7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7878 SECTION 1. AMENDATORY 41 O.S. 2021, Section 121, is
7979 amended to read as follows:
8080 Section 121. A. Except as otherwise provided in this act the
8181 Residential Landlord and Tenant Act , if there is a material
8282 noncompliance by the landlord with the terms of the rental agreement
8383 or a noncompliance with any of the provisions of Section 18 118 of
8484 this act title which noncompliance mat erially affects health or
8585 safety, the tenant may deliver to the lan dlord a written notice
8686 specifying the acts and omissions constituting the breach and that
8787 the rental agreement will terminate upon a date not less than thirty
8888 (30) days after receipt of the notice if the breach is not remedied

140140 within fourteen (14) days, an d thereafter the rental agreement s hall
141141 so terminate as provided in the notice unless the landlord
142142 adequately remedies the breach within the time specified.
143143 B. Except as otherwise provided in this act the Residential
144144 Landlord and Tenant Act , if there is a material noncompliance by the
145145 landlord with any of the terms of the rental agreement or any of the
146146 provisions of Section 18 118 of this act title which noncompliance
147147 materially affects health and the breach is rem ediable by repairs,
148148 the reasonable cost of which is less than One Hundred Dollars
149149 ($100.00) does not exceed Two Thousand Dollars ($2,000.00) , the
150150 tenant may notify the landlord in writing of his the tenant’s
151151 intention to correct the condition at the landlo rd’s expense after
152152 the expiration of fourt een (14) days. If the landlord fails to
153153 comply within said fourteen (14) days, or as promptly as conditions
154154 require in the case of an emergency, t he tenant may thereafter cause
155155 the work to be done in a workmanlike manner and, after submitting to
156156 the landlord an itemized statement, deduct from his or her rent in
157157 an amount not to exceed fifty pe rcent (50%) of the rental payment,
158158 the actual and reasonable cost or the fair and reasonable value of
159159 the work, not exceeding the amount specified in this subsection, in
160160 which event the rental agreement shall not terminate by reason of
161161 that breach. If the actual and reasonable cost of the repair
162162 exceeds fifty percent (50%) of the rental payment, the tenant may
163163 deduct an additional amount in a subsequent rental payment or

215215 payments, not to exceed fifty percent ( 50%) of each payment, until
216216 the cost of the repair is fully reimbursed.
217217 C. Except as otherwise provided in this act the Residential
218218 Landlord and Tenant Act , if, contrary to the rental agreement or
219219 Section 18 118 of this act title, the landlord willfull y or
220220 negligently fails to supply heat, running water, hot water,
221221 electric, gas or other essential service, the tenant may give
222222 written notice to the landlord specifying the b reach and thereafter
223223 may:
224224 1. Upon written notice, immediately terminate the renta l
225225 agreement; or
226226 2. Procure reasonable amounts of heat, hot water, running
227227 water, electric, gas or other essential service during t he period of
228228 the landlord’s noncompliance and deduct their actual and reasonable
229229 cost from the rent; or
230230 3. Recover damages b ased upon the diminution of the fair rental
231231 value of the dwelling unit; or
232232 4. Upon written notice, procure reasonable substitute h ousing
233233 during the period of the landlord ’s noncompliance, in which case the
234234 tenant is excused from paying rent for the period of the landlord’s
235235 noncompliance.
236236 D. Except as otherwise provided in this act the Residential
237237 Landlord and Tenant Act, if there is a noncompliance by the landlord
238238 with the terms of the rental agreement or Section 18 118 of this act

290290 title, which noncompliance renders the dwelling unit uninhabitable
291291 or poses an imminent threat to the health and safety of any occupant
292292 of the dwelling unit and which noncompliance is not remedied as
293293 promptly as conditions require, the t enant may immediately terminate
294294 the rental agreement upon written notice to the landlord which
295295 notice specifies the noncompliance.
296296 E. All rights of the tenant under this section do not arise
297297 until he the tenant has given written notice to the landlord or if
298298 the condition complained of was caused by the deliberate or
299299 negligent act or omission of the tenant, a member of his the family
300300 of the tenant, his the tenant’s animal or pet or other person or
301301 animal on the premis es with his consent of the tenant.
302302 SECTION 2. This act shall become effective November 1, 2022.
