7777 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
7878 SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
7979 last amended by Section 3, Chapter 353, O.S.L. 2017, is amended to
8080 read as follows:
8181 Section 4-112. A. Except as otherwise provided for in the
8282 Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
8383 Act, no person may hunt, pursue, trap, harass, catch, kill, take or
8484 attempt to take in any manner, use, have in possession, sell, or
8585 transport all or any portion of any wildlife ex cept fish, without
8686 having first procured a license from the Department of Wildlife
8787 Conservation. The Oklahoma Wildlife Conservation Commission shall
8888 designate a consecutive Saturday and Sunday in September of each

141141 without first procuring a hunting license pursuant to the provisions
142142 of this section.
143143 B. The following legal residents of Oklahoma shall be exempt
144144 from the annual hunti ng license requirement of paragraph 1 of
145145 subsection F of this section and the following nonresidents shall be
146146 exempt from the annual nonresident hunting licenses required
147147 pursuant to paragraph 1 of subsection C of this section:
148148 1. Legal residents under si xteen (16) years of age;
149149 2. Legal residents sixty -five (65) years of age or older
150150 provided they have obtained a senior citizen lifetime hunting or
151151 combination hunting and fishing license pursuant to the provisions
152152 of Section 4-114 of this title;
153153 3. Legal residents born on or before January 1, 1923;
154154 4. Legal resident veterans having a disability of sixty percent
155155 (60%) or more;
156156 5. Legal resident owners or tenants who hunt on land owned or
157157 leased by them;
158158 6. Any nonresident under fourteen (14) years of ag e;
159159 7. Legal residents having a proven disability which rend ers
160160 them nonambulatory and confines them to a whee lchair, as certified
161161 by a physician licensed in this state or in any state which borders
162162 this state;

214214 8. Any legal resident or nonresident under e ighteen (18) years
215215 of age who is in the physical custody of a child care facility as
216216 defined by Section 402 of Title 10 of the Oklahoma Statutes; and
217217 9. Any legal resident or nonresident hunting, pursuing,
218218 trapping, harassing, catching, killing, taking, o r attempting to
219219 take in any manner any species of rattlesnak e during an organized
220220 rattlesnake-hunting event or festival and who has a rattlesnake
221221 permit issued pursuant to Section 4 -143 of this title.
222222 C. Except as otherwise provided for in the Oklahoma Wi ldlife
223223 Conservation Code, the nonresident hunting licenses i ssued pursuant
224224 to this section and the fee for eac h license shall be:
225225 1. Annual hunting license for nonresidents hunting game other
226226 than deer, antelope, elk or bear which expires on December 31 o f the
227227 year purchased – One Hundred Forty-one Dollars ($141.00).
228228 Nonresidents hunting big game, combination bi g game and upland game
229229 or exotic wildlife in a commercial hunting area shall be required to
230230 have this license;
231231 2. Annual hunting license for nonr esidents hunting game other
232232 than deer, antelope, elk or bear which expires on June 30 of the
233233 fiscal year purchased – One Hundred Seventy-five Dollars ($175.00).
234234 Nonresidents hunting big game, combination big game and upland game
235235 or exotic wildlife in a co mmercial hunting area shall be required to
236236 have this license;

511511 6. Hunting license for antelope for nonresidents – Three
512512 Hundred Five Dollars ($305.00);
513513 7. Hunting license for elk for non residents – Three Hundred
514514 Five Dollars ($305.00);
515515 8. Five-day hunting license for nonresidents hunting game other
516516 than deer, antelope, elk, quail, turkey or bear – Seventy-four
517517 Dollars ($74.00). Nonresidents hunting big game, combination big
518518 game and upland game or exotic wildlife in a commercial hunting area
519519 shall be required to have this license; and
520520 9. Ten-day hunting license for nonresidents hunting small game
521521 in a commercial hunting area – Five Dollars ($5.00).
522522 D. The Department of Wildlife Conserv ation shall provide a
523523 report to both the President Pro Tempore of the Senate and the
524524 Speaker of the House of Representatives by February 1 of 2019 and
525525 2020 setting forth information regarding lice nses issued pursuant to
526526 paragraphs 3, 4 and 5 of subsection C of this section, which shall
527527 include, but not be limited to:
528528 1. The number of licenses issued during the most recent
529529 respective deer hunting seasons; and
530530 2. A fiscal analysis comparing revenue generated from the fees
531531 of the licenses issued during the m ost recent respective deer
532532 hunting seasons compared to previous years and whether the deer
533533 hunting license structure is beneficial to the Department.

585585 E. Of the fees collected pursuant to the prov isions of
586586 subsection C of this section:
587587 1. Five Dollars ($5 .00) of the license fee of each license
588588 issued pursuant to paragraphs 1 through 7 of subsection C of this
589589 section and Two Dollars and fifty cents ($2.50) of the license fee
590590 for each license issued pursuant to paragraph 8 of subsection C of
591591 this section shall be deposited in the Wildlife Land Acquisition
592592 Fund created pursuant to the provisions of Section 4 -132 of this
593593 title; and
594594 2. Five Dollars ($5.00) of the license fee for each license
595595 issued pursuant to paragraphs 1 through 8 of subsection C of this
596596 section shall be for the Oklahoma Wildlife Land Stamp and shall be
597597 deposited in the Oklahoma Wildlife Land Fund created pursuant to the
598598 provisions of Section 4 -141 of this title.
599599 F. Except as otherwi se provided, the resident hunting licenses
600600 issued pursuant to this section and the fee for each license shall
601601 be:
602602 1. Annual hunting license for residents eighteen (18) years of
603603 age and older which expires on December 31 of the year purchased -
604604 Twenty-four Dollars ($24.00);
605605 2. Annual hunting license for residents eighteen (18) years of
606606 age and older which expires on June 30 of the fiscal year purchased
607607 – Thirty-one Dollars ($31.00);

668668 state for at least six (6) months who are receiving Social Security
669669 Disability benefits, Su pplemental Security Income benefits or
670670 disability benefits u nder the Railroad Retirement Act, 45 U.S.C.A.,
671671 Section 231a, or residents who are one -hundred-percent disabled and
672672 are receiving disability payments from the Multiple Injury Trust
673673 Fund pursuant to Section 31 of Title 85A of the Oklahoma Statutes -
674674 Ten Dollars ($10.00);
675675 7. Gun hunting license for deer for residents eighteen (18)
676676 years of age or older - Nineteen Dollars ($19.00). The following
677677 persons shall be exempt:
678678 a. residents with proper certi fication from the United
679679 States Department of Veterans Affai rs or its
680680 successor, certifying that the person is a disabled
681681 veteran in receipt of compensation at the one -hundred-
682682 percent rate, and

814814 ($50.00). Residents hunting in big game or combination big game and
815815 upland game commercial hunting areas shall be exempt from this
816816 license;
817817 14. Hunting license for antelope for residents – Fifty Dollars
818818 ($50.00). Residents hunting in big game or combination big game and
819819 upland game commercial hunting areas shall be exempt from this
820820 license; and
821821 15. Bonus, special or additional gun hunti ng license for deer
822822 for residents - Nineteen Dollars ($19.00 ). The following persons
823823 shall be exempt:
824824 a. residents with proper certification from the United
825825 States Department of Veterans Affairs or its
826826 successor, certifying that the person is a disabled
827827 veteran in receipt of compensation at the one -hundred-
828828 percent rate, and
829829 b. residents hunting in big game or combination big game
830830 and upland game commercial hunting areas.

882882 G. Residents hunting big game, combination big game and upland
883883 game or exotic wildlif e in a commercial hunting area shall be
884884 required to have one of the following licenses:
885885 1. An annual hunting license issued pursuant to paragraph 1, 2,
886886 3 or 4 of subsection F of this section;
887887 2. An annual hunting and fishing combination license issued
888888 pursuant to Section 4-113 of this title;
889889 3. A five-year hunting license or five-year combination hunting
890890 and fishing license issued pursuant to Section 4 -113.1 of this
891891 title; or
892892 4. A lifetime hunting license or lifetime combination hunting
893893 and fishing license issued pursuant to Section 4-114 of this title.
894894 H. Of the fees collected pursuant to the provisions of
895895 paragraphs 1 and 2 of subsection F of this section, Five Dollars
896896 ($5.00) of the license fee shall be for the Oklahoma Wildlife Land
897897 Stamp and shall be deposited in the Oklahoma Wildlife Land Fund
898898 created pursuant to the provisions of Section 4 -141 of this title.
899899 I. The provisions of this section shall not be construed to
900900 require a hunting license, resident or nonresident, of any person
901901 merely because the person participates, as owner or handler of an
902902 entry, as an official, or as a spectator in the conduct of a field
903903 trial or performance test of dogs, whether a resident or nonresident
904904 of the State of Oklahoma. No license to hunt shall be required of
905905 any person engaged in training or working dogs, provided that person

958958 in any manner any game.
959959 J. 1. Any person arrested for hunting game other than deer,
960960 antelope, elk, bear or turkey wi thout a valid hunting license as
961961 required by the provisions o f subsection A of this section may
962962 purchase a substitute temporary thirty -day license from the
963963 arresting game warden in lieu of posting bond. Proof of hunter
964964 safety certification will not be req uired for the temporary
965965 substitute license. The fee for a su bstitute license purchased
966966 pursuant to the provisions of this subsection shall be:
967967 a. for legal residents, Fifty Dollars ($50.00), and
968968 b. for nonresidents, One Hundred Forty -five Dollars
969969 ($145.00).
970970 2. Except as otherwise provided for by this subsection, t he
971971 fees from licenses purchased pursuant to the provisions of this
972972 subsection shall be deposited in the Wildlife Conservation Fund to
973973 be used exclusively for developing, managing, preserving, and
974974 protecting wildlife and wildlife habitat.
975975 K. Any person producing proof in court that a current hunting
976976 license issued by the Department of Wildlife Conservation to that
977977 person was in force at the time of the alleged offense shall be

10331033 attorney within seventy-two (72) hours after the violation, the
10341034 charge shall be dismissed without payment of court costs.
10351035 L. Unless a substitute license is purchased as provided for by
10361036 subsection J of this section, any resident convicted of violating
10371037 the provisions of this section shall be punished by the imposition
10381038 of a fine of not less than Twenty-five Dollars ($25.00) nor more
10391039 than Two Hundred Dollars ($200.00), or by imprisonment in the county
10401040 jail for a period not to exceed thirty (30) days, or by both.
10411041 M. Unless a substitute license is purchased as provided for by
10421042 subsection J of this section, any nonresident convicted of violating
10431043 the provisions of this section shall be punished by the imposition
10441044 of a fine of not less than Two Hundred Dollars ($200.00) nor more
10451045 than Five Hundred Dollars ($500.00), or by imprisonment in the
10461046 county jail for a period not to exceed six (6) months, or by both.
10471047 SECTION 2. This act shall become effective November 1, 2022.
