59 | 52 | | BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA : |

60 | 53 | | SECTION 1. AMENDATORY 10A O.S. 2011, Section 1 -3-102, is |
---|
61 | 54 | | amended to read as f ollows: |
---|
62 | 55 | | Section 1-3-102. A. For purposes of this section: |
---|
63 | 56 | | 1. “Routine and ordinary medical care and treatment” includes |
---|
64 | 57 | | any necessary medical and dental examinations and treatment, medic al |
---|
65 | 58 | | screenings, clinical laboratory tes ts, blood testing, preventati ve |
---|
66 | 59 | | care, health assessments, physical examinations, immunizations, |
---|
67 | 60 | | contagious or infectious diseas e screenings or tests and care |
---|
98 | 90 | | 2. “Extraordinary medical care and tre atment” includes, but is |
---|
99 | 91 | | not limited to, surgery, general anesthesia, blood transfusions, o r |
---|
100 | 92 | | invasive or experimental procedures. |
---|
101 | 93 | | B. If a child taken into pr otective custody without a court |
---|
102 | 94 | | order requires emergency medical care prior to the emergency cust ody |
---|
103 | 95 | | hearing, and either the treatment is related t o the suspected abuse |
---|
104 | 96 | | or neglect or the parent or legal guardian is unavailable or |
---|
105 | 97 | | unwilling to consent to t reatment recommended by a physician, a |
---|
106 | 98 | | peace officer, court employ ee or the court may authorize su ch |
---|
107 | 99 | | treatment as is necessary to safeguard the heal th or life of the |
---|
108 | 100 | | child. Before a peace officer, court employee or the court |
---|
109 | 101 | | authorizes treatment based on unavailability of the parent or legal |
---|
110 | 102 | | guardian, law enforcement sh all exercise diligence in locati ng the |
---|
111 | 103 | | parent or guardian, if known. |
---|
112 | 104 | | C. 1. If a child has been placed in the custody of t he |
---|
113 | 105 | | Department of Human Services, the D epartment shall have the |
---|
114 | 106 | | authority to consent to routine and ordinary medical care and |
---|
115 | 107 | | treatment. The Department shall make re asonable attempts to notify |
---|
116 | 108 | | the child’s parent or legal guardian of the provision of routin e and |
---|
117 | 109 | | ordinary medical care and treatm ent and to keep the parent or legal |
---|
118 | 110 | | guardian involved in such care. |
---|
149 | 140 | | sustaining medical treatme nt or the denial of the administration of |
---|
150 | 141 | | cardiopulmonary resuscit ation on behalf of a child in th e |
---|
151 | 142 | | Department’s custody, and may additionally autho rize anatomical |
---|
152 | 143 | | gifts to be procured from such child if the withdrawal of life - |
---|
153 | 144 | | sustaining medical treatment or denial of the administration of |
---|
154 | 145 | | cardiopulmonary resuscitation is authorized, upon the written |
---|
155 | 146 | | recommendation of a licensed physician of such withdrawal or denial |
---|
156 | 147 | | and of such procurement, as applicable, after notice to th e parties |
---|
157 | 148 | | and a hearing. |
---|
158 | 149 | | 3. Nothing herein shall prevent the Department from |
---|
159 | 150 | | authorizing, in writi ng, any person, foster parent or administrator |
---|
160 | 151 | | of a facility into whose care a chi ld in its custody has been |
---|
161 | 152 | | entrusted, to consent to routine and ordinary me dical care and |
---|
162 | 153 | | treatment to be rendered to a child upon the advice of a licensed |
---|
163 | 154 | | physician, including the continuation of psychotro pic medication. |
---|
164 | 155 | | D. Consent for a child ’s extraordinary medical care and |
---|
165 | 156 | | treatment shall be obtained from the parent or legal guardian unless |
---|
166 | 157 | | the treatment is either related to the abuse or neglect or the |
---|
167 | 158 | | parent or legal guardian is unavailable or refuses to consent to |
---|
168 | 159 | | such care, in which case in an emerg ency, based upon recommendation |
---|
169 | 160 | | of a physician, the court may enter an ex p arte order authorizing |
---|
200 | 190 | | application by the district attorney and notice to all parties, and |
---|
201 | 191 | | may authorize such recommended extraordinary care. |
---|
202 | 192 | | E. If a child has been placed in the custody of a person, other |
---|
203 | 193 | | than a parent or legal guardian, or an institution or agency other |
---|
204 | 194 | | than the Department, the court shall dete rmine the authority of the |
---|
205 | 195 | | person, institution, or agency to consent to medical care including |
---|
206 | 196 | | routine and ordinary medical care an d treatment and extraordinary |
---|
207 | 197 | | care. The parent, l egal guardian, or person having legal cus tody |
---|
208 | 198 | | shall be responsible for the costs of medical care as determin ed by |
---|
209 | 199 | | the court. |
---|
210 | 200 | | SECTION 2. AMENDATORY 63 O.S. 2011, Section 2200.8A, is |
---|
211 | 201 | | amended to read as follows: |

212 | 202 | | Section 2200.8A. A. Except as otherwise provided in paragraph |

---|
314 | 302 | | minor’s refusal. |
---|
315 | 303 | | SECTION 3. AMENDATORY 63 O.S. 2011, Section 2200.9A, is |
---|
316 | 304 | | amended to read as follows: |

317 | 305 | | Section 2200.9A. A. Subject to subsections B and C of this |
---|
318 | 306 | | section and unless barr ed by Section 7 or 8 of this act Section |

356 | 343 | | 3. Adult children of the decedent; |
---|
357 | 344 | | 4. Parents of the decedent; |
---|
358 | 345 | | 5. Adult siblings of th e decedent; |
---|
359 | 346 | | 6. Adult grandchildren of the decedent; |
---|
360 | 347 | | 7. Grandparents of the decedent; |
---|
361 | 348 | | 8. An adult who exhibited special care and co ncern for the |
---|
362 | 349 | | decedent; |
---|
363 | 350 | | 9. The persons who were acting as the guardians of the person |
---|
364 | 351 | | of the decedent at the time of death ; and |
---|
365 | 352 | | 10. A court pursuant to an order entered pursuant to paragraph |
---|
366 | 353 | | 2 of subsection C of Section 1-3-102 of Title 10A of the Oklahoma |
---|
367 | 354 | | Statutes; and |
---|
368 | 355 | | 11. Any other person having the authority to dispose of the |
---|
369 | 356 | | decedent’s body. |
---|
370 | 357 | | B. If there is more than on e member of a class listed in |
---|
371 | 358 | | paragraph 1, 3, 4, 5, 6 , 7 or 9 of subsection A of this section |
---|
372 | 359 | | entitled to make an anatomical gift, an anatomical gift may be made |
---|
402 | 388 | | title knows of an objection by another member of the class. If an |
---|
403 | 389 | | objection is known, th e gift may be made only by a ma jority of the |
---|
404 | 390 | | members of the class who are reasonably available. |
---|
405 | 391 | | C. A person may not make an anatomical gift if, at the time of |
---|
406 | 392 | | the decedent’s death, a person in a prior class under subsec tion A |
---|
407 | 393 | | of this section is reasonably available to make or to object to the |
---|
408 | 394 | | making of an anatomical gift. |
---|
409 | 395 | | SECTION 4. AMENDATORY 63 O.S. 2011, Section 2200.10A, is |
---|
410 | 396 | | amended to read as follows: |
---|
411 | 397 | | Section 2200.10A. A. A person authoriz ed to make an anatomical |
---|
412 | 398 | | gift under Section 9 of this act Section 2200.9A of this title may |
---|
413 | 399 | | make an anatomical gift by a document of gift signed by the person |
---|
414 | 400 | | making the gift or by that person ’s oral communication that is |
---|
415 | 401 | | electronically recorded or is cont emporaneously reduced to a record |
---|
416 | 402 | | and signed by the individual rece iving the oral communication. |
---|
417 | 403 | | B. Subject Except as provided by pa ragraph 2 of subsection C of |
---|
418 | 404 | | Section 1-3-102 of Title 10A of the Oklahoma Statute s and subject to |
---|
419 | 405 | | subsection C of this sect ion, an anatomical gift by a person |
---|
420 | 406 | | authorized under Section 9 of this act Section 2200.9A of this title |
---|
421 | 407 | | may be amended or revoked orally or in a record by any mem ber of a |
---|
422 | 408 | | prior class who is reas onably available. If more than one member of |
---|
423 | 409 | | the prior class is reasonably available, the gift mad e by a person |
---|
453 | 438 | | 1. Amended only if a majority of the reasonably available |
---|
454 | 439 | | members agree to amending the gift; or |
---|
455 | 440 | | 2. Revoked only if a majorit y of the members agree to the |
---|
456 | 441 | | revoking of the gift or if they are e qually divided as to whether to |
---|
457 | 442 | | revoke the gift. |
---|
458 | 443 | | C. A revocation under subsection B of this section is effective |
---|
459 | 444 | | only if, before an incision has b een made to remove a part from the |
---|
460 | 445 | | donor’s body or before invasive p rocedures have begun to prepare the |
---|
461 | 446 | | recipient, the procurement organization, transplant hospital , or |
---|
462 | 447 | | physician or technician knows of the revocation. |
---|
463 | 448 | | SECTION 5. This act shall become effective November 1, 2021. |
---|
