129129 BE IT ENACTED BY THE PEOPLE OF T HE STATE OF OKLAHOMA:
130130 SECTION 1. AMENDATORY 47 O.S. 2021, Section 1104.18, is
131131 amended to read as follows:
132132 Section 1104.18. A. Twenty Dollars ($20.00) of the fee
133133 authorized by Section 1135.5 of this title for the Oklahoma State
134134 Capitol Restoration License Plate shall be deposited i n the Oklahoma
135135 Friends of the Capitol License Plate Revolv ing Fund created in
136136 subsection B of this section.
137137 B. There is hereby created in the State Treasury a revolving
138138 fund for the Office of Management and Enterpr ise Services to be

165+designated the "Oklahoma Friends of the Capitol License Plate
167166 Revolving Fund". The fund shall be a continuing fund, not subje ct
168167 to fiscal year limitations, and sha ll consist of all monies received
169168 by the Office of Management and Enterpr ise Services pursuant to the
170169 provisions of subsection A of this section. All monies accruing to
171170 the credit of the fund are hereby appropriated a nd shall be budgeted
172171 and expended by the Office of Management and Enterprise Services for
173172 restoration and modification of the Oklahoma State Capitol. B efore
174173 the Office makes any expenditur e from the fund, the expenditure
175174 shall be approved by the State Capitol Preservation Commission
176175 created pursuant to Section 4102 of Title 74 of the Oklahoma
177176 Statutes. Expenditur es from the fund shall be made upon warra nts
178177 issued by the State Treasurer aga inst claims filed as prescribed by
179178 law with the Director of the Office of Management and Enterprise
180179 Services for approval and payment.
181180 SECTION 2. AMENDATORY 73 O.S. 2021, Section 15.4, is
182181 amended to read as follows:
183182 Section 15.4. A. There is hereby authorized the creation of a
184183 not-for-profit corporation to be known as "Friends of the Capitol"
185184 to raise funds and to assist in the preservation and enhancem ent of
186185 the Oklahoma Capitol and surr ounding areas as defined in Section 1
187186 of this title 4101 of Title 74 of the Oklahoma Statutes .
188187 B. The board of director s of the corporation authorized in
189188 subsection A of this section shall choose its own chairperson.

217215 C. After proper incorporation, the not-for-profit corporation
218216 is authorized and directed to apply for tax -exempt status under
219217 Section 501(c)(3) of the Intern al Revenue Code (26 U.S.C., Section
220218 501(c)(3)).
221219 D. In addition to funds received from the general public or
222220 other public and private sources, the not-for-profit corporation may
223221 receive funds from state agencies at such t imes and in such amounts
224222 as may be appropriated by the Legislature for the Oklahoma Capito l
225223 or made available to the corporation from state agenci es from their
226224 sources of revenue.
227225 E. Costs to underwrite activities related to the preservation
228226 and enhancement of the Oklahoma Capitol may be b orne from revenues
229227 of the not-for-profit corporation.
230228 F. Upon the incorporation, the not -for-profit corporation shall
231229 be authorized to hire staff and name advisory groups or steering
232230 committees as necessary to assist in the preservation and
233231 enhancement of the Oklahoma Capitol.
234232 G. The corporation shall coordi nate preservation and,
235-restoration, enhancement, maintenance, and modification projects in

268265 Section 83.1. A. There is hereby re-created to continue until
269266 July 1, 2022 2026, in accordance with the Oklahoma Sunset Law, a
270267 Capitol-Medical Center Improvement and Zoning Commission to exercise
271268 the functions and perform the du ties hereinafter prescribed.
272269 B. The Commission shall be c omposed of eleven (11) members a s
273270 follows:
274271 1. The Director of the Office of Management and Enterprise
275272 Services or his or her designee, who sh all be ex officio chair of
276273 the Capitol-Medical Center Improvement and Zoning Commission;

320316 C. One of the two members shall be appointed upon the
321317 recommendation of the Citizens' Advisory Committee. The Commission
322318 is authorized to appoint and hire a Directo r, who shall serve as the
323319 chief administrative officer of the Commission, and other nece ssary
324320 personnel.
325321 The Attorney General of the State of Oklahoma this state shall
326322 be the legal advisor to the Commis sion in the same capacity as he or
327323 she is to other boards and commissions.
328324 D. At least one of the members One member appointed by the
329325 President Pro Tempore of the Senate and one member appointed by the
330326 Speaker of the House of Represent atives shall be a re sident within
331327 the boundaries of the Capitol-Medical Center Improvement and Zoning
332328 District as set forth in Section 83 of this title.
333329 SECTION 4. NEW LAW A new section of law t o be codified
334330 in the Oklahoma Statutes as Section 93 of Title 73, unless there is
335331 created a duplication in numb ering, reads as follows:
336332 The Department of Public Safety shall create a security plan for
337333 the Capitol and Capitol grounds and the Governor’s Mansion. The
338334 plan shall be submitted to the Capitol Preservati on Commission for
339335 review and approval. A new plan shall be submitted every three (3)
340336 years.

368363 The department shall coordi nate with the Office of Management
369364 and Enterprise Services to implement and staff the approved security
370365 plan.
371366 SECTION 5. AMENDATORY 73 O.S. 2021, Section 176 , is
372367 amended to read as follows:
373368 Section 176. A. There shall be established created within the
374369 Legislative Service Bureau the position of a permanent legislative
375370 liaison Capitol Liaison committee, composed of three (3) members
376371 from each house, appointed by the President P ro Tempore and Speaker,
377372 respectively to the Capitol Preservation Commission. The
378373 legislative liaison Capitol Liaison committee will shall keep the
379374 Legislature properly a dvised as to the activiti es of the Oklahoma
380375 Capitol Improvement Authority and the Office of Management and
381376 Enterprise Services by making such reports as they deem the Capitol
382377 Liaison deems necessary to the appropriate committees and leadership
383378 of both houses. All l egislative studies c oncerning the
384379 responsibilities or activities of the Oklahoma Capitol Imp rovement
385380 Authority or the Office of Management and Enterprise Servi ces and
386381 all studies of activities or projects rel ating to the Oklahoma State
387382 Capitol Complex shall be considered by presented to the liaison
388383 committee created Capitol Liaison authorized by this section. The
389384 Oklahoma Capitol Improvement Authority and the Office of Management
390385 and Enterprise Services shall notify the membership of the
391386 legislative liaison Capitol Liaison committee in advance of any

420414 furnishing the proposed agenda in writing at least t wenty-four (24)
421415 hours in advance of such meeting.
422416 B. The Oklahoma Capitol Improvement Authority and the Office of
423417 Management and Enterprise Services shall provide such information,
424418 records, testimony, or recommendations as the committee Capitol
425419 Liaison may require.
426420 C. The Capitol Liaison responsibilities shall include serving
427421 as the primary contact for Americans with Disabi lities Act (ADA)
428422 compliance for the Capitol.
429423 D. All proposals for enhancement, modification, preservation,
430424 or restoration of the Capi tol and Capitol grounds, and the
431-Governor's Mansion and grounds, shall be submitted to the Liaison.

432426 The Liaison shall submit all proposals to the Capitol Preserv ation

434428 E. All proposals for space allocation in the Capitol and

438432 F. All proposals for security modifications and enhancements by
439433 agencies, the Senate, o r House of Representatives sha ll be submitted
440434 to the Liaison. The Liaison shall submit all proposals to the
441435 Capitol Preservation Commission for appr oval.

469462 G. The Capitol Liaison shall be the primary liaison for all
470463 tenants that occupy space in the Capitol.
471464 SECTION 6. AMENDATORY 73 O.S. 2021, Section 345, is
472465 amended to read as follows:
473466 Section 345. A. In addition to any other authorization
474467 provided by law, the Ok lahoma Capitol Improvement Aut hority is
475468 authorized to issue o bligations to acquire real property, to gether
476469 with improvements located thereon, an d personal property to
477470 construct improvements to real property and to provide funding for
478471 repairs, refurbishment s and improvements to real and personal
479472 property of the State Capitol Building in a total amount not to
480473 exceed One Hundred Twenty Million Dollar s ($120,000,000.00). The
481474 funds shall be used for the renovation, repair and remodeling of the
482475 State Capitol Building.
483476 B. The Authority may h old title to the property and
484477 improvements until such time as any obli gations issued for this
485478 purpose are retired or defeased and may lease the property and
486479 improvements to the Office of Management and Enterprise Services.
487480 Upon final redemption or defeasa nce of the obligations created
488481 pursuant to this section, title to the property and improvements
489482 shall be transferred from the Oklahoma Capitol Improvement Authority
490483 to the Office of Management and Enterprise Services.
491484 C. For the purposes of paying the cos ts for construction of the
492485 real property and improvements, and providi ng funding for the

520512 project authorized in sub section A of this section, and for the
521513 purpose authorized in subsection D of this section, the Authority is
522514 hereby authorized to borrow monies on the credit of the income an d
523515 revenues to be derived from the leasi ng of such property and
524516 improvements and, in anticipation of the collection of such income
525517 and revenues, to issue negotiable obligations in a total amount n ot
526518 to exceed One Hundred Twent y Million Dollars ($120,000,000 .00)
527519 whether issued in one or more seri es. The Authority is authorized
528520 to capitalize interest on the obligations issued pursuant to this
529521 section for a period of not to exceed one (1) year from t he date of
530522 issuance. For subsequent fiscal years, it is the intent of the
531523 Legislature to appropriat e to the Office of Management and
532524 Enterprise Services sufficient monies to make rental payments for
533525 the purpose of retiring the obligations created pursuant to this
534526 section. To the exte nt funds are available from the proceeds of the
535527 borrowing authorized b y this subsection, the Oklahoma Capitol
536528 Improvement Authority shall provide for the payment of professional
537529 fees and associated costs related to the project authorized in
538530 subsection A of this section.
539531 D. The Authority may issue obligations in one or more series
540532 and in conjunction with other issues of the Authority. The
541533 Authority is authorized to hire bond counsel, financial consultants,
542534 and such other profe ssionals as it may deem necess ary to provide for
543535 the efficient sale of the obligations and may utili ze a portion of

571562 the proceeds of any borrowin g to create such reserves as may be
572563 deemed necessary and to pay costs associated with the issuance and
573564 administration of such obligations.
574565 E. The obligations authorized und er this section may be sold at
575566 either competitive or negotiated sale, as determined by the
576567 Authority, and in such form and at such prices as may be authorized
577568 by the Authority. The Authority may enter into agreements with su ch
578569 credit enhancers and liquidi ty providers as may be determined
579570 necessary to efficiently market the obligations. The obligations
580571 may mature and have such provisions for redemption as shall be
581572 determined by the Authority, but in no event shall the final
582573 maturity of such obligations occ ur later than ten (10) years from
583574 the first principal maturity date.
584575 F. Any interest earnings on funds or accounts created for the
585576 purposes of this section may be utilized as partial payment of the
586577 annual debt service or for the purposes directed by the A uthority.
587578 G. The obligations issued un der this section, the transfer
588579 thereof and the interest earned on such obligations, including any
589580 profit derived from the sale thereof, shall not be subject to
590581 taxation of any kind by the State of Oklahoma this state, or by any
591582 county, municipality or poli tical subdivision therein.
592583 H. The Authority may direct the investment of all monies in any
593584 funds or accounts created in connection with the offering of the
594585 obligations authorized under this section. Such investments shall

622612 be made in a manner consistent w ith the investment guidelines of the
623613 State Treasurer. The Authority may place additional re strictions on
624614 the investment of such monies if necessary to enha nce the
625615 marketability of the o bligations.
626616 I. There is hereby created a State Capitol Repair Expendi ture
627617 Oversight Committee. The proceeds from the sale of obligations
628618 issued pursuant to the provisions of this section and Section 1 of
629619 Enrolled House Bill No. 3168 of the 2nd Session of the 55th Oklahoma
630620 Legislature that are ne eded for repairs to the inte rior and exterior
631621 of the State Capitol shall be subject to the approval of the State
632622 Capitol Repair Expenditure Oversight Committee; provided, however,
633623 the expenditure of those proceeds shall be subject to a request for
634624 proposal process.
635625 The Committee shall be composed of nine (9) members as follows :
636626 1. Three persons to be appointed by the Gover nor, one of whom
637627 shall serve as chair of the Committee;
638628 2. Three legislators to be appointed by the Speaker of the
639629 House of Representat ives, two of whom shall be m embers of the
640630 majority political party and o ne of whom shall be a member of the
641631 minority political party; and
642632 3. Three legislators to be appointed by the P resident Pro
643633 Tempore of the Senate, two of whom shall be members of the majority
644634 political party and one of whom shall be a member of the minori ty
645635 political party. Five members of the Committ ee shall constitute a

674663 action taken by the Committee. The Committee shall be staffed by
675664 employees of the Office of Management and Enterprise Serv ices. The
676665 Committee shall be subject to the Okl ahoma Open Meeting Act.
677666 J. The Committee shall deliver a prelim inary plan for the
678667 renovation, repair and remodeling of the State Capito l to the
679668 Director of the Office of Management and Enterprise Services no
680669 later than December 31, 2014. The preliminary plan shall include
681670 the following components:
682671 1. Establishment of the Office of Management and Enterprise
683672 Services' goal and criteria fo r use by the vendor; and
684673 2. Selection criteria for the design -build team vendor to be
685674 selected through a Request For Pr oposal process.
686675 K. Following receipt of the preliminary plan as approved by the
687676 Committee, the Office of Management and Enterprise Serv ices shall
688677 solicit Requests For Proposals to select the vendor for the p roject.
689678 L. The Committee shall deliver a final plan to the Director of
690679 the Office of Management and Enterprise Services no later than June
691680 30, 2015. The final plan shall include the following components:
692681 1. Approval of the final scope of work developed by the vendor;
693682 and
694683 2. Approval of the project p hasing developed by the vendor.
695684 M. Following delivery of the fi nal plan, the Committee shall
696685 continue to oversee the expenditure of pro ceeds from the sale of

11411121 9. Consult the Oklahoma Arts Council to determine the location

14261400 SECTION 13. AMENDATORY 74 O.S. 2021, Section 4108, is

14281402 Section 4108. The provisions of Sections 4101 through 4107
14291403 4110.1 of this title shall apply to all modifications in the
14301404 structure or decor of the Capitol and the, Governor's Mansion, and
14311405 the respective grounds except for those immedi ate emergency repairs
14321406 needed to prevent loss or damage to property or to protect the

14341408 art displayed on the grounds.
14351409 SECTION 14. NEW LAW A new section of law to be codi fied
14361410 in the Oklahoma Statutes as Section 4108.1 of Title 74, unless there
14371411 is created a duplicat ion in numbering, reads as follows:
14381412 The Oklahoma Arts Council shall be given the responsibility to
14391413 acquire, maintain, preserve, or restore any state-owned art that is
14401414 in storage or on display in the Capitol, Governor's Mansion, and the
14411415 respective grounds. The council is authorized to hold exhibitions
14421416 and commissions to display art to the general public. The Oklahoma
14431417 Arts Council may request direct appropriations or sub mit requests to
14441418 the Office of Management and Enterprise S ervices.

14881461 of the public peace, health or safety, an emergency is hereby
14891462 declared to exist, by reason whereo f this act shall take effect and
14901463 be in full force from and after its passage and approval.
