer student from their resident school district.
18871887 A virtual charter school shall pre-enroll any public school student
18881888 whose parent expresses intent to enroll in the district. Upon pre -
18891889 enrollment, the State Department of Education shall initiate a
18901890 transfer on a form t o be completed by the recei ving virtual charter
18911891 school. Upon approval of the receiving virtual charter school, the
18921892 student may begin instructional activities. Upon notice that a
18931893 public school student has transferred to a virtual charter school,
18941894 the resident school district shall t ransmit the student’s records
18951895 within three (3) school days.
18961896 2. The State Department of Education shall notify the
18971897 Legislature and Governor if it determines that the information
18981898 technology infrastructure necessary to process the transfer of
18991899 students to a virtual charter school is inadequate and one (1)
19001900 additional school year is needed for implementation.
19011901 3. A public school student may transfer to one statewide
19021902 virtual charter school at any time during a school year. For
19031903 purposes of this subsection, “school year” shall mean July 1 through
19041904 the following June 30. After one statewide virtual charter school
19051905 transfer during a school year, no public school student shall be
19061906 permitted to transfer to any other statewide virtual charter sc hool
19071907 without the concurrenc e of both the resident s chool district and the

19591959 receiving virtual charter school. A student shall have a grace
19601960 period of fifteen (15) school days from the first day of enrollment
19611961 in a statewide virtual charter school to withdraw without academic
19621962 penalty and shall continue to have the option of one virtual charter
19631963 school transfer without the concurrence of both districts during
19641964 that same school year. A statewide virtual charter school student
19651965 that has utilized the allowable one tr ansfer pursuant to this
19661966 subsection shall not be per mitted to transfer to another district or
19671967 other statewide virtual charter school without first notifying his
19681968 or her resident district and initiating a new transfer. Upon
19691969 cancellation of a transfer the vir tual charter school shall t ransmit
19701970 the student’s records to the student’s new school district within
19711971 three (3) school days. Students enrolled in a statewide virtual
19721972 charter school shall not be required to submit a virtual charter
19731973 transfer for consecutive years of enrollment. Any s tudent enrolled
19741974 in a statewide virtual charter school the year prior to the
19751975 implementation of this section shall not be required to submit a
19761976 transfer in order to remain enrolled.
19771977 4. For purposes of this subsection, “parent” shall mean the
19781978 parent of the student or person having c ustody of the student as
19791979 provided for in paragraph 1 of subsection A of Section 1 -113 of this
19801980 title.
19811981 I. A virtual charter school shall not accept or deny a transfer

20362036 J. The decision of the Statewide Virtual Charter School Board
20372037 to deny, nonrenew or terminate the charter contract of a stat ewide
20382038 virtual charter school may be appealed to the State Board of
20392039 Education within thirty (30) days of the decision by the Statewide
20402040 Virtual Charter School Board. The State Board of Education shall
20412041 act on the appeal within sixty (60) days of receipt of t he request
20422042 from the statewide virtual charter schoo l applicant. The State
20432043 Board of Education may reverse the decision of the Statewide Virtual
20442044 Charter School Board or may remand the matter back to the Statewide
20452045 Virtual Charter School Board for further pro ceeding as directed. If
20462046 the State Board of Educati on rejects an application for a statewide
20472047 virtual charter school, it shall notify the applicant in writing of
20482048 the reasons for the rejection. The applicant may s ubmit a revised
20492049 application for reconsiderat ion to the Board within thirty (30) days
20502050 after receiving notification of the rejection. The Board shall
20512051 accept or reject the revised application within thirty (30) days of
20522052 its receipt.
20532053 SECTION 4. AMENDATORY Section 6, Chapter 36 7, O.S.L.
20542054 2012, as amended by Section 6, Chapter 212 , O.S.L. 2013 (70 O.S.

21142114 Section 3-145.5. A. Notwithstanding any other provision of

21172117 school district or enter into a virtu al charter school contract with
21182118 a provider to provide full -time virtual education to students who do
21192119 not reside within the school district bou ndaries.
21202120 B. Effective July 1, 2014 July 1, 2022, the Statewide Virtual
21212121 Charter School Board State Board of Educat ion shall succeed to any
21222122 contractual rights and responsibilities incurred by a school
21232123 district in a as the sponsor of any statewide virtual charter school
21242124 contract executed operating in this state prior to January 1, 2014,
21252125 with a provider to provide full -time virtual education to students
21262126 who do not reside within t he school district boundaries July 1,
21272127 2022. All property, equipment, supplies, re cords, assets, current
21282128 and future liability, encumbrances, obl igations and indebtedness
21292129 associated with the sponsorship contract shall be transferred to the
21302130 Statewide Virtual Charter School Board State Board of Education.
21312131 Appropriate conveyances and other documents shall be execute d to

21862186 term of the contract. Prior t o the end of the current te rm of the
21872187 contract, the Board shall allow the provider of the virtual charter
21882188 school to apply for renewal of the contract with the Board in
21892189 accordance with the renewal procedures established pursua nt to
21902190 Section 3-145.3 of this title.
21912191 SECTION 6. AMENDATORY Section 1, Chapter 225, O.S.L.
21922192 2015 (70 O.S. Supp. 2020, Sect ion 3-145.7), is amended to read as
21932193 follows:
21942194 Section 3-145.7. There is hereby created in the State Treasury
21952195 a revolving fund for the Statewide Virtual Charter School Bo ard
21962196 State Board of Education to be designated the “Statewide Virtual
21972197 Charter School Board Revolving Fund”. The fund shall be a
21982198 continuing fund, not subject to fiscal year limitations, and shall
21992199 consist of all monies received by t he Statewide Virtual Chart er
22002200 School Board State Board of Education from State Aid pursuant to
22012201 Section 3-145.3 of Title 70 of the Oklahoma Statutes this title or
22022202 any other state appropriation. All monies accruing to the credit of
22032203 the fund are hereby approp riated and may be budgeted and expended by

22722272 and locally selected by t he virtual school from the ap proved list.
22732273 B. By July 1, 2020, the governing body of each virtual charter
22742274 school shall adopt an attendance poli cy. The policy may allow
22752275 attendance to be a proportional amo unt of the required attendance
22762276 policy provisions bas ed upon the date of enrollmen t of the student.
22772277 The attendance policy shall include the following provisions:
22782278 1. The first date of attendance and membership shall be th e
22792279 first date the student completes an instructional activity.

23402340 3. For a student who does not meet any of the criteria set
23412341 forth in paragraph 1 or 2 of thi s subsection, the amount of
23422342 attendance recorded shall be the greater of:
23432343 a. the number of school days during which the student
23442344 completed the instructional activities dur ing the
23452345 quarter,
23462346 b. the number of school days proportional to the
23472347 percentage of the cou rse that has been completed, or
23482348 c. the number of school days proportional to the
23492349 percentage of the required minimum number of completed
23502350 instructional activities during t he quarter.
23512351 C. For the purposes of this section, “instructional activities ”
23522352 shall include instructional meetings wi th a teacher, completed
23532353 assignments that are used to record a grade for a student that is
23542354 factored into the studen t’s grade for the semester during which the
23552355 assignment is completed, testing and school -sanctioned field trips,
23562356 and orientation.

24082408 D. Each statewide virtual charter school approved and sponsored
24092409 by the Statewide Virtual Charter School Board State Board of
24102410 Education pursuant to the provisions of Section 3-145.3 of this
24112411 title shall offer a student orientation, notify th e parent or legal
24122412 guardian and each student who enroll s in that school of the
24132413 requirement to participate in the student orientation , and require
24142414 all students enrolled to complete the student orientation p rior to
24152415 completing any other instructional activity. The Statewide Virtual
24162416 Charter School Board State Board of Education shall promulgate rules
24172417 to develop materials for orientation.
24182418 E. Any student that is behind pace an d does not complete an
24192419 instructional activity for a fifteen -school-day period shall be
24202420 withdrawn for truancy. The virtual charter school shall submit a
24212421 notification to the parent or legal guardian of a student who has
24222422 been withdrawn for truancy or is appr oaching truancy.
24232423 F. A student who is reported for truancy two times in the same
24242424 school year shall be withdrawn and prohibited from enrolling in the
24252425 same virtual charter school for the remainder of the school year.
24262426 G. The governing body of each statewide virtual charter school
24272427 shall develop, adopt and post on the school ’s website a policy
24282428 regarding consequences for a student ’s failure to attend school and
24292429 complete instructional activities. The policy shall state, at a
24302430 minimum, that if a student fails to c onsistently attend school and
24312431 complete instructional activities after receiving a notif ication

24892489 school shall immediately notify the student ’s resident district in
24902490 writing of the student’s disenrollment.
24912491 I. The provisions of subsections F, G and H of this section
24922492 shall not be in effect until the implementation of subsection H of
24932493 Section 3-145.3 of this title.
24942494 J. The Statewide Virtual Charter School Board State Board of
24952495 Education may promulgate rules to implement t he provisions of this
24962496 section.
24972497 SECTION 8. AMENDATORY Section 1, Chapter 86, O.S.L. 2020
24982498 (70 O.S. Supp. 2020, Section 1210.704), is amended to read as
24992499 follows:
25002500 Section 1210.704. A. Beginning with the 2024–2025 school year,
25012501 all public high schools in this state shall make a minimum of four
25022502 advanced placement course s available to students.
25032503 B. Local boards of education in each district shall be
25042504 responsible for ensuring annu ally that all high school students have
25052505 access to advanced p lacement courses beginning in the 2024 -2025

25652565 C. The Statewide Virtual Charter Sch ool Board State Board of
25662566 Education shall maintain an online learning platform to provid e high
25672567 quality online learning opportunities for Oklahoma students that are
25682568 aligned with the subject matter standards adopted by the State Board
25692569 of Education pursuant to Section 11-103.6 of Title 70 of the
25702570 Oklahoma Statutes this title. The Board shall imp lement online
25712571 courses, with an emphasis on science, technology, engineering , and
25722572 math (STEM) courses, foreign language courses and advanced plac ement
25732573 courses. The online platform shall be available to al l Oklahoma
25742574 school districts.
25752575 D. The State Departmen t of Education shall provide information
25762576 to all local boards of education, to be distributed to their
25772577 students and parents, on available opportu nities and the enrollment
25782578 process for students to take advan ced placement courses. The
25792579 information shall explai n the value of advanced placement courses in
25802580 preparing students for postsecondary -level coursework, enabling

26412641 SECTION 9. REPEALER Section 3, Chapter 3 67, O.S.L. 2012,
26422642 as amended by Section 4, Chapter 21 2, O.S.L. 2013 (70 O.S. Supp.
26432643 2020, Section 3-145.1), and Section 4, Chapter 367, O.S.L. 2012 (70
26442644 O.S. Supp. 2020, Section 3 -145.2), are hereby repealed.
