7575 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
7676 SECTION 1. AMENDATORY 22 O.S. 2021, Section 60.2, is
7777 amended to read as follows:
7878 Section 60.2. A. A victim of domestic abuse, a victim of
7979 stalking, a victim of harassment, a victim of rape, any adult or
8080 emancipated minor household member on behalf o f any other family or
8181 household member who is a minor or incompetent, or any minor age
8282 sixteen (16) or seventeen (17) years may seek relief under the
8383 provisions of the Protection from Domestic Abuse Act.
8484 1. The person seeking relief may file a petition fo r a
8585 protective order with the district court in the county in which the
8686 victim resides, the county in which the defendant resides, or the
8787 county in which the domestic violence occurred. If the person

139139 seeking relief is a victim of stalking but is not a fam ily or
140140 household member or an individu al who is or has been in a dating
141141 relationship with the defendant, the person seeking relief must file
142142 a complaint against the defendant with the proper law enforcement
143143 agency before filing a petition for a protective order with the
144144 district court. The pe rson seeking relief shall provide a copy of
145145 the complaint that was filed with the law enforcement agency at the
146146 full hearing if the complaint is not available from the law
147147 enforcement agency. Failure to provide a copy of the complaint
148148 filed with the law e nforcement agency shall constitute a frivolous
149149 filing and the court may assess attorney fees and court costs
150150 against the plaintiff pursuant to paragraph 2 of subsection C of
151151 this section. The filing of a petition for a protective order shall
152152 not require jurisdiction or venue of the criminal offense if ei ther
153153 the plaintiff or defendant resides in the county. If a petition has
154154 been filed in an action for divorce or separate maintenance and
155155 either party to the action fil es a petition for a protective order
156156 in the same county where the action for divorce or separate
157157 maintenance is filed, the petition for the protective order may be
158158 heard by the court hearing the divorce or separate maintenance

160160 a. there is no established protective order docket in

213213 b. the court finds that, in the inter est of judicial
214214 economy, both actions may be heard together; provided ,
215215 however, the petition for a protective order,
216216 including, but not limited to, a petition in which
217217 children are named as petitioners, sha ll remain a
218218 separate action and a separate order s hall be entered
219219 in the protective order action. Protective orders ma y
220220 be dismissed in favor of restraining orders in the
221221 divorce or separate maintenance action if the court
222222 specifically finds, upon hearing , that such dismissal
223223 is in the best interests of the parties and does not
224224 compromise the safety of any petitioner.
225225 If the defendant is a minor child, the petition shall be filed
226226 with the court having jurisdiction over juvenile matters.
227227 2. When the abuse occurs when the court is not open for
228228 business, such person may request an emergency temporary order of
229229 protection as authorized by Section 40.3 of this title.
230230 B. The petition forms shall be provided by the clerk of t he
231231 court. The Administrative Office o f the Courts shall develop a
232232 standard form for the petition.
233233 C. 1. Except as otherwise provided by this section, no f iling
234234 fee, service of process fee, attorney fees or any other fee or costs
235235 shall be charged the pla intiff or victim at any time for filin g a
236236 petition for a protective order whether a prot ective order is

288288 granted or not granted. The court may assess court c osts, service
289289 of process fees, attorney fees, other fees and filing fees against
290290 the defendant at the hearing on the petition, if a prote ctive order
291291 is granted against the defendant; prov ided, the court shall have
292292 authority to waive the costs and fees if t he court finds that the
293293 party does not have the ability to pay the costs and fees.
294294 2. If the court makes specific findings that a petiti on for a
295295 protective order has been filed frivolous ly and no victim exists,
296296 the court may assess attorney fees and court costs against the
297297 plaintiff.
298298 D. The person seeking relief shall prepare the petition or, at
299299 the request of the plaintiff, the court cle rk or the victim-witness
300300 coordinator, victim suppo rt person, and court case manager shall
301301 prepare or assist the plainti ff in preparing the petition.
302302 E. The person seeking a protective order may further request
303303 the exclusive care, possession, or control of any animal owned,
304304 possessed, leased, kept, or hel d by either the petitioner, defendant
305305 or minor child residing in the residence of the petitioner or
306306 defendant. The court may order the defendant to make no contact
307307 with the animal and forbid the defendant from taking, transferring,
308308 encumbering, concealing , molesting, attacking, striking,
309309 threatening, harming, or otherwise disposing of the animal.
310310 F. A court may not require the victim to seek legal sanctions
311311 against the defendant including, but not limited to, divorce,

363363 separation, paternity or criminal pro ceedings prior to hearing a
364364 petition for protective order.
365365 G. A victim of rape, forcible sodomy, a sex offense,
366366 kidnapping, assault and battery with a deadly weapon , child abuse,
367367 or member of the immediate family of a victim of first -degree
368368 murder, as such terms are defined in Section 40 of this title, may
369369 petition, or have a petition filed on the victim’s behalf if the
370370 victim is a minor, for an emergency temporary order or emergency ex
371371 parte order regardle ss of any relationship or scenario pursuant to
372372 the provisions of this section. The Administrative Office of the
373373 Courts shall modify the petition forms as necessary to effectuate
374374 the provisions of this subsection.
375375 SECTION 2. This act shall become effective November 1, 2022.
