5579 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
5680 SECTION 1. AMENDATORY 25 O.S. 2021, Section 307, is
5781 amended to read as follows:
5882 Section 307. A. No public body shall hold executive sessions
5983 unless otherwise specifically provid ed in this section.
6084 B. Executive sessions of public bodies wil l be permitted only
6185 for the purpose of:
6286 1. Discussing the employment, hiring , appointment, promotion,
6387 demotion, disciplining or resignation of any individual salaried

142214 10. Discussing contract negotiations involving contracts
143215 requiring approval of the Board of Corrections, whic h shall be
144216 limited to members of the public body, the attorney for the public
145217 body, and the immedi ate staff of the public body. No person who may
146218 profit directly or indirectly by a proposed transaction whi ch is
147219 under consideration may be present or partic ipate in the executive
148220 session; or
149221 11. Discussing the following:
150222 a. the investigation of a plan o r scheme to commit an act
151223 of terrorism,
152224 b. assessments of the vulnerability of government
153225 facilities or public improvements to an act of
154226 terrorism,
155227 c. plans for deterrence or prevention of or protection
156228 from an act of terrorism,
157229 d. plans for response or re mediation after an act of
158230 terrorism,
159231 e. information technology of the public body but only if
160232 the discussion specifically identifies:
161233 (1) design or functional schematics that demonstrat e
162234 the relationship or connections between devices

204300 For the purposes of this su bsection, the term “terrorism” means any
205301 act encompassed by the definitions set forth in Section 1268.1 of
206302 Title 21 of the Oklahoma Statutes.
207303 C. Notwithstanding the provisions of subse ction B of this
208304 section, the following public bodies may hold executive sessions:
209305 1. The State Banking Board, as provided for under Section 306.1
210306 of Title 6 of the Oklahoma Statu tes;
211307 2. The Oklahoma Industrial Finance Authority , as provided for
212308 in Section 854 of Title 74 of the Oklahoma Statutes;
213309 3. The Oklahoma Developmen t Finance Authority, as provided for
214310 in Section 5062.6 of Title 74 of the Oklahoma Statutes;

247367 products, if public disclosure of the matter discussed would
248368 interfere with the de velopment of patents, copyrights, products, or

250370 6. The Workers’ Compensation Commission for the purposes
251371 provided for in Section 20 of Title 85A of the Oklahoma Statutes ;
252372 7. A review committee, as provided for in Secti on 855 of Title
253373 62 of the Oklahoma Statutes;
254374 8. The Child Death Review Board for purposes of rece iving and
255375 conferring on matters pertaining to materials declared confidential
256376 by law;
257377 9. The Domestic Viole nce Fatality Review Board as provided in
258378 Section 1601 of Title 22 of the Okla homa Statutes;
259379 10. The Opioid Overdose Fatality Review Board, as provi ded in
260380 Section 2-1001 of Title 63 of the Oklahoma Statutes;
261381 11. All nonprofit foundations, boards, bureaus, commissions,
262382 agencies, trusteeships, authorities, councils, committees, publ ic
263383 trusts, task forces or study groups supported in whole or part by
264384 public funds or entrusted with the expenditure of public funds for
265385 purposes of conferring on matters pertainin g to economic

294438 creation of a proposal to entice a business to remain or to locate
295439 within their jurisdiction if public disclosure of the matter
296440 discussed would interfere with the development of products or
297441 services or if public disclosure wo uld violate the confidentia lity
298442 of the business;
299443 12. The Oklahoma Indigent Defense System Board f or purposes of
300444 discussing negotiating strategies in connection with making possible
301445 counteroffers to offers to contract to provide legal representation
302446 to indigent criminal defendants a nd indigent juveniles in cases for
303447 which the System must provide repres entation pursuant to the
304448 provisions of the Indigent Defense System Act;
305449 13. The Quality Investment Committe e for purposes of discussing
306450 applications and conf idential materials pursuant to the terms of the
307451 Oklahoma Quality Investment Act; and
308452 14. The Oklahoma Municipal Power Authority established pursuant
309453 to Section 24-101 et seq. of Title 11 of the Oklahoma St atutes and
310454 in its role as an electric utility regu lated by the federal
311455 government, for purposes of discussing security plans and procedures
312456 including, but not limited to, cybersecurity matters.
313457 D. Except as otherwise specified in this subsection, an
314458 executive session for the purpose of discussing the pur chase or
315459 appraisal of real property shall be limited to members of the public
316460 body, the attorney f or the public body and the immediate staff of

344512 the public body. No landowner, real estate salesperson, broke r,
345513 developer or any other person who may profit di rectly or indirectly
346514 by a proposed transaction concerning real property which is under
347515 consideration may be present or participate in the executive
348516 session, unless they are operating under an existing agree ment to
349517 represent the public body.
350518 E. No public body may go into an executiv e session unless the
351519 following procedures are strictly complied with:
352520 1. The proposed executive session is noted on the agenda as
353521 provided in Section 311 of this title;
354522 2. The executive session is authorized by a majority vote of a
355523 quorum of the members present and the vote is a recorded vote; and
356524 3. Except for matters con sidered in executive sessions of the
357525 State Banking Board and the Oklahoma Savings and Loan Board, and
358526 which are required by state or federal law to be confide ntial, any
359527 vote or action on any item of business considered in an executive
360528 session shall be take n in public meeting with the vote of each
361529 member publicly cast and recorded.
362530 F. A willful violation of the provisions of this section shall:
363531 1. Subject each member of the public body to criminal sanctions
364532 as provided in Section 314 of this title; and
365533 2. Cause the minutes and all other records of the executive
366534 session, including tape recordings, to be immediat ely made public.
