47 | 56 | | SECTION 1. AMENDATORY 63 O.S. 2021, Section 427.14, as |

48 | 57 | | last amended by Section 8, Chapter 584, O.S.L. 2021, is amended to |
---|

50 | 59 | | Section 427.14. A. There is hereby created the medical |
---|
51 | 60 | | marijuana business license, which shall include the following |
---|
52 | 61 | | categories: |
---|
53 | 62 | | 1. Medical marijuana commercial grower; |
---|
54 | 63 | | 2. Medical marijuana processor; |
---|
55 | 64 | | 3. Medical marijuana dispensary; |
---|
56 | 65 | | 4. Medical marijuana transporte r; and |
---|
87 | 97 | | C. The Authority shall ma ke available on its website in an |
---|
88 | 98 | | easy-to-find location, applications for a medical marijuana |
---|
89 | 99 | | business. |
---|
90 | 100 | | D. The nonrefundable application fee for a medical marijuana |
---|
91 | 101 | | business license shall be Two Thousand Five Hundred Dollars |
---|
92 | 102 | | ($2,500.00). |
---|
93 | 103 | | E. All applicants seeking licensure as a medical marijuana |
---|
94 | 104 | | business shall comply with the following general requirements: |

95 | 105 | | 1. All applications for licenses and registrations authorized |
---|
96 | 106 | | pursuant to this secti on shall be made upon forms prescribed by the |
---|
97 | 107 | | Authority; |
---|
98 | 108 | | 2. Each application shall identify the city or cou nty in which |
---|
99 | 109 | | the applicant seeks to obtain licensure as a medical ma rijuana |
---|
100 | 110 | | business; |
---|
101 | 111 | | 3. Applicants shall submit a complete application to the |
---|
102 | 112 | | Authority before the application may be accepted or considered; |
---|
103 | 113 | | 4. All applications shall be compl ete and accurate in e very |
---|
104 | 114 | | detail; |
---|
137 | 148 | | 7. All applicants shall be approved for licensing review that, |
---|
138 | 149 | | at a minimum, meets the following criteria: |

139 | 150 | | a. all applicants shall be age twent y-five (25) years of |

141 | 152 | | b. any applicant applying as an individual sha ll show |

142 | 153 | | proof that the applicant is an Okl ahoma resident |

145 | 156 | | seventy-five percent (75%) of all members, manag ers, |
---|
146 | 157 | | executive officers, partners, board members or any |
---|
147 | 158 | | other form of business ownership are Oklahoma |
---|
148 | 159 | | residents pursuant to paragraph 11 of this subsection, |
---|
149 | 160 | | d. all applying individuals or ent ities shall be |
---|
150 | 161 | | registered to conduc t business in this state, |
---|
151 | 162 | | e. all applicants shall disclose all ownership interest s |
---|
152 | 163 | | pursuant to the Oklahoma Medical Marijuana and Patient |
---|
153 | 164 | | Protection Act, and |
---|
154 | | - | f. applicants shall not have been convicted o f a |
---|
155 | | - | nonviolent felony in the last two (2) years, and any |
---|
156 | | - | other felony conviction within the last five (5) |
---|
157 | | - | years, shall not be current inmates, or currently |
---|
158 | | - | incarcerated in a jail or corrections facility; |
---|
159 | | - | 8. There shall be no limit to the number of medical marijuana |
---|
160 | | - | business licenses or categories that an in dividual or entity can |
---|

193 | 205 | | 9. All applicants for a medical marijuana business license, |
---|
194 | 206 | | research facility license or education facility license authorize d |
---|
195 | 207 | | by the Oklahoma Medical Mari juana and Patient Protection Act shall |
---|
196 | 208 | | undergo an Oklahoma criminal history background check conducted by |
---|
197 | 209 | | the Oklahoma State Bureau of Investigation (OSBI) within thirty (30) |
---|
198 | 210 | | days prior to the application for the license including: |
---|
199 | 211 | | a. individual applicants applying on their own behalf, |
---|
200 | 212 | | b. individuals applying on behalf of an entity, |
---|
201 | 213 | | c. all principal officers of an entity, and |
---|
202 | 214 | | d. all owners of an entity as d efined by Section 427.2 of |
---|
203 | 215 | | this title; |
---|
237 | 250 | | continuous Oklahoma residency during the preceding twent y-five (25) |
---|
238 | 251 | | years immediately preceding the date of application. Sufficien t |
---|
239 | 252 | | documentation of proof of residency shall include a combination of |
---|
240 | 253 | | the following: |
---|
241 | 254 | | a. an unexpired Oklahoma -issued driver license, |
---|
242 | 255 | | b. an Oklahoma voter identification card, |
---|
243 | 256 | | c. a utility bill preceding the date of application, |
---|
244 | 257 | | excluding cellular telephone and Internet bills, |
---|
245 | 258 | | d. a residential property deed to property in this state, |
---|
246 | 259 | | and |
---|
247 | 260 | | e. a rental agreement preceding the date of application |
---|
248 | 261 | | for residential property located in this state. |
---|
249 | 262 | | Applicants that were issued a medical ma rijuana business license |
---|
250 | 263 | | prior to the enactment of the Oklahoma Medical Marijuana and Patient |
---|
251 | 264 | | Protection Act are hereby exempt from the two-year or five-year |
---|
252 | 265 | | Oklahoma residence requirement m entioned above; |
---|
287 | 301 | | b. front and back of an Oklahoma identification card, |
---|
288 | 302 | | c. a United States passport or other photo identifica tion |
---|
289 | 303 | | issued by the United States government, |
---|
290 | 304 | | d. certified copy of the applicant ’s birth certificate |
---|
291 | 305 | | for minor applicants who do not posse ss a document |
---|
292 | 306 | | listed in this section, or |
---|
293 | 307 | | e. a tribal identification card approved for |
---|
294 | 308 | | identification purposes by the Oklahoma Department of |
---|
295 | 309 | | Public Safety; and |
---|
296 | 310 | | 14. All applicants shall submit an applicant photograph. |
---|
297 | 311 | | F. The Authority shall review the medi cal marijuana business |
---|
298 | 312 | | application, approve or reject the applicat ion and mail the |
---|
299 | 313 | | approval, rejection or status -update letter to the applicant within |
---|
300 | 314 | | ninety (90) business day s of receipt of the applicatio n. |
---|
301 | | - | G. 1. The Authority shall review the medical m arijuana |
---|
302 | | - | business applications and conduct all investigations, in spections |
---|
303 | | - | and interviews before approving the app lication. |
---|
304 | | - | 2. Approved applicants shall be issued a medical m arijuana |
---|
305 | | - | business license for the specific category applied under which shall |
---|
306 | | - | act as proof of their approved status. Rejection letters shall |
---|
307 | | - | provide a reason for the rejection. Applications ma y only be |
---|
308 | | - | rejected based on the applicant not meeting the stan dards set forth |
---|
309 | | - | in the provisions of this section, improper completion of the |
---|

342 | 357 | | 3. Status-update letters shall provide a reason for delay in |
---|
343 | 358 | | either approval or re jection should a situation ari se in which an |
---|
344 | 359 | | application was submitted properly, but a delay in processing the |
---|
345 | 360 | | application occurred. |
---|
346 | 361 | | 4. Approval, rejection or status -update letters shall be s ent |
---|
347 | 362 | | to the applicant in the s ame method the application was subm itted to |
---|
348 | 363 | | the Authority. |
---|
349 | 364 | | H. A medical marijuana business license shall not b e issued to |
---|
350 | 365 | | or held by: |
---|
351 | | - | 1. A person until all required fees have been paid; |
---|
352 | | - | 2. A person who has been convicte d of a nonviolent felony |
---|
353 | | - | within two (2) years of the date of applicat ion, or within five (5) |
---|
354 | | - | years for any other felony; |
---|
355 | | - | 3. A corporation, if th e criminal history of any of its |
---|
356 | | - | officers, directors or stockholders indicates that the officer, |
---|
357 | | - | director or stockholder has been convicted of a nonviolent felony |
---|

394 | 410 | | 6. A sheriff, deputy sheriff, police officer or prosecuting |
---|
395 | 411 | | officer, or an officer or employee of the Authority o r municipality; |
---|
396 | 412 | | or |
---|
397 | 413 | | 7. A person whose authorit y to be a caregiver as defined in the |
---|
398 | 414 | | Oklahoma Medical Marijuana and Patient Protection Act has been |
---|
399 | 415 | | revoked by the Authority. |
---|
400 | | - | I. In investigating the qualifications of an applica nt or a |
---|
401 | | - | licensee, the Authority and municipalities may have access to |
---|
402 | | - | criminal history record information furnished by a criminal justice |
---|
403 | | - | agency subject to any restrictions imposed by such an agency. In |
---|
404 | | - | the event the Authority considers the criminal histo ry record of the |
---|
405 | | - | applicant, the Authority shall also consider any information |
---|
406 | | - | provided by the applicant regarding such criminal history record |
---|
407 | | - | including but not limited to evidence of rehabilitation, character |
---|
408 | | - | references and educational achievements, espec ially those items |

409 | | - | pertaining to the period of time between the last criminal |

439 | 456 | | information by the Authority dea dline may be grounds for denial of |
---|
440 | 457 | | the application. |
---|
441 | 458 | | K. All applicants shall subm it information to the Authority in |
---|
442 | 459 | | a full, faithful, truthful and fair manner. The Authority may |
---|
443 | 460 | | recommend denial of an application where t he applicant made |
---|
444 | 461 | | misstatements, omissions, misrepresentati ons or untruths in the |
---|
445 | 462 | | application or in connection with the background investigation of |
---|
446 | 463 | | the applicant. This type of conduct may be considered as the ba sis |
---|
447 | 464 | | for additional administrative action aga inst the applicant. Typos |
---|
448 | 465 | | and scrivener errors shall not b e grounds for denial. |
---|
449 | 466 | | L. A licensed medical marijuana bu siness premises shall be: |
---|
450 | | - | 1. Be subject to and responsible for compliance with applicable |
---|
451 | | - | provisions for medical marijuana business facilities as d escribed in |
---|
452 | | - | the most recent versions of the Oklahoma Unif orm Building Code, the |
---|
453 | | - | International Building Code and the International Fire Code, unless |
---|
454 | | - | granted an exemption by the Authority or municipality ; and |
---|
455 | | - | 2. Post conspicuous, easy-to-read signage at each licensed |
---|
456 | | - | property entrance with the medical marijuana business license number |

495 | 513 | | continue the same type of business at that location under a license |

496 | 514 | | issued by the Authority, except as may be provided in Sectio ns 425 |

497 | 515 | | and 426.1 of this title. Any change in ownership after the original |

498 | 516 | | medical marijuana business license has been is sued by the Authority |

499 | 517 | | shall be construed by the Authority to be a continuation of the same |
