66	66	declaring circumstances under which a territory may
67	67	be detached; providing definition; prohibiting
68	68	municipalities from annexing territory after
69	69	defunding; providing exception; requiring conformance
70	70	with state law; providing for codification; and

77	77	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OK LAHOMA:
78	78	SECTION 1. NEW LAW A new section o f law to be codified
79	79	in the Oklahoma Statutes as Section 21-110a of Title 11, unless
80	80	there is created a duplication in numb ering, reads as follows:
81	81	A. A territory may be detached from the corporate limits of a
82	82	municipality when the governing municip ality has defunded the pol ice
83	83	department at least once within the previous twenty-four (24)
84	84	months.
85	85	"Defunded" means the municipality has adopted a budget for a
86	86	fiscal year that red uces appropriated monies to the municipal police
87	87	department by five percent (5%) or greater compared to the previous
88	88	fiscal year.

140	140	This provision shall not apply to municipalities that have a
141	141	total budget that is at least ten percent (10%) less than the
142	142	previous fiscal year
143	143	B. A municipality shall not annex an area during a fiscal year
144	144	that defunds the munici pal police department unless the budget of
145	145	the police department is the same or exceeds what it was before it
146	146	was defunded.
147	147	C. Any annexed territory that wishes to detach from the
148	148	governing municipality shall comply with all procedures in Section
149	149	21-110 of Title 11 of the Oklahoma Statutes .
150	150	SECTION 2. This act shall bec ome effective November 1, 2022.
