38	39		An Act relating to home inspections; amending 59 O.S.
39	40		2021, Section 858-622, which relates to definitions;
40	41		expanding definition; allowing for pricing options
41	42		for services provided by home inspectors; and

48	49		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
49	50		SECTION 1. AMENDATORY 59 O.S. 2021, Section 858 -622, is
50	51		amended to read as follows:
51	52		Section 858-622. As used in the Home Inspection Licensing Act:
52	53		1. "Board" means the Construction Industries Board;
53	54		2. "Committee" means the Committee of Home Inspector E xaminers;
54	55		3. "Home inspection" means a visual examination of any or all
55	56		of the readily accessible phys ical real property and improvements to
56	57		real property consisting of four or fewer dwelling units , including
57	58		structural, lot drainage, roof, electrical, pl umbing, heating and
58	59		air conditioning and such other areas of concern as ar e specified in
59	60		writing to determine if performance is as intended;
60	61		4. "Home inspection report" means a written opinion of the
61	62		functional and physical condition of property written by the

88	90		licensed home inspector pursuant to home inspection . The inspection
89	91		report may include a cost estimate, or a range of estimated costs,
90	92		to correct any defect. Additional inspection services provided
91	93		beyond or outside the scope of the standards of practi ce, as
92	94		established by the Constructions Industries Board , shall be a
93	95		contractual matter between the parties. Additional services may
94	96		include a determination of the cost or a range of estimated cost s to
95	97		correct any defect; and
96	98		5. "Home inspector" means an individual licensed pursuant to
97	99		the Home Inspection Licens ing Act who, for compe nsation, conducts
98	100		home inspections.
99	101		SECTION 2. It being immediately necessary for the pr eservation
100	102		of the public peace, health or safety, an emergency is hereby
101	103		declared to exist, by reason whereof this act shall take effect and
102	104		be in full force from and after its passage and approval.
