49 | 52 | | Section 2-503. A. The following shall be subject to |
---|

---|
51 | 54 | | 1. All controlled dangerous substances a nd synthetic controlled |
---|
52 | 55 | | substances which have been manufactured, distributed, disp ensed, |
---|
53 | 56 | | acquired, concealed or possesse d in violation of the Uniform |
---|
54 | 57 | | Controlled Dangerous Substances Act; |
---|
55 | 58 | | 2. All raw materials, products and equipment of any kind and |
---|
56 | 59 | | all drug paraphernalia as defined by the Uniform Controlled |
---|
57 | 60 | | Dangerous Substances Act, whi ch are used, or intended for use, in |
---|
58 | 61 | | manufacturing, compounding, processing, delive ring, importing or |
---|
59 | 62 | | exporting, injecting, ingesting, inhaling, or otherwise introducing |
---|
87 | 91 | | controlled substance in violation of the provisions of t he Uniform |
---|
88 | 92 | | Controlled Dangerous Substances Ac t; |
---|
89 | 93 | | 3. All property which is used, or intended for use, as a |
---|
90 | 94 | | container for property describ ed in paragraphs 1, 2, 5 and 6 of this |
---|

92 | 96 | | 4. All conveyances, including aircraft, vehicles, vessels, or |
---|
93 | 97 | | farm implements which are used to transport, concea l, or cultivate |
---|
94 | 98 | | for the purpose of distribution as defined in the Uniform Controlled |
---|
95 | 99 | | Dangerous Substances Act, or which are used in any manner to |
---|
96 | 100 | | facilitate the transportati on or cultivation for the purpose of s ale |
---|
97 | 101 | | or receipt of property described in parag raphs 1 or 2 of this |
---|
98 | 102 | | subsection or when the property described in paragraphs 1 or 2 of |
---|
99 | 103 | | this subsection is unlawfully possessed by an occupant thereof, |
---|
100 | 104 | | except that: |
---|
101 | 105 | | a. no conveyance used by a person as a common c arrier in |
---|
102 | 106 | | the transaction of business as a co mmon carrier shall |
---|
103 | 107 | | be forfeited under the provisions of the Uniform |
---|
104 | 108 | | Controlled Dangerous Su bstances Act unless it shall |
---|
105 | 109 | | appear that the owner or other person in charge of |
---|
106 | 110 | | such conveyance was a consenting party o r privy to a |
---|
107 | 111 | | violation of the Uniform Control led Dangerous |
---|
108 | 112 | | Substances Act, and |
---|
137 | 142 | | established by the owner thereof to have been |
---|
138 | 143 | | committed or omitted with out the knowledge or consent |
---|
139 | 144 | | of such owner, and if the act is committed by any |
---|
140 | 145 | | person other than such owner the owner shall establish |
---|
141 | 146 | | further that the conveyance was unlawfully in the |
---|
142 | 147 | | possession of a person other than the owner in |
---|
143 | 148 | | violation of the criminal laws of the United States, |
---|
144 | 149 | | or of any state; |
---|
145 | 150 | | 5. All books, records and research, including formulas, |
---|
146 | 151 | | microfilm, tapes and data which ar e used in violation of the Uniform |
---|
147 | 152 | | Controlled Dangerous Substances Act; |
---|
148 | 153 | | 6. All things of value furnished, or intended t o be furnished, |
---|
149 | 154 | | in exchange for a controlled dangerous substance in violation of the |
---|
150 | 155 | | Uniform Controlled Dangerous Substances Act, all pr oceeds traceable |
---|
151 | 156 | | to such an exchange, and all monies, negotiable instruments, and |
---|
152 | 157 | | securities used, or intended to be use d, to facilitate any violation |
---|
153 | 158 | | of the Uniform Controlled Dangerous Substances Act; |
---|
154 | 159 | | 7. All monies, coin and currency found in close prox imity to |
---|
155 | 160 | | any amount of forfeitable substances, to forfeitable drug |
---|
156 | 161 | | manufacturing or distribution paraphernalia or to for feitable |
---|
157 | 162 | | records of the importation, manufact ure or distribution of |
---|
158 | 163 | | substances, which are rebuttably presumed to be forfeitable under |
---|
187 | 193 | | 8. All real property, including any right, title, and interest |
---|
188 | 194 | | in the whole of any lot or tract of land and any appurtenance o r |
---|
189 | 195 | | improvement thereto, which is used, or intended to be used, in any |
---|
190 | 196 | | manner or part, to commit, or to facilitate the com mission of, a |
---|
191 | 197 | | violation of the Uniform Contro lled Dangerous Substances Act which |
---|
192 | 198 | | is punishable by imprisonment for more than one (1) yea r, except |
---|
193 | 199 | | that no property right, title or interest shall be forfeited |
---|
194 | 200 | | pursuant to this paragraph, by reason of any act or omission |
---|
195 | 201 | | established by the owner thereof to have been committed or omitted |
---|
196 | 202 | | without the knowledge or consent of that owner; and |
---|
197 | 203 | | 9. All weapons possessed, used or available for use in any |
---|
198 | 204 | | manner to facilitate a viol ation of the Uniform Controlled Danger ous |
---|
199 | 205 | | Substances Act; and |
---|
200 | 206 | | 10. Property possess ed, used, or available for use in the |
---|
201 | 207 | | cultivation, distribution, processing, sale , or transfer of |
---|
202 | 208 | | marijuana by any person or business entity not licensed by the |
---|
203 | 209 | | Oklahoma Medical Marijuana Authority or otherwise in violation of |
---|
204 | 210 | | the medical marijuana laws in this state. |
---|
205 | 211 | | B. Any property or thing of value of a person is subject to |
---|
206 | 212 | | forfeiture if it is established by a preponderance of the evidence |
---|
207 | 213 | | that such property or thing of val ue was acquired by such person |
---|
208 | 214 | | during the period of the violation of the U niform Controlled |
---|
237 | 244 | | value other than the violation o f the Uniform Controlled Dangerous |
---|
238 | 245 | | Substances Act. |
---|
239 | 246 | | C. Any property or thi ng of value of a person is subject to |
---|
240 | 247 | | forfeiture if it is established by a preponderance of the evid ence |
---|
241 | 248 | | that the person has not paid all or part of a fine imposed pursuant |
---|
242 | 249 | | to the provisions of Section 2 -415 of this title. |
---|
243 | 250 | | D. All items forfeited in this s ection shall be forfeited under |
---|
244 | 251 | | the procedures established in Section 2 -506 of this title. Whenever |
---|
245 | 252 | | any item is forfeited pursuant to this section except for items |
---|
246 | 253 | | confiscated by the Oklahoma State Bureau of Narcotics and Dangerous |
---|
247 | 254 | | Drugs Control, the Depa rtment of Public Safety, the Oklahoma State |
---|
248 | 255 | | Bureau of Investigation, the Alcoholic Beverage Laws Enf orcement |
---|
249 | 256 | | Commission, the Department of Corrections, or the Office of the |
---|
250 | 257 | | Attorney General, the district court of the district shall order |
---|
251 | 258 | | that such item, money, or monies derived from the sale of such item |
---|
252 | 259 | | be deposited by the state, county or city law enfo rcement agency |
---|
253 | 260 | | which seized the item in the revolving fund provided for in Section |
---|
254 | 261 | | 2-506 of this title; provided, such item, money or monies derived |
---|
255 | 262 | | from the sale of such item forfeited due to nonpayment of a fine |
---|
256 | 263 | | imposed pursuant to the provisions of Sect ion 2-415 of this title |
---|
257 | 264 | | shall be apportioned as provided in Section 2 -416 of this title. |
---|
258 | 265 | | Items, money or monies seized pursuant to subsections A and B of |
---|
287 | 295 | | materials used or intended to be used by persons to un lawfully |
---|
288 | 296 | | manufacture or attempt to manufacture any controlled dangerous |
---|
289 | 297 | | substance in violation of the Uniform Controlled Dangerous |
---|
290 | 298 | | Substances Act shall be summarily forfeited pursuant to the |
---|
291 | 299 | | provisions of Section 2 -505 of this title. |
---|
292 | 300 | | E. All property taken or detained under this section by the |
---|
293 | 301 | | Oklahoma State Bureau of Narcotics and Dangerous Drugs Control, the |
---|
294 | 302 | | Department of Public Safety, the Oklahoma State Bureau of |
---|
295 | 303 | | Investigation, the Alcoholic Beverage Laws Enforcement Commission, |
---|
296 | 304 | | the Department of Correc tions, or the Office of the Attorney |
---|
297 | 305 | | General, shall not be repleviable, bu t shall remain in the custody |
---|
298 | 306 | | of the Bureaus, Departments, Commission, or Office, respectively, |
---|
299 | 307 | | subject only to the orders and decrees of a court of competent |
---|
300 | 308 | | jurisdiction. The Dire ctor of the Oklahoma State Bureau of |
---|
301 | 309 | | Narcotics and Dangerous Drugs Control , the Commissioner of Public |
---|
302 | 310 | | Safety, the Director of the Oklahoma State Bureau of Investigation, |
---|
303 | 311 | | the Director of the Alcoholic Beverage Laws Enforcement Commission, |
---|
304 | 312 | | the Director of the Department of Corrections, and the Attorney |
---|
305 | 313 | | General shall follow the pr ocedures outlined in Section 2-506 of |
---|
306 | 314 | | this title dealing with notification of seizure, intent of |
---|
307 | 315 | | forfeiture, final disposition procedures, and release to innocent |
---|
308 | 316 | | claimants with regard to all property included in this section |
---|
337 | 346 | | Commission, the Department of Corrections, or the Office of the |
---|
338 | 347 | | Attorney General. Property taken or detained by the Oklahoma State |
---|
339 | 348 | | Bureau of Narcotics and D angerous Drugs Control, the Department of |
---|
340 | 349 | | Public Safety, the Oklahoma State Bureau of Investigation, the |
---|
341 | 350 | | Alcoholic Beverage Laws Enforcement Commission, the Department of |
---|
342 | 351 | | Corrections, or the Office of the Attorney General shall be disposed |
---|
343 | 352 | | of or sold pursuant to the provisions of Section 2-508 of this |
---|
344 | 353 | | title. Any money, coins, and currency, taken or deta ined pursuant |
---|
345 | 354 | | to this section may be deposited in an interest bearing account by |
---|
346 | 355 | | or at the direction of the State Treasurer if the seizing agency |
---|
347 | 356 | | determines the currency is not to be held as evidence. All interest |
---|
348 | 357 | | earned on such monies shall be returned t o the claimant or forfeited |
---|
349 | 358 | | with the money, coins, and currency which was taken or detained as |
---|
350 | 359 | | provided by law. |
---|
351 | 360 | | F. The proceeds of any forfeiture of items seized by the |
---|
352 | 361 | | Oklahoma State Bureau of Narcotics and Dangerous Drugs Control shall |
---|
353 | 362 | | be distributed as follows: |
---|
354 | 363 | | 1. To the bona fide or innocent purchaser, conditional sales |
---|
355 | 364 | | vendor or mortgagee of the property, if any, up to the amount of his |
---|
356 | 365 | | interest in the property, when the court declaring a forfeiture |
---|
357 | 366 | | orders a distribution to such person; and |
---|
387 | 397 | | state or federal law enforcement agencies, or other state agencies |
---|
388 | 398 | | with CLEET-certified law enforcement officers, assisting in the |
---|
389 | 399 | | forfeiture or underlying cr iminal investigation, to return to such |
---|
390 | 400 | | an agency a percentage of said pro ceeds. |
---|
391 | 401 | | G. Any agency that acquires seized or forfeited property or |
---|
392 | 402 | | money shall maintain a true and accurate inventory and record of all |
---|
393 | 403 | | such property seized pursuant to this section . |
---|
394 | 404 | | SECTION 2. This act shall become effective N ovember 1, 2022. |
---|
