4655 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
4756 SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.14, as
4857 last amended by Section 8, Chapter 584, O.S.L. 2021, is amended to
4958 read as follows:
5059 Section 427.14. A. There is hereby created the medical
5160 marijuana business license, which shall include the following
5261 categories:
5362 1. Medical marijuana commercial grower;
5463 2. Medical marijuana processor;
5564 3. Medical marijuana dispensary;
5665 4. Medical marijuana transporte r; and
57-5. Medical marijuana testing laboratory.
58-B. The Oklahoma Medical Marijuana Authority, with the aid of
59-the Office of Management and Enterprise Services, shall develop a
60-website for medical marijuana business applications.

93+5. Medical marijuana testing laboratory.
94+B. The Oklahoma Medical Marijuana Authority, with the aid of
95+the Office of Management and Enterprise Services, shall develop a
96+website for medical marijuana business applications.
8797 C. The Authority shall ma ke available on its website in an
8898 easy-to-find location, applications for a medical marijuana
8999 business.
90100 D. The nonrefundable application fee for a medical marijuana
91101 business license shall be Two Thousand Five Hundred Dollars
92102 ($2,500.00).
93103 E. All applicants seeking licensure as a medical marijuana
94104 business shall comply with the following general requirements:
95105 1. All applications for licenses and registrations authorized
96106 pursuant to this secti on shall be made upon forms prescribed by the
97107 Authority;
98108 2. Each application shall identify the city or cou nty in which
99109 the applicant seeks to obtain licensure as a medical ma rijuana
100110 business;
101111 3. Applicants shall submit a complete application to the
102112 Authority before the application may be accepted or considered;
103113 4. All applications shall be compl ete and accurate in e very
104114 detail;
105-5. All applications shall include all attachments or
106-supplemental information required by the forms supplied by the
107-Authority;
108-6. All applications shall be acco mpanied by a full remittance
109-for the whole amount of the application fees. Appli cation fees are
110-nonrefundable;

145+6. All applications shall be acco mpanied by a full remittance
146+for the whole amount of the application fees. Appli cation fees are

137148 7. All applicants shall be approved for licensing review that,
138149 at a minimum, meets the following criteria:
139150 a. all applicants shall be age twent y-five (25) years of
140151 age or older,
141152 b. any applicant applying as an individual sha ll show
142153 proof that the applicant is an Okl ahoma resident
143154 pursuant to paragraph 11 of this subsection,
144155 c. any applicant applying as an entity shall show that
145156 seventy-five percent (75%) of all members, manag ers,
146157 executive officers, partners, board members or any
147158 other form of business ownership are Oklahoma
148159 residents pursuant to paragraph 11 of this subsection,
149160 d. all applying individuals or ent ities shall be
150161 registered to conduc t business in this state,
151162 e. all applicants shall disclose all ownership interest s
152163 pursuant to the Oklahoma Medical Marijuana and Patient
153164 Protection Act, and
154-f. applicants shall not have been convicted o f a
155-nonviolent felony in the last two (2) years, and any
156-other felony conviction within the last five (5)
157-years, shall not be current inmates, or currently
158-incarcerated in a jail or corrections facility;
159-8. There shall be no limit to the number of medical marijuana
160-business licenses or categories that an in dividual or entity can

188200 shall require a separate application and application fee. A
189201 commercial grower, processor and dispensary, or any c ombination
190202 thereof, are authorized to share the same address or physical
191203 location, subject to the restrictions set forth in the Oklahoma
192204 Medical Marijuana and Patient Protection Act ;
193205 9. All applicants for a medical marijuana business license,
194206 research facility license or education facility license authorize d
195207 by the Oklahoma Medical Mari juana and Patient Protection Act shall
196208 undergo an Oklahoma criminal history background check conducted by
197209 the Oklahoma State Bureau of Investigation (OSBI) within thirty (30)
198210 days prior to the application for the license including:
199211 a. individual applicants applying on their own behalf,
200212 b. individuals applying on behalf of an entity,
201213 c. all principal officers of an entity, and
202214 d. all owners of an entity as d efined by Section 427.2 of
203215 this title;
204-10. All applicable fees charged by OSBI are the responsibility
205-of the applicant and shall not be higher than fees charged to any
206-other person or industry for such background checks;
207-11. In order to be consi dered an Oklahoma resident for purpo ses
208-of a medical marijuana business application, all applicants shall
209-provide proof of Oklahoma residency for at least two (2) years

243+10. All applicable fees charged by OSBI are the responsibility
244+of the applicant and shall not be higher than fees charged to any
245+other person or industry for such background checks;
246+11. In order to be consi dered an Oklahoma resident for purpo ses
247+of a medical marijuana business application, all applicants shall
248+provide proof of Oklahoma residency for at least two (2) years
249+immediately preceding the date of application or five (5) years of
237250 continuous Oklahoma residency during the preceding twent y-five (25)
238251 years immediately preceding the date of application. Sufficien t
239252 documentation of proof of residency shall include a combination of
240253 the following:
241254 a. an unexpired Oklahoma -issued driver license,
242255 b. an Oklahoma voter identification card,
243256 c. a utility bill preceding the date of application,
244257 excluding cellular telephone and Internet bills,
245258 d. a residential property deed to property in this state,
246259 and
247260 e. a rental agreement preceding the date of application
248261 for residential property located in this state.
249262 Applicants that were issued a medical ma rijuana business license
250263 prior to the enactment of the Oklahoma Medical Marijuana and Patient
251264 Protection Act are hereby exempt from the two-year or five-year
252265 Oklahoma residence requirement m entioned above;
253-12. All license applicants shall be required to s ubmit a
254-registration with the Oklahoma State Bureau of Narcotics and
255-Dangerous Drugs Control as provided in Sections 2-302 through 2-304
256-of this title;
257-13. All applicants shall establish their identity through
258-submission of a color copy or digital image o f one of the following
259-unexpired documents:
260-a. front and back of an Oklahoma driv er license,

293+12. All license applicants shall be required to s ubmit a
294+registration with the Oklahoma State Bureau of Narcotics and
295+Dangerous Drugs Control as provided in Sections 2 -302 through 2-304
296+of this title;
297+13. All applicants shall establish their identity through
298+submission of a color copy or digital image o f one of the following
299+unexpired documents:
300+a. front and back of an Oklahoma driv er license,
287301 b. front and back of an Oklahoma identification card,
288302 c. a United States passport or other photo identifica tion
289303 issued by the United States government,
290304 d. certified copy of the applicant ’s birth certificate
291305 for minor applicants who do not posse ss a document
292306 listed in this section, or
293307 e. a tribal identification card approved for
294308 identification purposes by the Oklahoma Department of
295309 Public Safety; and
296310 14. All applicants shall submit an applicant photograph.
297311 F. The Authority shall review the medi cal marijuana business
298312 application, approve or reject the applicat ion and mail the
299313 approval, rejection or status -update letter to the applicant within
300314 ninety (90) business day s of receipt of the applicatio n.
301-G. 1. The Authority shall review the medical m arijuana
302-business applications and conduct all investigations, in spections
303-and interviews before approving the app lication.
304-2. Approved applicants shall be issued a medical m arijuana
305-business license for the specific category applied under which shall
306-act as proof of their approved status. Rejection letters shall
307-provide a reason for the rejection. Applications ma y only be
308-rejected based on the applicant not meeting the stan dards set forth
309-in the provisions of this section, improper completion of the
310-application or for a reason provided for in the Oklahoma Medical

342+G. 1. The Authority shall review the medical m arijuana
343+business applications and conduct all investigations, in spections

338353 for failure to provide required information, the applicant shall
339354 have thirty (30) days to submit the required information for
340355 reconsideration. No additional application fee shall be charged for
341356 such reconsideration.
342357 3. Status-update letters shall provide a reason for delay in
343358 either approval or re jection should a situation ari se in which an
344359 application was submitted properly, but a delay in processing the
345360 application occurred.
346361 4. Approval, rejection or status -update letters shall be s ent
347362 to the applicant in the s ame method the application was subm itted to
348363 the Authority.
349364 H. A medical marijuana business license shall not b e issued to
350365 or held by:
351-1. A person until all required fees have been paid;
352-2. A person who has been convicte d of a nonviolent felony
353-within two (2) years of the date of applicat ion, or within five (5)
354-years for any other felony;
355-3. A corporation, if th e criminal history of any of its
356-officers, directors or stockholders indicates that the officer,
357-director or stockholder has been convicted of a nonviolent felony
358-within two (2) years of the date of application , or within five (5)
359-years for any other felon y;
360-4. A person under twenty-five (25) years of age;

389405 to:
390406 a. file taxes, interest or penalties due related to a
391407 medical marijuana business, or
392408 b. pay taxes, interest or penalties due related to a
393409 medical marijuana business;
394410 6. A sheriff, deputy sheriff, police officer or prosecuting
395411 officer, or an officer or employee of the Authority o r municipality;
396412 or
397413 7. A person whose authorit y to be a caregiver as defined in the
398414 Oklahoma Medical Marijuana and Patient Protection Act has been
399415 revoked by the Authority.
400-I. In investigating the qualifications of an applica nt or a
401-licensee, the Authority and municipalities may have access to
402-criminal history record information furnished by a criminal justice
403-agency subject to any restrictions imposed by such an agency. In
404-the event the Authority considers the criminal histo ry record of the
405-applicant, the Authority shall also consider any information
406-provided by the applicant regarding such criminal history record
407-including but not limited to evidence of rehabilitation, character
408-references and educational achievements, espec ially those items
409-pertaining to the period of time between the last criminal

438455 J. The failure of an applicant to provide the request ed
439456 information by the Authority dea dline may be grounds for denial of
440457 the application.
441458 K. All applicants shall subm it information to the Authority in
442459 a full, faithful, truthful and fair manner. The Authority may
443460 recommend denial of an application where t he applicant made
444461 misstatements, omissions, misrepresentati ons or untruths in the
445462 application or in connection with the background investigation of
446463 the applicant. This type of conduct may be considered as the ba sis
447464 for additional administrative action aga inst the applicant. Typos
448465 and scrivener errors shall not b e grounds for denial.
449466 L. A licensed medical marijuana bu siness premises shall be:
450-1. Be subject to and responsible for compliance with applicable
451-provisions for medical marijuana business facilities as d escribed in
452-the most recent versions of the Oklahoma Unif orm Building Code, the
453-International Building Code and the International Fire Code, unless
454-granted an exemption by the Authority or municipality ; and
455-2. Post conspicuous, easy-to-read signage at each licensed
456-property entrance with the medical marijuana business license number
457-and a telephone number accessible for the public to reach the
458-medical marijuana business license holder .

485503 M. All medical marijuana business licensees shall pa y the
486504 relevant licensure f ees prior to receiving licensure to operate a
487505 medical marijuana business, as defined in the Oklahoma Medical
488506 Marijuana and Patient Protection Act for each class of license.
489507 N. An original medical marijuana business license issued on or
490508 after June 26, 2018, by the Authority, for a medical marijuana
491509 commercial grower, a medical marijuana proces sor or a medical
492510 marijuana dispensary shall be deemed to have been grandfathered into
493511 the location on the date the original license was first issued for
494512 purposes of determining the autho rity of the business to conduc t and
495513 continue the same type of business at that location under a license
496514 issued by the Authority, except as may be provided in Sectio ns 425
497515 and 426.1 of this title. Any change in ownership after the original
498516 medical marijuana business license has been is sued by the Authority
499517 shall be construed by the Authority to be a continuation of the same
500-type of business originally licensed at tha t location. Nothing
501-shall authorize the Author ity to deny issuance or renewal of a
502-license or transfer of license due to a change in ownership for the
503-same business location previously licensed, except when a revocation
504-is otherwise authorized by law or a protest is made under the
505-municipal compliance provisions of Section 426.1 of this title.
506-SECTION 2. This act shall become effective November 1, 2022.
