7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104, is
7777 amended to read as follows:
7878 Section 1104. A. Unless otherwise provided by law, all fees,
7979 taxes, and penalties collected or received pursuant to the Oklahoma
8080 Vehicle License and Re gistration Act or Section 1 -101 et seq. of
8181 this title shall be apportioned and distribu ted monthly by the
8282 Oklahoma Tax Commission i n accordance with this section.
8383 B. 1. The following percentages of the monies referred to in
8484 subsection A of this section s hall be apportioned to the various
8585 school districts in accordance with paragraph 2 of t his subsection:
8686 a. from October 1, 2000, u ntil June 30, 2001, thirty -five

160160 credit of the Rebuilding Oklaho ma Access and Driver
161161 Safety Fund created in Section 1521 of Title 69 of the
162162 Oklahoma Statutes.

214214 2. The monies apportioned pu rsuant to subparagraphs a through e
215215 of paragraph 1 of this subsection shall be apportioned to the
216216 various school districts so that e ach district shall receive an
217217 amount based upon the proportion that each district ’s average daily
218218 attendance bears to the to tal average daily attendance of those
219219 districts entitled to receive funds pursuant to this section as
220220 certified by the State Departm ent of Education.
221221 Each district’s allocation of funds shall be remitted to the
222222 county treasurer of the county wherein the a dministrative
223223 headquarters of the district are located.
224224 No district shall be eligible for the funds herein provided
225225 unless the district makes an ad valorem tax levy of fi fteen (15)
226226 mills and maintains nine (9) years of i nstruction and pursuant to
227227 the rules of the State Board of Education, is authorized to maintain
228228 ten (10) years of instruction.
229229 C. The following percentages of the monie s referred to in
230230 subsection A of this section shall be remitted to the State
231231 Treasurer to be credited to the General Reve nue Fund of the State
232232 Treasury:
233233 1. From October 1, 2000, until June 30, 2001, forty -five and
234234 ninety-seven one-hundredths percent (45.9 7%);
235235 2. For the year beginning July 1, 2001, and ending June 30,
236236 2002, forty-five and twenty-nine one-hundredths percent (45.29%);

363363 2. For the year beginning July 1, 2001 , through the year ending

379379 Oklahoma Statutes.
380380 E. 1. The following percentages of th e monies referred to in
381381 subsection A of this section shall be apportioned to the various
382382 counties as set forth in paragraph 2 of this section:
383383 a. from October 1, 2000, u ntil June 30, 2001, seven and

511511 2. The monies apportioned pursuant to subparagraphs a thr ough e
512512 of paragraph 1 of this subsect ion shall be apportioned as follows:
513513 forty percent (40%) of such sum shall be distributed to the various
514514 counties in that proportion which the county road mileage of each
515515 county bears to the entire state road mileage as certified by the
516516 Transportation Commission and the remaining sixty percent (60%) of
517517 such sum shall be distributed to the various counties on the basis
518518 which the population and area of each county bears to the total
519519 population and area of the state . The population shall be as shown
520520 by the last Federal Census or the most recent annual estima te
521521 provided by the United States Bureau of the Census . The funds shall
522522 be used for the purpose of constructing and maintaining county
523523 highways; provided, however, the c ounty treasurer may deposit so
524524 much of the funds in the sinking fund as may be necessar y for the
525525 retirement of interest and annual accrual of indebtedness created by
526526 the issuance of county or township bonds for road purposes . Such
527527 deposits to the sinking fund shall not exceed forty percent ( 40%) of
528528 the funds allocated to a county pursuant t o this paragraph.
529529 F. 1. The following percentages of the monies referred to in
530530 subsection A of this section shall be remitted to the county
531531 treasurers of the respectiv e counties and by them deposited in a
532532 separate special revenue fund to be used by the c ounty commissioners
533533 in accordance with paragraph 2 of this subsection:

596596 amount apportioned in any fiscal year pursuant to this
597597 subparagraph exceed the total amount apportioned for
598598 the fiscal year ending on June 30 , 2015. Any amounts
599599 in excess of such limitation shall be placed to the
600600 credit of the General Revenue Fund, and
601601 e. for the year beginning July 1, 2019, and all
602602 subsequent years, two and fifty -nine one-hundredths
603603 percent (2.59%), but in no event shall the amount
604604 apportioned in any fiscal year pursuant to this
605605 subparagraph exceed the total amount apportioned for
606606 the fiscal year ending on June 30, 2015 . Any amounts
607607 in excess of such limitation shall be placed to the
608608 credit of the Rebuilding Oklahoma Access a nd Driver

662662 2. The monies apportioned pursuant to subparagraphs a through e
663663 of paragraph 1 of this subsection shall be used for the primary
664664 purpose of matching federal funds for the c onstruction of federal
665665 aid projects on county road s, or constructing and maintaining county
666666 or township highways and permanent bridges of such counties . The
667667 distribution of monies apportioned by this paragraph shall be made
668668 upon the basis of the current f ormula based upon road mileage, area
669669 and population as related to county road improvement and maintenance
670670 costs. Provided, however, the Department of Transportation may
671671 update the formula factors from time to time as n ecessary to account
672672 for changing conditions.
673673 G. 1. The following percentages of the m onies referred to in
674674 subsection A of this section shall be transmitted by the Tax
675675 Commission to the various counties as set forth in paragraph 2 of
676676 this subsection:
677677 a. from October 1, 2000, until June 30, 2 001, three and
678678 fifty-five one-hundredths percent ( 3.55%),
679679 b. for the year beginning July 1, 2001, and ending June
680680 30, 2002, three and fifty -nine one-hundredths percent

754754 2. The monies apportioned pursuan t to subparagraphs a through e

813813 formula factors from time to time as necessary t o account for
814814 changing conditions. The funds shall be transmitted to the various
815815 county treasurers to be deposited in the county highway fund of
816816 their respective counties.
817817 H. 1. The following percentages of the monie s referred to in
818818 subsection A of this section shall be apportioned to the various
819819 counties as set forth in paragraph 2 of this subsection:
820820 a. from October 1, 2000, until June 30, 2001, eighty -one
821821 one-hundredths percent (0.81%),
822822 b. for the year beginning Ju ly 1, 2001, and ending June
823823 30, 2002, eighty-two one-hundredths percent (0.82%),
824824 c. for the year beginning July 1, 2002, through the year
825825 ending on June 30, 2015, eighty -three one-hundredths
826826 percent (0.83%),
827827 d. for the year beginning July 1, 2015, through the year
828828 ending on June 30, 2019, eig hty-three one-hundredths
829829 percent (0.83%), but in no event shall the amount

896896 2. The monies apportioned pursuant to subparagraphs a through e
897897 of paragraph 1 of this subsection shall be apportioned to the
898898 various counties based upon the proportion that each county ’s
899899 population bears to the total state population.
900900 Each county’s allocation of funds shall be remitted to the
901901 various county treasurers to be deposited in the general fund of the
902902 county and used for the support of county government.
903903 I. 1. The following percentages of the monies referred to in
904904 subsection A of this section shall be a pportioned to the various
905905 cities and incorporated towns as set forth in paragraph 2 of this
906906 subsection:

975975 subsequent years, three and ten one -hundredths percent
976976 (3.10%), but in no event shall the amount apportioned
977977 in any fiscal year pursuant to this subparagraph
978978 exceed the total amount apportioned for the fiscal
979979 year ending on June 30, 2015 . Any amounts in excess

10351035 2. The monies apportioned pursuant to subparagraphs a through e
10361036 of paragraph 1 of this subsection shall be apportioned to the
10371037 various cities and incorporated towns based upon the proportion that
10381038 each city or incorporated town’s population bears to the total
10391039 population of all cities and incorporated towns in the state . Such
10401040 funds shall be remitted to the various county treasurers for
10411041 allocation to the various cities and in corporated towns. All such
10421042 funds shall be used for the construction, maintenance, repair,
10431043 improvement, and lighting of streets and alleys . Provided, however,
10441044 the governing board of any city or town may, with the appro val of
10451045 the county excise board, trans fer any surplus funds to the general
10461046 revenue fund of such city or town whenever an emergency requires
10471047 such a transfer.
10481048 J. The following percentages of the monies referred to in
10491049 subsection A of this section shall be rem itted to the State
10501050 Treasurer to be credited to the Oklahoma Law Enforcement Retirement
10511051 Fund:
10521052 1. From October 1, 2000, until June 30, 2001, one and twenty -
10531053 two one-hundredths percent (1.22%);
10541054 2. For the year beginning July 1, 2001, and ending June 30,

11091109 K. Three one-hundredths of one percent (3/100 of 1%) of the

11111111 to the State Treasurer to be credit ed to the Wildlife Conservation
11121112 Fund. Seventy-five percent (75%) of the funds shall be used for
11131113 fish habitat restoration and twenty -five percent (25%) of the funds
11141114 shall be used in the fish hatchery system for fish production.
11151115 L. 1. For the year beginni ng July 1, 2007, and ending June 30,
11161116 2008, five percent (5%) of monies referred to in subsection A of
11171117 this section shall be remitted to the State Treasurer to be credite d
11181118 to the County Improvements for Road s and Bridges Fund as created in
11191119 Section 507 of Title 69 of the Oklahoma Statutes.
11201120 2. For the year beginning July 1, 2008, and ending June 30,
11211121 2009, ten percent (10%) of monies referred to in subsection A of
11221122 this section shall be remitted to the State Tre asurer to be credited
11231123 to the County Improvements f or Roads and Bridges Fund as created in
11241124 Section 507 of Title 69 of the Oklahoma Statutes.
11251125 3. For the period beginning July 1, 2009, and ending December
11261126 31, 2012, fifteen percent (15%) of monies referred to in subsection
11271127 A of this section shall be remitted to the State Treasurer to be
11281128 credited to the County Improvements for Roads and Bridges Fund as
11291129 created in Section 507 of Title 69 of the Oklahoma Statutes.

11891189 of this section shall be remitted to the State Treasurer to be
11901190 credited to the Coun ty Improvements for Roads and Bridges Fund as
11911191 created in Section 507 of Title 69 of the Oklahoma Statutes.
11921192 6. For the year beginning July 1, 2014, twenty percent (20%) of
11931193 monies referred to in subsection A of this sect ion shall be remitted
11941194 to the State Treasurer to be credited to the County Improvements for
11951195 Roads and Bridges Fund as created in Section 507 of Title 69 of the
11961196 Oklahoma Statutes.
11971197 7. For the year beginning July 1, 2015, through the year ending
11981198 on June 30, 2019, twenty percent (20%) of monies r eferred to in
11991199 subsection A of this section shall b e remitted to the State
12001200 Treasurer to be credited to the County Improvements for Roads and
12011201 Bridges Fund as created in Section 507 of Title 69 of the Oklahoma
12021202 Statutes, but in no event shall the total amount apportioned in any

14861486 exceed One Hundred Twenty Million Dollars
14871487 ($120,000,000.00).
14881488 M. Twenty-four and eighty-four one-hundredths percent (24.84%)
14891489 of the monies referred to in subsection A of this section shall be
14901490 remitted to the State Treasurer to be c redited to the Rebuilding
14911491 Oklahoma Access and Driv er Safety Fund created in Section 1521 of
14921492 Title 69 of the Oklahoma Statutes.
14931493 N. Monies allocated to counties by this section may be
14941494 estimated by the county excise board in the budget for the county as
14951495 anticipated revenue to the extent of ninety percent (9 0%) of the
14961496 previous year’s income from such source; provided, not more than
14971497 fifteen percent (15%) can be encumbered during any month.
14981498 O. Notwithstanding any other provi sions of this section, for
14991499 the fiscal year beginning July 1, 2003, the first One Hundre d
15001500 Thousand Dollars ($100,000.00) of the monies collected or rece ived
15011501 by the Tax Commission pursuant to the registration of motorcycles
15021502 and mopeds in this state shall be placed to the credit of the
15031503 Oklahoma Tax Commission Revolving Fund.
15041504 SECTION 2. This act shall become effective July 1, 2022.
