61	87		BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
62	88		SECTION 1. AMENDATORY 2 O.S. 2021, Section 6 -604, is
63	89		amended to read as fo llows:
64	90		Section 6-604. A. Except as otherwise specified in the Feral
65		-	Swine Control Act, any person with written permission of the owner
66		-	may remove feral swine from private or public prop erty during
67		-	daylight hours or at night. Any person who removes or attempts to

100	150		swine at night shall obtain a permit issued by the D epartment of
101	151		Wildlife Conservatio n pursuant to Section 4-135 of Title 29 of the
102	152		Oklahoma Statutes and promulgat ed rules Any person who removes or
103	153		attempts to remove feral swine pursuant to this section may use a
104	154		motor-driven land conveyance to pursue or fo llow feral swine, may
105	155		use a vehicle-mounted spotlight or other powerful light also known
106		-	as a headlight, and may use night-vision equipment that uses either
	156	+	as a headlight and may use night-vision equipment that uses either
107	157		image-enhancement technology or thermal -imaging technology.
108	158		SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -135, is
109	159		amended to read as follows:
110	160		Section 4-135. A. The Department of Wildlife Conservation is
111	161		authorized to issue permits to landowner s, lessees, or their
112	162		designated agents and to any entity of state, county, or local
113	163		government to control nuisance or damage by any spe cies of wildlife
114	164		including, but not limited to beaver, coyote, deer, bobcat, raccoon,
115	165		and crow under rules promulgated by the Oklahoma Wildlife
116	166		Conservation Commission. The permits may be issued wit hout
117	167		limitation by statewid e season regulations, bag limi ts or methods of
118	168		taking. A permitted landowner, lessee or a designated agent of the

	220	+	landowner or lessee may, with a vali d permit issued pursuant to this
147	221		section, control the wildlife specified in th is subsection and feral
148	222		swine at night to protect marketa ble agricultural crops, livestock,
149	223		or processed feed, seed or other materials used in the production of
150	224		an agricultural commodity.
151	225		B. Except as otherwise specified in this subsection, the permit
152	226		to hunt at night shall be valid for a period of up to one (1 ) year
153	227		from the date the permit was issued. Each landowner, lessee, or
154	228		designated agent with a valid permit shall be req uired to have a
155	229		current agricultural exemption permit issued by the Oklahoma T ax
156	230		Commission.
157	231		C. Notwithstanding the provisions of Sect ion 5-203.1 of this
158	232		title, a landowner, lessee, or designated agent of the landowner or
159	233		lessee with a valid permit may us e a headlight carried on the person
160	234		while hunting at night. Nothing in this s ection shall authorize the
161	235		use of a headlight mounted on a vehicle or the use of a headlight
162	236		from a public roadway.
163	237		D. Any person who has been convicted of, or pled guilty to, a
164	238		violation of Section 5 -203.1 or Section 5-411 of this title within
165	239		the previous three (3) years shall no t be eligible to receive a
166	240		permit pursuant to this section. The permit can may be issued by
167	241		the local game warden in the county for which the permit i s to be
168	242		used or by the Law Enforcement Division of the Department of
169	243		Wildlife Conservation.

197	295		E. Notwithstanding the provisions of Secti on 1289.13 of Title
198	296		21 of the Oklahoma Statutes, it shall be lawful for any private
199	297		landowner or designated employee of t he landowner or lessee to have
200	298		a chamber-loaded firearm on property owned by t he landowner, and to
201	299		use the firearm for the purpose of c ontrolling nuisance or damage by
202	300		any wildlife or feral swine. Nothing in this section shall
203	301		authorize any convicted felo n to carry a firearm.
204	302		SECTION 3. AMENDATORY 29 O.S. 2021, Section 5-203.1, is
205	303		amended to read as follows:
206	304		Section 5-203.1. A. No person may attempt to take, take,
207	305		attempt to catch, catc h, attempt to capture, capture, attempt to
208	306		kill, or kill any deer, feral animal or other wildlife except fish
209		-	and, frogs, and feral swine as provided for in Section 6 -604 of
210		-	~~Title~~ 2 of the Oklahoma Statutes, by the use of a vehicle mounted
	307	+	and, frogs and feral swine as provided for in Section 6 -604 of Title
	308	+	2 of the Oklahoma Statutes, by the use of a vehicle mounted
211	309		spotlight or other powerful light at night, by what is commonly
212	310		known as “headlighting”. Provided, however, nothing in this section
213	311		shall prevent one from possessing a .22 caliber rimfire rifle or .22
214	312		pistol and a light carried while in pursuit of furbearers with
215	313		hounds during the legal, open furbearers season, while possessing a
216	314		valid hunting license.
217	315		B. Any person may use a shotgun, using No. 6 size shot or
218	316		smaller, longbow, light and a call f or the purpose of hunting
219	317		predatory animals, provided that written permission is obtained from
220	318		the local game warden for each twenty -four-hour period of hunting.

248	370		C. It shall be illegal to hunt from a boat with a firearm from
249	371		sunset until one-half (1/2) hour before sunrise. This shall not
250	372		pertain to hunting of waterfowl enroute from bank to blind with
251	373		unloaded shotguns.
252	374		D. Except as otherwise provided for in this se ction and except
253	375		when removing feral swine as provided for in Section 6 -604 of Title
254	376		2 of the Oklahoma Statutes, no person may harass, attempt to
255	377		capture, capture, attempt to take or take, kill or attempt to kill
256	378		any wildlife or feral swine with the aid of any motor -driven land,
257	379		air or water conveyance. A nonambulatory person may hunt from said
258	380		conveyances with written perm ission of the Director of Wildlife
259	381		Conservation. A person may hunt from an air conveyance if issued a
260	382		permit pursuant to Section 1 of this act 4-107.2 of this title.
261	383		Nothing in this section shall prevent the use of motor -driven land
262	384		or water conveyances for following dogs in the act of hunting, when
263	385		use is restricted to public roads or waterways. Motor -driven land
264	386		or water conveyances may be used on pri vate property for follo wing
265	387		dogs in the act of hunting with the permissio n of the landowner or
266	388		occupant.
267	389		E. Employees of the Oklahoma Department of Agriculture, Food,
268	390		and Forestry Wildlife Services Division and the United States
269	391		Department of Agriculture Wildlife Services while engaged in
270	392		wildlife management activities for the protection of agriculture,

298	444		property, human health a nd safety and natural resources shall be
299	445		exempt from the provisions of this section.
300	446		F. Any person convicted of violating the prov isions of this
301	447		section shall be guilty of a misdemeanor and shall be puni shed by a
302	448		fine of not less than Two Hundred Fifty Do llars ($250.00) for a
303	449		first offense and not less than Five Hundred Dollars ($500.00) for a
304	450		second offense or by imprisonment in the county jail for not le ss
305	451		than ten (10) days nor more than one (1) year, or by confiscation
306	452		pursuant to Section 5 -402 of this title or by such fine,
307	453		imprisonment and confiscation.
308	454		SECTION 4. REPEALER 2 O.S. 2021, Section 6-605, is
309	455		hereby repealed.
310	456		SECTION 5. This act shall become effecti ve November 1, 2022.
