77 | 77 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA: |

78 | 78 | | SECTION 1. AMENDATORY 41 O.S. 2021, Section 121, is |
---|
79 | 79 | | amended to read as follows: |

80 | 80 | | Section 121. A. Except as otherwise provided in this act the |
---|
81 | 81 | | Residential Landlord and Tenant Act , if there is a material |
---|
82 | 82 | | noncompliance by the landlord with the terms of the rental agreement |
---|
83 | 83 | | or a noncompliance with any of the provisions of Section 18 118 of |
---|
84 | 84 | | this act title which noncompliance mat erially affects health or |
---|
85 | 85 | | safety, the tenant may deliver to the lan dlord a written notice |
---|
86 | 86 | | specifying the acts and omissions constituting the breach and that |
---|
87 | 87 | | the rental agreement will terminate upon a date not less than thirty |
---|
88 | 88 | | (30) days after receipt of the notice if the breach is not remedied |

147 | 147 | | materially affects health and the breach is rem ediable by repairs, |
---|
148 | 148 | | the reasonable cost of which is less than One Hundred Dollars |
---|
149 | 149 | | ($100.00) does not exceed Two Thousand Dollars ($2,000.00) , the |
---|
150 | 150 | | tenant may notify the landlord in writing of his the tenant’s |
---|
151 | 151 | | intention to correct the condition at the landlo rd’s expense after |
---|
152 | 152 | | the expiration of fourt een (14) days. If the landlord fails to |
---|
153 | 153 | | comply within said fourteen (14) days, or as promptly as conditions |
---|
154 | 154 | | require in the case of an emergency, t he tenant may thereafter cause |
---|
155 | 155 | | the work to be done in a workmanlike manner and, after submitting to |
---|
156 | 156 | | the landlord an itemized statement, deduct from his or her rent in |
---|
157 | 157 | | an amount not to exceed fifty pe rcent (50%) of the rental payment, |
---|
158 | 158 | | the actual and reasonable cost or the fair and reasonable value of |
---|
159 | 159 | | the work, not exceeding the amount specified in this subsection, in |
---|
160 | 160 | | which event the rental agreement shall not terminate by reason of |
---|
161 | 161 | | that breach. If the actual and reasonable cost of the repair |
---|
162 | 162 | | exceeds fifty percent (50%) of the rental payment, the tenant may |
---|
163 | 163 | | deduct an additional amount in a subsequent rental payment or |

226 | 226 | | 2. Procure reasonable amounts of heat, hot water, running |
---|
227 | 227 | | water, electric, gas or other essential service during t he period of |
---|
228 | 228 | | the landlord’s noncompliance and deduct their actual and reasonable |
---|
229 | 229 | | cost from the rent; or |
---|
230 | 230 | | 3. Recover damages b ased upon the diminution of the fair rental |
---|
231 | 231 | | value of the dwelling unit; or |
---|
232 | 232 | | 4. Upon written notice, procure reasonable substitute h ousing |
---|
233 | 233 | | during the period of the landlord ’s noncompliance, in which case the |
---|
234 | 234 | | tenant is excused from paying rent for the period of the landlord’s |
---|
235 | 235 | | noncompliance. |

298 | 298 | | the condition complained of was caused by the deliberate or |

299 | 299 | | negligent act or omission of the tenant, a member of his the family |

300 | 300 | | of the tenant, his the tenant’s animal or pet or other person or |
---|
301 | 301 | | animal on the premis es with his consent of the tenant. |
---|
302 | 302 | | SECTION 2. This act shall become effective November 1, 2022. |
