81	81	BE IT ENACTED BY THE PEOPLE OF TH E STATE OF OKLAHOMA:
82	82	SECTION 1. NEW LAW A new section of law to be codified
83	83	in the Oklahoma Statutes as Section 563.1 of Title 47, unless there
84	84	is created a duplication in numbering, reads as follows:
85	85	A. As used in this section:
86	86	1. “Commission” means the Oklahoma Tax Commission;
87	87	2. “Director” means the Executive Director of the Oklahoma
88	88	Motor Vehicle Commission; and
89	89	3. “Open recall” means a safety recall applicable to a specific
90	90	motor vehicle, according to information made available by the

143	143	repaired.
144	144	B. The Oklahoma Motor Vehicle Commission shall, prior to
145	145	issuing a motor vehicle registration or mailing a motor vehicle
146	146	registration renewal notice, check information made available by the
147	147	National Highway Traffic Safety Administration to determine whether
148	148	the motor vehicle is subject to an open recall. For a vehicle that
149	149	is subject to one or more open recalls, the Comm ission shall provide
150	150	the owner of the motor vehicl e written notice of all open recalls
151	151	applicable to the motor vehicle. The recall notice shall be
152	152	provided at the time the vehicle is registered, except that for
153	153	registrational renewals, t he recall notice shall be included in the
154	154	registration renewal notic e. The recall notice shall include the
155	155	following:
156	156	1. A description of each open recall ;
157	157	2. A statement that each open recall may be repaired by a motor
158	158	vehicle dealer approv ed by the manufacturer of the motor vehicle at
159	159	no cost to the owner of the motor vehicle, except as provided in 49
160	160	U.S.C., Section 30120; and
161	161	3. A statement that, except as provided in subsection D or E of
162	162	this section, the Commission shall not issue a registration
163	163	certificate for a motor vehicle until each open recall is repaired
164	164	in compliance with the p rovision of subsection C of this section.

216	216	C. Notwithstanding any provision of law, after an owner of a
217	217	motor vehicle receives notice that the moto r vehicle is subject to
218	218	one or more open recalls pursuant to subsection B of this section,
219	219	the owner shall obtain the necessary repairs b efore the motor
220	220	vehicle’s next registration renewal. It shall be the responsibility
221	221	of the owner to submit proof, in a manner determined by the
222	222	Director, that the repairs needed to address all open recalls have
223	223	been made. The Direct or shall deny an application for registration
224	224	renewal for any motor v ehicle that has failed to receive repairs
225	225	necessary to remedy an open recall within the time peri od
226	226	established by this section.
227	227	D. The Director shall extend for six-month intervals, the
228	228	registration of a mot or vehicle subject to an open recall for which
229	229	parts or equipment to repair the open recall are unavailable.
230	230	E. The Director may, at the Director ’s discretion, extend the
231	231	registration of a motor vehicle subject to an open recall for a
232	232	period not to exceed one six-month period if the owner of the motor
233	233	vehicle fails to repair the motor vehicle due to cir cumstances
234	234	beyond the control of the owner or due to u ndue hardship.
235	235	F. Nothing in this section shall alt er the liability under law
236	236	of any motor vehicle manufacturer or motor vehicle dealer approved
237	237	by the manufacturer to repair an open re call.
238	238	G. The Director and employees of the Commission who are
239	239	designated by the Director, for the purposes of discharging their

292	292	for any act or omission related to the open recall notice provided
293	293	pursuant to this section, except for cases of gross negligence.
294	294	SECTION 2. This act shall become e ffective November 1, 2022.
