5952 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA :
6053 SECTION 1. AMENDATORY 10A O.S. 2011, Section 1 -3-102, is
6154 amended to read as f ollows:
6255 Section 1-3-102. A. For purposes of this section:
6356 1. “Routine and ordinary medical care and treatment” includes
6457 any necessary medical and dental examinations and treatment, medic al
6558 screenings, clinical laboratory tes ts, blood testing, preventati ve
6659 care, health assessments, physical examinations, immunizations,
6760 contagious or infectious diseas e screenings or tests and care
61+required for treatment of illness and injury , including x-rays,
62+stitches and casts, or the provisi on of psychotropic medication s but
63+does not include any type of extraordinary care; and

95-required for treatment of illness and inju ry, including x-rays,
96-stitches and casts, or the provision of psychotropic medications but
97-does not include any type of extraordinary care; and
9890 2. “Extraordinary medical care and tre atment” includes, but is
9991 not limited to, surgery, general anesthesia, blood transfusions, o r
10092 invasive or experimental procedures.
10193 B. If a child taken into pr otective custody without a court
10294 order requires emergency medical care prior to the emergency cust ody
10395 hearing, and either the treatment is related t o the suspected abuse
10496 or neglect or the parent or legal guardian is unavailable or
10597 unwilling to consent to t reatment recommended by a physician, a
10698 peace officer, court employ ee or the court may authorize su ch
10799 treatment as is necessary to safeguard the heal th or life of the
108100 child. Before a peace officer, court employee or the court
109101 authorizes treatment based on unavailability of the parent or legal
110102 guardian, law enforcement sh all exercise diligence in locati ng the
111103 parent or guardian, if known.
112104 C. 1. If a child has been placed in the custody of t he
113105 Department of Human Services, the D epartment shall have the
114106 authority to consent to routine and ordinary medical care and
115107 treatment. The Department shall make re asonable attempts to notify
116108 the child’s parent or legal guardian of the provision of routin e and
117109 ordinary medical care and treatm ent and to keep the parent or legal
118110 guardian involved in such care.
111+2. In no case shall the De partment consent to a child ’s
112+abortion, sterilization, termination of life support or a “Do Not
113+Resuscitate” order. The court may authorize the withdrawal of li fe-

146-2. In no case shall the Department consent to a child ’s
147-abortion, sterilization, termination of life support or a “Do Not
148-Resuscitate” order. The court may authorize the withdrawal of life -
149140 sustaining medical treatme nt or the denial of the administration of
150141 cardiopulmonary resuscit ation on behalf of a child in th e
151142 Department’s custody, and may additionally autho rize anatomical
152143 gifts to be procured from such child if the withdrawal of life -
153144 sustaining medical treatment or denial of the administration of
154145 cardiopulmonary resuscitation is authorized, upon the written
155146 recommendation of a licensed physician of such withdrawal or denial
156147 and of such procurement, as applicable, after notice to th e parties
157148 and a hearing.
158149 3. Nothing herein shall prevent the Department from
159150 authorizing, in writi ng, any person, foster parent or administrator
160151 of a facility into whose care a chi ld in its custody has been
161152 entrusted, to consent to routine and ordinary me dical care and
162153 treatment to be rendered to a child upon the advice of a licensed
163154 physician, including the continuation of psychotro pic medication.
164155 D. Consent for a child ’s extraordinary medical care and
165156 treatment shall be obtained from the parent or legal guardian unless
166157 the treatment is either related to the abuse or neglect or the
167158 parent or legal guardian is unavailable or refuses to consent to
168159 such care, in which case in an emerg ency, based upon recommendation
169160 of a physician, the court may enter an ex p arte order authorizing
161+such treatment or procedure in order to safeguard the child ’s health
162+or life. If the recommended extraordin ary medical care and
163+treatment is not an emergency , the court shall hold a hearing, upon

198-or life. If the recommended extraordinary medical care and
199-treatment is not an emergency, the court shall hold a hearing, upon
200190 application by the district attorney and notice to all parties, and
201191 may authorize such recommended extraordinary care.
202192 E. If a child has been placed in the custody of a person, other
203193 than a parent or legal guardian, or an institution or agency other
204194 than the Department, the court shall dete rmine the authority of the
205195 person, institution, or agency to consent to medical care including
206196 routine and ordinary medical care an d treatment and extraordinary
207197 care. The parent, l egal guardian, or person having legal cus tody
208198 shall be responsible for the costs of medical care as determin ed by
209199 the court.
210200 SECTION 2. AMENDATORY 63 O.S. 2011, Section 2200.8A, is
211201 amended to read as follows:
212202 Section 2200.8A. A. Except as otherwise provided in paragraph
213203 2 of subsection C of Section 1 -3-102 of Title 10A of the Oklahoma
214204 Statutes and subsection G of this section , and subject to subsection
215205 F of this section, in the absence of an express, contrary indication
216206 by the donor, a person other than the donor is bar red from making,
217207 amending, or revoking an anatomical gift of a dono r’s body or part
218208 if the donor made an anatomical gift of the donor’s body or part
219209 under Section 5 of this act Section 2200.5A of this title or an
210+amendment to an anatomical gift of the d onor’s body or part under
211+Section 6 of this act Section 2200.6A of thi s title.
212+B. A donor’s revocation of an anatomical gift of the donor ’s
213+body or part under Section 6 of this act Section 2200.6A of this

261250 the gift of the donor’s body or part under Section 10 of this act

263252 D. A revocation of an anatomical gift of a donor ’s body or part
264253 under Section 6 of this act Section 2200.6A of this title by a
265254 person other than the donor does not bar another person from making
266255 an anatomical gift of the body or part under Section 5 or 10 of this
267256 act Section 2200.5A or 2200.10A of this title .
268257 E. In the absence of an express, contrary indication by the

299-limitation on the making of an anatomical gift of another part at a
300-later time by the donor or another person.
301289 F. In the absence of an express, contrary indication by the
302290 donor or other person authorized to make an anatomical gift under
303291 Section 4 of this act Section 2200.4A of this title, an anatomical
304292 gift of a part for one or more of the purposes set for th in Section
305293 4 of this act Section 2200.4A of this title is not a limitation on
306294 the making of an anatomical gift of the part for any of the other
307295 purposes by the donor or any other person under Section 5 or 10 of
308296 this act Section 2200.5A or 2200.10A of this title.
309297 G. If a donor who is an unemancipated minor dies, a parent of
310298 the donor who is reasonably available may revoke or amend an
311299 anatomical gift of the donor ’s body or part.
312300 H. If an unemancipated minor who signe d a refusal dies, a
313301 parent of the minor who is reasonably available may revoke the
314302 minor’s refusal.
315303 SECTION 3. AMENDATORY 63 O.S. 2011, Section 2200.9A, is
316304 amended to read as follows:
317305 Section 2200.9A. A. Subject to subsections B and C of this
318306 section and unless barr ed by Section 7 or 8 of this act Section
319307 2200.7A or 2200.8A of this title , an anatomical gift of a decedent’s
320308 body or part for purpose of transpl antation, therapy, research, or
321309 education may be made by any member of th e following classes of
310+persons who is reasonably available, in the order of priority
311+listed:

351338 1. An agent of the decedent at the ti me of death who could have
352339 made an anatomical gift u nder paragraph 2 of Section 4 of this act
353340 Section 2200.4A of this title immediately before the decedent ’s
354341 death;
355342 2. The spouse of the deced ent;
356343 3. Adult children of the decedent;
357344 4. Parents of the decedent;
358345 5. Adult siblings of th e decedent;
359346 6. Adult grandchildren of the decedent;
360347 7. Grandparents of the decedent;
361348 8. An adult who exhibited special care and co ncern for the
362349 decedent;
363350 9. The persons who were acting as the guardians of the person
364351 of the decedent at the time of death ; and
365352 10. A court pursuant to an order entered pursuant to paragraph
366353 2 of subsection C of Section 1-3-102 of Title 10A of the Oklahoma
367354 Statutes; and
368355 11. Any other person having the authority to dispose of the
369356 decedent’s body.
370357 B. If there is more than on e member of a class listed in
371358 paragraph 1, 3, 4, 5, 6 , 7 or 9 of subsection A of this section
372359 entitled to make an anatomical gift, an anatomical gift may be made
360+by a member of the class unless that member or a person to whom the
361+gift may pass under Section 11 of this act Section 2200.11A of this

401-gift may pass under Section 11 of this act Section 2200.11A of this
402388 title knows of an objection by another member of the class. If an
403389 objection is known, th e gift may be made only by a ma jority of the
404390 members of the class who are reasonably available.
405391 C. A person may not make an anatomical gift if, at the time of
406392 the decedent’s death, a person in a prior class under subsec tion A
407393 of this section is reasonably available to make or to object to the
408394 making of an anatomical gift.
409395 SECTION 4. AMENDATORY 63 O.S. 2011, Section 2200.10A, is
410396 amended to read as follows:
411397 Section 2200.10A. A. A person authoriz ed to make an anatomical
412398 gift under Section 9 of this act Section 2200.9A of this title may
413399 make an anatomical gift by a document of gift signed by the person
414400 making the gift or by that person ’s oral communication that is
415401 electronically recorded or is cont emporaneously reduced to a record
416402 and signed by the individual rece iving the oral communication.
417403 B. Subject Except as provided by pa ragraph 2 of subsection C of
418404 Section 1-3-102 of Title 10A of the Oklahoma Statute s and subject to
419405 subsection C of this sect ion, an anatomical gift by a person
420406 authorized under Section 9 of this act Section 2200.9A of this title
421407 may be amended or revoked orally or in a record by any mem ber of a
422408 prior class who is reas onably available. If more than one member of
423409 the prior class is reasonably available, the gift mad e by a person
410+authorized under Section 9 of this act Section 2200.9A of this title
411+may be:

454439 members agree to amending the gift; or
455440 2. Revoked only if a majorit y of the members agree to the
456441 revoking of the gift or if they are e qually divided as to whether to
457442 revoke the gift.
458443 C. A revocation under subsection B of this section is effective
459444 only if, before an incision has b een made to remove a part from the
460445 donor’s body or before invasive p rocedures have begun to prepare the
461446 recipient, the procurement organization, transplant hospital , or
462447 physician or technician knows of the revocation.
463448 SECTION 5. This act shall become effective November 1, 2021.
