179179 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
180180 SECTION 1. NEW LAW A new section of law to be codified
181181 in the Oklahoma Statutes as Section 802 of Title 40, unless there is
182182 created a duplication in numbering, reads as follows:
183183 As used in this act:
184184 1. “Applicable agency” means a department or agency of the
185185 state that by law regulates a business acti vity and person engage d
186186 in such business activity including the issuances of licenses or
187187 other types of authorization, which the office determines would
188188 otherwise regulate a participant;

240240 2. “Applicant” means a person that purcha ses or otherwise
241241 enters into a transaction or ag reement to receive an offering
242242 pursuant to a demonstration by a participant;
243243 3. “Commission” means the General Regulatory Business Program
244244 Advisory Commission;
245245 4. “Commissioner” means the Commissioner of Labor;
246246 5. “Consumer” means a person that purchases or otherwise enters
247247 into a transaction or agreement to receive an offering pursuant to a
248248 demonstration by a participant;
249249 6. “Demonstrate” or “demonstration” means to temporarily
250250 provide an offering in accordance with the provision of this act;
251251 7. “Director” means the Director of the General Regulatory
252252 Business Relief Office;
253253 8. “Innovation” means the use or incorporation of a new idea, a
254254 new or emerging technology or a new use of existing technology to
255255 address a problem, provide a benefit, or otherwise offer a product,
256256 production method, o r service;
257257 9. “Innovative offering” means an offering th at includes an
258258 innovation;
259259 10. “Participant” means a person whose appli cation to
260260 participate in the General Regulatory Business Program is in
261261 accordance with the provisions of this act;
262262 11. “Product” means a commercially distributed good that is :
263263 a. tangibly personal property,

316316 c. passed through the distribution channel before
317317 consumption;
318318 12. “Production” means the method or process of creating or
319319 obtaining a good, which may include assembling, breeding, cap turing,
320320 collecting, extractin g, fabricating, farming, fishing, gathering,
321321 growing, harvesting, hunting, manufacturing, mining, processing,
322322 raising, or trapping a g ood;
323323 13. “Program” means the General Regulatory Business Program
324324 created in Section 5 of this act, which allows a person to
325325 temporarily demonstrate an offering under a waiver or suspension of
326326 one or more state laws and regulation ;
327327 14. “Regulatory relief office” means the General Regulatory
328328 Business Relief Office created in Section 2 of this act; and
329329 15. “Service” means any commercial activity, duty, or labor
330330 performed for another person.
331331 SECTION 2. NEW LAW A new section of law to be codified
332332 in the Oklahoma Statutes as Sec tion 802.1 of Title 40, unless there
333333 is created a duplication in numbering, rea ds as follows:
334334 A. There is created with in the Department of Labor the General
335335 Regulatory Business Relief Office.
336336 B. 1. The regulatory relief office shall be administered by
337337 the Director of the General Regulatory Business Relief Office.

389389 2. The Director shall report to the Commissioner of Labor and
390390 may appoint staff subject to the approval of the Commissioner.
391391 C. The regulatory relief office shall:
392392 1. Administer the provisions of this act ;
393393 2. Administer the General Regulatory Business Program ; and
394394 3. Act as a liaison between private businesse s and applicable
395395 agencies to identity state laws or agency rules that could
396396 potentially be repealed or suspended under the regulatory business
397397 program.
398398 D. The regulatory relief office may:
399399 1. Review state laws and regulations that may un necessarily
400400 inhibit the creation and success of new c ompanies or industries and
401401 provide recommendations to the Governor and the Legislature on
402402 modifying such laws and regulations ;
403403 2. Create a framework for analyzing the risk level to the
404404 health, safety, and financial well being of consumers related to
405405 permanently removing or temporarily suspending laws and agency rules
406406 inhibiting the creation or success of new and existing com panies or
407407 industries;
408408 3. Propose potential reciprocity agreements between states that
409409 use or are proposing to use similar programs as described in this
410410 act; and
411411 4. In accordance with administrative rules and this act,
412412 establish rules regarding:

465465 regarding application process and the reporting
466466 requirements of participants, and
467467 b. cooperating and consulting with other agencies in this
468468 state that administer business programs.
469469 SECTION 3. NEW LAW A new section of law to be codified
470470 in the Oklahoma Statutes as Section 802.2 of Title 40, unless there
471471 is created a duplication in numbering, reads as follows:
472472 A. There is hereby created the General Regulatory Business
473473 Program Advisory Commission.
474474 B. The Commission shall consist of eleven (11) members to be
475475 appointed and serve as f ollows:
476476 1. Six members appointed by the Director of the General
477477 Regulatory Business Relief Office who represent business interests
478478 and are selected from a variety of industries;
479479 2. Three members appointed by the Director who represent state
480480 agencies that regulate business;
481481 3. One member of the Senate, appointed by the President Pro
482482 Tempore of the Senate; and
483483 4. One member of the House of Representatives, appointed by the
484484 Speaker of the House of Representatives.
485485 C. 1. Except as otherwise provided in paragraph 2 of this
486486 subsection, members of the Commission who are not members of the
487487 Legislature shall be appointed to four -year terms.

539539 2. The Director may adjust the length of terms of appointments
540540 and reappointments to the Commission so the majority of members are
541541 appointed every two years.
542542 D. The Director shal l appoint a chair for the Commission
543543 annually.
544544 E. A Majority of the Commission shall constitute a quorum for
545545 purposes of conducting the business of the Commission, and the
546546 actions of the majority shall constitute the actions of the advisory
547547 commission.
548548 F. The Commission shall advise and make recommendations to the
549549 regulatory relief office as described in this act.
550550 G. The regulatory relief office shall provide administrative
551551 staff support for the Commission.
552552 H. Members shall not receive a salary for duties performed as
553553 members of the Commission but shall be reimbursed for their actual
554554 and necessary expenses incurred in the perfo rmance of Commission
555555 duties pursuant to the provisions of the State Travel Reimbursement
556556 Act.
557557 I. The Commission shall be subject to the Oklahoma Open Meeting
558558 Act and the Oklahoma Open Records Act.
559559 SECTION 4. NEW LAW A new section o f law to be codified

613613 A. The Director of the General Regulatory Business Relief
614614 Office shall prepare a report on the activities of the General
615615 Regulatory Business Relief Office, which shall include:
616616 1. Information regarding each participate in the program
617617 created in this act including which indu stries each participant
618618 represents and the anticipated or actual cost savings that each
619619 participant experienced;
620620 2. Recommendations regarding any laws or agency rules that
621621 should be permanently amended;
622622 3. Information regarding outcomes for consumers; and
623623 4. Recommendations for changes to the program or other duties
624624 of the regulatory re lief office.
625625 B. By October 1 of each year, the Director shall provide the
626626 report to the Legislature.
627627 SECTION 5. NEW LAW A new section of law to be codified
628628 in the Oklahoma Statutes as Section 802.4 of Title 40, unless there
629629 is created a duplication in numbering, reads as follows:
630630 A. There is hereby created in the General Regulatory Business
631631 Relief Office the General Regulatory Business Program.
632632 B. In administering th e program, the regulatory relief office:
633633 1. Shall consult with each applicable agency;
634634 2. Shall establish a program to enable a person to o btain legal
635635 protections and limited access to the market in this state to

688688 other authorization that mi ght otherwise be required;
689689 3. May enter into agreements with or adopt the best practices
690690 of corresponding federal regulatory agencies or other states that
691691 are administering similar programs; and
692692 4. May consult with business es in this state about existing or
693693 potential proposals for the program.
694694 C. 1. An applicant for the program may contact the regulatory
695695 relief office to request a consultation regarding the program before
696696 submitting an application.
697697 2. The regulatory relief office may provide assistance to an
698698 applicant in preparing an application for su bmission.
699699 D. An applicant for the program shall provide the regulatory
700700 relief office an application in a form prescrib ed by the regulatory
701701 relief office that:
702702 1. Confirms the applicant is subject to the jurisdiction of
703703 this state;
704704 2. Confirms the applicant has established a physical or virtual
705705 location in this state, from which the d emonstration of an
706706 innovative offering will be developed and performed and where all
707707 required records, documents, and data will be maintained;
708708 3. Contains relevant personal and contact information for th e
709709 applicant including legal names, addresses, telephones numbers, E -

763763 4. Discloses criminal convictions of the applicant or othe r
764764 participating personnel, if any;
765765 5. Contains a description of the innovative offering to be
766766 demonstrated including statements regarding:
767767 a. how the offering is subject to licensing, legal
768768 prohibition, or other authorization requirements
769769 outside of the program,
770770 b. each law or rule that that the applicant seeks to have
771771 waived or suspended while participating in the
772772 program,
773773 c. how the offering would benefit cons umers,
774774 d. how the offering is different from other offerings
775775 available in this state,
776776 e. what risks may exist for consumers who use or p urchase
777777 the offering,
778778 f. how participating in the program, would enable a
779779 successful demonstration of the off ering,
780780 g. a description of the proposed demonstration plan
781781 including estimated time periods for beginning a nd
782782 ending the demonstration,
783783 h. recognition that the applicant will be subject to all
784784 laws and agency rules pertaining to the applicant’s

836836 offering after the conclusion of the demonstration,
837837 and
838838 i. how the applicant shall end the demonstration and
839839 protect consumers if the demonstration fails;
840840 6. Lists each gover nment agency, if any, that the applicant
841841 knows regulates the applicant’s business; and
842842 7. Provides any other required information as determined by the
843843 regulatory relief office.
844844 E. The regulatory relief office may collect an application fee
845845 from an applicant set in administrative rules by the Department of
846846 Labor.
847847 F. An applicant shall file a separate application fo r each
848848 innovative offering that the applicant wishes to demonstrate.
849849 G. After an application is filed, the regulatory relief office:
850850 1. Shall classify the application and any related information
851851 provided by the applicant as confidential;
852852 2. Consult with each applicable government agency that
853853 regulates the applica nt’s business regarding whether more
854854 information is needed from the app licant; and
855855 3. Seek additional informat ion from the applicant that the
856856 regulatory relief office determines is necessary.
857857 H. No later than five (5) business days after the day on which
858858 a completed application is received, the regulatory relief office
859859 shall:

911911 1. Review the application an d refer the application to each
912912 applicable government agency tha t regulates the applicant’s
913913 business; and
914914 2. Provide to the applicant:
915915 a. an acknowledgement o f receipt of the appli cation, and
916916 b. the identity and contact information of each
917917 regulatory agency to which the application h as been
918918 referred for review.
919919 I. 1. Subject to paragraphs 3 and 7 of this subsection, no
920920 later than thirty (30) days after the applicable agency rec eives a
921921 completed application for re view, the applicable agency shall
922922 provide a written report to the Director of the applicable agency’s
923923 findings.
924924 2. The report shall:
925925 a. describe any identifiable, likely, and significant
926926 harm to the health, safety, or financial wellbeing of
927927 consumers that the relevant law or rule protects
928928 against, and
929929 b. make a recommendation to the re gulatory relief office
930930 that the applicant either be admitted or denied
931931 entrance into the program .
932932 3. a. the applicable agency may request an a dditional five
933933 (5) business days to deliver the writ ten report by

985985 providing notice to the Director, which request shall
986986 automatically be granted, and
987987 b. the applicable agency may only request on e extension
988988 per application.
989989 4. If the applicable agency recomme nds an applicant under this
990990 section be denied entra nce into the program, the written report
991991 shall include a description of the reasons for the recommendation
992992 including why a temporary waiver or suspension of the relevant laws
993993 or agency rules would potentially significantly harm the health,
994994 safety, or financial wellbeing of consumers or the public and the
995995 likelihood of such harm occurring.
996996 5. If the agency determines that the consumer’s or public’s
997997 health, safety, or financia l wellbeing can be protected thr ough less
998998 restrictive means than the existing relev ant laws or agency rules,
999999 then the applicable agency shall pro vide a recommendation of how
10001000 that be achieved.
10011001 6. If an applicable agency fails to deliver a written report
10021002 pursuant to this subsection, the Director shall assume the
10031003 applicable agency does no t object to the temporary waiver or
10041004 suspension of the relevant laws or agency rules for an applicant
10051005 seeking to participate in the program.
10061006 7. Notwithstanding any other pr ovisions of this secti on, an
10071007 applicable agency may by written notice to the regulator y relief

10661066 applicant’s offering fails to co mply with standards or
10671067 specifications:
10681068 (1) required by federal law or rule , or
10691069 (2) previously approved for use by a federal agency,
10701070 or
10711071 b. reject an application preliminarily approved by the
10721072 regulatory relief office, if the applicable agency:
10731073 (1) recommended rejection of the application in
10741074 accordance with paragraph 4 of this subsection in
10751075 the agency’s report, and
10761076 (2) provides in the written notice under paragraph 4
10771077 of this subsection, a description o f the
10781078 applicable agency’s reasons why approval of the
10791079 application would create a substa ntial risk of
10801080 harm to the health or safety of the public or
10811081 create unreasonable expenses for taxpayers of
10821082 this state.

11341134 8. If an applicable agency rejects an application under
11351135 paragraph 7 of this subsection, the regulatory relief office shall
11361136 not approve the applicat ion.
11371137 J. 1. Upon receiving a written report desc ribed in subsection
11381138 I of this section, the Director shall provide t he application and
11391139 the written report to the Commission.
11401140 2. The Director may call the Commission to meet as needed, but
11411141 not less than once per quarter if appli cations are available for
11421142 review.
11431143 3. After receiving and reviewing the application and each
11441144 written report, the Commission shall provid e to the Director the
11451145 Commission’s recommendation as to whether or not the applicant
11461146 should be admitted as a participant under this act.
11471147 4. As part of the Commission’s review of each written report,
11481148 the Commission shall use the criteria required for an applicable
11491149 agency as prescribed in subsection I of this section.
11501150 K. 1. In reviewing an application and each applicable agency ’s
11511151 written report, the regulatory rel ief office shall consult with each
11521152 applicable agency and the Commission before admitting an applicant
11531153 into the program.
11541154 2. The consultation with e ach applicable agency and the
11551155 consultation with the Commission may include seeking information

12131213 L. In reviewing an application under this section, the
12141214 regulatory relief office and applica ble agency shall consider
12151215 whether a competitor to the applicant is or has been a participant
12161216 and, if so, weigh that as a factor in favor of allowing the
12171217 applicant to also become a p articipant.
12181218 M. In reviewing an application under this section, the
12191219 regulatory relief office shall consider whether :
12201220 1. The applicant’s plan will adequately protect consumers from
12211221 potential harm identified by an applicable agency in the applicable
12221222 agency’s written report;
12231223 2. The risk of harm to consumers is outweighed by the potential
12241224 benefits to consumers from the applican t’s participation in the
12251225 program; and
12261226 3. Certain state laws or agency rules that regulate an offering
12271227 should not be waived or suspended eve n if the applicant is approved
12281228 as a participant including applicable antifraud or disclosure
12291229 provisions.
12301230 N. 1. An applicant becomes a participant if the regulatory

12861286 2. Notwithstanding any other provisions of this act, the
12871287 regulatory relief office may not enter into a written agreement with
12881288 an applicant that waives or suspends a tax, fee, or charges t hat are
12891289 administered by the Oklahoma Tax Commission.
12901290 O. 1. The Director may deny at the Director ’s sole discretion
12911291 any application submitted under this section for any reason
12921292 including if the Director determines that the preponderance of
12931293 evidence demonstrates that suspending or waiving enforcement of a
12941294 law or rule would cause a significant risk or harm to consumers or
12951295 residents of this state.
12961296 2. If the Director denies an application submitted under this
12971297 section, the regulatory relief office shall provide to the applicant
12981298 a written description of the reasons for not al lowing the applicant
12991299 to be a participant.
13001300 3. The denial of an application submitted under this section is
13011301 not subject to:
13021302 a. agency or judicial review, or
13031303 b. the provisions of the Administrative Procedures Act.
13041304 P. The Director shall deny an app lication for participation in
13051305 the program described in this section if the applicant or any person
13061306 who seeks to participate with the applicant in demonstrating an

13631363 Q. When an applicant is approved f or participation in the
13641364 program, the Director may provide notice of the approval to
13651365 competitors of the applicant and the public.
13661366 SECTION 6. NEW LAW A new section of law to be codified
13671367 in the Oklahoma Statutes as Section 802.5 of Title 40, unless there
13681368 is created a duplication in numbering, reads as follows:
13691369 A. If the General Regulatory Business Relief Office approves an
13701370 application under this section, the participant has twelve (12)
13711371 months after approval to demonstrate the offering described in the
13721372 participant’s application.
13731373 B. An offering that is demonstrated within the program is
13741374 subject to the following:
13751375 1. Each consumer shall be a resident of this state; and
13761376 2. No law or rule may be waived or suspended if waiving or
13771377 suspending the law or rule would prevent a consumer from seeking
13781378 restitution in the even t that the consumer is harmed.
13791379 C. The section does not restric t a participant who holds a
13801380 license or other authorization in another ju risdiction from acting
13811381 in accordance with that license or other authorization.

14331433 D. A participant is deemed to possess an appr opriate license or
14341434 other authorization under the laws of this sta te for the purposes of
14351435 any provision of federa l law requiring licensure or other
14361436 authorization by the s tate.
14371437 E. Except as provided in subsection F of this section, during
14381438 the demonstration period:
14391439 1. A participant is not subject to the enforcement of state
14401440 laws or agency rules identified in the written agreement betwee n the
14411441 regulatory relief office and the parti cipant;
14421442 2. A prosecutor may not file or pursue charges pertaining to a
14431443 law or rule identified in the written agreement between the
14441444 regulatory relief office and the participant; and
14451445 3. A state agency may not file or pursue any punitive action
14461446 against a participant including a fine or license suspension or
14471447 revocation, for the violation of a law or rule that is identified as
14481448 being waived or suspended in the w ritten agreement between the
14491449 regulatory relief office and the participant.
14501450 F. Notwithstanding any other provision of this section, a
14511451 participant shall not have immuni ty related to any criminal offense
14521452 committed during the participant’s participation in the program.
14531453 G. By written notice, the regulatory re lief office may end a
14541454 participant’s participation in the p rogram at any time an d for any
14551455 reason including if the Director determines that a participant is

15111511 recouping of application expenses or other expenses related to the

15131513 1. Denying an applicant’s application to part icipate in the
15141514 program, for any reason; and
15151515 2. Ending a participant’s participation in the p rogram at any
15161516 time and for any reason.
15171517 SECTION 7. NEW LAW A new section of law to be codified
15181518 in the Oklahoma Statutes as Section 802.6 of Title 40, unless there
15191519 is created a duplication in numbering, reads as follows :
15201520 A. Before demonstrating an offering to a consumer, a
15211521 participant shall disclose the following to the consumer:
15221522 1. The name and contact information of the participant;
15231523 2. That the offering is authorized pursuant to this act and, if
15241524 applicable, that the participant does not have a license or other
15251525 authorization to provide an of fering under state laws that regulate
15261526 offering outside of the program;
15271527 3. That the offering is undergoing testing and may not fu nction
15281528 as intended and may expose the consumer to c ertain risks as
15291529 identified by the applicable agency ’s written report;

15911591 demonstrated and provide the regulatory re lief office’s telephone
15921592 number and website addres s where a complaint may be filed.
15931593 B. The Disclosures required by subsection A of this section
15941594 shall be provided to a consumer in a clear and conspicuous form and,
15951595 for an Internet or application -based offering, a consumer shall
15961596 acknowledge receipt of the d isclosure before any transaction ma y be
15971597 completed.
15981598 C. The regulatory relief office may require that a participant
15991599 make additional disclosures to a con sumer.
16001600 SECTION 8. NEW LAW A new section of law to be codified

16661666 ongoing duties, the partic ipant may continue to do so but will be
16671667 subject to enforcement of the laws or agency rules that were waived
16681668 or suspended as part of the program.
16691669 SECTION 9. NEW LAW A new section of law to be codified
16701670 in the Oklahoma Statutes as Section 802.8 of Title 40, unless there
16711671 is created a duplication in numbering, reads as follows:
16721672 A. No later than thirty (30) days before the end of the tw elve-
16731673 month demonstration period, a pa rticipant may request an extension

16751675 B. The General Regulatory Business Relief Office shall grant or

17361736 produced in the ordinary course of business regarding an offering

17381738 B. If a participant ceases to provide an offer ing before the
17391739 end of a demonstration period, the participant shall notify the
17401740 General Regulatory Business Relief Office and each applicable agency
17411741 and report on actions taken by the participant to ensure consumers
17421742 have not been harmed as a result. The regulatory relief office
17431743 shall establish quart erly reporting requirements for a participant
17441744 including information about any consumer complaints .
17451745 C. The regulatory relief office may request records, documents,
17461746 and data from a partic ipant and, upon the regula tory relief office’s
17471747 request, the participant shall make such records, documents, and
17481748 data available for inspection by the regulatory relief office.
17491749 D. 1. The participant shall notify the regulatory relief
17501750 office and each applicable agency of any incidents that result in
17511751 harm to the health, safety, or financial wellbeing of a c onsumer.

18081808 immediately remove the par ticipant from the pr ogram.
18091809 E. 1. No later than thirty ( 30) days after the participant
18101810 exits the program, the participant shall submit a written report to
18111811 the regulatory relief office and each applicable agency describing
18121812 an overview of the participant’s demonstration includ ing any:
18131813 a. incidents of harm to consumers,
18141814 b. legal action filed against the participant as a result
18151815 of the participant’s demonstration, and
18161816 c. complaints filed with an appli cable agency as a result
18171817 of the participant’s demonstration.
18181818 2. No later than thirty (30) days after an applicable agenc y
18191819 receives the quarterly reporting described in subsection C of this
18201820 section or a written report from a participant pursuant to paragraph
18211821 1 of subsection E of t his section, the applicable agency shall
18221822 provide a written report to the regulatory relief office on t he
18231823 demonstration that describes any statu tory or rule change the
18241824 applicable agency recommends as a result of the demonstration.
18251825 F. The regulatory re lief office may remove a participant from
18261826 the program at any time if the regulatory relief office determines

18821882 SECTION 11. NEW LAW A new section of law to be codified
18831883 in the Oklahoma Statutes as Section 802.10 of Title 40, unless there
18841884 is created a duplicat ion in numbering, reads as follow s:
18851885 A. General Regulatory Business Relief Office shall create and
18861886 maintain on the Department of Labor’s website a webpage that invites
18871887 residents and businesses in this state to make suggestions regarding
18881888 laws and agency rules that could be modified or eliminated to reduce
18891889 the regulatory burden of residents and businesses in this state.
18901890 B. On no less than a quarterly basis, the regulatory relief
18911891 office shall compile the results of the suggestions from the web page
18921892 and provide a written report to the Governor, the President Pro
18931893 Tempore of the Senate, and the Speaker of the House of
18941894 Representatives that describes the most common suggestions.
18951895 C. In creating the report described in s ubsection B of this
18961896 section, the regulatory relief office and the Commission:
18971897 1. Shall ensure the priv ate information of residents and
18981898 businesses that make suggestions on the website is not made public;
18991899 and
19001900 2. May evaluate the suggestions and provide analysis and
19011901 suggestions regarding which state laws and agency rules could be
