51 | 52 | | SECTION 1. AMENDATORY 37A O.S. 2021, Section 7 -102, is |

53 | 54 | | Section 7-102. As used in this act Section 7-101 et seq. of |

55 | 56 | | 1. “Cocktail” or “mixed drink” means any beverage obtaine d by |

56 | 57 | | combining ingredients alcoholic in nature, whether brewed, |
---|

58 | 59 | | such as fruit juice, lemonade, cream or a carbonated beverage; |

59 | 60 | | 2. “Single-serve wine” means a bottle or sealed container, |

60 | 61 | | containing seven (7) fluid ounces, or less, of wine; |

61 | 62 | | 3. “Original container” means, for the purposes of this act |

98 | 100 | | container with a lid with sipping holes o r openings for straws or a |

99 | 101 | | container made of plastic, paper or polystyrene foam; and |

100 | 102 | | 5. “Tamper evident” means a lid or cap that has been sealed |
---|
101 | 103 | | with tamper-evident covers, including, but not limited to, wax dip |
---|
102 | 104 | | or heat-shrink wrap. |

103 | 105 | | SECTION 2. AMENDATORY 37A O.S. 2021, Sec tion 7-103, is |

143 | 146 | | single-serve wine is not able to safely veri fy a person’s age or |

144 | 147 | | level of intoxication upon delivery, the employee shall cancel the |
---|
145 | 148 | | sale of alcohol and return the product to the retail licens e holder; |
---|
146 | 149 | | 3. The sealed container is placed in the trunk of the vehicle |
---|
147 | 150 | | or, if there is no trunk, in the veh icle’s rear compartment that is |
---|
148 | 151 | | not readily accessible to the passenger area; and |
---|
149 | 152 | | 4. The In the case of a mixed drink sealed by the mi xed |
---|
150 | 153 | | beverage or caterer licensee, the sealed container shall be affixed |
---|
151 | 154 | | with a label or tag that contains the following i nformation: |

152 | 155 | | a. the cocktail, mixed drink or single -serve wine |

153 | 156 | | ingredients, type and name of the alcohol, |
---|
154 | 157 | | b. the name, license number and add ress of the mixed |
---|
155 | 158 | | beverage licensee or caterer licensee who filled the |
---|
156 | 159 | | original container and sold the product, |
---|
157 | 160 | | c. the volume of the cocktail, mixed drink or single - |
---|
158 | 161 | | serve wine in the sealed container, and |
---|
159 | 162 | | d. verification that the sealed container was fille d less |
---|
160 | 163 | | than seven (7) days before the date of sale; and |
---|
161 | 164 | | 5. In the case of a mixed drink in its original container f rom |
