107200 12. "Dispense" means the selling of medical marijuana or a
108201 medical marijuana product to a qualified patient or the design ated
109202 caregiver of the patient that is packaged in a suitable container
110203 appropriately labeled for subsequent administration to or use by a

113205 13. "Dispensary" means a medical marijuana dispensary, an
114206 entity that has been licensed by the De partment pursuant to the
115207 Oklahoma Medical Marijuana and Patient Protection Act to purchase

139251 17. "Flowering" means the reproductive state of the marijuana
140252 or cannabis plant in which th ere are physical signs of flower or

144255 marijuana concentrate that was produced by extracting cannabinoids
145256 from medical marijuana through the use of propylene glycol,

149259 19. "Good cause" for purposes of an initial, renewal or
150260 reinstatement license application, or for purposes of discipline of

156265 promulgated pursuant the reto, or any supplemental
157266 relevant state or local law, rule or regulation,

161269 the license pursuant to an order of the State

167300 adversely affects the public health or welfare or the
168301 safety of the immediate vicinity in w hich the
169302 establishment is located;

171303 20. "Harvest batch" means a specifically identified quantity of
172304 medical marijuana that is uniform in strain, cultivate d utilizing
173305 the same cultivation practices, harvested at the same time f rom the
174306 same location and cur ed under uniform conditions;

176307 21. "Harvested marijuana" means post-flowering medical
177308 marijuana not including trim, concentrate or waste;

181309 22. "Heat- or pressure-based medical marijuana concentrate"
182310 means a medical marijuana con centrate that was produced by
183311 extracting cannabinoids from medical marijuana through the use of

187314 has not demonstrated signs of flower ing;

189315 24. "Inventory tracking system " means the required tracking
190316 system that accounts for medical marijuana from either the seed or
191317 immature plant stage until the medical mar ijuana or medical
192318 marijuana product is sold to a pa tient at a medical marijuana
193319 dispensary, transferred to a medical mariju ana research facility,
194320 destroyed by a medical marijuana business or used in a research

197348 25. "Licensed patient" or "patient" means a person who has been
198349 issued a medical marijuana patient license by the Stat e Department
199350 of Health or Oklahoma Medical Marijuana Authority;

201351 26. "Licensed premises" means the premises specified in an
202352 application for a medical marijuana business license, medica l
203353 marijuana research facility license or medical marijuana education
204354 facility license pursuant to the Oklahoma Medical Marijuana and
205355 Patient Protection Act that are owned or in possession of the
206356 licensee and within which the licensee is authorized to culti vate,
207357 manufacture, distribute, sell, store, transport, test or research
208358 medical marijuana or medical marij uana products in accordance with
209359 the provisions of the Oklahoma Medical Marijuana and Patient
210360 Protection Act and rules promulgated pursuant thereto;

212361 27. "Manufacture" means the production, propagation,
213362 compounding or processing of a medical marijuana prod uct, excluding
214363 marijuana plants, either directly or indirectly by extraction from
215364 substances of natural or synthetic origin, or independently by means
216365 of chemical synthesis, or by a combination of extraction and
217366 chemical synthesis;

219367 28. "Marijuana" shall have the same meaning as such term is
220368 defined in Section 2-101 of this title and shall not include a ny

228399 substantive revision to the standard operating procedures of a
229400 licensee for the cultivation or produc tion of medical marijuana,
230401 medical marijuana concentrate or medic al marijuana products;

232402 30. "Mature plant" means a harvestable female marijuana plant
233403 that is flowering;

235404 31. "Medical marijuana business (MMB) " means a licensed medical
236405 marijuana dispensary, medical marijuana processor, medical mari juana
237406 commercial grower, medical marijuana laboratory, medical marijuana
238407 business operator or a medical marijuana transporter;

240408 32. "Medical marijuana concentrate " or "concentrate" means a
241409 specific subset of medica l marijuana that was produced by extractin g
242410 cannabinoids from me dical marijuana. Categories of medical
243411 marijuana concentrate include water-based medical marijuana
244412 concentrate, food-based medical marijuana concentrate, so lvent-based
245413 medical marijuana conce ntrate, and heat- or pressure-based medical

248415 33. "Medical marijuana commercial grower" or "commercial
249416 grower" means an entity licensed to cultivate, pre pare and package

259451 facility" means a person or entity approved pu rsuant to the Oklahoma
260452 Medical Marijuana and Patient Protection Act to operate a facility
261453 providing training and education to individuals involving the
262454 cultivation, growing, harvesting, curing, preparing, packagi ng or
263455 testing of medical marijuana, or the p roduction, manufacture,

274462 36. "Medical marijuana product" or "product" means a product
275463 that contains cannabinoids that have been extracted from plant
276464 material or the resin therefrom by physical or che mical means and is
277465 intended for administration to a qualified patient includ ing, but
278466 not limited to, oils, tinctures, edibles, pills, topical forms,
279467 gels, creams, vapors, patc hes, liquids and forms administered by a
280468 nebulizer, excluding live plant forms wh ich are considered medical

283470 37. "Medical marijuana processor " means a person or entity

292504 facility" means a person or entity approved pursuant to the Oklahoma
293505 Medical Marijuana and P atient Protection Act to conduct medical
294506 marijuana research. A medical marijuana research facility is not a

297508 39. "Medical marijuana testing laboratory " or "laboratory"
298509 means a public or private laboratory licensed pursuant to the
299510 Oklahoma Medical Marijuana and Patient Protection Act, to conduct

303513 40. "Medical marijuana transporter " or "transporter" means a
304514 person or entity that is licensed pursuant to the Oklahoma Medical

314547 41. "Medical marijuana waste " or "waste" means unused, surplus,
315548 returned or out-of-date marijuana, plant debris of the plant of the
316549 genus Cannabis including dead plants and all unused plant parts and
317550 roots, except the term shall not include roots, st ems, stalks and
318551 fan leaves;

320552 42. "Medical use" means the acquisition, possession, use,
321553 delivery, transfer or transportat ion of medical marijuana, medical
322554 marijuana products, medical marijuana devices or paraphernalia
323555 relating to the administration of medi cal marijuana to treat a

326557 43. "Mother plant" means a marijuana plant that is grown or
327558 maintained for the purpose of generating clones, and that will not

332562 licensed by and in good standing with the State Board of Medical

387653 "pesticide" shall not include any article that is a "new animal
388654 drug" as designated by the United States Food and Drug

411696 52. "Public money" means any funds or money obtained by the
412697 holder from any government al entity including, but not limited to,
413698 research grants;

415699 53. "Recommendation" means a document that is signed or
416700 electronically submitted by a physician on behalf of a patient for
417701 the use of medical marijuana pursuant to the Oklahoma Medical
418702 Marijuana and Patient Protection Act;

420703 54. "Registered to conduct business" means a person that has
421704 provided proof that the business applicant is in good standing with
422705 the Oklahoma Secretary of State and Oklahoma Tax Commission;

424706 55. "Remediation" means the process by which the medical
425707 marijuana flower or trim, which has failed microbial testing, is
426708 processed into solvent-based medical marijuana concentrate and
427709 retested as required by the Oklahoma Medical Marijuana and Patient
428710 Protection Act;

430711 56. "Research project" means a discrete scientific endeavor to
431712 answer a research question or a set of research questions rel ated to
432713 medical marijuana and is required fo r a medical marijuana research
433714 license. A research project shall include a des cription of a
434715 defined protocol, cl early articulated goals, defined methods and
435716 outputs, and a defined start and end date. The descri ption shall
436717 demonstrate that the research pr oject will comply with all
437718 requirements in the Oklahoma Medical Marijuana and P atient
438719 Protection Act and rules promulgated pursuant thereto. All research

442747 shall be conducted in fur therance of an approved research project;

444748 57. "Revocation" means the final decision by the Department
445749 that any license issued pursuant to the Oklahoma Medical Marijuana
446750 and Patient Protection Act is rescinded because the individual or
447751 entity does not comply with the appl icable requirements set forth in
448752 the Oklahoma Medical Marijuana and Pati ent Protection Act or rules
449753 promulgated pursuant thereto;

533897 take action against a medical marijuana patient licensee if the
534898 licensee uses or possesses mar ijuana while in his or her place of
535899 employment or during the hours of employment . Employers may not
536900 take action against a medical marijuana patient licensee solely
537901 based upon the status of an employee as a medical marijuana patient
538902 licensee or the results of a drug test showing positive for
539903 marijuana or its components.

541904 C. For the purposes of medical care, including organ
542905 transplants, the authorized use of marijuana by a medical marijuana
543906 patient licensee shall be considered the equivalent of the use of
544907 any other medication under the direction of a physician and does not
545908 constitute the use of an illicit substance or otherwise disqualify a
546909 registered qualifying patient from medical care.

5931000 not be subject to nonrenewal or revocation due to subseque nt events
5941001 or changes in regulations o ccurring after licensure that would
5951002 render the medical marijuana dispensary in violation by being within
5961003 one thousand (1,000) feet of a public school or private school. If
5971004 any public school or private school is established within one
5981005 thousand (1,000) feet of any medical marijuana dispensary after such
5991006 medical marijuana dispensary has been licensed, the provisions of
6001007 this subsection paragraph shall not be a deterrent to the renewal of
6011008 such license or warrant revocation o f the license. For purposes of
6021009 this subsection paragraph, a property owned, used or operate d by a
6031010 public school or by a private school that is not used for classroom
6041011 instruction on core curriculum, such as an administrative building,
6051012 athletic facility, ballpark, field or stadium, shall not constitute
6061013 a public school or private school unless such property is located on
6071014 the same campus as a building used for classroom ins truction on core

6451100 license. The research license shall be granted, provided the
6461101 applicant meets the criteria list ed in the Medical Marijuana and
6471102 Patient Protection Act. Research licensees shall be required to
6481103 file monthly consumpti on reports to the State Department of Health
6491104 with amounts of marijuana used for research. Biomedical and
6501105 clinical research which is subj ect to federal regulations and
6511106 institutional oversight shall not be subject to oversight by the

1146+suitable. Upon a finding that a pr oposed medical marijuana waste
1147+disposal facility is not physically or technically suitable, the
1148+Authority shall deny the license . The Authority may, upon
1149+determining that public health or safety requires emergency action,
1150+issue a temporary license for tre atment or storage of medical
1151+marijuana waste for a period not to exceed ninety (90) days. The
1152+Authority shall not, for the first yea r of the licensure program ,
1153+issue more than ten medical marijuana waste disposal licenses. Upon
1154+the conclusion of the firs t year, the Authority shall assess the
1155+need for additional medical marijuana waste disposal licenses and
1156+shall, if demonstrated, incr ease the number of license s as deemed
1157+necessary by the Authority.
1158+B. Entities applying for a medical marijuana waste dispo sal
1159+license shall undergo the follo wing screening process:
1160+1. Complete an application form, as prescribed by the
1161+Authority, which shall include:
1162+a. an attestation that the applicant is authorized to
1163+make application on behalf of the entity,
1164+b. full name of the organization,
1165+c. trade name, if applicable,
1166+d. type of business organization,

1201+license made by an individual on his or her own behalf shall be on
1202+the form prescribed by the Authority and shall incl ude, but not be

1204+a. the first, middle and last name of the applicant and
1205+suffix, if applicable,
1206+b. the residence address and mailing address of the
1207+applicant,
1208+c. the date of birth of the applicant,
1209+d. the preferred telephone number and email add ress of
1210+the applicant,
1211+e. an attestation that the information provided by the
1212+applicant is true and correct, and
1213+f. a statement signed by the applicant pledging not to
1214+divert marijuana to any individual or entity that is
1215+not lawfully entitled to possess ma rijuana; and

1254+nearest perimeter wall of the premises of such
1255+disposal facility. If any public or private school is
1256+established within one thousand (1,000) feet of any
1257+disposal facility after such disposal f acility has
1258+been licensed, the provisions of this subparagrap h
1259+shall not be a deterrent to the renewal of such
1260+license or warrant revocation of the license . For the
1261+purposes of this section, "school" shall mean the same
1262+as provided in Section 427.2 of this title, and
1263+e. documents establishing the applicant, the mem bers,
1264+managers and board members, if applicable, and
1265+seventy-five percent (75%) of the ownership interests
1266+are Oklahoma residents as established in Section 420

1295+C. No license shall be issued excep t upon proof of sufficient
1296+liability insurance and financial re sponsibility. Liability
1297+insurance shall be provided by th e applicant and shall apply to
1298+sudden and nonsudden bodily injury or prope rty damage on, below or
1299+above the surface, as required by the rules of the Authority . Such
1300+insurance shall be maintained fo r the period of operation of the
1301+facility and shall provid e coverage for damages resulting from
1302+operation of the facility during ope ration and after closing.
1303+D. Submission of an application fo r a medical marijuana waste
1304+disposal license shall constitute p ermission for entry to and
1305+inspection of the facility of the licensee during hours of operation
1306+and other reasonable times. Refusal to permit such entry of
1307+inspection shall constitute grounds for the nonrenewal, suspension
1308+or revocation of a license . The Authority may perform an annual
1309+unannounced on-site inspection of the operations and any facility of
1310+the licensee. If the Authority receives a complaint concerning
1311+noncompliance by a licensee with the provisions o f the Oklahoma
1312+Medical Marijuana Waste Ma nagement Act, the Authority may conduct
1313+additional unannounced, on-site inspections beyond an ann ual
1314+inspection. The Authority may refer all complaints alleging
1315+criminal activity that are made against a licensed facility to
1316+appropriate state or local law enforcement authorities.

1343+E. The Authority shall issu e an annual permit for each medical
1344+marijuana waste disposal facility operated by a licensee. A permit
1345+shall be issued only upon proper app lication by a licensee and
1346+determination by the Authority that the proposed site and facility
1347+are physically and techni cally suitable. Upon a finding that a
1348+proposed medical marijuana waste disp osal facility is not physically
1349+or technically suitable, the Authority shall deny the permit . The
1350+Authority shall have the authority to revoke a permit upon a finding
1351+that the site and facility are not physically and tec hnically
1352+suitable for processing. The Authority may, upon determining that
1353+public health or saf ety requires emergency action, issue a temporary
1354+permit for treatment or storage of medical marijuana waste for a
1355+period not to exceed ninety (90) days.
1356+F. The cost of a medical marijuana waste disposal license shall
1357+be Five Thousand Dollars ($5,000.00) f or the initial license . The
1358+cost of a medical marijuana waste disposal facility permit shall be
1359+Five Hundred Dollars ($500.00). A medical marijuana waste disp osal
1360+facility permit that has been revoked shall be reinstated upon
1361+remittance of a reinstatemen t fee of Five Hundred Dollars ($500.00)
1362+to restore the facility permit. All license and permit fees shall
1363+be deposited into the Oklahoma Medical Marijuana Auth ority Revolving
1364+Fund as provided in Section 427.5 of this title.
1365+G. The holder of a medical mar ijuana waste disposal license
1366+shall not be required to obtain a medical marijuana transporter

1399+I. The State Commissioner of Health shall promulgate rules for
1400+the implementation of the Oklahoma Medical Marijuana Waste
1401+Management Act. Promulgated rules shall address disposal process
1402+standards, site security and any other subject m atter deemed
1403+necessary by the Autho rity.
1404+SECTION 4. It being immediately necess ary for the preservation
1405+of the public peace, health or safety, an emergency is hereby
1406+declared to exist, by reason whereof this act shall take effect and
1407+be in full force from and after its pass age and approval."

1536+3. “Batch number” means a unique numeric or alphanumeric
1537+identifier assigned prior to testing to allow for in ventory tracking
1538+and traceability;
1539+4. “Cannabinoid” means any of the chemical compounds that are
1540+active principles of marijuana;
1541+5. “Caregiver” means a family member or assistant who regularly
1542+looks after a medical marijuana license holder whom a physi cian
1543+attests needs assistance;
1544+6. “Child-resistant” means special packaging that is:
1545+a. designed or construc ted to be significantly difficult
1546+for children under five (5) years of age to open and
1547+not difficult for normal adults to use properly as
1548+defined by 16 C.F.R. 1700.15 (1995) and 16 C.F .R.
1549+1700.20 (1995),
1550+b. opaque so that the outermost packaging does not a llow
1551+the product to be seen withou t opening the packaging
1552+material, and
1553+c. resealable to maintain its ch ild-resistant
1554+effectiveness for multipl e openings for any product
1555+intended for more than a single use or containing
1556+multiple servings;
1557+7. “Clone” means a nonflowering plant cut from a m other plant
1558+that is capable of developing into a new plant and has sho wn no
1559+signs of flowering;

1586+8. “Commissioner” means the State Commissioner of Hea lth;
1587+9. “Complete application” means a document prepared in
1588+accordance with the provisions set forth in the Oklahoma Medical
1589+Marijuana and Patient Protection Act, rules promulgated pursuant
1590+thereto, and the forms and instructions provided by the Departmen t
1591+including any supporting documentation req uired and the applicable
1592+license application fee;
1593+10. “Department” means the State Department of Health;
1594+11. “Director” means the Executive Director of th e Oklahoma
1595+Medical Marijuana Authority;
1596+12. “Dispense” means the selling of medical marijuana or a
1597+medical marijuana product to a qualified patient or the design ated
1598+caregiver of the patient that is packaged in a suitable container
1599+appropriately labeled for subsequent administration to or use by a
1600+qualifying patient;
1601+13. “Dispensary” means a medical marijuana dispensary, an
1602+entity that has been licensed by the De partment pursuant to the
1603+Oklahoma Medical Marijuana and Patient Protection Act to purchase
1604+medical marijuana or medical marijuana products from a lice nsed
1605+medical marijuana commercial grower or medical marijuana processor,
1606+sell medical marijuana or medical marijuana products to patients and
1607+caregivers as defined under the Oklahoma Medical Marijuana and
1608+Patient Protection Act , or sell or transfer product s to another
1609+dispensary;

1636+14. “Edible medical marijuana product” means any medical-
1637+marijuana-infused product for which the intended use is oral
1638+consumption including, but not limi ted to, any type of food, drink
1639+or pill;
1640+15. “Entity” means an individual, g eneral partnership, limited
1641+partnership, limited liability company, trus t, estate, association,
1642+corporation, cooperative or any other legal or commercial entity;
1643+16. “Flower” means the reproductive organs of the marijuana or
1644+cannabis plant referred to as the bud or parts of the plant that are
1645+harvested and used to consume in a variety of medical marijuana
1646+products;
1647+17. “Flowering” means the reproductive state of the marijuana
1648+or cannabis plant in which there are physical signs of flower or
1649+budding out of the nodes of the stem;
1650+18. “Food-based medical marijuana concentrate ” means a medical
1651+marijuana concentrate that was produced by extracting cannabinoids
1652+from medical marijuana through the use of propylene glycol,
1653+glycerin, butter, olive oil, coconut oil o r other typical food-safe
1654+cooking fats;
1655+19. “Good cause” for purposes of an initial, renewal or
1656+reinstatement license application, or for purposes of discipline of
1657+a licensee, means:
1658+a. the licensee or applicant has violated, does not meet,
1659+or has failed to comply with any of the terms,

1687+promulgated pursuant the reto, or any supplemental
1688+relevant state or local law, rule or regulation,
1689+b. the licensee or applicant has failed to comply with
1690+any special terms or c onditions that were placed upon
1691+the license pursuant to an order of the State
1692+Department of Health, Okl ahoma Medical Marijuana
1693+Authority or the municipality, or
1694+c. the licensed premises of a medical marijuana business
1695+or applicant have been operated in a m anner that
1696+adversely affects the public heal th or welfare or the
1697+safety of the immediate vicinity in w hich the
1698+establishment is located;
1699+20. “Harvest batch” means a specifically identified quantity of
1700+medical marijuana that is uniform in strain, cultivate d utilizing
1701+the same cultivation practices, harvested at the same time f rom the
1702+same location and cur ed under uniform conditions;
1703+21. “Harvested marijuana” means post-flowering medical
1704+marijuana not including trim, concentrate or waste;
1705+22. “Heat- or pressure-based medical marijuana concentrate ”
1706+means a medical marijuana con centrate that was produced by
1707+extracting cannabinoids from medical marijuana through the use of
1708+heat or pressure;

1735+23. “Immature plant” means a nonflowering marijuana plant that
1736+has not demonstrated signs of flowering;
1737+24. “Inventory tracking system ” means the required tracking
1738+system that accounts for medical marijuana from either the seed or
1739+immature plant stage until the medical marijuana or medical
1740+marijuana product is sold to a pa tient at a medical marijuana
1741+dispensary, transferred to a medical mariju ana research facility,
1742+destroyed by a medical marijuana business or used in a research
1743+project by a medical marijuana research facility;
1744+25. “Licensed patient” or “patient” means a person who has been
1745+issued a medical marijuana patient license by the Stat e Department
1746+of Health or Oklahoma Medical Marijuana Authority;
1747+26. “Licensed premises” means the premises specified in an
1748+application for a medical marijuana business license, medica l
1749+marijuana research facility license or med ical marijuana education
1750+facility license pursuant to the Oklahoma Medical Marijuana and
1751+Patient Protection Act that are owned or in possession of the
1752+licensee and within which the licensee is authorized to culti vate,
1753+manufacture, distribute, sell, store, transport, test or research
1754+medical marijuana or medical marij uana products in accordance with
1755+the provisions of the Oklahoma Medical Marijuana and Patient
1756+Protection Act and rules promulgated pursuant thereto;
1757+27. “Manufacture” means the production, prop agation,
1758+compounding or processing of a medical marijuana prod uct, excluding

1786+substances of natural or synthetic origin, or independently by means
1787+of chemical synthesis, or by a combination of extraction and
1788+chemical synthesis;
1789+28. “Marijuana” shall have the same meaning as such term is
1790+defined in Section 2-101 of this title and shall not include any
1791+plant or material containing delta -8 or delta-10
1792+tetrahydrocannabinol which is grown, pro cessed or sold pursuant to
1793+the provisions of the Oklah oma Industrial Hemp Program;
1794+29. “Material change” means any change that would require a
1795+substantive revision to the standard operating procedures of a
1796+licensee for the cultivation or production of me dical marijuana,
1797+medical marijuana concentrate or medic al marijuana products;
1798+30. “Mature plant” means a harvestable female marijuana plant
1799+that is flowering;
1800+31. “Medical marijuana business (MMB) ” means a licensed medical
1801+marijuana dispensary, medical marijuana processor, medical mari juana
1802+commercial grower, medical marijuana laboratory, medical marijuana
1803+business operator or a medical marijuana transporter;
1804+32. “Medical marijuana concentrate ” or “concentrate” means a
1805+specific subset of medical mari juana that was produced by extractin g
1806+cannabinoids from me dical marijuana. Categories of medical
1807+marijuana concentrate include water-based medical marijuana
1808+concentrate, food-based medical marijuana concentrate, so lvent-based

1837+33. “Medical marijuana commercial grower” or “commercial
1838+grower” means an entity licensed to cultivate, prepare and package
1839+medical marijuana and transf er or contract for transfer medical
1840+marijuana to a medical marijuana dispensar y, medical marijuana
1841+processor, any other medical marijuana commercial grower, medical
1842+marijuana research facility, medical marijuana education facility
1843+and pesticide manufacture rs. A commercial grower may sell seeds,
1844+flower or clones to commercial grower s pursuant to the Oklahoma
1845+Medical Marijuana and Patient Protection Act;
1846+34. “Medical marijuana education facility ” or “education
1847+facility” means a person or entity approved pu rsuant to the Oklahoma
1848+Medical Marijuana and Patien t Protection Act to operate a facility
1849+providing training and education to individuals involving the
1850+cultivation, growing, harvesting, curing, preparing, packaging or
1851+testing of medical marijuana, or the p roduction, manufacture,
1852+extraction, processing, pac kaging or creation of medica l-marijuana-
1853+infused products or me dical marijuana products as described in the
1854+Oklahoma Medical Marijuana and Patient Protection Act ;
1855+35. “Medical-marijuana-infused product” means a product infused
1856+with medical marijuana includ ing, but not limited to , edible
1857+products, ointments and tinctu res;

1884+36. “Medical marijuana product” or “product” means a product
1885+that contains cannabinoids that have been extracted from plant
1886+material or the resin therefrom by physical or chemical means an d is
1887+intended for administration to a qualified patient includ ing, but
1888+not limited to, oils, tinctures, edibles, pills, topical forms,
1889+gels, creams, vapors, patches, liquids and forms administered by a
1890+nebulizer, excluding live plant forms which are consid ered medical
1891+marijuana;
1892+37. “Medical marijuana processor ” means a person or entity
1893+licensed pursuant to the Oklahoma Medical Marijuana and Patient
1894+Protection Act to operate a business including the pro duction,
1895+manufacture, extraction, processing, packagin g or creation of
1896+concentrate, medical-marijuana-infused products or medical marijuana
1897+products as described in the Oklahoma Medical Marijuana and Patient
1898+Protection Act;
1899+38. “Medical marijuana re search facility” or “research
1900+facility” means a person or en tity approved pursuant to the Oklahoma
1901+Medical Marijuana and P atient Protection Act to conduct medical
1902+marijuana research. A medical marijuana research facility is not a
1903+medical marijuana business;
1904+39. “Medical marijuana testing laboratory” or “laboratory”
1905+means a public or private laboratory licensed pursuant to the
1906+Oklahoma Medical Marijuana and Patient Protection Act, to conduct

1935+40. “Medical marijuana transporter” or “transporter” means a
1936+person or entity that is licensed pursuant to the Oklahoma Medical
1937+Marijuana and Patient Protection Act. A medical marijuana
1938+transporter does not include a medical marijuana business that
1939+transports its own medical marijuana, medical marijuana concentrate
1940+or medical marijuana products to a property or fac ility adjacent to
1941+or connected to the licensed premises if the property is another
1942+licensed premises of t he same medical marijuana busine ss;
1943+41. “Medical marijuana waste” or “waste” means unused, surplus,
1944+returned or out-of-date marijuana, plant debris of the plant of the
1945+genus Cannabis including dead plants and all unused plant parts and
1946+roots, except the term shall not include roots, st ems, stalks and
1947+fan leaves;
1948+42. “Medical use” means the acquisition, possession, use,
1949+delivery, transfer or transportat ion of medical marijuana, medical
1950+marijuana products, medical marijuana devices or paraphernalia
1951+relating to the administration of medi cal marijuana to treat a
1952+licensed patient;
1953+43. “Mother plant” means a marijuana plant that is grown or
1954+maintained for the purpose of generating clones, and that will not
1955+be used to produce plant material for sale to a med ical marijuana
1956+processor or medical marijuana dispensary;

1983+44. “Oklahoma physician” or “physician” means a physician
1984+licensed by and in good standing with the State Board of Medical
1985+Licensure and Supervision, the State Board of Osteopathic Examiners
1986+or the Board of Podiatric Medical Exam iners;
1987+45. “Oklahoma resident” means an individual who can p rovide
1988+proof of residency as required by the Oklahoma Medical Marijuana and
1989+Patient Protection Act;
1990+46. “Owner” means, except where the context otherw ise requires,
1991+a direct beneficial owner in cluding, but not limited to, all persons
1992+or entities as follows :
1993+a. all shareholders owning an interest of a corporate
1994+entity and all officers of a corporate entity,
1995+b. all partners of a general partnership,
1996+c. all general partners and all limited partn ers that own
1997+an interest in a limited partnership,
1998+d. all members that own an interest in a li mited
1999+liability company,
2000+e. all beneficiaries that hold a beneficial interest in a
2001+trust and all trustees of a trust,
2002+f. all persons or entities that own inter est in a joint
2003+venture,
2004+g. all persons or entities that own an intere st in an
2005+association,
2006+h. the owners of any other type of legal entity, and

2036+47. “Package” or “packaging” means any container or w rapper
2037+that may be used by a medical marijuana business to enc lose or
2038+contain medical marijuana;
2039+48. “Person” means a natural person, partn ership, association,
2040+business trust, compa ny, corporation, estate, l imited liability
2041+company, trust or any other leg al entity or organization, o r a
2042+manager, agent, owner, directo r, servant, officer or employee
2043+thereof, except that “person” does not include any governmental
2044+organization;
2045+49. “Pesticide” means any substance or mixture of substances
2046+intended for preventin g, destroying, repelling or mitigating any
2047+pest or any substance or mixture of substances intended for use as a
2048+plant regulator, defoliant or desiccant, except that the term
2049+“pesticide” shall not include any article that is a “new animal
2050+drug” as designated by the United States Food and Drug
2051+Administration;
2052+50. “Production batch” means:
2053+a. any amount of medical marijuana concentrate of the
2054+same category and produced using the same extraction
2055+methods, standard operating procedures and an

2088+51. “Public institution” means any entity esta blished or
2089+controlled by the feder al government, state government, or a local
2090+government or municipality in cluding, but not limited to,
2091+institutions of higher education or rel ated research institutions;
2092+52. “Public money” means any funds or money obtained by the
2093+holder from any government al entity including, but not limited to,
2094+research grants;
2095+53. “Recommendation” means a document that is signed o r
2096+electronically submitted by a physician on behalf of a patient for
2097+the use of medical marijuana pursuant to the Oklahoma Medical
2098+Marijuana and Patient Protection Act;
2099+54. “Registered to conduct business” means a person that has
2100+provided proof that the business applicant is in good standing with
2101+the Oklahoma Secretary of State and Ok lahoma Tax Commission;
2102+55. “Remediation” means the process by which the medical
2103+marijuana flower or trim, which has failed microbial testing, is
2104+processed into solvent -based medical marijuana concentrate and

2133+56. “Research project” means a discrete scientific endeavor to
2134+answer a research question or a set of research questions related to
2135+medical marijuana and is required fo r a medical marijuana research
2136+license. A research project shall include a des cription of a
2137+defined protocol, cl early articulated goals, defined methods and
2138+outputs, and a defined start and end date. The description shall
2139+demonstrate that the research pr oject will comply with all
2140+requirements in the Oklahoma Medical Marijuana and P atient
2141+Protection Act and rules promulgated pursuant thereto. All research
2142+and development conducted by a medical marijuana research facility
2143+shall be conducted in fur therance of an approved research project;
2144+57. “Revocation” means the final decision by the Department
2145+that any license issued pursuant to the Oklahoma Medical Marijuana
2146+and Patient Protection Act is rescinded because the individual or
2147+entity does not comply with the appl icable requirements set forth in
2148+the Oklahoma Medical Marijuana and Pati ent Protection Act or rules
2149+promulgated pursuant thereto;
2150+58. “School” means a public or private preschool or, a public
2151+or private elementary or secondary school, or a technology center
2152+school which is primarily used for classroom instruction. A
2153+homeschool, daycare or child-care facility shall not be considered a

2181+Protection Act;
2182+59. “Shipping container” means a hard-sided container with a
2183+lid or other enclosure that can be secured in place. A shipping
2184+container is used solel y for the transport of medical marijuana,
2185+medical marijuana concentrate, or medical marijuan a products between
2186+medical marijuana businesses, a medical marijuana research facility,
2187+or a medical marijuana education facility;
2188+60. “Solvent-based medical marijuana concentrate” means a
2189+medical marijuana concentrate that was produced by extracting
2190+cannabinoids from medical mariju ana through the use of a solvent
2191+approved by the Department;
2192+61. “State Question” means Oklahoma State Question No. 788,
2193+Initiative Petition No. 412, approved by a majority vote of the
2194+citizens of Oklahoma on June 26, 2018;
2195+62. “Strain” means the classification of marijuana or cannabis
2196+plants in either pure sativa, indica, afghanica, ruderalis or hybrid
2197+varieties;
2198+63. “THC” means tetrahydrocannabinol, which is the primary
2199+psychotropic cannabinoid in marijuana formed by dec arboxylation of
2200+naturally tetrahydrocannabinolic acid, which generally occurs by
2201+exposure to heat;
2202+64. “Test batch” means with regard to usable marijuana, a
2203+homogenous, identified quantity of usable marijuana by strain, no

2231+period from a specified cultivation area, and with regard to oils,
2232+vapors and waxes derived from us able marijuana, means an identifie d
2233+quantity that is uniform, that is intended to meet specifications
2234+for identity, strength and composition, and that is manufactured,
2235+packaged and labeled during a specified time period according to a
2236+single manufacturing, packaging and labeling protocol;
2237+65. “Transporter agent” means a person who transports medical
2238+marijuana or medical ma rijuana products for a licensed tr ansporter
2239+and holds a transporter agent license pursuant to the Oklahoma
2240+Medical Marijuana and Patient Protection Act;
2241+66. “Universal symbol” means the image established by the State
2242+Department of Health or Okla homa Medical Marijuana Authority an d
2243+made available to licensees through its website indicating that the
2244+medical marijuana or the medical marijuan a product contains THC;
2245+67. “Usable marijuana” means the dried leaves, flowers, oils,
2246+vapors, waxes and othe r portions of the marijuana plant an d any
2247+mixture or preparation thereof, exc luding seeds, roots, stems,
2248+stalks and fan leaves; and
2249+68. “Water-based medical marijuana concentrate ” means a
2250+concentrate that was produced by extracting cannabinoids from
2251+medical marijuana through the use of only water, ice or dry ice.

2293+take action against a medical marijuana patient licensee if the
2294+licensee uses or possesses marijuana while in his or her place of
2295+employment or during the ho urs of employment. Employers may not
2296+take action against a medical marijuana patient licensee solely
2297+based upon the status of an employee as a medical marijuana patient
2298+licensee or the results of a drug test showing positive for
2299+marijuana or its component s.
2300+C. For the purposes of medical care, including organ
2301+transplants, the authorized use of marijuana by a medical marijuana

2329+any other medication under the direction of a physician and does not
2330+constitute the use of an illicit substance or otherwise disqualify a
2331+registered qualifying patient from medical care.
2332+D. No medical marijuana patient licensee may be denied custody
2333+of or visitation or parenting time with a minor child, and there is
2334+no presumption of neglect or child endangerment for conduct al lowed
2335+under this law unless the behavior of the medical marijuana patient
2336+licensee creates an unreasonable danger to the safety of the minor
2337+child.
2338+E. No person who possesses a medical marijuana patient license
2339+may be unduly withheld from holdin g another state-issued license by
2340+virtue of his or her status as a medical marijuana patient licensee
2341+including, but not limited to, a concealed carry permit.
2342+F. 1. No city or local municipality may undul y change or
2343+restrict zoning laws to prevent the opening of a medical marijuana
2344+dispensary.
2345+2. For purposes of this subsection, an undue chang e or
2346+restriction of municipal zoning laws means an act which entirely
2347+prevents medical marijuana dispensaries from operating within
2348+municipal boundaries as a matter of law . Municipalities may follow
2349+their standard planning and zoning procedures to determi ne if
2350+certain zones or districts would be appropriate for locating
2351+marijuana-licensed premises, medical marijuana businesses or any

2380+3. A medical marijuana dispensary does not include those other
2381+entities licensed by th e Oklahoma Medical Marijuana Authority as
2382+marijuana-licensed premises, medical marijuana businesses or other
2383+facilities or locations where marijuana or any product containing
2384+marijuana or its by-products are cultivated, grown, processed,
2385+stored or manufactured.
2386+G. The location of any medical marijuana dispensary or
2387+commercial grower is specifically prohibited within one thousa nd
2388+(1,000) feet of any public school or private school. The distance
2389+indicated in this subsection shall be measured from the nearest
2390+property line of such public school or private school to the nearest
2391+perimeter wall of the licensed premises of such medic al marijuana
2392+dispensary or commercial grower. If a medical marijuana dispensary
2393+or commercial grower met the requirements o f this subsection at the
2394+time of its initial licens ure, the medical marijuana dispensary or
2395+commercial grower licensee shall be permitted to cont inue operating
2396+at the licensed premises in the sa me manner and not be subject to
2397+nonrenewal or revocation due to subsequent events o r changes in
2398+regulations occurring after licensure that would render the medical
2399+marijuana dispensary or commercial grower in violation by being
2400+within one thousand (1,000) feet of a public school or private

2433+subsection, a property owned, used or operate d by a public school or
2434+by a private school that is not used for classroom i nstruction on
2435+core curriculum, such as an administrative building, athletic
2436+facility, ballpark, field or stadium, shall not constitute a public
2437+school or private school unless such property is located on the same
2438+campus as a building used for classroom ins truction on core
2439+curriculum.
2440+H. Research shall be provided for under this law. A researcher
2441+may apply to the State De partment of Health for a sp ecial research
2442+license. The research license shall be granted, provided the
2443+applicant meets the criteria list ed in the Medical Marijuana and
2444+Patient Protection Act. Research licensees shall be required to
2445+file monthly consumpti on reports to the State Dep artment of Health
2446+with amounts of marijuana used for research. Biomedical and
2447+clinical research which is subj ect to federal regulations and
2448+institutional oversight shall not be subject to oversight by the
2449+State Department of Hea lth.

6612480 medical marijuana waste disposal license . A person or entity in
6622481 possession of a medical mariju ana waste disposal license shall be
6632482 entitled to possess, transport and dispose of medi cal marijuana
6642483 waste. No person or entity shall dispose of medical marijuana waste
6652484 without a valid medical marijuana waste disposal lice nse. The
6662485 Oklahoma Medical Marijua na Authority shall issue licenses upon
6672486 proper application by a licensee and determinat ion by the Authority
6682487 that the proposed site and facility are physically and technically
6692488 suitable. Upon a finding that a proposed medica l marijuana waste
6702489 disposal facility is not physically or technically suitable, the
6712490 Authority shall deny the license . The Authority may, upon
6722491 determining that public health or safety requires emer gency action,
6732492 issue a temporary license for treatment or sto rage of medical
6742493 marijuana waste for a period not to exceed ninety (90) days. The
6752494 Authority shall not, for the first yea r of the licensure program,
6762495 issue more than ten medical marijuana waste disp osal licenses. Upon
6772496 the conclusion of the first year, the A uthority shall assess the
6782497 need for additional medical marijuana waste disposal licenses and
6792498 shall, if demonstrated, incr ease the number of licenses as deemed

7732642 insurance shall be maintained for the period of operation of the
7742643 facility and shall provide coverage for damages resulting from

7872681 additional unannounced, on-site inspections beyond an annual
7882682 inspection. The Authority may refer all complaints alleging

7942685 E. The Authority shall i ssue an annual permit for each medical
7952686 marijuana waste dispo sal facility operated by a license e. A permit
7962687 shall be issued only upon proper app lication by a licensee and
7972688 determination by the Authority that t he proposed site and facility
7982689 are physically and technically suitable. Upon a finding that a
7992690 proposed medical marijuana waste disposal facilit y is not physically
8002691 or technically suitable, the Authority shall deny the permit . The
8012692 Authority shall have the a uthority to revoke a permit upon a finding
8022693 that the site and facility are not physically and technically
8032694 suitable for processing. The Authority may, upon determining that
8042695 public health or saf ety requires emergency action, issue a temporary
8052696 permit for treatment or storage of medical marijuana waste for a
8062697 period not to exceed ninety (90) days.

8242738 this title, shall utilize a licensed medical marijuana waste

8282741 I. The State Commissioner o f Health shall promulgate rules for
