163163 BE IT ENACTED BY THE PEOPLE OF THE STATE OF OKLAHOMA:
164164 SECTION 1. NEW LAW A new section of law to be codified
165165 in the Oklahoma Statutes as Section 2 -950 of Title 40, unless there
166166 is created a duplication in numbering, reads as follows:
167167 This act shall be known and may be cited as the “Shared Work
168168 Unemployment Compensation Program ”.
169169 SECTION 2. NEW LAW A new section of law to be codified
170170 in the Oklahoma Statutes as Section 2 -950.1 of Title 40, unless
171171 there is created a duplication in numbering, reads as follows:
172172 As used in this act:
173173 1. “Affected unit” means a specified department , shift or other
174174 unit of two or more employees that is designated by an e mployer to
175175 participate in a shared work plan;
176176 2. “Fringe benefit” means health insurance, a retirement
177177 benefit received under a pension plan, a paid vacation day, a paid
178178 holiday, sick leave, and any other analogous employee benefit that

231231 3. “Fund” means the Unemployment Trust Fund establishe d by
232232 Section 3-605 of Title 40 of the Oklahoma Statutes;
233233 4. “Normal weekly hours of work ” means the lesser of fort y (40)
234234 hours or the average obtained by dividing the total number of hours
235235 worked per week during the pr eceding twelve-week period by the
236236 number twelve;
237237 5. “Participating employee ” means an employee who works a
238238 reduced number of hours under a shared work plan;
239239 6. “Participating employer ” means an employer who has a shared
240240 work plan in effect;
241241 7. “Commission” has the same meaning as set o ut in Section 1-
242242 206 of Title 40 of the Oklahoma Statutes;
243243 8. “Shared work benefit” means an unemployment compensat ion
244244 benefit that is payable to an ind ividual in an affected unit because
245245 the individual works reduced hours under an approved shared work
246246 plan;
247247 9. “Shared work plan” means a program for reducing unempl oyment
248248 under which employees who are members of an af fected unit share the
249249 work remaining after a reduction in their normal weekly hours of
250250 work; and
251251 10. “Shared Work Unemployment Compensatio n Program” means a
252252 program designed to reduce unemployment and s tabilize the work force
253253 by allowing certain employee s to collect unemployment compensation
254254 benefits if the employees share the work remaining after a reduction

308308 SECTION 3. NEW LAW A new section of law to be codified
309309 in the Oklahoma Statutes as Section 2 -950.2 of Title 40, unless
310310 there is created a duplication in numbering, reads as follows:
311311 A. The Oklahoma Employment Security Commission shall establish
312312 a voluntary Shared Work Une mployment Compensation Program as
313313 provided by this act. The Commission may adopt rules and establish
314314 procedures necessary to administer the pr ogram.
315315 B. An employer who wishes to participate in the Shared Work
316316 Unemployment Compensation Program must submit a written shared work
317317 plan to the Commission for a pproval. As a condition for approval, a
318318 participating employer must agree to furnish the Commission with
319319 reports relating to the operation of the shared work plan. The
320320 report shall be in a form prescribed by the Co mmission.
321321 SECTION 4. NEW LAW A new section of law to be codified
322322 in the Oklahoma Statutes as Section 2 -950.3 of Title 40, unless
323323 there is created a duplication in numbering, reads as follows:
324324 A. The Oklahoma Employment Security Commission may approv e a
325325 shared work plan if:
326326 1. The participating employer regularly employs at least one
327327 hundred employees;
328328 2. The shared work plan app lies to and identifi es a specific
329329 affected unit or number of units;

381381 3. The employees in the affected unit are identifi ed by name
382382 and social security number;
383383 4. The shared work plan reduces the normal weekly hours of work
384384 for an employee in the affected unit by not less than twenty percent
385385 (20%) and not more than forty perce nt (40%);
386386 5. The shared work plan applies to at least ten percent (10%)
387387 of the employees in the a ffected unit and at least fifty employees
388388 within the company;
389389 6. The shared work plan maintains the fringe benefits of each
390390 employee in the affected unit at the benefit level in effect before
391391 the shared work plan is implemented;
392392 7. The employer certifies that the implementation of a shared
393393 work plan and the resulting reduction in work hours is in lieu of
394394 temporary layoffs that would affect at least ten percen t (10%) of
395395 the employees in the affected uni t and at least fifty employees
396396 within the company, and that would result in an equivalent reduction
397397 in work hours; and
398398 8. The employer has filed all reports req uired to be filed
399399 under the Employment Security Act of 1980 for all past and current
400400 periods, and has paid all contributions, interest, penalties and
401401 fees owing on the employer’s account with the Commission.
402402 B. If any of the employees who participate in a shared work
403403 plan pursuant to this act are covered by a collective bargaining

455455 agreement, the shared work plan must be approved in writing by the
456456 collective bargaining agent before approval by the Commission.
457457 C. A shared work plan may not be implemented to subsidize
458458 seasonal employers during the off -season or to subsidize employers
459459 who have traditionally employed workers less than thirty -two (32)
460460 hours per week.
461461 D. If any employer that is eligible for a tax rate computation
462462 under Sections 3-101 through 3-118 of Title 40 of the Oklahoma
463463 Statutes is assigned an experience tax rate of five and four -tenths
464464 percent (5.4%) or greater for a calendar year, that employer shall
465465 be ineligible to participate in the Shared Work Unemployment
466466 Compensation Program provided by this act for that calendar y ear.
467467 E. The Commission shall approve or deny a shared wor k plan no
468468 later than thirty (30) days after the day the shared work plan is
469469 received by the Commission. The Commission shall approve or deny a
470470 shared work plan in wr iting. If the plan is denied, the Commission
471471 shall notify the employer of the reasons for the denial.
472472 F. The employer may appeal the denial of a shared work plan
473473 pursuant to the provisions of Section 3 -115 of Title 40 of th e
474474 Oklahoma Statutes.
475475 SECTION 5. NEW LAW A new section of l aw to be codified
476476 in the Oklahoma Statutes as Section 2-950.4 of Title 40, unless

529529 A shared work plan is effec tive on the date it is approved b y
530530 the Oklahoma Employment Security Commission. For good cause shown,
531531 the Commission may designate the effective date to be on any day
532532 within a period of fourteen (14) days prior to the date the plan is
533533 approved by the Comm ission. The shared work plan exp ires on the
534534 last day of the twelfth full calendar m onth after the effective date
535535 of the shared work plan. Shared work benefits shall be paid for a
536536 maximum of twenty-six (26) weeks during the twelve (12) consecutive
537537 calendar months that the shared work pla n is in effect.
538538 SECTION 6. NEW LAW A new section of law to be co dified
539539 in the Oklahoma Statutes as Section 2 -950.5 of Title 40, unless
540540 there is created a duplication in numbering, reads as follows:
541541 An employer may modify a shared wo rk plan created pursuant to
542542 this act to meet change d conditions if the modification confo rms to
543543 the basic provisions of the shared work plan as a pproved by the
544544 Oklahoma Employment Security Commission. The employer must r eport
545545 the changes made to the share d work plan in writing to the
546546 Commission before imp lementing the changes. If the origina l shared
547547 work plan is substantially modified, the Commission shall reevaluate
548548 the shared work plan and may approve the mod ified shared work plan
549549 if it meets the requir ements for approval under Section 5 of this
550550 act. The approval of a mod ified shared work plan does not affect
551551 the expiration date originally set for that shared work plan. If
552552 substantial modifications cause the shared wo rk plan to fail to meet

605605 the modifications as provided b y subsection E of Section 4 of this
606606 act.
607607 SECTION 7. NEW LAW A new section of law to be codified
608608 in the Oklahoma Statutes as Section 2 -950.6 of Title 40, unless
609609 there is created a duplication in numbering, reads as follows:
610610 A. Notwithstanding any other provisions of the Employment
611611 Security Act of 1980, an individual is unemployed and is eligible
612612 for shared work benefits in any week in which the i ndividual, as an
613613 employee in an affected unit, work s for less than the indivi dual’s
614614 normal weekly hours of work in accordance with an approved shared
615615 work plan in effect for that week. The Oklahoma Employment Security
616616 Commission may not deny shared work b enefits for any week to an
617617 otherwise eligible indiv idual by reason of the a pplication of any
618618 provision of this title that relates to avai lability for work,
619619 active search for work or refusal to apply for or accept work w ith
620620 an employer other than the partic ipating employer. The Oklahoma
621621 Employment Security Commission shall not deduct wages pai d by the
622622 participating employer to the participating employee from the shared
623623 work benefit in any week the shared work plan is bei ng implemented
624624 for the participating employee.
625625 B. An individual is eligible to receive shared work benefits
626626 with respect to any week in which the Commission finds that:

678678 1. The individual is employed as a member of an affected unit
679679 subject to a shared w ork plan that was approved and is in ef fect for
680680 that week;
681681 2. The individual is able to w ork and is available for
682682 additional hours of work or full -time work with the participating
683683 employer;
684684 3. The individual’s normal weekly hours of work have been
685685 reduced by at least twenty percent (20%) but not more than forty
686686 percent (40%) with a corr esponding reduction in wages; and
687687 4. The individual’s normal weekly hours of work and wages have
688688 been reduced as described in par agraph 3 of this subse ction for a
689689 waiting period of one (1) week which occurs wit hin the period the
690690 shared work plan is in effect, w hich period includes the week for
691691 which the individual is claiming shared work ben efits.
692692 C. The participating employer shall be responsible for the
693693 filing of the weekly claims for shared work benefits on behalf of
694694 the participating employee. The particip ating employer shall
695695 provide the Oklahoma Employment Security Commission with the name
696696 and social security number of each participating employee along with
697697 any other information necessary to complete the c laim. The
698698 participating employer shall certify tha t the participating employee
699699 is qualified to receive the shared work benefit.

751751 SECTION 8. NEW LAW A new section of law to be codified
752752 in the Oklahoma Statutes as Section 2 -950.7 of Title 40, unless
753753 there is created a duplication in n umbering, reads as follows:
754754 A. The Oklahoma Employment Security Commission shall pay an
755755 individual who is eligible for shared work benefits a weekly shared
756756 work benefit amount equal to the individual ’s regular weekly benefit
757757 amount, calculated pursuant to Section 2-106 of Title 40 of th e
758758 Oklahoma Statutes, for a period of total unemployment multiplied by
759759 the nearest full percentage of reduction of the ind ividual’s hours
760760 as set forth in the employer ’s shared work plan. If the shared
761761 benefit amount is not a multiple of One Dollar ($1.00), the
762762 Commission shall reduce the amount to the next lowest multiple of
763763 One Dollar ($1.00). All shared work ben efits under this act shall
764764 be payable from the Unemployment Co mpensation Fund.
765765 B. The Commission may not pay an individual shared work
766766 benefits for any week in which the individual performs paid work for
767767 the participating employer in excess of the reduced hours
768768 established under the shared work plan.
769769 C. An individual shall not receive shared work benefits or
770770 regular unemployment compensation be nefits or both, in an amount
771771 that exceeds the maximum benefit amount payable to that individual,
772772 pursuant to Section 2 -106 of Title 40 of the Oklahoma Statutes, in
773773 the benefit year that shall begin as of the effective date of the
774774 shared work plan.

827827 benefits and regular unemployment compensation benefits avai lable in
828828 a benefit year has exhausted his or her benefits and may be entitled
829829 to receive extended benefits, if exten ded benefits are available an d
830830 if the individual is otherwise elig ible.
831831 SECTION 9. NEW LAW A new section of law to be codified
832832 in the Oklahoma Statutes as Section 2 -950.8 of Title 40, unless
833833 there is created a duplication in numberi ng, reads as follows:
834834 Shared work benefits paid under a shared work plan shall be
835835 based on benefit wages of the participating employee and shall be
836836 charged to the participating employer as provided in Sect ions 1-221,
837837 3-105, 3-106 and 3-806 of Title 40 of t he Oklahoma Statutes.
838838 SECTION 10. NEW LAW A new section of law to be codified
839839 in the Oklahoma Statutes as Section 2 -950.9 of Title 40, unless
840840 there is created a duplication in number ing, reads as follows:
841841 The Oklahoma Employment Secu rity Commission may terminate a
842842 shared work plan for good cause if the Commission determines that
843843 the shared work plan is not being executed according to the terms
844844 and intent of the Shared Work Une mployment Compensation Program.
845845 SECTION 11. NEW LAW A new sectio n of law to be codified
846846 in the Oklahoma Statutes as Section 2 -950.10 of Title 40, unless
847847 there is created a duplication in n umbering, reads as follows:
848848 No shared work benefit pa yment shall be made under any shared
849849 work plan for any week which commences before January 1, 2022.

901901 SECTION 12. This act shall become effective July 1, 20 21.
902902 SECTION 13. It being immediately necessary for the preservation
903903 of the public peace, health and safety, an emergency is hereby
904904 declared to exist, by reason whereof this act shall take effect and
905905 be in full force from and after its passage and approval.
