8181 BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
8282 SECTION 1. NEW LAW A new section of law to be codified
8383 in the Oklahoma Statutes as Section 563.1 of Title 47, unless there
8484 is created a duplication in numbering, reads as follows:
8585 A. As used in this section:
8686 1. “Commission” means the Oklahoma Tax Commission;
8787 2. “Director” means the Executive Director of the Oklahoma
8888 Motor Vehicle Commission; and
8989 3. “Open recall” means a safety recall applicable to a specific

143143 repaired.
144144 B. The Oklahoma Motor Vehicle Commission shall, prior to
145145 issuing a motor vehicle registration or mailing a motor vehicle
146146 registration renewal notice, check information made available by the
147147 National Highway Traffic Safety Administration to determine whether
148148 the motor vehicle is subject to an open recall. For a vehicle that
149149 is subject to one or more open recalls, the Comm ission shall provide
150150 the owner of the motor vehicl e written notice of all open recalls
151151 applicable to the motor vehicle. The recall notice shall be
152152 provided at the time the vehicle is registered, except that for
153153 registrational renewals, t he recall notice shall be included in the
154154 registration renewal notic e. The recall notice shall include the
155155 following:
156156 1. A description of each open recall ;
157157 2. A statement that each open recall may be repaired by a motor
158158 vehicle dealer approv ed by the manufacturer of the motor vehicle at
159159 no cost to the owner of the motor vehicle, except as provided in 49
160160 U.S.C., Section 30120; and
161161 3. A statement that, except as provided in subsection D or E of
162162 this section, the Commission shall not issue a registration
163163 certificate for a motor vehicle until each open recall is repaired
164164 in compliance with the p rovision of subsection C of this section.

216216 C. Notwithstanding any provision of law, after an owner of a
217217 motor vehicle receives notice that the moto r vehicle is subject to
218218 one or more open recalls pursuant to subsection B of this section,
219219 the owner shall obtain the necessary repairs b efore the motor
220220 vehicle’s next registration renewal. It shall be the responsibility
221221 of the owner to submit proof, in a manner determined by the
222222 Director, that the repairs needed to address all open recalls have
223223 been made. The Direct or shall deny an application for registration
224224 renewal for any motor v ehicle that has failed to receive repairs
225225 necessary to remedy an open recall within the time peri od
226226 established by this section.
227227 D. The Director shall extend for six-month intervals, the
228228 registration of a mot or vehicle subject to an open recall for which
229229 parts or equipment to repair the open recall are unavailable.
230230 E. The Director may, at the Director ’s discretion, extend the
231231 registration of a motor vehicle subject to an open recall for a
232232 period not to exceed one six-month period if the owner of the motor
233233 vehicle fails to repair the motor vehicle due to cir cumstances
234234 beyond the control of the owner or due to u ndue hardship.
235235 F. Nothing in this section shall alt er the liability under law
236236 of any motor vehicle manufacturer or motor vehicle dealer approved
237237 by the manufacturer to repair an open re call.
238238 G. The Director and employees of the Commission who are
239239 designated by the Director, for the purposes of discharging their

291291 duties pursuant to this section, shall not be liable to any person
292292 for any act or omission related to the open recall notice provided
293293 pursuant to this section, except for cases of gross negligence.
294294 SECTION 2. This act shall become e ffective November 1, 2022.
