253 | 253 | | 8. “Innovation” means the use or incorporation of a new idea, a |

254 | 254 | | new or emerging technology or a new use of existing technology to |

255 | 255 | | address a problem, provide a benefit, or otherwise offer a product, |
---|
256 | 256 | | production method, o r service; |
---|
257 | 257 | | 9. “Innovative offering” means an offering th at includes an |
---|
258 | 258 | | innovation; |
---|
259 | 259 | | 10. “Participant” means a person whose appli cation to |
---|

325 | 325 | | temporarily demonstrate an offering under a waiver or suspension of |

326 | 326 | | one or more state laws and regulation ; |
---|
327 | 327 | | 14. “Regulatory relief office” means the General Regulatory |
---|
328 | 328 | | Business Relief Office created in Section 2 of this act; and |
---|
329 | 329 | | 15. “Service” means any commercial activity, duty, or labor |
---|
330 | 330 | | performed for another person. |

395 | 395 | | agencies to identity state laws or agency rules that could |

396 | 396 | | potentially be repealed or suspended under the regulatory business |
---|
397 | 397 | | program. |
---|
398 | 398 | | D. The regulatory relief office may: |
---|
399 | 399 | | 1. Review state laws and regulations that may un necessarily |
---|
400 | 400 | | inhibit the creation and success of new c ompanies or industries and |
---|
401 | 401 | | provide recommendations to the Governor and the Legislature on |
---|
402 | 402 | | modifying such laws and regulations ; |
---|
403 | 403 | | 2. Create a framework for analyzing the risk level to the |
---|
404 | 404 | | health, safety, and financial well being of consumers related to |
---|
405 | 405 | | permanently removing or temporarily suspending laws and agency rules |
---|
406 | 406 | | inhibiting the creation or success of new and existing com panies or |
---|
407 | 407 | | industries; |
---|
408 | 408 | | 3. Propose potential reciprocity agreements between states that |
---|
409 | 409 | | use or are proposing to use similar programs as described in this |
---|
410 | 410 | | act; and |
---|
411 | 411 | | 4. In accordance with administrative rules and this act, |
---|

477 | 477 | | Regulatory Business Relief Office who represent business interests |

478 | 478 | | and are selected from a variety of industries; |

479 | 479 | | 2. Three members appointed by the Director who represent state |
---|
480 | 480 | | agencies that regulate business; |

481 | 481 | | 3. One member of the Senate, appointed by the President Pro |
---|
482 | 482 | | Tempore of the Senate; and |
---|
483 | 483 | | 4. One member of the House of Representatives, appointed by the |

484 | 484 | | Speaker of the House of Representatives. |

698 | 698 | | applicant in preparing an application for su bmission. |

699 | 699 | | D. An applicant for the program shall provide the regulatory |

845 | 845 | | from an applicant set in administrative rules by the Department of |
---|

847 | 847 | | F. An applicant shall file a separate application fo r each |
---|
848 | 848 | | innovative offering that the applicant wishes to demonstrate. |
---|
849 | 849 | | G. After an application is filed, the regulatory relief office: |
---|
850 | 850 | | 1. Shall classify the application and any related information |
---|
851 | 851 | | provided by the applicant as confidential; |
---|
852 | 852 | | 2. Consult with each applicable government agency that |
---|
853 | 853 | | regulates the applica nt’s business regarding whether more |
---|
854 | 854 | | information is needed from the app licant; and |

855 | 855 | | 3. Seek additional informat ion from the applicant that the |

856 | 856 | | regulatory relief office determines is necessary. |

993 | 993 | | or agency rules would potentially significantly harm the health, |
---|
994 | 994 | | safety, or financial wellbeing of consumers or the public and the |
---|
995 | 995 | | likelihood of such harm occurring. |

996 | 996 | | 5. If the agency determines that the consumer’s or public’s |
---|
997 | 997 | | health, safety, or financia l wellbeing can be protected thr ough less |
---|
998 | 998 | | restrictive means than the existing relev ant laws or agency rules, |
---|
999 | 999 | | then the applicable agency shall pro vide a recommendation of how |
---|
1000 | 1000 | | that be achieved. |
---|
1001 | 1001 | | 6. If an applicable agency fails to deliver a written report |
---|
1002 | 1002 | | pursuant to this subsection, the Director shall assume the |
---|
1003 | 1003 | | applicable agency does no t object to the temporary waiver or |

1004 | 1004 | | suspension of the relevant laws or agency rules for an applicant |
---|
1005 | 1005 | | seeking to participate in the program. |

1144 | 1144 | | written report, the Commission shall provid e to the Director the |

1145 | 1145 | | Commission’s recommendation as to whether or not the applicant |

1146 | 1146 | | should be admitted as a participant under this act. |

1147 | 1147 | | 4. As part of the Commission’s review of each written report, |
---|
1148 | 1148 | | the Commission shall use the criteria required for an applicable |
---|
1149 | 1149 | | agency as prescribed in subsection I of this section. |

1150 | 1150 | | K. 1. In reviewing an application and each applicable agency ’s |
---|
1151 | 1151 | | written report, the regulatory rel ief office shall consult with each |
---|
1152 | 1152 | | applicable agency and the Commission before admitting an applicant |

1216 | 1216 | | and, if so, weigh that as a factor in favor of allowing the |
---|
1217 | 1217 | | applicant to also become a p articipant. |

1218 | 1218 | | M. In reviewing an application under this section, the |
---|
1219 | 1219 | | regulatory relief office shall consider whether : |
---|
1220 | 1220 | | 1. The applicant’s plan will adequately protect consumers from |
---|
1221 | 1221 | | potential harm identified by an applicable agency in the applicable |
---|
1222 | 1222 | | agency’s written report; |
---|
1223 | 1223 | | 2. The risk of harm to consumers is outweighed by the potential |
---|
1224 | 1224 | | benefits to consumers from the applican t’s participation in the |
---|
1225 | 1225 | | program; and |
---|
1226 | 1226 | | 3. Certain state laws or agency rules that regulate an offering |
---|
1227 | 1227 | | should not be waived or suspended eve n if the applicant is approved |
---|
1228 | 1228 | | as a participant including applicable antifraud or disclosure |

1290 | 1290 | | O. 1. The Director may deny at the Director ’s sole discretion |

1291 | 1291 | | any application submitted under this section for any reason |
---|
1292 | 1292 | | including if the Director determines that the preponderance of |
---|
1293 | 1293 | | evidence demonstrates that suspending or waiving enforcement of a |
---|
1294 | 1294 | | law or rule would cause a significant risk or harm to consumers or |
---|
1295 | 1295 | | residents of this state. |

1296 | 1296 | | 2. If the Director denies an application submitted under this |
---|
1297 | 1297 | | section, the regulatory relief office shall provide to the applicant |
---|
1298 | 1298 | | a written description of the reasons for not al lowing the applicant |
---|
1299 | 1299 | | to be a participant. |
---|
1300 | 1300 | | 3. The denial of an application submitted under this section is |
---|
1301 | 1301 | | not subject to: |
---|
1302 | 1302 | | a. agency or judicial review, or |
---|
1303 | 1303 | | b. the provisions of the Administrative Procedures Act. |

1304 | 1304 | | P. The Director shall deny an app lication for participation in |

1366 | 1366 | | SECTION 6. NEW LAW A new section of law to be codified |
---|
1367 | 1367 | | in the Oklahoma Statutes as Section 802.5 of Title 40, unless there |
---|
1368 | 1368 | | is created a duplication in numbering, reads as follows: |

1369 | 1369 | | A. If the General Regulatory Business Relief Office approves an |

1370 | 1370 | | application under this section, the participant has twelve (12) |
---|
1371 | 1371 | | months after approval to demonstrate the offering described in the |
---|
1372 | 1372 | | participant’s application. |

1373 | 1373 | | B. An offering that is demonstrated within the program is |

1374 | 1374 | | subject to the following: |

1375 | 1375 | | 1. Each consumer shall be a resident of this state; and |

1376 | 1376 | | 2. No law or rule may be waived or suspended if waiving or |
---|
1377 | 1377 | | suspending the law or rule would prevent a consumer from seeking |

1378 | 1378 | | restitution in the even t that the consumer is harmed. |

1379 | 1379 | | C. The section does not restric t a participant who holds a |

1445 | 1445 | | 3. A state agency may not file or pursue any punitive action |
---|
1446 | 1446 | | against a participant including a fine or license suspension or |
---|
1447 | 1447 | | revocation, for the violation of a law or rule that is identified as |
---|
1448 | 1448 | | being waived or suspended in the w ritten agreement between the |
---|
1449 | 1449 | | regulatory relief office and the participant. |

1450 | 1450 | | F. Notwithstanding any other provision of this section, a |
---|
1451 | 1451 | | participant shall not have immuni ty related to any criminal offense |
---|
1452 | 1452 | | committed during the participant’s participation in the program. |
