129	129		BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
130	130		SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104.18, is
131	131		amended to read as follows:
132	132		Section 1104.18. A. Twenty Dollars ($20.00) of the fee
133	133		authorized by Section 1135.5 of this title for the Oklahoma State
134	134		Capitol Restoration License Plate shall be deposited i n the Oklahoma
135	135		Friends of the Capitol License Plate Revolv ing Fund created in
136	136		subsection B of this section.
137	137		B. There is hereby created in the State Treasury a revolving
138	138		fund for the Office of Management and Enterpr ise Services to be

	165	+	designated the "Oklahoma Friends of the Capitol License Plate
167	166		Revolving Fund". The fund shall be a continuing fund, not subje ct
168	167		to fiscal year limitations, and sha ll consist of all monies received
169	168		by the Office of Management and Enterpr ise Services pursuant to the
170	169		provisions of subsection A of this section. All monies accruing to
171	170		the credit of the fund are hereby appropriated a nd shall be budgeted
172	171		and expended by the Office of Management and Enterprise Services for
173	172		restoration and modification of the Oklahoma State Capitol. B efore
174	173		the Office makes any expenditur e from the fund, the expenditure
175	174		shall be approved by the State Capitol Preservation Commission
176	175		created pursuant to Section 4102 of Title 74 of the Oklahoma
177	176		Statutes. Expenditur es from the fund shall be made upon warra nts
178	177		issued by the State Treasurer aga inst claims filed as prescribed by
179	178		law with the Director of the Office of Management and Enterprise
180	179		Services for approval and payment.
181	180		SECTION 2. AMENDATORY 73 O.S. 2021, Section 15.4, is
182	181		amended to read as follows:
183	182		Section 15.4. A. There is hereby authorized the creation of a
184	183		not-for-profit corporation to be known as "Friends of the Capitol"
185	184		to raise funds and to assist in the preservation and enhancem ent of
186	185		the Oklahoma Capitol and surr ounding areas as defined in Section 1
187	186		of this title 4101 of Title 74 of the Oklahoma Statutes .
188	187		B. The board of director s of the corporation authorized in
189	188		subsection A of this section shall choose its own chairperson.

217	215		C. After proper incorporation, the not-for-profit corporation
218	216		is authorized and directed to apply for tax -exempt status under
219	217		Section 501(c)(3) of the Intern al Revenue Code (26 U.S.C., Section
220	218		501(c)(3)).
221	219		D. In addition to funds received from the general public or
222	220		other public and private sources, the not-for-profit corporation may
223	221		receive funds from state agencies at such t imes and in such amounts
224	222		as may be appropriated by the Legislature for the Oklahoma Capito l
225	223		or made available to the corporation from state agenci es from their
226	224		sources of revenue.
227	225		E. Costs to underwrite activities related to the preservation
228	226		and enhancement of the Oklahoma Capitol may be b orne from revenues
229	227		of the not-for-profit corporation.
230	228		F. Upon the incorporation, the not -for-profit corporation shall
231	229		be authorized to hire staff and name advisory groups or steering
232	230		committees as necessary to assist in the preservation and
233	231		enhancement of the Oklahoma Capitol.
234	232		G. The corporation shall coordi nate preservation and,
235		-	restoration, enhancement, maintenance, and modification projects in

236	234		conjunction with and the consent approval of the State Capitol
237	235		Preservation Commission and the Office of Management and Enterprise

268	265		Section 83.1. A. There is hereby re-created to continue until
269	266		July 1, 2022 2026, in accordance with the Oklahoma Sunset Law, a
270	267		Capitol-Medical Center Improvement and Zoning Commission to exercise
271	268		the functions and perform the du ties hereinafter prescribed.
272	269		B. The Commission shall be c omposed of eleven (11) members a s
273	270		follows:
274	271		1. The Director of the Office of Management and Enterprise
275	272		Services or his or her designee, who sh all be ex officio chair of
276	273		the Capitol-Medical Center Improvement and Zoning Commission;
277	274		2. The Director of the T ransportation Commission or his or her
278	275		designee;
279	276		3. The President of the University of Oklahoma or his or her
280	277		designee;
281	278		4. Two members appoi nted by the President Pro Tempor e of the
282	279		Senate;
283	280		5. Two members appointed by the Speaker of t he House of
284	281		Representatives;
285	282		6. The Chair of the Pl anning Commission of Oklah oma City or his
286	283		or her designee;
287	284		7. The Chair of the Long-Range Capital Planning Co mmission
288	285		Capitol Liaison or his or her designee; and
289	286		8. Two members of the Commission appoint ed by the Governor,
290	287		with the advice and consent of the State Senate, for four-year

320	316		C. One of the two members shall be appointed upon the
321	317		recommendation of the Citizens' Advisory Committee. The Commission
322	318		is authorized to appoint and hire a Directo r, who shall serve as the
323	319		chief administrative officer of the Commission, and other nece ssary
324	320		personnel.
325	321		The Attorney General of the State of Oklahoma this state shall
326	322		be the legal advisor to the Commis sion in the same capacity as he or
327	323		she is to other boards and commissions.
328	324		D. At least one of the members One member appointed by the
329	325		President Pro Tempore of the Senate and one member appointed by the
330	326		Speaker of the House of Represent atives shall be a re sident within
331	327		the boundaries of the Capitol-Medical Center Improvement and Zoning
332	328		District as set forth in Section 83 of this title.
333	329		SECTION 4. NEW LAW A new section of law t o be codified
334	330		in the Oklahoma Statutes as Section 93 of Title 73, unless there is
335	331		created a duplication in numb ering, reads as follows:
336	332		The Department of Public Safety shall create a security plan for
337	333		the Capitol and Capitol grounds and the Governor’s Mansion. The
338	334		plan shall be submitted to the Capitol Preservati on Commission for
339	335		review and approval. A new plan shall be submitted every three (3)
340	336		years.

368	363		The department shall coordi nate with the Office of Management
369	364		and Enterprise Services to implement and staff the approved security
370	365		plan.
371	366		SECTION 5. AMENDATORY 73 O.S. 2021, Section 176 , is
372	367		amended to read as follows:
373	368		Section 176. A. There shall be established created within the
374	369		Legislative Service Bureau the position of a permanent legislative
375	370		liaison Capitol Liaison committee, composed of three (3) members
376	371		from each house, appointed by the President P ro Tempore and Speaker,
377	372		respectively to the Capitol Preservation Commission. The
378	373		legislative liaison Capitol Liaison committee will shall keep the
379	374		Legislature properly a dvised as to the activiti es of the Oklahoma
380	375		Capitol Improvement Authority and the Office of Management and
381	376		Enterprise Services by making such reports as they deem the Capitol
382	377		Liaison deems necessary to the appropriate committees and leadership
383	378		of both houses. All l egislative studies c oncerning the
384	379		responsibilities or activities of the Oklahoma Capitol Imp rovement
385	380		Authority or the Office of Management and Enterprise Servi ces and
386	381		all studies of activities or projects rel ating to the Oklahoma State
387	382		Capitol Complex shall be considered by presented to the liaison
388	383		committee created Capitol Liaison authorized by this section. The
389	384		Oklahoma Capitol Improvement Authority and the Office of Management
390	385		and Enterprise Services shall notify the membership of the
391	386		legislative liaison Capitol Liaison committee in advance of any

419	413		meeting in which official or formal action is to be taken by
420	414		furnishing the proposed agenda in writing at least t wenty-four (24)
421	415		hours in advance of such meeting.
422	416		B. The Oklahoma Capitol Improvement Authority and the Office of
423	417		Management and Enterprise Services shall provide such information,
424	418		records, testimony, or recommendations as the committee Capitol
425	419		Liaison may require.
426	420		C. The Capitol Liaison responsibilities shall include serving
427	421		as the primary contact for Americans with Disabi lities Act (ADA)
428	422		compliance for the Capitol.
429	423		D. All proposals for enhancement, modification, preservation,
430	424		or restoration of the Capi tol and Capitol grounds, and the
431		-	Governor's Mansion and grounds, shall be submitted to the Liaison.

432	426		The Liaison shall submit all proposals to the Capitol Preserv ation
433	427		Commission for appro val.
434	428		E. All proposals for space allocation in the Capitol and
435	429		parking allocation shall be submitted to the Liaison. The Liaison
436	430		shall submit all proposals to the Capitol Preservation Commission
437	431		for approval.
438	432		F. All proposals for security modifications and enhancements by
439	433		agencies, the Senate, o r House of Representatives sha ll be submitted
440	434		to the Liaison. The Liaison shall submit all proposals to the
441	435		Capitol Preservation Commission for appr oval.

469	462		G. The Capitol Liaison shall be the primary liaison for all
470	463		tenants that occupy space in the Capitol.
471	464		SECTION 6. AMENDATORY 73 O.S. 2021, Section 345, is
472	465		amended to read as follows:
473	466		Section 345. A. In addition to any other authorization
474	467		provided by law, the Ok lahoma Capitol Improvement Aut hority is
475	468		authorized to issue o bligations to acquire real property, to gether
476	469		with improvements located thereon, an d personal property to
477	470		construct improvements to real property and to provide funding for
478	471		repairs, refurbishment s and improvements to real and personal
479	472		property of the State Capitol Building in a total amount not to
480	473		exceed One Hundred Twenty Million Dollar s ($120,000,000.00). The
481	474		funds shall be used for the renovation, repair and remodeling of the
482	475		State Capitol Building.
483	476		B. The Authority may h old title to the property and
484	477		improvements until such time as any obli gations issued for this
485	478		purpose are retired or defeased and may lease the property and
486	479		improvements to the Office of Management and Enterprise Services.
487	480		Upon final redemption or defeasa nce of the obligations created
488	481		pursuant to this section, title to the property and improvements
489	482		shall be transferred from the Oklahoma Capitol Improvement Authority
490	483		to the Office of Management and Enterprise Services.
491	484		C. For the purposes of paying the cos ts for construction of the
492	485		real property and improvements, and providi ng funding for the

520	512		project authorized in sub section A of this section, and for the
521	513		purpose authorized in subsection D of this section, the Authority is
522	514		hereby authorized to borrow monies on the credit of the income an d
523	515		revenues to be derived from the leasi ng of such property and
524	516		improvements and, in anticipation of the collection of such income
525	517		and revenues, to issue negotiable obligations in a total amount n ot
526	518		to exceed One Hundred Twent y Million Dollars ($120,000,000 .00)
527	519		whether issued in one or more seri es. The Authority is authorized
528	520		to capitalize interest on the obligations issued pursuant to this
529	521		section for a period of not to exceed one (1) year from t he date of
530	522		issuance. For subsequent fiscal years, it is the intent of the
531	523		Legislature to appropriat e to the Office of Management and
532	524		Enterprise Services sufficient monies to make rental payments for
533	525		the purpose of retiring the obligations created pursuant to this
534	526		section. To the exte nt funds are available from the proceeds of the
535	527		borrowing authorized b y this subsection, the Oklahoma Capitol
536	528		Improvement Authority shall provide for the payment of professional
537	529		fees and associated costs related to the project authorized in
538	530		subsection A of this section.
539	531		D. The Authority may issue obligations in one or more series
540	532		and in conjunction with other issues of the Authority. The
541	533		Authority is authorized to hire bond counsel, financial consultants,
542	534		and such other profe ssionals as it may deem necess ary to provide for
543	535		the efficient sale of the obligations and may utili ze a portion of

571	562		the proceeds of any borrowin g to create such reserves as may be
572	563		deemed necessary and to pay costs associated with the issuance and
573	564		administration of such obligations.
574	565		E. The obligations authorized und er this section may be sold at
575	566		either competitive or negotiated sale, as determined by the
576	567		Authority, and in such form and at such prices as may be authorized
577	568		by the Authority. The Authority may enter into agreements with su ch
578	569		credit enhancers and liquidi ty providers as may be determined
579	570		necessary to efficiently market the obligations. The obligations
580	571		may mature and have such provisions for redemption as shall be
581	572		determined by the Authority, but in no event shall the final
582	573		maturity of such obligations occ ur later than ten (10) years from
583	574		the first principal maturity date.
584	575		F. Any interest earnings on funds or accounts created for the
585	576		purposes of this section may be utilized as partial payment of the
586	577		annual debt service or for the purposes directed by the A uthority.
587	578		G. The obligations issued un der this section, the transfer
588	579		thereof and the interest earned on such obligations, including any
589	580		profit derived from the sale thereof, shall not be subject to
590	581		taxation of any kind by the State of Oklahoma this state, or by any
591	582		county, municipality or poli tical subdivision therein.
592	583		H. The Authority may direct the investment of all monies in any
593	584		funds or accounts created in connection with the offering of the
594	585		obligations authorized under this section. Such investments shall

622	612		be made in a manner consistent w ith the investment guidelines of the
623	613		State Treasurer. The Authority may place additional re strictions on
624	614		the investment of such monies if necessary to enha nce the
625	615		marketability of the o bligations.
626	616		I. There is hereby created a State Capitol Repair Expendi ture
627	617		Oversight Committee. The proceeds from the sale of obligations
628	618		issued pursuant to the provisions of this section and Section 1 of
629	619		Enrolled House Bill No. 3168 of the 2nd Session of the 55th Oklahoma
630	620		Legislature that are ne eded for repairs to the inte rior and exterior
631	621		of the State Capitol shall be subject to the approval of the State
632	622		Capitol Repair Expenditure Oversight Committee; provided, however,
633	623		the expenditure of those proceeds shall be subject to a request for
634	624		proposal process.
635	625		The Committee shall be composed of nine (9) members as follows :
636	626		1. Three persons to be appointed by the Gover nor, one of whom
637	627		shall serve as chair of the Committee;
638	628		2. Three legislators to be appointed by the Speaker of the
639	629		House of Representat ives, two of whom shall be m embers of the
640	630		majority political party and o ne of whom shall be a member of the
641	631		minority political party; and
642	632		3. Three legislators to be appointed by the P resident Pro
643	633		Tempore of the Senate, two of whom shall be members of the majority
644	634		political party and one of whom shall be a member of the minori ty
645	635		political party. Five members of the Committ ee shall constitute a

677	666		J. The Committee shall deliver a prelim inary plan for the
678	667		renovation, repair and remodeling of the State Capito l to the
679	668		Director of the Office of Management and Enterprise Services no
680	669		later than December 31, 2014. The preliminary plan shall include
681	670		the following components:
682	671		1. Establishment of the Office of Management and Enterprise
683	672		Services' goal and criteria fo r use by the vendor; and
684	673		2. Selection criteria for the design -build team vendor to be
685	674		selected through a Request For Pr oposal process.
686	675		K. Following receipt of the preliminary plan as approved by the
687	676		Committee, the Office of Management and Enterprise Serv ices shall
688	677		solicit Requests For Proposals to select the vendor for the p roject.
689	678		L. The Committee shall deliver a final plan to the Director of
690	679		the Office of Management and Enterprise Services no later than June
691	680		30, 2015. The final plan shall include the following components:
692	681		1. Approval of the final scope of work developed by the vendor;
693	682		and
694	683		2. Approval of the project p hasing developed by the vendor.
695	684		M. Following delivery of the fi nal plan, the Committee shall
696	685		continue to oversee the expenditure of pro ceeds from the sale of

729	717		N. The Director of the Offic e of Management and Enterprise
730	718		Services shall have responsibilit y to substantially implement t he
731	719		plan as presented by the Committee; pro vided, the President Pro
732	720		Tempore of the Senate or the Speaker of the Hou se of Representatives
733	721		shall approve all proposed designs related to renovation, repair and
734	722		remodeling of space w ithin the State Capitol Buildi ng under the
735	723		management and control of the Legislature and allocated t o that
736	724		officer's house of the Legislature pu rsuant to the provisions of
737	725		Section 15.1 of this title, and any subsequent changes to such
738	726		plans. Joint approva l of the President Pro Tempore of the Senate
739	727		and the Speaker of the Hous e of Representatives shall b e required
740	728		for such plans for space under th e management and control of the
741	729		Legislature and not allocated to a specific house of the
742	730		Legislature. Such appr oval shall be in writing.
743	731		O. Insofar as they are not in conflict with t he provisions of
744	732		this section, the provisions of Section 151 et seq. of this title
745	733		shall apply to this section.

779	766		2. "Art" means fine art of museum qual ity representing the
780	767		highest quality of art objects available to include paintings,
781	768		murals, graphic arts, art photography and sculpture, aesthet ically
782	769		aligned with recognized values, created b y the conscious use of
783	770		skill and creative imagination.;
784	771		3. "Design standards" mea ns a document that is produc ed for the
785	772		purpose of guiding review of proposed alterations to the Capitol,
786	773		Governor's Mansion, and respective grounds.
787	774		Design standards set the acceptable level of finishes for the
788	775		historic fabric, features, and materials in use in the Capitol.
789	776		This document establishes specifications for alterat ions which,
790		-	if followed, will provide comp atible design;

791	778		4. "Enhancement" means an increase or improvement upon the

838	824		building appeared in 1917, and dome in 2002, b y means of the removal
839	825		of features from later periods in its history and reconstruction of
840	826		missing features from the restoration period.
841	827		SECTION 8. AMENDATORY 74 O.S. 2021, Section 410 2, is

989	972		of the Commission shall be the Governor, or designee, who shall
990	973		serve a term of two (2) years. Thereafter, the chair of the
991	974		Commission shall rotate between the President Pro Tempore of the
992	975		Senate, or designee, Speaker of the House of Representatives, or
993	976		designee, and the Governor, or designee, for two-year increments in
994	977		perpetuity. Members of the Commission shall not be compensated
995	978		except for reimbursement as provided in the State Travel
996	979		Reimbursement Act.

1026	1008		Capitol Preservation Commission. The State Capitol Preservation
1027	1009		Commission shall meet at least once per quarter and at the call of
1028	1010		the chair as needed. A quorum of the voting members shall be
1029	1011		present for any action taken. A quorum is the majority of the
1030	1012		appointed voting members. The Commission shall be subject to the
1031	1013		Oklahoma Open Meeting Act.
1032	1014		E. The Commission functions performed by the Governo r,
1033	1015		President Pro Tempore of the Senate, Speaker of the House o f
1034	1016		Representatives, Secretary of State, and appointed senators and
1035	1017		representatives are additional functions of their othe r public
1036	1018		offices and duties.
1037	1019		SECTION 10. AMENDATORY 74 O.S. 2021, Section 4104, is
1038	1020		amended to read as follows:
1039	1021		Section 4104. A. The State Capitol P reservation Commission
1040	1022		shall provide oversight to the Capitol Liaison and the Office of
1041	1023		Management and Enterp rise Services on duties for management and

1085	1066		proper disposition of works of art as may be donated to the
1086	1067		Commission and this state ;
1087	1068		4. Review and approve all requests for preservation,
1088	1069		restoration, enhancement , and modification to the Capitol,
1089	1070		Governor's Mansion, and the respective grounds submitted by the
1090	1071		Capitol Liaison. This review and approval process shall not apply
1091	1072		to actions deemed by the Capitol Superintendent to be maintenance
1092	1073		necessary for the upkeep and function of the Capitol , Governor's
1093	1074		Mansion, and the respective grounds;
1094	1075		4. 5. Have authority to approve and sub mit to the Long-Range
1095	1076		Capital Planning Commission any propose d modification, alteration,
1096	1077		renovation, repair, or construction on any part of the Capitol and
1097	1078		the Governor's Mansion Review and approve a security plan submitted

1133	1113		respective concerns;
1134	1114		7. Review and approve preservation zones and design standards
1135	1115		for the Capitol, Governor's Mansion, and the respective grounds;
1136	1116		8. Review and approve standards for the selection and
1137	1117		acquisition of works of art and monuments for permanent and
1138	1118		temporary public display in the Capitol, the Governor's Mansion, and
1139	1119		the respective grounds. Suc h works of art shall be direct ly related
1140	1120		to the history and culture of this state;
1141	1121		9. Consult the Oklahoma Arts Council to determine the location
1142	1122		of all works of art and monuments to be displayed;
1143	1123		10. Provide for the allocation of physical spa ce in the Capitol
1144	1124		to tenants within the limits of Section 15.1 of Title 73 of the
1145	1125		Oklahoma Statutes. Each tenant shall be responsible for assigning
1146	1126		its membership and personnel to locations within its allotted space;
1147	1127		11. Approve rooms and areas of the building available for use
1148	1128		and reservation by the public;

1185	1164		B. The Long-Range Capital Planning Commissio n shall submit any
1186	1165		capital construction or renovation project with respect to the State
1187	1166		Capitol or the Governor's Mansion to the State Capitol Preservation
1188	1167		Commission for its adv isory opinion prior to considerat ion by the
1189	1168		Long-Range Capital Planning Commis sion As of the effective date of
1190	1169		this act, the State Capitol Preservation Commission shall assume
1191	1170		oversight responsibility of the Capitol Restoration Project from the
1192	1171		State Capitol Repair Expenditure Oversight Committee created in
1193	1172		Section 345 of Title 73 of the Oklahoma Statutes .
1194	1173		SECTION 11. NEW LAW A new section of law to be codified
1195	1174		in the Oklahoma Statutes as Section 4105a of Title 74, unless there
1196	1175		is created a duplication in numbering, reads as follows:

1241	1219		5. Make recommendations to the State Capitol Preservation
1242	1220		Commission for preservation zones and design standards.
1243	1221		The Director of the Office of Mana gement and Enterprise Services
1244	1222		may contract for the services of a Capitol Architect and Curator or
1245	1223		employ such an individual on either a full- or part-time basis.
1246	1224		Compensation for the positi on shall be in accord with similar
1247	1225		professional positions in state government.

1286	1263		B. The State Capitol duties of the Office of Management and
1287	1264		Enterprise Services are as follows:
1288	1265		1. OMES shall have the responsibility for mainte nance,
1289	1266		restoration, preservation, enhancement, and modification of the
1290	1267		Capitol, Governor's Mansion, and respective grounds including
1291	1268		facilities planning, facilities const ruction, and facilities
1292	1269		administration;
1293	1270		2. OMES shall be responsible for all maintena nce duties
1294	1271		necessary to properly preserve and maintain the Capitol, Gov ernor's
1295	1272		Mansion, and the respective grounds;
1296	1273		3. OMES shall be responsible for devising a nd developing
1297	1274		processes for tenants in the Capitol and Governor's Mansion to

1326	1302		enhancement, and modification and evaluating such requests;
1327	1303		4. OMES shall manage each project to ensure execution of the
1328	1304		highest quality work product, time-cost schedules, and efficient
1329	1305		contract performance;
1330	1306		5. OMES shall be responsible for producing an annual budget and
1331	1307		submitting it to the State Capitol Pre servation Commission;
1332	1308		6. OMES shall be responsible for creating a long -range master
1333	1309		plan for the maintenan ce and upkeep of the Capitol, Governor's
1334	1310		Mansion, and the respective grounds which shall be submitted to the
1335	1311		State Capitol Preservation Commission every three (3) years;
1336	1312		7. OMES shall be responsible for operation or coordinating
1337	1313		operation of the visitor center, visitor relations activities, and
1338	1314		tours in the Capitol;
1339	1315		8. OMES shall be responsible for operation of all dining and
1340	1316		vending services in the Capitol and shall approve food trucks and
1341	1317		other mobile food prep aration vehicles on t he grounds;
1342	1318		9. OMES shall be responsible for taking and approving
1343	1319		reservations in all meeting rooms and areas of the Capitol and
1344		-	grounds not allocated to the Legislature by Section 15.1 of ~~Title 73~~

1377	1352		11. OMES shall coordinate with the Oklahoma Art s Council for
1378	1353		curation of and care for a ll exhibits, art, monuments, and memorials
1379	1354		in public areas at the Capitol, Governor's Mansion, and the
1380	1355		respective grounds;
1381	1356		12. OMES shall coordinate with the Department of P ublic Safety
1382	1357		to ensure the safety of all visitors, employee s, and elected
1383	1358		officials who are in the Cap itol, Governor's Mansion, or on the
1384	1359		respective grounds. In cooperation with the Department of Public
1385	1360		Safety, a security plan shall be submitted to the St ate Capitol
1386	1361		Preservation Commission every three (3) years;
1387	1362		13. OMES shall be responsible for all maintenance, upkeep, and
1388	1363		access to all parking lots on the grounds of the Capitol and
1389	1364		Governor's Mansion;
1390	1365		14. OMES shall be responsible for submitting proposed
1391	1366		administrative rules to the S tate Capitol Preservation Commission to
1392	1367		govern the execution of the duties of the Office; and
1393	1368		15. OMES may collect rent from third-party vendors in the
1394	1369		Capitol and proceeds from the sale of mer chandise or services
1395	1370		rendered.
1396	1371		C. The Office of Management and Enterprise Services shall
1397	1372		employ all staff and consultants necessary to perform the duties of
1398	1373		the Office including, but not limited to, a licensed architect.

1426	1400		SECTION 13. AMENDATORY 74 O.S. 2021, Section 4108, is
1427	1401		amended to read as follows:
1428	1402		Section 4108. The provisions of Sections 4101 through 4107
1429	1403		4110.1 of this title shall apply to all modifications in the
1430	1404		structure or decor of the Capitol and the, Governor's Mansion, and
1431	1405		the respective grounds except for those immedi ate emergency repairs
1432	1406		needed to prevent loss or damage to property or to protect the
1433	1407		health and safety of the public during use of the building and any
1434	1408		art displayed on the grounds.
1435	1409		SECTION 14. NEW LAW A new section of law to be codi fied
1436	1410		in the Oklahoma Statutes as Section 4108.1 of Title 74, unless there
1437	1411		is created a duplicat ion in numbering, reads as follows:
1438	1412		The Oklahoma Arts Council shall be given the responsibility to
1439	1413		acquire, maintain, preserve, or restore any state-owned art that is
1440	1414		in storage or on display in the Capitol, Governor's Mansion, and the
1441	1415		respective grounds. The council is authorized to hold exhibitions
1442	1416		and commissions to display art to the general public. The Oklahoma
1443	1417		Arts Council may request direct appropriations or sub mit requests to
1444	1418		the Office of Management and Enterprise S ervices.
1445	1419		SECTION 15. AMENDATORY 74 O.S. 202 1, Section 4109, is
1446	1420		amended to read as follows:
1447	1421		Section 4109. By the order of the Director of the Offi ce of

1478	1451		Governor's Mansion, and the respective grounds may be exempted from
1479	1452		the provisions of the Public Competitive Bidding Act of 1974,
1480	1453		Section 101 et seq. of Title 61 of the Oklahoma Statutes. For
1481	1454		exempted State Capitol Building or Governor's Mansion construction
1482	1455		projects, the Office of Management and Enterprise Services shall
1483	1456		select among contractors qualified by past experience to con duct
1484	1457		historical preservation projects.
1485	1458		SECTION 16. REPEALER 74 O.S. 2021, Sections 4106 and
1486	1459		4107, are hereby repealed.
1487	1460		SECTION 17. It being immediately n ecessary for the preserva tion
1488	1461		of the public peace, health or safety, an emergency is hereby
1489	1462		declared to exist, by reason whereo f this act shall take effect and
1490	1463		be in full force from and after its passage and approval.
