3965 An Act relating to long-term care; amending 63 O.S.
4066 2021, Section 330.53 , which relates to qualifications

6591 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6692 SECTION 1. AMENDATORY 63 O.S. 2021, Secti on 330.53, is
6793 amended to read as follows:
6894 Section 330.53. A. The Oklahoma State Board of E xaminers for
6995 Long-Term Care Administrators shall have authori ty to issue licenses

147+or certifications to qualified p ersons as long-term care
98148 administrators, and shall establish qualification criteria for each
99149 type of long-term care administrator.
100150 B. No license or certification shall be issued to a person as a
101151 long-term care administrator unless:
102152 1. The person shall ha ve submitted evidence satisfactory to the
103153 Board that the person is:
104154 a. not less than twenty -one (21) years of age, and
105155 b. of reputable and res ponsible character; and
106156 2. The person shall have submitted e vidence satisfactory to the
107157 Board of the person’s ability to supervise the defined facility type
108158 in which he or she is licensed or certified to serve as a long -term
109159 care administrator.
110160 C. 1. All persons currently licensed or certified or lawfully
111161 serving as an administrator in their defined facility type shall be
112162 permitted to continue to serve in their cu rrent capacity under their
113163 current terms of authorization. The Board may promulgate rules
114164 pursuant to Section 330.57 of this title to address future
115165 certification and licensure requirements for all long -term care
116166 administrator types without effect on the licensure or certification
117167 status of those currently certified or licensed. The Board shall
118168 not include a requirement for a four-year degree in any futu re
119169 licensing or certification requirements for assist ed living
120170 administrators, residential care or administrators, adult day care

149223 rules are promulgated, current licensure and certification processes
150224 and standards shall remain in place.
151225 2. For licensure or certification of nursing facility
152226 administrators, ten (10) years of experience a s a certified
153227 assistant administrator of a nursing facility shall substitute for
154228 requirement of completion of a four -year degree.
155229 D. The Oklahoma State Board of Examiners for Long-Term Care
156230 Administrators shall , on or before July 1, 2017, promulgate rules
157231 permitting eligible applicants to sit for the state standards
158232 examination at a testing facility using procedure s approved by the
159233 National Association of Long-Term Care Administrator Board,
160234 including but not lim ited to the use of electronic or online methods
161235 for examination.
162236 E. 1. The Oklahoma State Board of Examiners for Long-Term Care
163237 Administrators shall grant assistant administrator cert ification to
164238 any applicant for who:
165239 a. has obtained a high school diploma or General
166240 Educational Development (GED) credential , and
167241 b. has passed the state standards examination.
168242 2. The Board shall grant full licensure as a long -term care
169243 administrator to any applicant currently certified as an assistant
170244 administrator who:
171-a. has completed the required cours ework offered by the
172-Board,

296+a. has completed the required coursework offe red by the
297+Board,
200298 b. has completed a training program approved by the
201299 Board, and
202300 c. meets all other qualifications for licensure of long -
203301 term care administrators.
204302 F. 1. The Oklahoma State Board of Examiners for Long-Term Care
205303 Administrators shall grant a provisional license to any applicant
206304 who:
207305 a. is licensed as a long -term care administrato r in
208306 another state,
209307 b. has passed a nationally recognized examination for
210308 long-term care administrato rs, and
211309 c. has been recently hired or offered a position as a
212310 long-term care administrator at a facility licensed by
213311 the State Department of Health.
214312 2. A provisional licensee shall have all the same rights as a
215313 long-term care administrator licensed by the Board.
216314 3. Upon issuance of a provisional license, t he Board shall
217315 determine if the provisional licensee meets the criteria for
218316 licensure by endorsement as provided by rules of the Board. If the
219317 provisional licensee meets the qualification criteria for full
220318 licensure, the Board shall grant a full long-term care facility
221319 administrator license to the provisional licensee not later than six
222-(6) months after issuance of the provisional license and shall
223-revoke the provisional license upon issuance of the full license .

371+(6) months after issuance of the provisional license and shall
372+revoke the provisional license upon issuance of the full license .
251373 If the Board determines the provisional licensee does not meet
252374 qualification criteria for full licensure, the Board shall revoke
253375 the provisional license.
254376 G. The Oklahoma State Board of Examiners for Long -Term Care
255377 Administrators shall approve organizations or agencies to provide
256378 the training program requ ired by the Board. Each such organization
257379 or agency shall meet such requirements as may be prescribed by rules
258380 of the Board. The Board shall ensure that at all times at least two
259381 organizations or agencies offer the training program. In addition
260382 to such approved organizations or agencies, the Board may offer the
261383 training program.
262384 H. The Oklahoma State Board of Examiners for Long -Term Care
263385 Administrators shall promulg ate rules to implement the provisions of
264386 this section.
265387 SECTION 2. This act shall become effective November 1, 2022.
