55	79		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
56	80		SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, is
57	81		amended to read as follows:
58	82		Section 307. A. No public body shall hold executive sessions
59	83		unless otherwise specifically provid ed in this section.
60	84		B. Executive sessions of public bodies wil l be permitted only
61	85		for the purpose of:
62	86		1. Discussing the employment, hiring , appointment, promotion,
63	87		demotion, disciplining or resignation of any individual salaried
64	88		public officer or employe e;

112	160		9. Discussing matters involving safety and security at state
113	161		penal Department of Corrections institutions or corre ctional

143	215		requiring approval of the Board of Corrections, whic h shall be
144	216		limited to members of the public body, the attorney for the public
145	217		body, and the immedi ate staff of the public body. No person who may
146	218		profit directly or indirectly by a proposed transaction whi ch is
147	219		under consideration may be present or partic ipate in the executive
148	220		session; or
149	221		11. Discussing the following:
150	222		a. the investigation of a plan o r scheme to commit an act
151	223		of terrorism,
152	224		b. assessments of the vulnerability of government
153	225		facilities or public improvements to an act of
154	226		terrorism,
155	227		c. plans for deterrence or prevention of or protection
156	228		from an act of terrorism,
157	229		d. plans for response or re mediation after an act of
158	230		terrorism,
159	231		e. information technology of the public body but only if
160	232		the discussion specifically identifies:
161	233		(1) design or functional schematics that demonstrat e
162	234		the relationship or connections between devices
163	235		or systems,

202	298		f. the investigation of an act of terrorism that has

204	300		For the purposes of this su bsection, the term “terrorism” means any
205	301		act encompassed by the definitions set forth in Section 1268.1 of
206	302		Title 21 of the Oklahoma Statutes.
207	303		C. Notwithstanding the provisions of subse ction B of this
208	304		section, the following public bodies may hold executive sessions:
209	305		1. The State Banking Board, as provided for under Section 306.1
210	306		of Title 6 of the Oklahoma Statu tes;
211	307		2. The Oklahoma Industrial Finance Authority , as provided for
212	308		in Section 854 of Title 74 of the Oklahoma Statutes;
213	309		3. The Oklahoma Developmen t Finance Authority, as provided for
214	310		in Section 5062.6 of Title 74 of the Oklahoma Statutes;

245	365		5. The Oklahoma Hea lth Research Committee for purposes of
246	366		conferring on matters pertaining to research and development of
247	367		products, if public disclosure of the matter discussed would
248	368		interfere with the de velopment of patents, copyrights, products, or
249	369		services;
250	370		6. The Workers’ Compensation Commission for the purposes
251	371		provided for in Section 20 of Title 85A of the Oklahoma Statutes ;
252	372		7. A review committee, as provided for in Secti on 855 of Title
253	373		62 of the Oklahoma Statutes;
254	374		8. The Child Death Review Board for purposes of rece iving and
255	375		conferring on matters pertaining to materials declared confidential
256	376		by law;
257	377		9. The Domestic Viole nce Fatality Review Board as provided in
258	378		Section 1601 of Title 22 of the Okla homa Statutes;
259	379		10. The Opioid Overdose Fatality Review Board, as provi ded in
260	380		Section 2-1001 of Title 63 of the Oklahoma Statutes;
261	381		11. All nonprofit foundations, boards, bureaus, commissions,
262	382		agencies, trusteeships, authorities, councils, committees, publ ic
263	383		trusts, task forces or study groups supported in whole or part by
264	384		public funds or entrusted with the expenditure of public funds for
265	385		purposes of conferring on matters pertainin g to economic

293	437		development, including the transfer of property, financing, or the
294	438		creation of a proposal to entice a business to remain or to locate
295	439		within their jurisdiction if public disclosure of the matter
296	440		discussed would interfere with the development of products or
297	441		services or if public disclosure wo uld violate the confidentia lity
298	442		of the business;
299	443		12. The Oklahoma Indigent Defense System Board f or purposes of
300	444		discussing negotiating strategies in connection with making possible
301	445		counteroffers to offers to contract to provide legal representation
302	446		to indigent criminal defendants a nd indigent juveniles in cases for
303	447		which the System must provide repres entation pursuant to the
304	448		provisions of the Indigent Defense System Act;
305	449		13. The Quality Investment Committe e for purposes of discussing
306	450		applications and conf idential materials pursuant to the terms of the
307	451		Oklahoma Quality Investment Act; and
308	452		14. The Oklahoma Municipal Power Authority established pursuant
309	453		to Section 24-101 et seq. of Title 11 of the Oklahoma St atutes and
310	454		in its role as an electric utility regu lated by the federal
311	455		government, for purposes of discussing security plans and procedures
312	456		including, but not limited to, cybersecurity matters.
313	457		D. Except as otherwise specified in this subsection, an
314	458		executive session for the purpose of discussing the pur chase or
315	459		appraisal of real property shall be limited to members of the public
316	460		body, the attorney f or the public body and the immediate staff of

344	512		the public body. No landowner, real estate salesperson, broke r,
345	513		developer or any other person who may profit di rectly or indirectly
346	514		by a proposed transaction concerning real property which is under
347	515		consideration may be present or participate in the executive
348	516		session, unless they are operating under an existing agree ment to
349	517		represent the public body.
350	518		E. No public body may go into an executiv e session unless the
351	519		following procedures are strictly complied with:
352	520		1. The proposed executive session is noted on the agenda as
353	521		provided in Section 311 of this title;
354	522		2. The executive session is authorized by a majority vote of a
355	523		quorum of the members present and the vote is a recorded vote; and
356	524		3. Except for matters con sidered in executive sessions of the
357	525		State Banking Board and the Oklahoma Savings and Loan Board, and
358	526		which are required by state or federal law to be confide ntial, any
359	527		vote or action on any item of business considered in an executive
360	528		session shall be take n in public meeting with the vote of each
361	529		member publicly cast and recorded.
362	530		F. A willful violation of the provisions of this section shall:
363	531		1. Subject each member of the public body to criminal sanctions
364	532		as provided in Section 314 of this title; and
365	533		2. Cause the minutes and all other records of the executive
366	534		session, including tape recordings, to be immediat ely made public.
