239 | 239 | | 6. “Participating employer ” means an employer who has a shared |

240 | 240 | | work plan in effect; |

241 | 241 | | 7. “Commission” has the same meaning as set o ut in Section 1- |
---|
242 | 242 | | 206 of Title 40 of the Oklahoma Statutes; |
---|
243 | 243 | | 8. “Shared work benefit” means an unemployment compensat ion |
---|
244 | 244 | | benefit that is payable to an ind ividual in an affected unit because |
---|
245 | 245 | | the individual works reduced hours under an approved shared work |
---|
246 | 246 | | plan; |
---|
247 | 247 | | 9. “Shared work plan” means a program for reducing unempl oyment |
---|
248 | 248 | | under which employees who are members of an af fected unit share the |
---|
249 | 249 | | work remaining after a reduction in their normal weekly hours of |
---|
250 | 250 | | work; and |
---|
251 | 251 | | 10. “Shared Work Unemployment Compensatio n Program” means a |
---|
252 | 252 | | program designed to reduce unemployment and s tabilize the work force |
---|
253 | 253 | | by allowing certain employee s to collect unemployment compensation |

311 | 311 | | A. The Oklahoma Employment Security Commission shall establish |
---|
312 | 312 | | a voluntary Shared Work Une mployment Compensation Program as |
---|
313 | 313 | | provided by this act. The Commission may adopt rules and establish |
---|
314 | 314 | | procedures necessary to administer the pr ogram. |
---|
315 | 315 | | B. An employer who wishes to participate in the Shared Work |
---|
316 | 316 | | Unemployment Compensation Program must submit a written shared work |
---|
317 | 317 | | plan to the Commission for a pproval. As a condition for approval, a |
---|
318 | 318 | | participating employer must agree to furnish the Commission with |
---|
319 | 319 | | reports relating to the operation of the shared work plan. The |
---|
320 | 320 | | report shall be in a form prescribed by the Co mmission. |
---|
321 | 321 | | SECTION 4. NEW LAW A new section of law to be codified |

386 | 386 | | 5. The shared work plan applies to at least ten percent (10%) |
---|
387 | 387 | | of the employees in the a ffected unit and at least fifty employees |
---|
388 | 388 | | within the company; |

389 | 389 | | 6. The shared work plan maintains the fringe benefits of each |
---|
390 | 390 | | employee in the affected unit at the benefit level in effect before |
---|
391 | 391 | | the shared work plan is implemented; |
---|
392 | 392 | | 7. The employer certifies that the implementation of a shared |
---|
393 | 393 | | work plan and the resulting reduction in work hours is in lieu of |
---|
394 | 394 | | temporary layoffs that would affect at least ten percen t (10%) of |
---|
395 | 395 | | the employees in the affected uni t and at least fifty employees |
---|
396 | 396 | | within the company, and that would result in an equivalent reduction |
---|
397 | 397 | | in work hours; and |
---|
398 | 398 | | 8. The employer has filed all reports req uired to be filed |
---|
399 | 399 | | under the Employment Security Act of 1980 for all past and current |
---|
400 | 400 | | periods, and has paid all contributions, interest, penalties and |
---|
401 | 401 | | fees owing on the employer’s account with the Commission. |
---|
402 | 402 | | B. If any of the employees who participate in a shared work |
---|
403 | 403 | | plan pursuant to this act are covered by a collective bargaining |
---|

459 | 459 | | who have traditionally employed workers less than thirty -two (32) |
---|
460 | 460 | | hours per week. |

461 | 461 | | D. If any employer that is eligible for a tax rate computation |
---|
462 | 462 | | under Sections 3-101 through 3-118 of Title 40 of the Oklahoma |
---|
463 | 463 | | Statutes is assigned an experience tax rate of five and four -tenths |
---|
464 | 464 | | percent (5.4%) or greater for a calendar year, that employer shall |
---|
465 | 465 | | be ineligible to participate in the Shared Work Unemployment |
---|
466 | 466 | | Compensation Program provided by this act for that calendar y ear. |
---|
467 | 467 | | E. The Commission shall approve or deny a shared wor k plan no |
---|
468 | 468 | | later than thirty (30) days after the day the shared work plan is |
---|
469 | 469 | | received by the Commission. The Commission shall approve or deny a |
---|
470 | 470 | | shared work plan in wr iting. If the plan is denied, the Commission |
---|
471 | 471 | | shall notify the employer of the reasons for the denial. |
---|
472 | 472 | | F. The employer may appeal the denial of a shared work plan |
---|
473 | 473 | | pursuant to the provisions of Section 3 -115 of Title 40 of th e |
---|
474 | 474 | | Oklahoma Statutes. |
