142146 SECTION 1. AMENDATORY 59 O.S. 2021, Section 4200.2, is

175+Section 4200.2. As used in the Massage Therapy Practice Act:
171176 1. “Board” means the State Board of Cosmetology and Barbering;
172177 2. “Direct access” means the ability that the public has to
173178 seek out treatment by a massage therapist without the direct
174179 referral from a medical or health care p rofessional;
175180 3. “Massage therapist” means an individual who practices
176181 massage or massage therapy and is licensed under pursuant to the
177182 Massage Therapy Practice Ac t. A massage therapist uses visua l,
178183 kinesthetic, and palpatory skills to assess the body and may
179184 evaluate a condition to the extent of determi ning whether massage is
180185 indicated or contraindicated;
181186 4. “Massage therapy” means the skillful treatment of the s oft
182187 tissues of the human body. Ma ssage is designed to promote g eneral
183188 relaxation, improve mo vement, relieve somatic and muscular pain or
184189 dysfunction, stress and muscle tension, provide for general health
185190 enhancement, personal growth, education and the org anization,
186191 balance and integration of the human body and include s, but is not
187192 limited to:
188193 a. the use of touch, pressu re, friction, stroking,
189194 gliding, percussion, kneading, movement, positioning,
190195 holding, range of motion and nonspecific stretching
191196 within the normal anatomical range of movem ent, and
192197 vibration by manual o r mechanical means with or
193-without the use of massage devices that mimic or
194-enhance manual measures, and

222228 for thermal therapy, water, lub ricants, abrasives and
223229 external application of herbal or topical preparations
224230 not classified as prescription drugs; and
225231 5. “Massage therapy establishment” means any fixed business
226232 location, address, building, or property where a person engage s in,
227233 conducts, carries on, or permits the prac tice of massage therapy.
228234 The definition exclu des offices or workplaces of licensed health
229235 care professionals exempted from the provisions of the Massage
230236 Therapy Practice Act;
231237 6. “Massage therapy school” means a facility providing
232238 instruction in massage t herapy;
233239 7. “Person” means an individual, partner ship, limited liability
234240 company, corporation, or association, unless the context otherwise
235241 requires;
236242 8. “Poses a reasonable threat” means the nature of criminal
237243 conduct for which the person was con victed involved an act or threat
238244 of harm against another and has a b earing on the fitness or ability
239245 to serve the public or work with others in the occupation; and
240246 9. “Substantially relates” means the nature of crim inal conduct
241247 for which the person was convicted, or to which the pers on pleaded,
242248 has direct bearing on the f itness or ability to perform one or more
243-of the duties or responsibilities necessarily related to the
244-occupation.

271278 SECTION 2. AMENDATORY 5 9 O.S. 2021, Section 4200.3, is
272279 amended to read as follows:
273280 Section 4200.3. A. Unless a person is a licensed as a massage
274281 therapist by the State Board of Cosmetology and Barbering, a person
275282 shall not:
276283 1. Practice massage therapy in this state for remuneration;
277284 2. Use the title of massa ge therapist;
278285 2. 3. Represent himself or herse lf to be a massage therapist;
279286 3. 4. Use any other title, words, abbreviations, let ters,
280287 figures, signs or devices that indic ate the person is a massage
281288 therapist; or
282289 4. 5. Utilize the terms “massage”, “massage therapy” or
283290 “massage therapist” when advertising or printing promotional
284291 material.
285292 B. A person shall not maintain, manage or o perate a massage
286293 therapy school offering e ducation, instruction or training in
287294 massage therapy unless the school is a licensed massage therapy
288295 school pursuant to Section 7 of this act 4200.7 of this title.
289296 C. Individuals practicing massage therapy under t he Massage
290297 Therapy Practice Act shall not perform any of the following:
291298 1. Diagnosis of illness or disease;
292299 2. High-velocity, low-amplitude thrust;
293-3. Electrical stimulation;
294-4. Application of ultrasound;

322330 6. Prescribing of medici nes.
323331 D. No person shall own or operate a massage therapy
324332 establishment without first obtaining an establishment license from
325333 the Board.
326334 E. Nothing in the Massage The rapy Practice Act shall be
327335 construed to prevent :
328336 1. Qualified members of other recognize d professions who are
329337 licensed or regulated under pursuant to Oklahoma law from rend ering
330338 services within the scope of the license of the perso n, provided the
331339 person does not represent himself or herself as a massa ge therapist.
332340 A physician or other licens ed health care provider providing health
333341 care services within the scope of practice of the physician or
334342 provider shall not be required to be li censed by or registered with
335343 the State Board of Cosmetology and Barberi ng;
336344 2. Students from rendering massage th erapy services within the
337345 course of study when enrolled at a licensed massage therap y school;
338346 3. Visiting massage therapy instructors from ano ther state or
339347 territory of the United States, the District of Columbia or any
340348 foreign nation from teaching massag e therapy, provided the
341349 instructor is duly licensed or registered, if required, and is
342-qualified in the instructor ’s place of residence for the practice of
343-massage therapy;

377+qualified in the instructor ’s place of residence for the practice of
378+massage therapy;
370379 4. Any nonresident person holding a curr ent license,
371380 registration or certification in massage therapy from another state
372381 or recognized national certification system d etermined as acceptable
373382 by the Board when temporarily prese nt in this state from pr oviding
374383 massage therapy services as a part of a n emergency response team
375384 working in conjunction with disaster relief officials or at special
376385 events such as conventions, spor ting events, educational field
377386 trips, conferences, travelin g shows or exhibitions , as long as the
378387 services are not open to the gen eral public;
379388 5. Physicians or other healt h care professionals from
380389 appropriately referring to duly licensed massage therapist s or limit
381390 in any way the right of direct access of the pub lic to licensed
382391 massage therapists; or
383392 6. The practice of any person i n this state who uses touch,
384393 words and directed movement to deepen awareness of existing patterns
385394 of movement in the body as w ell as to suggest new possibilities of
386395 movement while engag ed within the scope of p ractice of a profession
387396 with established standa rds and ethics, provided that the services
388397 are not designated or implied to be massage or massage therapy.
389398 Practices shall include but are not limi ted to the Feldenkrais
390399 Method of somatic education, Rolf Move ment Integration by the Rolf
391400 Institute, the Trager Approach of movement education, and Bo dy-Mind
392-Centering. Practitioners shall be recognized by or meet the
393-established standards of either a pro fessional organization or

428+Centering. Practitioners shall be recognized by or meet the
429+established standards of either a pro fessional organization or
420430 credentialing agency that represent s or certifies the respective
421431 practice based on a minimal level of training, demonstratio n of
422432 competency, and adherence to ethical standards.
423433 E. F. A physician or other lic ensed health care provide r
424434 providing health care services w ithin their scope of pra ctice shall
425435 not be required to be licensed or r egistered with the State Board of
426436 Cosmetology.
427437 SECTION 3. AMENDATORY 59 O.S. 2021, Section 4200.4, i s
428438 amended to read as follows:
429439 Section 4200.4. A. The State Board of Cosmetology a nd
430440 Barbering is hereby authorized to adopt and promulgate rules
431441 pursuant to the Administr ative Procedures Act that are necessary for
432442 the implementation and enforcement of th e Massage Therapy Practic e
433443 Act, including, but not limited to, qualifications for l icensure,
434444 renewals, reinstatements, temporary work permits, inspection of
435445 establishments, and continuing education requirements.
436446 B. The State Board of Cosmetology and Barbering is hereby
437447 empowered to perform investigations, to requ ire the production of
438448 records and other documents relating to practices regulated by the
439449 Massage Therapy Practice Act, and to seek injunctive relief in a
440450 court of competent jurisdiction without bon d.
441-C. There is hereby created an Advisory Board on Massage
442-Therapy. The Advisory Board on Massage Therapy shall assist the
443-Board in carrying out the provision s of this section regarding the

478+C. There is hereby created an Advisory Board on Massage
479+Therapy. The Advisory Board on Massage Therapy shall assist the
480+Board in carrying out the provision s of this section regarding the
470481 qualifications, examination, r egistration, regulation, and stand ards
471482 of professional conduct of massage therapists. The Ad visory Board
472483 on Massage Therapy shall consist of five (5) members to be appointed
473484 by the Governor for four-year terms as follows:
474485 1. Three members who shall be li censed massage therapists and
475486 have practiced in Oklahoma for not less than three (3) years pr ior
476487 to their appointment ;
477488 2. One member who shall be an administrator or faculty member
478489 of a nationally accredited school of massage therapy; and
479490 3. One who shall be a citizen member.
480491 D. The fee for any license issued between the effective date of
481492 this act and May 1, 2017, sha ll be Twenty-five Dollars ($25.00).
482493 1. The Board shall establish a schedule of reasonable and
483494 necessary administrative fees.
484495 2. The initial fee or renewal fee for any a massage therapy
485496 license issued after May 1, 2017, shall be Fifty Dollars ($50.00)
486497 Twenty-five Dollars ($25.00) per year. The initial fee or renewal
487498 fee for a massage therapy establishment license shall be Thirty
488499 Dollars ($30.00) per year. A duplicate license fee shall be Ten
489500 Dollars ($10.00) Five Dollars ($5.00) .
490-SECTION 4. NEW LAW A new section of law to be codified
491-in the Oklahoma Statutes as Section 4200.4.1 of Title 59, unless
492-there is created a duplication in number ing, reads as follows:

528+SECTION 4. NEW LAW A new section of law to be codified
529+in the Oklahoma Statutes as Section 4200.4.1 of Title 59, unless
530+there is created a duplication in number ing, reads as follows:
519531 A. The State Board of Cosmetology and Barbering shall have
520532 authority to issue original licenses and t emporary work permits as
521533 provided in the Massage Therapy Practice Act.
522534 B. The Board may deny or place probationary conditions on a n
523535 original massage therapist license or temporary work permit if the
524536 applicant:
525537 1. Has pleaded guilty, nolo contendere , or been convicted of a
526538 crime that substantially relates to the practice of massage therapy
527539 and that poses a reasonable th reat to public health or safety;
528540 2. Has had a license or permit denied or has been th e subject
529541 of disciplinary action in another jurisdiction and if the gro unds
530542 for the denial or disciplinary action would constitute cause for
531543 denial or disciplinary action un der the Massage Therapy Practice Act
532544 or the Board’s rules;
533545 3. Has previously held a license or permit revoked by the Board
534546 or has been the subject of dis ciplinary action by the Board; or
535547 4. Attempts to obtain the license or permit by means of fraud,
536548 misrepresentation, deceit, or concealment of material facts.
537549 C. The Board may deny or place probationary conditions on an
538550 original massage therapy establishment license if the applicant:
539-1. Has pleaded guilty, nolo contendere, or been convicted of a
540-crime that substantially relates to the ownership, operation, or
541-management of a massage therapy establishment and that poses a
542-reasonable threat to public health or safety;

580+management of a massage therapy establishment and that poses a
581+reasonable threat to public health or safety;

570583 of disciplinary action in an other jurisdiction and if the grounds
571584 for the denial or disciplinary action would constitute cause for
572585 denial or disciplinary action un der the Massage Therapy Practice Act
573586 or the Board’s rules;
574587 3. Has previously held a license or permit revoked by the Board
575588 or has been the subject of disciplinary action by the Board; or
576589 4. Attempts to obtain the lice nse or permit by means of fraud,
577590 misrepresentation, deceit, or concealment of material facts.
578591 D. The Board may require an applicant for an original massage
579592 therapist license, a temporary permit, or an original establishment
580593 license to submit to a national criminal history record check as
581594 defined in Section 15 0.9 of Title 74 of the Oklahoma Sta tutes. The
582595 costs associated with the national criminal history record check
583596 shall be paid by the applicant.
584597 SECTION 5. AMENDATORY 59 O.S. 2 021, Section 4200.5, is
585598 amended to read as follows:
586599 Section 4200.5. A. Between the effective date of this act and
587600 May 1, 2017, the State Board of Cosmetology and Barbering shall
588601 issue a license to practice massage therapy to any person wh o files
589-a completed application, accompanied by the required fe es, and who
590-submits satisfactory evidence that the applicant:
591-1. Is at least eighteen (18) years of age;
592-2. Has one or more of the foll owing:

629+a completed application, accompanied by the required fe es, and who
630+submits satisfactory evidence that the applicant:
631+1. Is at least eighteen (18) years of age;
632+2. Has one or more of the foll owing:
619633 a. documentation that the applicant has completed and
620634 passed a nationally recognized competency examination
621635 in the practice of massage therapy,
622636 b. an affidavit of at least five (5) years of work
623637 experience in the state, or
624638 c. a certificate and trans cript of completion from a
625639 massage school with at least five hundred (500) hours
626640 of education;
627641 3. Provides proof of do cumentation that the applicant currently
628642 maintains liability insurance for practice as a massage therapist;
629643 and
630644 4. Provides full disclos ure to the Board of any criminal
631645 proceeding taken agains t the applicant including but not limited to
632646 pleading guilty or nolo contendere to, or receiving a conviction
633647 for, a felony crime that substantially relates to the practice of
634648 massage therapy and pose s a reasonable threat to public safety.
635649 B. To assist in determining the entry-level competence of an
636650 applicant who makes application for a license after May 1, 2017, the
637651 Board may adopt rules establishing additional standards or criteria
638-for examination acceptance and may adopt only those examinations
639-that meet the standards outlined in Section 4200.8 of this title.
640-C. 1. After May 1, 2017, except Except as otherwise provided
641-in the Massage Therapy Practice Act, every person desiring to

725741 2. “Poses a reasonable threat ” means the nature of criminal
726742 conduct for which th e person was convicted involved an act or threat
727743 of harm against another and has a bearing on the fitness or ability
728744 to serve the public or wo rk with others in the occupation.
729745 SECTION 6. NEW LAW A new section of law to be codified
730746 in the Oklahoma Statutes as Section 4200.5.1 of Title 59, unless
731747 there is created a duplication in numbering, reads as follows:
732748 A. No person shall own or operate a massage therapy
733749 establishment without obtaining a massage therapy establishment
734750 license from the State Board of Cosmetology and Barbering.
735751 B. The Board may issue an original massage therapy

775792 C. All massage therapy establishments shall be subject to
776793 inspection by the Board and shall comply with all provisions of the
777794 Massage Therapy Practice Act and rules of the Board. An inspection
778795 by the Board of a massage therapy establishment licensed to practice
779796 in a massage therapist’s private residence shall be limited to the
780797 spaces where massage therapy is practiced.
781798 D. Massage therapy establishment licenses shall be renewed
782799 biannually. The renewal date shall be established by the Board
783800 through adoption of a rule.
784801 E. A licensee may renew a massage therapy license by:
785802 1. Submitting a compl eted renewal application on a form
786803 prepared by the Board;
787804 2. Tendering the required renewal f ee;
788-3. Disclosing any plea of guilty, nolo contendere, or

828846 SECTION 8. AMENDATORY 59 O.S. 2021, Section 4200.7, is

830848 Section 4200.7. A. A person shall not advertise, maintain,
831849 manage or operate a massage therapy school unless the school is
832850 licensed by the Oklahoma Board of Pri vate Vocational Schools or is a
833851 technology center school accredited by the State Board of Career and
834852 Technology Education .
835853 B. A person shall not instruct as a m assage therapist unless

885904 of the thirty-day grace period, the license shall be placed on
886905 inactive status for a period not to exceed one (1 ) year. At the end
887-of one (1) year, if the license has not been reactivated, it shall

10221044 SECTION 12. AMENDATORY 59 O.S. 2021, Section 4200.10, is
10231045 amended to read as follows:
10241046 Section 4200.10. A. The Massage Therapy Pra ctice Act shall
10251047 supersede preempt all ordinances or regulations regulating massage
10261048 therapists and massage therapy estab lishments in any city, county,
10271049 or political subdivision.
10281050 B. This section shall not affect the regulations of a city,
10291051 county or a political subdivision relating to zoning requirements ,
10301052 general health and safety, or occupational license fees pertaining
10311053 to health care professions.
10321054 SECTION 13. AMENDATORY 59 O.S. 2021, Section 420 0.11, is

10721095 conduct or committed a violation of rule or law.
10731096 C. Disciplinary proceedings may be instituted by sworn the
10741097 filing of a complaint of any person, including members of the Board,
10751098 and shall conform to the provisions of the Administrative Procedures
10761099 Act. The Board shall conduct investigations in the same m anner and
10771100 according to the same terms as provided in the Oklahoma Cosmetology
10781101 and Barbering Act. Records and information obtained in connection
10791102 with an investigation of alleged violations shall be con fidential in
10801103 the same manner as provided in the Oklahoma Cosmetology and
10811104 Barbering Act and rules of the Board. However, in formation obtained
10821105 in the course of an investigation shall be made available to the
10831106 appropriate law enforcement or regulatory agency.

11191143 F. The surrender or expiration of a license shall no t deprive
11201144 the Board of jurisdiction to proceed wit h disciplinary action.
11211145 G. The Board may assess an administrative fine not to exceed
11221146 Two Hundred Fifty Dollars ($250.00) for each violation of the
11231147 Massage Therapy Practice Act or rule s of the Board. Each day a
11241148 violation continues shall constitute a separa te offense. Failure to
11251149 pay a citation that has been upheld by the Board shall constitute a
11261150 continued or flagrant violation of the Board’s rules, such that the
11271151 Board may refuse to renew the related license or issue an original
11281152 license where the individual cited is unlicensed unless and u ntil
11291153 the citation is paid.
11301154 H. The Board may issue field c itations in enforcement of the
11311155 Massage Therapy Practice Act. Field citations may require the
11321156 performance of an acti on and impose fines. Such citations shall
11331157 provide notice of a hearing as provided for in this section.
1134-However, a person who receives a citation may waive the hearing and
1135-pay the fine. Payment of the fine s hall constitute acknowledgement
1136-of the violation and may be considered in any future disciplinary
1137-actions by the Board.

11701195 imprisonment in the county jail for not more than thirty (30) days,
11711196 or both such fine and imprisonment, for any person, firm, or
11721197 corporation in this state to:
11731198 1. Operate or attempt to operat e a massage therapy
11741199 establishment without having obtained a massage therapy
11751200 establishment license from the State Board of Cosmetology and
11761201 Barbering;
11771202 2. Practice massage therapy without having obtained a massage
11781203 therapist license from the Board;
11791204 3. Permit any person in one ’s employ, supervision, or control
11801205 to practice massage therapy unless that person has obtained an
11811206 appropriate license from the Board;
11821207 4. Willfully violate any rule promulgated by the Board for the
11831208 operation of a massage therapy establishment; or
1184-5. Violate any of the provisions of the Massage Therapy
1185-Practice Act.
1186-B. The Board shall have the aut hority to levy administrative
1187-fines not to exceed Two Hundred Fifty Dollars ($250.00) for persons

12201246 of Title 59 of the Oklahoma Statutes while such persons are engaged
12211247 in the proper dischar ge of their professional duties.
12221248 SECTION 15. REPEALER 59 O.S. 2021, Sections 4200.8 and
12231249 4200.13, are hereby repealed.
12241250 SECTION 16. This act shall become effective Novem ber 1, 2022.
