65 | 91 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

66 | 92 | | SECTION 1. AMENDATORY 63 O.S. 2021, Secti on 330.53, is |
---|
67 | 93 | | amended to read as follows: |

68 | 94 | | Section 330.53. A. The Oklahoma State Board of E xaminers for |
---|
69 | 95 | | Long-Term Care Administrators shall have authori ty to issue licenses |
---|
98 | 148 | | administrators, and shall establish qualification criteria for each |
---|
99 | 149 | | type of long-term care administrator. |
---|
100 | 150 | | B. No license or certification shall be issued to a person as a |
---|
101 | 151 | | long-term care administrator unless: |
---|
102 | 152 | | 1. The person shall ha ve submitted evidence satisfactory to the |
---|
103 | 153 | | Board that the person is: |
---|
104 | 154 | | a. not less than twenty -one (21) years of age, and |
---|
105 | 155 | | b. of reputable and res ponsible character; and |
---|
106 | 156 | | 2. The person shall have submitted e vidence satisfactory to the |
---|
107 | 157 | | Board of the person’s ability to supervise the defined facility type |
---|
108 | 158 | | in which he or she is licensed or certified to serve as a long -term |
---|
109 | 159 | | care administrator. |
---|
110 | 160 | | C. 1. All persons currently licensed or certified or lawfully |
---|
111 | 161 | | serving as an administrator in their defined facility type shall be |
---|
112 | 162 | | permitted to continue to serve in their cu rrent capacity under their |
---|
113 | 163 | | current terms of authorization. The Board may promulgate rules |
---|
114 | 164 | | pursuant to Section 330.57 of this title to address future |
---|
115 | 165 | | certification and licensure requirements for all long -term care |
---|
116 | 166 | | administrator types without effect on the licensure or certification |
---|
117 | 167 | | status of those currently certified or licensed. The Board shall |
---|
118 | 168 | | not include a requirement for a four-year degree in any futu re |
---|
119 | 169 | | licensing or certification requirements for assist ed living |
---|
120 | 170 | | administrators, residential care or administrators, adult day care |
---|
149 | 223 | | rules are promulgated, current licensure and certification processes |
---|
150 | 224 | | and standards shall remain in place. |
---|
151 | 225 | | 2. For licensure or certification of nursing facility |
---|
152 | 226 | | administrators, ten (10) years of experience a s a certified |
---|
153 | 227 | | assistant administrator of a nursing facility shall substitute for |
---|
154 | 228 | | requirement of completion of a four -year degree. |

155 | 229 | | D. The Oklahoma State Board of Examiners for Long-Term Care |
---|
156 | 230 | | Administrators shall , on or before July 1, 2017, promulgate rules |
---|
157 | 231 | | permitting eligible applicants to sit for the state standards |
---|
158 | 232 | | examination at a testing facility using procedure s approved by the |
---|
159 | 233 | | National Association of Long-Term Care Administrator Board, |
---|
160 | 234 | | including but not lim ited to the use of electronic or online methods |
---|
161 | 235 | | for examination. |
---|
162 | 236 | | E. 1. The Oklahoma State Board of Examiners for Long-Term Care |
---|
163 | 237 | | Administrators shall grant assistant administrator cert ification to |
---|
164 | 238 | | any applicant for who: |
---|
165 | 239 | | a. has obtained a high school diploma or General |
---|
166 | 240 | | Educational Development (GED) credential , and |
---|
167 | 241 | | b. has passed the state standards examination. |
---|
168 | 242 | | 2. The Board shall grant full licensure as a long -term care |
---|
169 | 243 | | administrator to any applicant currently certified as an assistant |
---|
170 | 244 | | administrator who: |
---|
200 | 298 | | b. has completed a training program approved by the |
---|
201 | 299 | | Board, and |
---|
202 | 300 | | c. meets all other qualifications for licensure of long - |
---|
203 | 301 | | term care administrators. |
---|
204 | 302 | | F. 1. The Oklahoma State Board of Examiners for Long-Term Care |
---|
205 | 303 | | Administrators shall grant a provisional license to any applicant |
---|
206 | 304 | | who: |
---|
207 | 305 | | a. is licensed as a long -term care administrato r in |
---|
208 | 306 | | another state, |
---|
209 | 307 | | b. has passed a nationally recognized examination for |
---|
210 | 308 | | long-term care administrato rs, and |
---|
211 | 309 | | c. has been recently hired or offered a position as a |
---|
212 | 310 | | long-term care administrator at a facility licensed by |
---|
213 | 311 | | the State Department of Health. |
---|
214 | 312 | | 2. A provisional licensee shall have all the same rights as a |
---|
215 | 313 | | long-term care administrator licensed by the Board. |
---|
216 | 314 | | 3. Upon issuance of a provisional license, t he Board shall |
---|
217 | 315 | | determine if the provisional licensee meets the criteria for |
---|
218 | 316 | | licensure by endorsement as provided by rules of the Board. If the |
---|
219 | 317 | | provisional licensee meets the qualification criteria for full |
---|
220 | 318 | | licensure, the Board shall grant a full long-term care facility |
---|
221 | 319 | | administrator license to the provisional licensee not later than six |
---|
251 | 373 | | If the Board determines the provisional licensee does not meet |
---|
252 | 374 | | qualification criteria for full licensure, the Board shall revoke |
---|
253 | 375 | | the provisional license. |
---|
254 | 376 | | G. The Oklahoma State Board of Examiners for Long -Term Care |
---|
255 | 377 | | Administrators shall approve organizations or agencies to provide |
---|
256 | 378 | | the training program requ ired by the Board. Each such organization |
---|
257 | 379 | | or agency shall meet such requirements as may be prescribed by rules |
---|
258 | 380 | | of the Board. The Board shall ensure that at all times at least two |
---|
259 | 381 | | organizations or agencies offer the training program. In addition |
---|
260 | 382 | | to such approved organizations or agencies, the Board may offer the |
---|
261 | 383 | | training program. |
---|
262 | 384 | | H. The Oklahoma State Board of Examiners for Long -Term Care |
---|
263 | 385 | | Administrators shall promulg ate rules to implement the provisions of |
---|
264 | 386 | | this section. |
---|
265 | 387 | | SECTION 2. This act shall become effective November 1, 2022. |
