75	75	BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
76	76	SECTION 1. AMENDATORY 26 O.S. 2021, Section 13A -103, is
77	77	amended to read as follows:
78	78	Section 13A-103. A. 1. The general election of mem bers of the
79	79	board of education of every s chool district and tec hnology center
80	80	school district shall be conducted o n the first second Tuesday of
81	81	April November of each odd-numbered year, and on the first Tuesd ay
82	82	after the first Monday of November in each even-numbered year.
83	83	2. The primary election of members of the board of education of
84	84	every school district and technology center sc hool district, if
85	85	necessary, shall be conducted on the second Tues day in February
86	86	September of each odd-numbered year, except in any year when a
87	87	Presidential Preferenti al Primary is held in February, then t he

140	140	Preferential Primary and on the fourth Tuesday of August in each
141	141	even-numbered year.
142	142	3. If only two candidates qua lify to have their names appear on
143	143	the ballot, the names of both c andidates shall appear on the ballot
144	144	at the board of education general election.
145	145	4. If more than two candidates qualify to have their names
146	146	appear on the ballot, the names of all such candi dates shall appear
147	147	on the ballot at the b oard of education primary election. A
148	148	candidate receiving more than fifty p ercent (50%) of the votes cast
149	149	in the board of education primary election shall be elected to the
150	150	office. If no candidate receives more th an fifty percent (50%) of
151	151	the votes cast in the board of education primary election, then the
152	152	two candidates with the highest number of votes shall appear on the
153	153	ballot at the board of education general elect ion.
154	154	B. Elections on the question of making a l evy or levies for
155	155	schools under Section 9 , Section 9B or Section 1 0 of Article X of
156	156	the Oklahoma Constitution shall b e held on the second Tuesday in
157	157	February of each year, except in any year when a Presidenti al
158	158	Preferential Primary is held in February, the n the election shall be
159	159	held on the same day as the Presidential P referential Primary.
160	160	C. The board of education of every school district or
161	161	technology center scho ol district may call a special election for
162	162	the purpose of voting on any matter or question authorized by law.

214	214	SECTION 2. AMENDATORY 26 O.S. 2021, Section 13A-105, is
215	215	amended to read as follows:
216	216	Section 13A-105. Candidates for member of the board of
217	217	education of every scho ol district or technology center school
218	218	district shall file declarations of candidacy in t he same place and
219	219	with the same officials as candidates for coun ty office. The
220	220	declaration of candidacy to be signed by the candidate shall have an
221	221	attachment to be signed by the candidate listing the requirements of
222	222	a candidate for election or reelection to a school board as set
223	223	forth in Sections 13A-106 and 5-105a of this title and Sec tions 5-
224	224	110, 5-110.1, and 5-113 of Title 70 of the Oklahoma Statutes, and
225	225	the candidate shall swear or affirm that he or she is eligible to
226	226	run for the office or serve in the office if elected. Candidates
227	227	shall file no earlier than 8:00 a.m. on the first Monday second
228	228	Wednesday in December April through no later than 5:00 p.m. on the
229	229	following Wednesday next succeeding Friday. For school districts
230	230	and technology center school districts located in more than on e
231	231	county, filing may be either in the county wherein supervision of
232	232	the district is located or in the county where t he candidate
233	233	resides.
234	234	SECTION 3. This act shall become effective January 1, 2023.
