6187 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
6288 SECTION 1. AMENDATORY 2 O.S. 2021, Section 6 -604, is
6389 amended to read as fo llows:
6490 Section 6-604. A. Except as otherwise specified in the Feral
65-Swine Control Act, any person with written permission of the owner
66-may remove feral swine from private or public prop erty during
67-daylight hours or at night. Any person who removes or attempts to
68-remove feral swine pursuant to this section shall not be required to

99149 B. Any person who intends to kill or attempt to kill feral
100150 swine at night shall obtain a permit issued by the D epartment of
101151 Wildlife Conservatio n pursuant to Section 4-135 of Title 29 of the
102152 Oklahoma Statutes and promulgat ed rules Any person who removes or
103153 attempts to remove feral swine pursuant to this section may use a
104154 motor-driven land conveyance to pursue or fo llow feral swine, may
105155 use a vehicle-mounted spotlight or other powerful light also known
106-as a headlight, and may use night-vision equipment that uses either

107157 image-enhancement technology or thermal -imaging technology.
108158 SECTION 2. AMENDATORY 29 O.S. 2021, Section 4 -135, is
109159 amended to read as follows:
110160 Section 4-135. A. The Department of Wildlife Conservation is
111161 authorized to issue permits to landowner s, lessees, or their
112162 designated agents and to any entity of state, county, or local
113163 government to control nuisance or damage by any spe cies of wildlife
114164 including, but not limited to beaver, coyote, deer, bobcat, raccoon,
115165 and crow under rules promulgated by the Oklahoma Wildlife
116166 Conservation Commission. The permits may be issued wit hout
117167 limitation by statewid e season regulations, bag limi ts or methods of
118168 taking. A permitted landowner, lessee or a designated agent of the

220+landowner or lessee may, with a vali d permit issued pursuant to this
147221 section, control the wildlife specified in th is subsection and feral
148222 swine at night to protect marketa ble agricultural crops, livestock,
149223 or processed feed, seed or other materials used in the production of
150224 an agricultural commodity.
151225 B. Except as otherwise specified in this subsection, the permit
152226 to hunt at night shall be valid for a period of up to one (1 ) year
153227 from the date the permit was issued. Each landowner, lessee, or
154228 designated agent with a valid permit shall be req uired to have a
155229 current agricultural exemption permit issued by the Oklahoma T ax
156230 Commission.
157231 C. Notwithstanding the provisions of Sect ion 5-203.1 of this
158232 title, a landowner, lessee, or designated agent of the landowner or
159233 lessee with a valid permit may us e a headlight carried on the person
160234 while hunting at night. Nothing in this s ection shall authorize the
161235 use of a headlight mounted on a vehicle or the use of a headlight
162236 from a public roadway.
163237 D. Any person who has been convicted of, or pled guilty to, a
164238 violation of Section 5 -203.1 or Section 5-411 of this title within
165239 the previous three (3) years shall no t be eligible to receive a
166240 permit pursuant to this section. The permit can may be issued by
167241 the local game warden in the county for which the permit i s to be
168242 used or by the Law Enforcement Division of the Department of
169243 Wildlife Conservation.

197295 E. Notwithstanding the provisions of Secti on 1289.13 of Title
198296 21 of the Oklahoma Statutes, it shall be lawful for any private
199297 landowner or designated employee of t he landowner or lessee to have
200298 a chamber-loaded firearm on property owned by t he landowner, and to
201299 use the firearm for the purpose of c ontrolling nuisance or damage by
202300 any wildlife or feral swine. Nothing in this section shall
203301 authorize any convicted felo n to carry a firearm.
204302 SECTION 3. AMENDATORY 29 O.S. 2021, Section 5-203.1, is
205303 amended to read as follows:
206304 Section 5-203.1. A. No person may attempt to take, take,
207305 attempt to catch, catc h, attempt to capture, capture, attempt to
208306 kill, or kill any deer, feral animal or other wildlife except fish
209-and, frogs, and feral swine as provided for in Section 6 -604 of
210-Title 2 of the Oklahoma Statutes, by the use of a vehicle mounted
307+and, frogs and feral swine as provided for in Section 6 -604 of Title
308+2 of the Oklahoma Statutes, by the use of a vehicle mounted
211309 spotlight or other powerful light at night, by what is commonly
212310 known as “headlighting”. Provided, however, nothing in this section
213311 shall prevent one from possessing a .22 caliber rimfire rifle or .22
214312 pistol and a light carried while in pursuit of furbearers with
215313 hounds during the legal, open furbearers season, while possessing a
216314 valid hunting license.
217315 B. Any person may use a shotgun, using No. 6 size shot or
218316 smaller, longbow, light and a call f or the purpose of hunting
219317 predatory animals, provided that written permission is obtained from
220318 the local game warden for each twenty -four-hour period of hunting.

248370 C. It shall be illegal to hunt from a boat with a firearm from
249371 sunset until one-half (1/2) hour before sunrise. This shall not
250372 pertain to hunting of waterfowl enroute from bank to blind with
251373 unloaded shotguns.
252374 D. Except as otherwise provided for in this se ction and except
253375 when removing feral swine as provided for in Section 6 -604 of Title
254376 2 of the Oklahoma Statutes, no person may harass, attempt to
255377 capture, capture, attempt to take or take, kill or attempt to kill
256378 any wildlife or feral swine with the aid of any motor -driven land,
257379 air or water conveyance. A nonambulatory person may hunt from said
258380 conveyances with written perm ission of the Director of Wildlife
259381 Conservation. A person may hunt from an air conveyance if issued a
260382 permit pursuant to Section 1 of this act 4-107.2 of this title.
261383 Nothing in this section shall prevent the use of motor -driven land
262384 or water conveyances for following dogs in the act of hunting, when
263385 use is restricted to public roads or waterways. Motor -driven land
264386 or water conveyances may be used on pri vate property for follo wing
265387 dogs in the act of hunting with the permissio n of the landowner or
266388 occupant.
267389 E. Employees of the Oklahoma Department of Agriculture, Food,
268390 and Forestry Wildlife Services Division and the United States
269391 Department of Agriculture Wildlife Services while engaged in
270392 wildlife management activities for the protection of agriculture,

298444 property, human health a nd safety and natural resources shall be
299445 exempt from the provisions of this section.
300446 F. Any person convicted of violating the prov isions of this
301447 section shall be guilty of a misdemeanor and shall be puni shed by a
302448 fine of not less than Two Hundred Fifty Do llars ($250.00) for a
303449 first offense and not less than Five Hundred Dollars ($500.00) for a
304450 second offense or by imprisonment in the county jail for not le ss
305451 than ten (10) days nor more than one (1) year, or by confiscation
306452 pursuant to Section 5 -402 of this title or by such fine,
307453 imprisonment and confiscation.
308454 SECTION 4. REPEALER 2 O.S. 2021, Section 6-605, is
309455 hereby repealed.
310456 SECTION 5. This act shall become effecti ve November 1, 2022.
