77	77		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAH OMA:
78	78		SECTION 1. AMENDATORY 29 O.S. 2021, Section 4 -112, as
79	79		last amended by Section 3, Chapter 353, O.S.L. 2017, is amended to
80	80		read as follows:
81	81		Section 4-112. A. Except as otherwise provided for in the
82	82		Oklahoma Wildlife Conservation Code or the Oklahoma Farmed Cervidae
83	83		Act, no person may hunt, pursue, trap, harass, catch, kill, take or
84	84		attempt to take in any manner, use, have in possession, sell, or
85	85		transport all or any portion of any wildlife ex cept fish, without
86	86		having first procured a license from the Department of Wildlife
87	87		Conservation. The Oklahoma Wildlife Conservation Commission shall
88	88		designate a consecutive Saturday and Sunday in September of each

140	140		year as free hunting days in which reside nts of this state may hunt
141	141		without first procuring a hunting license pursuant to the provisions
142	142		of this section.
143	143		B. The following legal residents of Oklahoma shall be exempt
144	144		from the annual hunti ng license requirement of paragraph 1 of
145	145		subsection F of this section and the following nonresidents shall be
146	146		exempt from the annual nonresident hunting licenses required
147	147		pursuant to paragraph 1 of subsection C of this section:
148	148		1. Legal residents under si xteen (16) years of age;
149	149		2. Legal residents sixty -five (65) years of age or older
150	150		provided they have obtained a senior citizen lifetime hunting or
151	151		combination hunting and fishing license pursuant to the provisions
152	152		of Section 4-114 of this title;
153	153		3. Legal residents born on or before January 1, 1923;
154	154		4. Legal resident veterans having a disability of sixty percent
155	155		(60%) or more;
156	156		5. Legal resident owners or tenants who hunt on land owned or
157	157		leased by them;
158	158		6. Any nonresident under fourteen (14) years of ag e;
159	159		7. Legal residents having a proven disability which rend ers
160	160		them nonambulatory and confines them to a whee lchair, as certified
161	161		by a physician licensed in this state or in any state which borders
162	162		this state;

214	214		8. Any legal resident or nonresident under e ighteen (18) years
215	215		of age who is in the physical custody of a child care facility as
216	216		defined by Section 402 of Title 10 of the Oklahoma Statutes; and
217	217		9. Any legal resident or nonresident hunting, pursuing,
218	218		trapping, harassing, catching, killing, taking, o r attempting to
219	219		take in any manner any species of rattlesnak e during an organized
220	220		rattlesnake-hunting event or festival and who has a rattlesnake
221	221		permit issued pursuant to Section 4 -143 of this title.
222	222		C. Except as otherwise provided for in the Oklahoma Wi ldlife
223	223		Conservation Code, the nonresident hunting licenses i ssued pursuant
224	224		to this section and the fee for eac h license shall be:
225	225		1. Annual hunting license for nonresidents hunting game other
226	226		than deer, antelope, elk or bear which expires on December 31 o f the
227	227		year purchased – One Hundred Forty-one Dollars ($141.00).
228	228		Nonresidents hunting big game, combination bi g game and upland game
229	229		or exotic wildlife in a commercial hunting area shall be required to
230	230		have this license;
231	231		2. Annual hunting license for nonr esidents hunting game other
232	232		than deer, antelope, elk or bear which expires on June 30 of the
233	233		fiscal year purchased – One Hundred Seventy-five Dollars ($175.00).
234	234		Nonresidents hunting big game, combination big game and upland game
235	235		or exotic wildlife in a co mmercial hunting area shall be required to
236	236		have this license;

302	302		hunting all deer allowe d during the current calendar
303	303		year deer gun season - Two Hundred Ninety-nine Dollars
304	304		($299.00), and
305	305		d. during any deer gun season occurring on or after
306	306		January 16, 2021, for nonresidents which shall be
307	307		valid for hunting all deer allowed during the current
308	308		calendar year deer gun season - Two Hundred Seventy-
309	309		nine Dollars ($279.00) Thirty Dollars ($30.00);
310	310		4. Archery hunting license for deer for nonresidents which
311	311		shall expire on January 15 of the calendar year after the year

364	364		expire at the end of that deer archery season:
365	365		a. during deer archery seaso ns occurring prior to January
366	366		16, 2021, for youth nonresidents seventeen (17) years
367	367		of age or younger which shall be valid for hunting one
368	368		antlerless deer allowed during the current deer
369	369		archery season – Thirty Dollars ($30.00),
370	370		b. during deer archery seas ons occurring prior to January
371	371		16, 2021, for youth nonresidents seventeen (17) years
372	372		of age or younger which shall be valid for hunting one
373	373		antlered or antlerless deer allowed during the current
374	374		deer archery season – Ninety-nine Dollars ($99.00),
375	375		c. during deer archery seasons occurring prior to January
376	376		16, 2021, for nonresidents which shall be valid for
377	377		hunting all deer allowed during the current d eer
378	378		archery season - Two Hundred Ninety-nine Dollars

452	452		calendar year deer primitive firearms season - Two
453	453		Hundred Ninety-nine Dollars ($299.00), and
454	454		d. during any deer primitive firearms season occurring on
455	455		or after January 16, 2021, for nonresidents which
456	456		shall be valid for hunt ing all deer allowed during the
457	457		current calendar year deer primitive firearms season -
458	458		Two Hundred Seventy-nine Dollars ($279.00) Thirty

512	512		Hundred Five Dollars ($305.00);
513	513		7. Hunting license for elk for non residents – Three Hundred
514	514		Five Dollars ($305.00);
515	515		8. Five-day hunting license for nonresidents hunting game other
516	516		than deer, antelope, elk, quail, turkey or bear – Seventy-four
517	517		Dollars ($74.00). Nonresidents hunting big game, combination big
518	518		game and upland game or exotic wildlife in a commercial hunting area
519	519		shall be required to have this license; and
520	520		9. Ten-day hunting license for nonresidents hunting small game
521	521		in a commercial hunting area – Five Dollars ($5.00).
522	522		D. The Department of Wildlife Conserv ation shall provide a
523	523		report to both the President Pro Tempore of the Senate and the
524	524		Speaker of the House of Representatives by February 1 of 2019 and
525	525		2020 setting forth information regarding lice nses issued pursuant to
526	526		paragraphs 3, 4 and 5 of subsection C of this section, which shall
527	527		include, but not be limited to:
528	528		1. The number of licenses issued during the most recent
529	529		respective deer hunting seasons; and
530	530		2. A fiscal analysis comparing revenue generated from the fees
531	531		of the licenses issued during the m ost recent respective deer
532	532		hunting seasons compared to previous years and whether the deer
533	533		hunting license structure is beneficial to the Department.

585	585		E. Of the fees collected pursuant to the prov isions of
586	586		subsection C of this section:
587	587		1. Five Dollars ($5 .00) of the license fee of each license
588	588		issued pursuant to paragraphs 1 through 7 of subsection C of this
589	589		section and Two Dollars and fifty cents ($2.50) of the license fee
590	590		for each license issued pursuant to paragraph 8 of subsection C of
591	591		this section shall be deposited in the Wildlife Land Acquisition
592	592		Fund created pursuant to the provisions of Section 4 -132 of this
593	593		title; and
594	594		2. Five Dollars ($5.00) of the license fee for each license
595	595		issued pursuant to paragraphs 1 through 8 of subsection C of this
596	596		section shall be for the Oklahoma Wildlife Land Stamp and shall be
597	597		deposited in the Oklahoma Wildlife Land Fund created pursuant to the
598	598		provisions of Section 4 -141 of this title.
599	599		F. Except as otherwi se provided, the resident hunting licenses
600	600		issued pursuant to this section and the fee for each license shall
601	601		be:
602	602		1. Annual hunting license for residents eighteen (18) years of
603	603		age and older which expires on December 31 of the year purchased -
604	604		Twenty-four Dollars ($24.00);
605	605		2. Annual hunting license for residents eighteen (18) years of
606	606		age and older which expires on June 30 of the fiscal year purchased
607	607		– Thirty-one Dollars ($31.00);

667	667		6. Five-year disability hunting license for residents of this
668	668		state for at least six (6) months who are receiving Social Security
669	669		Disability benefits, Su pplemental Security Income benefits or
670	670		disability benefits u nder the Railroad Retirement Act, 45 U.S.C.A.,
671	671		Section 231a, or residents who are one -hundred-percent disabled and
672	672		are receiving disability payments from the Multiple Injury Trust
673	673		Fund pursuant to Section 31 of Title 85A of the Oklahoma Statutes -
674	674		Ten Dollars ($10.00);
675	675		7. Gun hunting license for deer for residents eighteen (18)
676	676		years of age or older - Nineteen Dollars ($19.00). The following
677	677		persons shall be exempt:
678	678		a. residents with proper certi fication from the United
679	679		States Department of Veterans Affai rs or its
680	680		successor, certifying that the person is a disabled
681	681		veteran in receipt of compensation at the one -hundred-
682	682		percent rate, and

814	814		($50.00). Residents hunting in big game or combination big game and
815	815		upland game commercial hunting areas shall be exempt from this
816	816		license;
817	817		14. Hunting license for antelope for residents – Fifty Dollars
818	818		($50.00). Residents hunting in big game or combination big game and
819	819		upland game commercial hunting areas shall be exempt from this
820	820		license; and
821	821		15. Bonus, special or additional gun hunti ng license for deer
822	822		for residents - Nineteen Dollars ($19.00 ). The following persons
823	823		shall be exempt:
824	824		a. residents with proper certification from the United
825	825		States Department of Veterans Affairs or its
826	826		successor, certifying that the person is a disabled
827	827		veteran in receipt of compensation at the one -hundred-
828	828		percent rate, and
829	829		b. residents hunting in big game or combination big game
830	830		and upland game commercial hunting areas.

883	883		game or exotic wildlif e in a commercial hunting area shall be
884	884		required to have one of the following licenses:
885	885		1. An annual hunting license issued pursuant to paragraph 1, 2,
886	886		3 or 4 of subsection F of this section;
887	887		2. An annual hunting and fishing combination license issued
888	888		pursuant to Section 4-113 of this title;
889	889		3. A five-year hunting license or five-year combination hunting
890	890		and fishing license issued pursuant to Section 4 -113.1 of this
891	891		title; or
892	892		4. A lifetime hunting license or lifetime combination hunting
893	893		and fishing license issued pursuant to Section 4-114 of this title.
894	894		H. Of the fees collected pursuant to the provisions of
895	895		paragraphs 1 and 2 of subsection F of this section, Five Dollars
896	896		($5.00) of the license fee shall be for the Oklahoma Wildlife Land
897	897		Stamp and shall be deposited in the Oklahoma Wildlife Land Fund
898	898		created pursuant to the provisions of Section 4 -141 of this title.
899	899		I. The provisions of this section shall not be construed to
900	900		require a hunting license, resident or nonresident, of any person
901	901		merely because the person participates, as owner or handler of an
902	902		entry, as an official, or as a spectator in the conduct of a field
903	903		trial or performance test of dogs, whether a resident or nonresident
904	904		of the State of Oklahoma. No license to hunt shall be required of
905	905		any person engaged in training or working dogs, provided that person

957	957		is in no way engaged in hunting and does not take or attempt to take
958	958		in any manner any game.
959	959		J. 1. Any person arrested for hunting game other than deer,
960	960		antelope, elk, bear or turkey wi thout a valid hunting license as
961	961		required by the provisions o f subsection A of this section may
962	962		purchase a substitute temporary thirty -day license from the
963	963		arresting game warden in lieu of posting bond. Proof of hunter
964	964		safety certification will not be req uired for the temporary
965	965		substitute license. The fee for a su bstitute license purchased
966	966		pursuant to the provisions of this subsection shall be:
967	967		a. for legal residents, Fifty Dollars ($50.00), and
968	968		b. for nonresidents, One Hundred Forty -five Dollars
969	969		($145.00).
970	970		2. Except as otherwise provided for by this subsection, t he
971	971		fees from licenses purchased pursuant to the provisions of this
972	972		subsection shall be deposited in the Wildlife Conservation Fund to
973	973		be used exclusively for developing, managing, preserving, and
974	974		protecting wildlife and wildlife habitat.
975	975		K. Any person producing proof in court that a current hunting
976	976		license issued by the Department of Wildlife Conservation to that
977	977		person was in force at the time of the alleged offense shall be
978	978		entitled to dismissa l of a charge of violating this section upon
979	979		payment of court costs. If proof of a current hunting license
980	980		issued by the Department to the person that was in force at the time

1033	1033		attorney within seventy-two (72) hours after the violation, the
1034	1034		charge shall be dismissed without payment of court costs.
1035	1035		L. Unless a substitute license is purchased as provided for by
1036	1036		subsection J of this section, any resident convicted of violating
1037	1037		the provisions of this section shall be punished by the imposition
1038	1038		of a fine of not less than Twenty-five Dollars ($25.00) nor more
1039	1039		than Two Hundred Dollars ($200.00), or by imprisonment in the county
1040	1040		jail for a period not to exceed thirty (30) days, or by both.
1041	1041		M. Unless a substitute license is purchased as provided for by
1042	1042		subsection J of this section, any nonresident convicted of violating
1043	1043		the provisions of this section shall be punished by the imposition
1044	1044		of a fine of not less than Two Hundred Dollars ($200.00) nor more
1045	1045		than Five Hundred Dollars ($500.00), or by imprisonment in the
1046	1046		county jail for a period not to exceed six (6) months, or by both.
1047	1047		SECTION 2. This act shall become effective November 1, 2022.
